* Tension as Supreme Court decides in 48 hours By Soni Daniel, Ikechukwu Nnochiri and Erunke Joseph Tension is mounting at the Presidency and the core North over the court case challenging the eligibility of President Goodluck Jonathan to contest the 2015 presidential election. Competent sources said, last night, that the Presidency was worried that the case could upset its political permutations should the Supreme Court rule against Jonathan running in the election. The main headache of the Presidency is that if the apex court rules that its principal could not run in 2015, it would be difficult for the ruling Peoples Democratic Party (PDP) to organise another National Convention to elect another candidate to meet the deadline set by the Independent National Electoral Commission (INEC) said to be December 18, two days after the hearing. The case was said to have been on the radar of presidential minders believed to have also made contacts to know how the case could go and the justices to sit on it. Meanwhile, Jonathan’s opponents, particularly from the core North, it was learnt, were expectant that the case would be decided against the president having taken the oath of office twice for the office. Sunday Vanguard gathered from judicial sources that top officials of the Supreme Court were aware of the heightened interest in the case, slated for hearing on Tuesday, December 16, 2014 and were working hard to block undue access to the case file. The heightened tension, according to the sources, manifested in unceasing enquiries over the composition of the panellists to hear the crucial matter. Although the case was filed during the tenure of the former Chief Justice of Nigeria (CJN), Aloma Mukthar, the sources said there had been intense pressure on the current CJN, who took over about two weeks ago, to reconstitute the panel. Those in support of Jonathan were said to be rooting for a justice sympathetic to his cause to head the panel while those who want the president disqualified from running in the 2015 election, favoured a neutral and fearless arbiter to preside over the case. The official said it was normal in a very crucial judicial matter of that nature for the CJN to interfere in the composition of the panellists to ensure that justice is delivered to all the parties concerned. He said: “The eligibility case filed by some persons against President Jonathan is a serious matter, which the CJN has taken notice of and the normal process of setting up the panel, a few hours to the hearing, will be done. “As at the close of work at the weekend, no panel had been raised by the CJN and we believe that, because of the sensitive nature of the matter and the interest it has generated, the CJN will empanel a team to handle it at the right time. “This is not the first time such a case is coming before the Supreme Court and there is an established procedure for dealing with such matters. “In a case of this nature, the CJN might want to put in neutral justices in the panel taking into consideration where they come from, their maturity, objectivity, and how they have handled similar critical assignments in the past. Anxiety A northern politician from Kano State, who has been campaigning against Jonathan’s presidency, said he was hopeful that Jonathan would lose the case and return power to the North, ”where the presidency is supposed to be following the death of Umaru Yar’Adua.” But a PDP governor, who spoke to Sunday Vanguard, last night, expressed optimism that the president had the right to run for second term, having merely completed the tenure of the late president before seeking a fresh mandate in accordance with the Constitution of Nigeria. “Obviously, I don’t think there is anything to worry about as far as this case is concerned,” the governor said. ”There is no law that says that Jonathan should not run in 2015 and that is it”. The anxiety over the case follows the declaration by INEC that the different parties must submit to it the names of their candidates for the 2015 elections in the shortest possible time as stipulated by the law. The commission said, last night, that it was awaiting the parties to forward to it lists of candidates and their running mates where necessary. But it said it will only recognize candidates that emerged from primaries supervised by its officials, warning politicians who conducted parallel party primaries not to approach it with any list. Mr Kayode Idowu, Chief Press Secretary to INEC Chairman, Prof. Attahiru Jega, who spoke in a telephone interview with Sunday Vanguard, said the electoral law was clear on the time frame, and asked all parties to rectify their problems where necessary with a view to forwarding their candidates to the electoral body. It will be recalled that the Supreme Court had okayed the appeal filed before it by a chieftain of the PDP, from Adamawa State, Dr. Umar Ardo, for hearing on a day Jonathan insisted he was legally qualified to contest the 2015 presidential election. The president, through his lawyer, Mr. Ade Okeaya-Inneh, SAN, told the court that he had cited legal authorities backing his re-election bid. He argued that Ardo had no case against him, insisting that he is permitted by the 1999 Constitution to go for a second tenure in office. `Busy body’ Ardo is, through his lawyer, Dr. A. Amuda Kannike, praying the court to stop Jonathan. He is further challenging the refusal of the Abuja Division of the Appeal Court to join him as a party in the suit that was originally filed against the president by another member of the PDP, Mr. Cyriacus Njoku. He contended that the outcome of that case will personally affect him since the PDP had adopted Jonathan as its sole candidate for the 2015 presidential poll. However, a three-man panel of the Appeal Court declined to join him as a party to the suit, describing him as a meddlesome interloper. The court branded him a “busy body”, saying he lacked locus standi to challenge the judgement that was delivered by Justice Mudashiru Oniyangi of the FCT High Court on March 1, 2013, which declared Jonathan legally fit to contest for second term next year. In an unanimous decision, the Court of Appeal panel, led by Justice Abubakar Yahaya, ordered Ardo to pay N50,000 costs to the president and the PDP. The court held that Ardo’s application was completely devoid of any merit. Meanwhile, Jonathan challenged the jurisdiction of the Supreme Court where Ardo lodged an appeal to set aside that decision of the appellate court which he said was flawless. He further contended that Ardo was not a party before the High Court and did not show any good ground on why he should be joined at the Appeal Court. Jonathan noted that whereas the main appeal by Njoku was filed on April 16, 2013, Ardo waited till September 23 to apply with a view to be allowed to seek his disqualification from participating in the 2015 election. Njoku, a member of the PDP in Zuba Ward, Abuja, had, in his appeal, insisted that the lower court misinterpreted the law to favour Jonathan, even as he urged the court to go ahead and determine “whether Section 135(2) of the Constitution, which specifies a period of four years in office for the president, is only available or applicable to a person elected on the basis of an actual election or includes one in which a person assumes the position of president by operation of law, as in the case of Dr. Goodluck Jonathan.” Arguing that Jonathan is constitutionally barred from contesting the presidency in 2015, the plaintiff prayed the court to determine “whether Section 137(1) (b) of the Constitution, which provides that a person shall not be qualified for election to the office of president, if he has been elected to such office at any two previous elections, applies to the first defendant, who first took an oath of office as substantive President on May 6, 2010 and took a second oath as President on May 29, 2011.” He is also seeking a declaration that ‘the president’s tenure of office began on May 6, 2010 when his first term began and his two terms shall end on May 29, 2015 after taking his second oath of office on May 29, 2011; and by virtue of Section 136 (1) (b) of the Constitution, no person (including the first defendant) shall take the oath of allegiance and the oath of office prescribed to in the Seventh Schedule to this Constitution more than twice. He further asked the court for an order of injunction restraining president Jonathan from further contesting or attempting to vie for president after May 29, 2015 when his tenure shall by the Nigerian Constitution end. |

The major business of any Government is security, if my Government doesn't know who the sponsors of BH are then there is no need for me to vote for them next time, but if they know that Buhari is the sponsor as we are always made blind to believe and they can not arrest and prosecute him that also show sign of incompetence. Let all those who want us to vote for Jonathan tell us what he has done in the last 6 years rather than smearing the image of other candidates. PDP knows that jona can not win primary let alone the presidential elections that was why they did not sell forms to other candidates. |

I got an 800va Sukam inverter recently to compliment the Genus 1.4kva inverter I have. I installed it with 200AH battery, the problem I have is, the inverter will charge the battery for like 2 hours and show full charged. It discharges quickly, showing it was not fully charged as the inverter suggest, though the battery is new. I have tested it with another battery but same result. What may be wrong? |

He made this known while fielding questions from Nigeria Moment recently. He said that the Igbos would suffocate in Igbo land if Nigeria breaks up because it would lead to population explosion, food and housing crisis, job problems, etc, and that he would not support any move that would lead to the division of the country. He added that the Igbos are the people who actually need free movement in the country because of their spread in the country. He also said that what needed to be done was to create atmosphere that would guarantee the Igbos to realize their futures where ever they are, even as he said the Igbos need to reach out to others for the best interest of their children. He said: “They have forgotten what happened to those who ran back because of the crisis in the North: that only a week after, their relations asked them out of their homes. So, what do we do? Now, you find that if a trailer blocks the road to the North today, we will starve. We won’t have tomatoes, fish and others. “What are you separating for? All these things will now be imported and you will have to pay duties on them. Some people don’t understand this: we are the people who need free movement in Nigeria; the others don’t, we do. So, why splitting the country? “What we can do is to make it possible for every Igbo man where ever he to realize his future. We want friendship with others; we want to unclench our fist and have a handshake with others in the interest of our children who are elsewhere. Look at all the universities all around the place! You want our children to be foreign students in those places? Because that would be the implication. Now, those at home enjoying themselves don’t know what the effect would be on others, but I know. So, in Nigeria, in every state, you would find that after the indigenes of that state, the next in population is the Igbo. So, where are you going to put these people if they come back home? “Since (Michael) Opkara, has anyone built industry here? Look at Naze Industrial Area; look at Onitsha Road Industrial Area; how many governors have come here since they were set up? Do you have anything there? And when you talk about governorship nomination people are talking about somebody who has money to give to delegates and not somebody who has a programme to create job for the people. “That is what we are interested in. If we work to ensure that anybody who lives anywhere in Nigeria should have full citizenship rights in those places, it would be to the advantage of the Igbos instead of losing what we already have. That is the position I take, and I think that those who oppose me do so out of ignorance. They need to understand. Igbos need to learn to accommodate other people in their community. Go to the north, the s Igbos are number one as far as business is concerned, also south west igbos are second to none but go to east you hardly find any other ethnic group in sizeable number being accommodated there. Go to south south u will see Hausas and Yorubas in large numbers leaving peaceful there. So the earlier the Igbos try to accommodate other ethnic groups in their communities the better for them. I don't need any statistics to show the level of igbos businesses in Lagos, Abuja, sokoto, kano etc. Tell any town in Igbo land where other people do business in sizeable number. |
Am a product of polygamous home, my dad has 4 wives and 11 children. Am the only child of my mom and the no 10 for my dad. My mom was also born alone, so I have neither aunty nor uncle. My mom died when I was 14 years old, so I was raised by one of my step mom. My dad died just before I entered the university. My university education was sponsored by my step brothers and sisters. I don't know how life would have been if I was not born into a polygamous home. Though I don't intend to marry another wife but I see nothing wrong with polygamous home. Everything depends on how want it to be. |

He regretted that not even China with a population of over one billion people can compare with the number of delegates that Nigeria sends to the annual general assembly each year. According to the minister, 80 per cent of members of the nation’s delegation to the annual event do not add any value to the team’s work at the assembly. The minister made this disclosure yesterday in Abuja while addressing heads of government ministries, departments and agencies at the inter-ministerial meeting of the 69th regular session of the United Nation General Assembly, UNGA, to adopt the country’s working documents to guide Nigeria’s participation at this year’s United Nation General Assembly, which comes up next week, September 16, in New York. The theme of this year’s gathering is: “Delivering on implementing a transformative post 2015 Development Agenda.” Wali, who expressed shock that 576 delegates from Nigeria attended last year’s General Assembly pointed out that when compared to countries like Germany, South Africa and Egypt, which had about a third of Nigeria’s population, “certainly, something has to be done to put a stop to this embarrassment.” He said he is awaiting the approval of President Goodluck Jonathan to place ceiling on the number of delegates that will be in New York this year. “The size of Nigeria’s delegation to the United Nation General Assembly last year was 567, that is something that is certainly way way out; certainly it is unacceptable. On that basis I asked that they send me the list of three countries, Germany, South Africa and Egypt to compare with what we in Nigeria have. None of them is up to one third of our own delegation,” the minister said. “So, you can see that there is certainly need to really take a second look and see that those of our delegates that go the UN General Assembly do have value. It is not a question of having a jamboree, but indeed, it is more like a jamboree.” “I happen to have observed for four years as Nigeria’s ambassador to the UN, the delegation of Nigeria to the UN General Assembly. So, I know and if we are going to be honest to ourselves, I know that 80 per cent of the delegates that go from Nigeria do not add value to our team to the UN.” He however assured that his ministry is currently working to ensure that at least, the country has value for money, stressing that there ought to be some measure of accountability and responsibility on the part of our delegates. “So, I am appealing to the MDAs to please ensure that we abide by the directives which I am waiting to send to Mr. President in terms of the sealing of our delegation. Certainly we cannot afford to have 567-man delegation. “So, it is certainly something we will have to take a second look at again and see how we can look credible when it comes to issues like this,” the minister said. It is generally acknowledged that public servants seize the opportunity of travelling abroad on socalled official assignments including countless workshops, seminars and conferences to collect generous travel allowances known as estacode.
