For Nnamdi kanu in the last court outing on the 27th of this month to ask the prosecutor Chief Adegboyega Awomolo, who is a senior advocate of Nigeria, to name the extant Nigeria law he is using to charge him, and the prosecutor was dumbfounded and couldn't identify any Nigerian law he is basing his charges against kanu clearly shows the case is a dead on arrival. It makes you wonder how some of these guys actually became senior advocates of Nigeria. Nawao

I personally can't believe since 2015, that the government hasn't found the law they are using to charge a man for an offense.

Nnamdi Kanu’s attempt to buy time and trigger confusion by calling 23 Witnesses who are totally irrelevant to the charges against him; at a time the Court has given specific dates to present his defence has already been shut down by the Court which cautioned him to use what is left of the 6-day time window stipulated by the Court, to present his defense.

For the enlightenment of those who wish to learn, it is the Court, in its discretion, that can summon witnesses by way of Subpoenas on behalf of any Party that so requests. However, to invoke the power of subpoenas, the Court must be satisfied that such witnesses are NECESSARY to establish the case of the party requesting the subpoena.

It is also on account of being a NECESSARY Witness that the person to be so subpoenaed can be COMPELLABLE.

Unfortunately for the accused person here, Nnamdi Kanu, the charges before the court against him relate only to WHETHER OR NOT he made the inciting statements prohibited by the Terror Prevention and Prohibition Act of 2022 (TPPA-2022), as presented by the Prosecution by way of audiovisual evidence. Nothing else other than establishing that the voice on the audiovisuals belong to Nnamdi Kanu, is required by the Prosecution to prove their case and secure conviction.

None of the 23 so-called witnesses listed by Nnamdi Kanu are required to establish whether or not the voice on the various audiovisuals presented by the Prosecution belongs to Nnamdi Kanu.

This means that none of them is a necessary Witness and so none is a compellable witness that can be subpoenaed by the Court to testify at the request of the accused.

The Court already dismissed the ignorant request of the accused, reminding him in the proceedings that the 6-day window stipulated by the Court for him to present his defense will not be extended.

When the Trial comes to a conclusion and a verdict is pronounced, it will be self-evident that a dishonest, ignorant, and arrogant accused person was aided by his greedy, dishonest and mediocre lawyers to plunge himself into the outcome represented by the Verdict.

It is bad how someone will wake up and start blackmailing someone with something as damaging as HIV.

I just read the thread where it was reported that court remands an influencer Ghali Osma'il for releasing false rumor that Tinubu died of food poisoning.

But it was the same offense Nnamdi kanu committed by alleging that Buhari died and he was kidnapped from Kenya to Nigeria only for Nigeria to charge him with 15 baseless charges but refused to charge him with saying that Buhari died.

What it means is that Buhari truly died in 2017 and government did not include that in kanu's charges because they know kanu will demand that a DNA be conducted to prove his case.

The Judge in the case of Nnamdi Kanu has given Kanu's defence team two weeks to file a no case submission application they asked for, and the prosecution two weeks to respond. But what is a no case submission?


In Nigeria, whenever a person is charged with an offence, the person (referred to as the accused) can either plead guilty or not guilty.

If the accused pleads not guilty for that offence, it is the duty of the Prosecution to provide evidence that all elements of the offence have been committed as well as to prove that the Defendant is the person who committed them. Therefore, the burden of proof lies with them. The burden of proof in criminal trials is beyond reasonable doubt.

During a Criminal Trial in Nigeria, it is the duty of the prosecution to prove that the accused is guilty beyond reasonable doubt, this is true to upholding the fundamental principle that everyone is innocent until proven guilty. If there is any possibility of innocence which still exists when the case is over, the court must acquit and find the accused not guilty.

The process of a criminal trial has 2 parts. In the first part, the prosecution presents its case and calls its witnesses. In the second part, the defence presents its own case and calls its own witnesses. When can a No Case Submission application be raised? At the end of part 1, after the prosecution has finished presenting its case, if the defence feels that the prosecution has failed to prove its case, then the legal process in Nigeria allows the defence to make an application known as a no case submission.

When a no case submission is made, it basically means that the defendant is asking the court for an acquittal without it having to present a defence. The defendant is literally saying to the court that there is no case to answer i.e. the prosecution has not sufficiently proven the legal threshold to establish the commission of a crime in the court of law.

The submission is reliant on the strength or rather, the lack thereof) of the prosecution's evidence. When used, the results are extremely beneficial to a defendant because, when successful, it means that the case effectively stops without the need for the defendant to call any evidence at all.

The defence makes the plea by filing an application before the court, and if the judge agrees, then the matter is dismissed and the defendant is acquitted without having ta to present any evidence in their defence. lf the judge does not accept the submission, the case continues and the defence must present their case. Therefore, the lefence really loses nothing by filing a no case submission application.

The general standard which the courts in Nigeria will use in determining whether a no case submission should be allowed and the accused person acquitted is contained in Section 303 of the Administration of Criminal Justice Act 2015, it provides that the Judge will onsider four things:

whether an essential element of the offence has been proven by the prosecution.
whether there is evidence linking the defendant with the commission of the offence
if the evidence so far which the
prosecution has provided is one that no reasonable court or tribunal would convict on it. Reasonable doubt, the court when determining this, has to decide whether a prima facie case has been made by the prosecution. Prima facie case here refers to the standard of proof under which the prosecution need only present enough evidence to create a rebuttable presumption that the matter asserted is true. A prima facie standard of proof is relatively low.
