The United States hit back Wednesday at allegations by the Nigerian ambassador of failing to help fight Boko Haram militants, saying there had been “a great deal” of US aid to his country. In the past six months since the Islamic militants snatched some 200 schoolgirls in northern Nigeria, Washington has shared intelligence with the Nigerian army, begun training a new battalion and held high-level talks on the threat of Boko Haram, a US official said. In a speech made public Tuesday, ambassador Adebowale Adefuye appeared to have taken US officials by surprise when he launched into a tirade against the US administration. Nigerian leaders were “not satisfied with the scope, nature and content of the United States’ support for us in our struggle against terrorists,” he said. He accused Washington of not providing the “lethal” weapons needed to deliver “a killer punch” to the militants. But State Department spokeswoman Jen Psaki shot back that the US had “provided and approved sales of military equipment to its armed forces.” “These decisions are made, of course, after careful scrutiny to ensure they conform with United States law.” But she acknowledged the US had refused to transfer some Cobra helicopters due to concerns about the Nigerian army’s ability to use them. There were also “ongoing concerns about the Nigerian military’s protection of civilians when conducting military operations,” Psaki said, adding these had been discussed with the Nigerian authorities. Adefuye told members of the Council on Foreign Relations on Monday that allegations of human rights abuses by the military were “rumors, hearsays and exaggerated accounts” put about by rivals of President Goodluck Jonathan and rights groups. Benin – An Oredo Magistrates’ Court sitting in Benin on Monday remanded a nursing mother in prison custody for pouring hot water mixed with pepper on her husband. Mrs Obiaka Friday, who is a mother of three, was said to have committed the offence on Nov. 8, 2014, at First Ihogbe St., Institute of Continuing.Education (ICE) Road, Benin City. Friday, who was first arraigned on Monday, however, pleaded guilty to the one-count charge. The court was told that the victim was still critically ill at the Central Hospital in Benin with injuries. The Chief Magistrate, Mr Williams Aziegbemhin, adjourned the case till Nov. 17, for the Police to present the facts of the case. Gunmen, suspected to be members of the terrorist group, Boko Haram, attacked the headquarters of Nafada Local Government Area of Gombe state, North-East Nigeria on Tuesday, killing soldiers, an Islamic cleric and left no fewer than 10 persons dead. But the state Police Commissioner, Kudu Nma, however, said he had yet to hear of the incident. He however pledged to give the details of the incident when he had information on it. A resident of the area told journalists on the telephone that the gunmen stormed the town around 11am in four Hilux vans and numerous Bajaj motorcycles, wielding guns and shooting sporadically into the air. He said they immediately set the Police station and the local government secretariat ablaze. “The gunmen then went to the house of an Islamic cleric named Adamu Misira and opened fire on him and other people numbering over 10 that were there with him, killing all of them. They had earlier killed the soldiers on duty at the checkpoint between Gombe and Yobe states, located in Nafada,” said the resident, who pleaded for anonymity. A member of the Peoples Democratic Party, Emmanuel Onu, has filed a fresh suit asking the Federal High Court in Abuja to remove Alhaji Adamu Mu’azu as the National Chairman of the party. Onu asked the court to remove Mu’azu and reinstate the immediate past National Chairman of the party, Alhaji Bamanga Tukur, whose resignation on January 15, 2014, the plaintiff argued failed to comply with the provisions of the party’s constitution. Mu’azu was on January 15, appointed by the party’s National Executive Committee to succeed Turkur, who the plaintiff argued resigned under circumstances that never followed due process. A lawyer and a member of the PDP, Ezionye Ndubuisi, had on September 23 filed a similar suit before the same court seeking an order sacking Mu’azu as the PDP National Chairman. Ndubuisi had asked the court to remove Mu’azu on the grounds that he did not emerge as the National Chairman of the party through an election at a special convention of the party as stipulated by the party’s constitution. The older case has yet to be heard by the court. Onu, who anchored his fresh suit on grounds similar to those of Ndubuisi, joined as defendants, the PDP, Mu’azu and the Independent National Electoral Commission. He argued that the resignation of Tukur and the subsequent appointment of Mu’azu violated sections 47(5) and (6) of the PDP Constitution 2012. His counsel, Mr. Elochukwu Nweke, stated in his written address accompanying the suit, “A literal interpretation of section 47(5) is that a letter of resignation of an elected officer of the 1st defendant (PDP) serves as a notice and as such a letter becomes operational after the period of 30days elapses. This is to enable the Executive Committee time and room to carry out the process of filling the vacancy. “Also a literal interpretation of section 47(6) is to the effect that if such an election cannot be conducted within a period of 30days, an appointment ought to be made by the appropriate committee and until and election is conducted. By necessary implication, it is mandatory that election shall be conducted thereafter.” The plaintiff said instead of complying with the provisions of the party’s constitution, what transpired was that “On 15th day of January, 2014, a purported envelope containing a resignation letter by Alhaji Bamanga Tukur was presented to National Executive Committee. “The committee debated it and accepted the same day. Kano – Gov. Rabi’u Kwankwaso of Kano State on Saturday said those trying to break the unity of the country would fail. The governor said this when he briefed newsmen in Kano on Saturday. He said that some people who were trying to divide the country on religious line and ethnicity would never succeed. Kwankwaso said he would tackle the security challenges bedeviling the country if given the mandate to rule the country in 2015. “My major concern if elected as president of this country is to tackle the current insecurity and ensure economic development in the country,” he said. He said that the state government recently donated foodstuffs to displaced persons affected by insurgency in Borno and Yobe states as part of effort to cushion their sufferings. Kwankwaso said that the state government would soon send relief materials to displaced persons in Adamawa and other affected states. He said that he aware of the recent visit of the Emir of Kano, Alhaji Muhammad Sunusi II, to President Goodluck Jonathan for reconciliation. “The Emir of Kano told me he was going to Abuja for meeting with President Jonathan and I gave him approval to go. “The Emir, after their meeting with the president, also briefed me all what happened there. “I will be very happy if Villa will be inviting Kano people for reconciliation,’’ he said. The president of the Nigeria Bar Association Augustine Alegeh, SAN, on Saturday attributed the leadership crisis currently brewing in the Federal House of Representatives over the defection of the Speaker, Aminu Tambuwal, to loopholes in the Nigerian Constitution. Alegeh, who disclosed this to journalists after a meeting of the Midwest Bar Forum comprising lawyers from Edo and Delta, also identified poor administration of justice in the country as a factor responsible the removal of Tambuwal’s security aides by the Nigeria Police. The NBA chief explained that the Nigerian Constitution did not envisage the defection of the Speaker or Senate President, since both offices were expected to preside over the argument of a lawmaker defecting from one party to another. He said that the police erred by withdrawing the security details attached to the speaker because the power to determine whether or not there had been a breach of the constitution in the defection of the Tambuwal to the All Progressives Congress was beyond the jurisdiction of the agency. “Section 68 of the constitution enumerates the procedure to be adopted by the National Assembly when a member defects from one party to another. “Unless and until that procedure is followed and adopted, Aminu Tambuwal remains speaker of the House of Representatives. “We have stated clearly that the police lacks jurisdictional competence to determine whether or not there has been a breach of the constitution; that duty is a function of the court. “There is no provision in our constitution that says if you are in PDP or APC and you decamp to another party you automatically lose your position of leadership of the House, the NBA president said. Explaining further, Alegeh stated that there was nothing in the Constitution or legal jurisprudence which read that the Speaker or President of the Senate must come from the ruling party, rather “all that must happen is that majority of members of the House must vote for him.” He said “There ought to be an expectation where a speaker of the House who is charge constitutionally to declare a seat vacant is the person in the act of decamping. “He should allow his deputy to preside over the sitting so that when he presents his reasons for decamping, the deputy can take a decision. “In the case of Aminu Tambuwal, he has said that ‘I’m leaving the PDP for the APC.’ The next question under the constitution is that he gives reasons and the Speaker of the House will arrive at a decision whether the reasons he has given are in accordance with the constitution.” Speaking on the role of the court in the matter, Alegeh said that it was important for the court to always act in order to uphold democracy. He also described as unacceptable the pending court cases of some Peoples Democratic Party lawmakers who decamped to the APC, which he said had lasted for an upward of eight months in court, noting that the argument surrounding Tambuwal’s defection would not have arisen, if such cases had been resolved. “We call on our justices and judges that their duty to uphold the constitution is sacred. When there is a delay correcting the constitution, then their is a denial of justice. “And when their is a denial of justice, people resort to self help. The present situation involving Tambuwal would have been avoided if the judiciary had given a pronouncement on the issue of decamping. “The present situation, with respect, is a direct fallout from the inability of our courts to determine this matter earnestly. “As of now, the simple matter of the interpretation of Section 68 is lacking forever. This is unacceptable. Former Vice- President and leading presidential candidate of the All Progressive Congress, Alhaji Atiku Abubakar, has explained his decision to stay away from Wednesday’s Special Convention of the party. Atiku made the disclosure via his official facebook account (Atiku Abubakar), which boast of 390,408 likes, saying that he was unable to return from a business trip abroad as earlier scheduled to make it to the convention. “I was scheduled to return to Nigeria yesterday from a quick business trip abroad, but could not, due to last minute logistics changes. This is why I couldn’t attend the APC Special Convention. Apologies to leaders & supporters of our great party, who were expecting me -AA,” he posted on his facebook’s wall. The Special convention was convened to approve the party’s amended constitution and adopt its revised six point manifesto. It was also an avenue for all the other presidential aspirants to address party’s delegates. Is it a surprise the 23-man short list for the Ballon d'Or ignored Barcelona's Luis Suarez as one of the best players in the world? On one hand, he is a one-in-a-million player who scored 33 goals in 39 matches in all competitions last season. On the other, he has a problem controlling himself on a football pitch. Specifically, he bites people. He has done so three times and has only just returned from a third ban for such an offence. The initial reaction was one of shock when Suarez's name was missing from what is a who's who of world football, but Article 3 of the Ballon d'Or rules perfectly sums up why Suarez was missing: "The awards are bestowed according to on-field performance and overall behaviour on and off the pitch." The player -- once banned after being found guilty of racially abusing Patrice Evra while playing for Liverpool -- returned to action on Saturday after that infamous incident of biting Italy's Giorgio Chiellini, this time in Brazil on the grandest stage of all, the World Cup. He looked sharp during his debut in el clasico, laying on the goal for Neymar before things turned sour for Barcelona as they were swept aside 3-1 by Real Madrid. By Tuesday, Suarez was back in the news following his Ballon d'Or snub, and the debate centered on why a player who had 31 goals and 12 assists in just 33 games for Liverpool last season was not included among the best 23 players on FIFA's list. The debate for his inclusion is fairly obvious. He is a forward who last week won the Golden Shoe award as the top league goal scorer in Europe last season. It is an honour he shared with Cristiano Ronaldo, who is rightly the favourite to hold on to his Ballon d'Or prize this term. Liverpool legend Kenny Dalglish awarded Suarez that trophy at a ceremony in his new city Barcelona as he prepared for his first official game, after missing a large chunk of the beginning of this season thanks to that ban stemming from the World Cup. Suarez's goal scoring and all-round play at Liverpool was incredible last term and the main reason they went so close to ending their agonising wait for a league title. The record was even more impressive when you take into account that he missed Liverpool's first six Premier League games. That was a result of the second biting incident of his career, inflicted on Chelsea's Branislav Ivanovic at the back end of the 2012-13 campaign. Last term started with one ban ending and finished with Suarez sinking England at the World Cup with two well-taken goals -- before sinking his teeth into Chiellini. The third (yes, third, with the first coming in 2010 against PSV Eindhoven's Otman Bakkal) biting shame was the first time it had come in a match governed by FIFA, and while it meant his World Cup abruptly ended, it also saw him handed a ban from competitive international football that he is still serving. Part of that FIFA ban initially stopped him taking part in all football activity, including training with his teammates, until it was successfully appealed before the Court of Arbitration for Sport in Switzerland. Further concessions were made and Suarez has returned to play for Uruguay in friendly games, but for many it would be surprising for FIFA to then produce a list of the best players from last season and include a player who shamed the game with the world watching this past summer. Suarez has once again had the slate wiped clean and he has been able to start again at another club, thanks to his goal-scoring ability. He now needs to prove last season was not a flash in the pan and he can match Ronaldo again in the goal-scoring charts -- this time in La Liga. If he does, he will be rightly included in next season's race to be crowned the world's best, but for now, he's best off out of it. Nigerian Bottling Company, NBC and Coca Cola Nigeria Limited said, yesterday, they had not been served with any court summons as a result of the suit filed against them by the Consumer Protection Council, CPC, over half-empty Sprite cans. The companies, in a co- signed statement by the Head, Public Affairs & Communications of NBC, Uzo Odenigbo and Head, Public Affairs & Communications of CCNL, Clem Ugorji, said they had only noted from media reports that criminal charges had been instituted against both companies as a result of the Consumer Protection Council’s CPC’s reaction to February 2014 complaint by a consumer involving two short– filled cans of Sprite. “To date we have not been served with any criminal charges,” the statement said. Continuing, the statement said NBC and CCNL had the utmost respect for the CPC as a regulator and an agency of government and would continue to co-operate with the council on the matter. According to the statement, “we filed applications for a judicial review of these orders in February 2014, which review is pending in the courts. We do not believe that our submission to judicial review is in violation of the council’s orders. We have full trust in the Nigerian judicial system. “Our consumers and customers are our highest priority. NBC and CCNL take all matters relating to our products very seriously and remain committed to maintaining the highest international quality and food safety standards.” It added, “out of respect for the ongoing court processes, we do not wish to comment further in public on this issue.” It could be recalled that in February CPC warned Coca-Cola that Nigeria was not a “dumping ground for substandard products” and that it had also been inundated with complaints about rusty cans, rusty bottle tops and foreign particles in beverages. It said the half-filled cans continued to evaporate during its investigation. Attorney General Mohammed Bello Adoke, who is also the justice minister, filed the suit at the Federal High Court in Abuja against Coca-Cola Nigeria and its chief executive, and the NBC and its managing director for criminal breach of the Consumer Protection Act. He accused both companies of “deliberately failing, refusing and/or neglecting to comply” with orders to subject their manufacturing processes to its inspection, and filed an additional charge against Coca-Cola for refusing to appear before the council. – A former President, Academic Staff Union of Universities (ASUU), Prof. Oladipo Fashina, on Monday said that 54 per cent of Nigerians were illiterates. Fashina spoke at the opening of National Education Summit with theme “Toward a System of Education for Liberation in Nigeria,’’ held in Abuja. He said that only 15 per cent of Nigerians had managed to attain higher education since the country’s independence 54 years ago. “The present crisis in education is an offshoot of the neo-liberal misdirection which Nigerian people did not choose. “Our rulers still insist in the main that the solution to the crisis in education lies with flooding the country with private schools, universities and commercialised education to operate in acceptance with market rules. “This explains why public expenditure on education has never gone anywhere near the UNESCO prescription that each country should expend at least 26 per cent of its national budget on education,’’ he said. Fashina said that Nigerian education had also witnessed policy summersaults arising from inadequate conception of the philosophy, purpose and practice of education and class domination. He noted that for effective national development in the education sector, it must be re- conceptualised in a manner that would make it capable of performing its transformative functions for the nation at large. Fashina said that the summit would chart a new pathway for educational delivery capable of fostering the needed body of knowledge, skills, value and ethics in liberating education system, among others. “We are expected to come up with viable proposals the acceptance and execution of which will bring about a re-engineering and liberation of the education sector.’’ The Minister of Education, Mallam Ibrahim Shekarau, commended the organisers of the summit, which he said was timely. Shekarau, who was represented by Mrs Ann Harrison, the Deputy Director, Institution Services, said that the summit would not only identify mistakes but strengthen the sector. “The summit will also strengthen the pitfalls to avoid in the future and also come up with recommendations that will move the sector forward,’’ he said. Prof. Biodun Jeyifo, an academic don at Harvard University, Cambridge U.S., who is also the Chairman of the summit condemned the educational module which Nigeria still adopts. Jeyifo said that lack of proper implementation of the education policies were the reasons Nigerian universities produced graduates that were unemployable. He noted that corruption and policy somersault were at the core factors limiting the education potentials of the country. The summit was jointly organised by Senior Staff Association of Nigerian Universities (SSANU) National Association of Academic Technologists (NAATS). The French Minister of Foreign Affairs, Mr Laurent Fabius, has urged the Independent National Electoral Commission (INEC) to defend Nigeria and Africa’s image by conducting credible elections in 2015. Fabius gave the advice when he and the Garman Minister of Foreign Affairs, Dr. Frank Seinmeier, led a delegation to a courtesy visit on the Chairman of INEC, Prof. Attahiru Jega, in Abuja on Monday. Fabius said the delegation visited the commission because of INEC’s responsibility to conduct credible elections by 2015. “We congratulate your institution for the way you handled general elections in 2011 and more recently the current elections. “Now that new elections are coming next year, the challenge is tremendous. You have great responsibility towards Nigeria. The image of Nigeria is at stake and the image of Africa as well. “We have no doubt that this election will be free, fair and transparent. “European Union (EU) will contribute to it, financially and will also dispatch EU observation mission ’’ Fabius said. Fabius said the delegation was interested in knowing INEC’s preparation to face the security challenges because of the current situation, particularly the northern part of Nigeria. “We are here to tell you that we have great confidence in what you are going and what you will do,’’ he said. Also in his address, the German Minister of Foreign Affairs, Dr Frank Seinmeier, tasked Nigeria to increase its efforts on ending insurgency ahead of the 2015 elections. “You know that the elections you are preparing for are taking place under difficult conditions, fighting two enemies at a time. “First of all, it was even until last week we were commenting on your effort and success fighting Ebola. “The second enemy we were talking about this morning during breakfast meeting with different religious organisations is against the Boko Haram and its terrorist groups. “Therefore we know that the fight against Boko Haram is not yet enough successful as over 200 girls are still kidnapped and not yet released,’’ he said. Fabius wished the commission success in the 2015 general elections even as the country continued its fight against Boko Haram and security situation in the North. The minister said that the visit was to underline the importance of Nigeria to EU, saying Nigeria mattered not only beyond trans-borders, Africa but also in Europe. Responding, the Jega said the commission was working closely with all key stakeholders to address challenges that had to be ended before the elections. “One of the challenges is security and how it could affect the conduct of the elections. From our interaction, we are working with security agencies. “We know that these challenges are there; our hope and prayer is that before the 2015 general elections, tremendous success would have been attained to ensure that election are peaceful and credible throughout Nigeria. “We, as electoral body, are adequately prepared to deploy but we need to work closely with security agencies,’’ he said. Jega said the commission was taking its responsibilities to contribute towards deepening the democracy of Nigeria with all seriousness that it deserved and promised to deliver credible elections in 2015. “Obviously that does not underestimate the challenges. There are enormous challenges; it is going to be difficult but we believe it will not be impossible. “The kind of support, encouragements and assistance that we have received from all stakeholders – domestic and international partners – have not only inspired us but reinforced our commitment to ensure that we deliver free fair credible elections,’’ he said. The chairman commended EU’s support to the commission, saying the visit underscored the kind of importance EU attached to the democracy of Nigeria. “The support has enabled us to conduct free, fair and credible election in 2011 and since then, we have been receiving timely and important support as we prepare for 2015 general elections ,’’ he said. The Academic Staff Union of Nigerian Universities (ASUU) has officially suspended it five months old industrial action action starting from today. The union took the decision after a marathon meeting in Minna, Niger State. The decision to end the protracted industrial action was taken after ASUU signed a new agreement with the federal government on December 11 2013. ASUU President, Dr. Nasir Fagge told SaharaReporters shortly before commencing a press conference in Minna that ASUU has concluded its National Executive Council meeting and accordingly decided to suspend the strike.
