Section 305 of the Nigerian Constitution deals with the procedure for proclaiming a state of emergency. According to this section, the President can issue a proclamation of a state of emergency in the Federation or any part thereof, but only under specific circumstances.

*Grounds for Proclamation*

These circumstances include:

- _War or Imminent Danger_: When the Federation is at war or in imminent danger of invasion or involvement in a state of war.
- _Breakdown of Public Order_: When there's an actual breakdown of public order and public safety in the Federation or any part thereof.
- _Natural Disaster or Calamity_: When there's an occurrence or imminent danger of a natural disaster or calamity affecting the community or a section of the community.
- _Request by Governor_: When the Governor of a State requests the President to issue a proclamation of a state of emergency in the State.

*Procedure for Proclamation*

The President must follow these steps:

- Publish the proclamation in the Official Gazette of the Government of the Federation.
- Transmit copies of the proclamation to the President of the Senate and the Speaker of the House of Representatives.
- The National Assembly must approve the proclamation within two days if they're in session or within ten days if they're not in session.

*Duration of Proclamation*

The proclamation ceases to have effect after six months, but the National Assembly can extend it for another six months.¹ ²
