If the prosecution establishes a prima facie case and the defendant fails to respond to the facts established by the prosecution, then the defendant loses the case. In summary the test for the burden of proof is simply considering which party would lose the case if no more evidence is offered at any particular stage of the trial.

When we talk of shifting the burden of proof, we have to keep in mind that the burden of proof does not rests eternally on the person on whom it is was first cast. As soon as he/she finds relevant evidence which, on the face of it, rebuts whatever evidence that was initially given against which he/she is challenging, the burden of proof shifts again until there is enough evidence which meets the demands of the evidence that was previously given.

In conclusion, during a criminal trial the burden of proof can be shifted to the defendant by way of;

Rebuttable presumptions of law
Presumptions of facts
Evidence capable of establishing a prima facie case against the prosecution.

Section 141-143 of the evidence act places the burden of proof on the accused to establish certain facts, the accused is required to deny the allegation, offer explanations or give evidence that makes the case of the accuser improbable or which raises reasonable doubt on the case of the accuser in which case the burden of proof then shifts to the prosecution to prove it's case beyond reasonable doubt.

He has neither given any explanation or evidence to make us disbelieve her, in the case of Neymar you saw how fast he brought evidence against his accuser. While the burden of proof rests on the accuser, the accused has to give evidence in his defence.
