AGONIES of the university undergraduates and their parents may linger for much longer following the discordant notes from the workers of the affected institutions, National Daily can reveal. Despite the latest deal with the Federal Government that seemingly snapped the cord which since June 22, 2009 bonded the various branches of the Academic Staff Union of Universities (ASUU) together in a strike, and their weekend suspension of action, technically, the gates of most tertiary institutions in the country still remain shut. Whereas ASSU promised a two weeks truce and resumption of lectures to create room for more dialogue, the Non-Academic Staff Union of Universities (NASU) has vowed to keep the classrooms under key and locks. NASU, the Senior Staff Association of Nigerian Universities (SSANU), and the National Association of Academic Technologists (NAAT) , at the weekend warned the Federal Government against reopening the institutions without negotiating with them. "We are surprised at the unilateral action of the Federal Government to terminate the agreement reached with the four unions two and half years. It was based on this that the Joint Action Committee of the three unions directed that their members to embark on massive protest to sensitise the people against preferential treatment meted to them. The latest turn of event has further heightened fear of explosion in criminality and cultism among Nigerians. Though the government succeeded in securing a deal with ASUU, its failure to carry the other three unions along will scuttle the peaceful atmosphere in the campus stakeholder have said. Speaking with National Daily last week, the National Co-Chairman of NASU, Comrade Peter Adeyem, who frowned at the government one-sided negotiation with ASUU, however explained that the strike by the union could only be suspended after the planned consultation with its branches to reach a consensus on the matter. “I cannot single-handedly declare the stand of the union, we will have consultation with other members of the union to take a stance, so until that time, the strike will is still ongoing.” The other sister unions in the struggle for better condition and qualitative education NASU, SSANU, and NAAT, decided to press ahead with the strike action to protest their exclusion from the negotiation between government and ASUU. It would be recalled that NASU, SSANU and NAAT , Obafemi Awolowo University (OAU) branch, last week staged warning protest against government's refusal to dialogue with them on the protracted crisis rocking tertiary institutions. The workers locked up the university's gate against members of the university community and visitors insisting that their action was to sensitise members of the public on the danger the students would face if the government and ASUU announce the resumption date without addressing pressing issues involving them. While castigating the administration of President Musa Umar Yar' Adua for attempting to cause disunity among the staff unions, the unions cautioned that ASUU's members would not have place to stay if they continue with the negotiation with government without other three unions. Remi Adetoro, Bayo Aderonmu and Alofe Kayode who spoke on behalf of SSANU, NASU and NAAT respectively, called on the government to reopen negotiations with the three unions along ASUU so as to address the offending issues once and for all. Adetoro cautioned that discrimination should not be introduced into the Nigerian university system, adding that without one union, the others cannot function effectively. The union in a 1981 agreement established the principle of collective bargaining as a platform to fight for salaries and conditions of service of academic staff; funding and the roles of Pro-Chancellors and other functionaries associated with the running of universities. The 1992 and 1999 agreements highlighted issues, such as autonomy, academic freedom, academic allowances and conditions of service. ASUU came up with the 2001 agreement as a result of the need to reverse the decay of infrastructure in the system and brain drain. To achieve this feat, the union advocated increased funding up to the 26 per cent recommended by United Nations Education , Scientific and Cultural Organisation(UNESCO). The document recommended that implementation should be based on a three-year budget estimate which could be reviewed once in three years and re-negotiated if there were problems with implementation. The Federal Government had on August 11, said there would be no further negotiations with ASUU until the union returned to work. It is holding onto a part of the agreement which its negotiation team, headed by Deacon Gamaliel Onosode, said conflicts with Federalism. The government said it could not sign the agreement because of "the principle of collective bargaining", saying it could not compel state governments to pay stipulated salaries. The states have also said they would not align with any such agreement. A day after the Federal Government pulled out of the strike, governors warned that they would sue the federal authority if it signs a deal with the ASUU. Strike: SSANU, SSANIP, NASU vow to fight on The leadership of the Senior Staff Association of Nigerian Universities (SSANU) and that of the Senior Staff Association of Nigeria Polytechnics (SSANIP) have condemned the Federal Government’s recourse to the Industrial Arbitration Panel (IAP) on the on-going nationwide strike embarked upon by unions in the nation’s tertiary institutions. The National President of SSANU, Comrade Promise Adewusi said that the move will not help matters unless and until government respects and implements the agreement reached with the union, adding that government willingly entered into the agreement which took over two years to reach. He said, “Sneaking from behind to obtain ex parte injunctions will not help matters. And it is important that the arbitral tribunals continue to maintain their integrity, particularly in relation to an insincere government.” On the recent pronouncement of the Minister of Education, Dr Sam Egwu that SSANU members are not entitled to retirement age of 65 years, Comrade Adewusi said that Egwu should prepare to oversee a completely unpeaceful sector. His words, “Well, Dr. Sam Egwu will live with the strike or sack all of us so that his children can take over our jobs. We have been patient for eight years and there will no longer be peace in the universities until all the problems are resolved holistically. If they think they can employ their usual divide and rule tactics, then I wish them luck.” Comrade Adewusi, who is also a deputy President of the Nigerian Labour Congress (NLC), said the strike has been very successful as there is full compliance by members nationwide, adding that the strike will continue until their demands for negotiated new salary, 65 years retirement age, university autonomy and the payment of 2003 to 2005 monetisation arrears are met. Speaking in the same vein, the Chairman of Yabatech branch of SSANIP, Comrade Austin Okoh said the Federal Government has not shown any seriousness in meeting the union’s demands. He said, “Up till now, there is nothing on ground to show that government is ready to implement the Consolidated Tertiary Institutions Salary Structure (CONTISS) 15. To worsen the situation, government unilaterally approved discriminatory salary increase for academic and non-teaching staff in tertiary institutions. This is unfortunate, unjust, unfair and unacceptable. We are not inferior! Why would government treat us like second class workers within the same system.” Okoh further disclosed that while rectors of the nation’s polytechnics are already on Salary Grade Level 15, in line with CONTISS 15, Registrars and other officers below them have not started enjoying it, adding that the strike will continue until government accedes to their demands. Apart from the implementation of CONTISS 15, SSANIP is also demanding for the payment of the 24 months arrears of monetisation of fringe benefits and the establishment of a National Commission for Polytechnics (NCP). Similarly striking members of the Non-Academic Staff of Educational and Associated Institutions (NASU) in the nation’s universities, have also resolved to continue their ongoing strike, saying the industrial action is not all about emoluments, but about the funding of the university system, failing and decaying infrastructure among other things that have made Nigeria incapable of producing world class graduates any longer. While announcing their rejection of the 20 percent salary increase awarded by the Federal government, their leaders declared that the ongoing industrial action would continue until the government signed and implemented the agreement reached with NASU and government negotiating team headed by Chief Gamelie Onosode. At a meeting of leaders of NASU in the 42 federal, state universities and inter-university centres, which held at the University of Lagos, leaders of NASU argued that besides the fact that the 20% salary award was discriminatory, lower than what was awarded to other category of workers in the system, it was not a product of negotiation, the issues at stake were more than salary but about the funding of the university system, about failing and decaying infrastructure among other things. Vanguard gathered that before the Lagos meeting, they had earlier met at the University of Nigeria Nsukka (UNN) where the 20 percent offer was debated and rejected, after which the leaders were then directed to go back to their respected institutions to present the matter to them and obtain a fresh mandate from them on the way forward. At the meeting which took place recently, it was gathered that while 41 institutions rightly rejected the 20 percent salary increase awarded them by the government, one voted for the acceptance of the 20 percent salary increase and have the action suspended. Addressing journalists on the out come of the meeting earlier, General Secretary of NASU, Comrade Peters Adeyemi, lamented increasing government disrespect for due processes and rule of law in spite of the government so-called commitment to due process and rule of law. He wondered why government allow a negotiating team it constituted, to go on for two years if it (government) knew it was not going to honour the agreement? He posited that besides wasted public funds and time for negotiation, before the final agreement was documented the government team told us that while government had accepted some of our positions, others were rejected before the final agreement was reached. The General Secretary pointed out that on every page of the agreement with NASU, both the government team and NASU President signed until the final page, arguing that it was strange that government was denying the agreement. According to him: “We are surprised with government’s U-turn, about government new talk, on this new type of industrial relations practice while government can unilaterally award salary increase. It is unacceptable to us. Government cannot use its will power to determine what agreement to accept and which not to accept. If government had no confidence in its team, it ought to have dissolved it. For government to give us an award of 20 percent, another set of workers, 40 percent when it knows that even if it had given everybody 100 percent there would still be disparity, is completely unacceptable to us. Nevertheless, we have said the action is not just about salary. It is about lack of funding for the universities, decayed infrastructure, and general conditions that made the Nigerian universities no longer capable of producing world class graduates. We want to use this opportunity to say no amount of intimidation or threat of no work no pay and other tactics of government could break our ranks. DELSU SSANU vows not to call off strike WARRI—Delta State University, Abraka chapter of the Senior Staff Association of Nigerian Universities (SSANU) said yesterday that the strike embarked upon by its members would not be called off until the government adhered to the legitimate agreement signed with the union on February 13, 2009. The Union further cautioned the Education Minister, Dr. Sam Egwu, over alleged unguarded statement asking the unions to happily accept the 20% and 40% increment unilaterally awarded by government to the striking workers. According to the union, the minister’s statement is a ploy by the government to introduce a divide and rule tactics in the university system, but expressed joy that the approach failed. The union also appealed to students not to see the action as intended to punish them, but designed to bring government to take urgent steps that would make Nigerian university degree acceptable and competitive anywhere in the world. Chairman of SSANU, Comrade Stephen Erubrenyo, made these remarks at Abraka in an exclusive interview with Vanguard, said the union opted for strike because re-course to court would certainly fail and lead nowhere. According to him, the government and its officials are very comfortable with the strike that has kept students in tertiary institutions in the country at home for more than three months now because non-of their wards is in schools in Nigeria. Comrade Erubrenyo described the action of the government as most ungentlemanly and disappointing, as the Deacon Gamaliel Onosode –led government team promised them that the agreement reached with them was going to be binding on government. Stating reasons the strike would not be called off, the union leader said it was most disheartening that instead of government setting up machinery to implement the content of the agreement signed on February 13, 2009 by both parties, it was rather requesting requesting the unions to go back and re-negotiate with their various councils, insisting that the action was in bad faith. He wondered why government wasted almost two years negotiating with them, if it knew it was not prepared to honour any agreement entered into with them. JAMB, universities may clash over Post-UME By Segun Olatunji, Kaduna Published: Wednesday, 22 Oct 2008 The Joint Admissions and Matriculation Board and the universities may be on a collision course as the board has cautioned them to stop encroaching on its legal functions through their conduct of the post-University Matriculation Examinations. JAMB advised the universities to immediately restrict themselves to the proper screening of candidates that met the prescribed scores qualifying them for admission rather than conducting another examination for them under the guise of Post-UME. The board said it was surprised that instead of screening the qualified candidates after the release of the Universities Matriculation Examination results, the universities engaged in the conduct of what it described as” second-leg examination” for the candidates who had met the cut-off marks. This, it said, contradicted the purpose for which the board backed by the requisite law was set up. The Registrar and Chief Executive of JAMB, Prof. ‘Dibu Ojerinde, stated these while speaking with journalists shortly after the opening of the Technical Committee meeting on admissions to National Diploma and Nigerian Certificate in Education-awarding institutions at the Kaduna State University. Ojerinde warned that JAMB would no longer tolerate acts that could undermine the law or the decree establishing it. He said it was a great irony that the universities which provided all the questions administered on candidates during the UME examinations exercise, would go round again to conduct separate examinations under the guise of Post-UME screening. “The universities set all the questions administered by JAMB and we see no reason they should go back again and set separate questions themselves during the Post-UME screening. “If in the first instance, they are saying that the questions they set and provided to JAMB for the examinations are bad and they are now engaging in setting another separate questions to be administered in their universities, so who is blaming who?,” the JAMB boss said. Ojerinde who was represented on the occasion by the JAMB Director of Finance and Accounts, Mallam Yakubu Umar, argued that, ”the issue of Post-UME examination is illegal because by law and the decree setting up JAMB, it states that JAMB is the only body in the country that actually administers examinations into tertiary institutions, be it universities, polytechnics, monotechnics and colleges of education, for admission purposes.” |
