The Nigerian Ports Authority (NPA) has released new guidelines which would serve as a new procedures for barge operations across the country and this is to be adhered to by all barge operators. According to the Mohammed Bello Koko, who is the acting managing director of Nigerian Ports Authority (NPA), the move will help regulate operations in the country. This move would help eradicate irregularities and illegal operations and create an atmosphere for legally regulated operations across the country.

In accordance with this decision of new procedures for barge operations, a comprehensive profile of all barge operators would be captured. The profile would include, the carriers’ corporate name, to make for easy identification, especially in line with efforts to check the deployment of dilapidated barges that are in poor state and do not meet the minimum standards for barges and tugboats.

To ease off the tension for the barge operators, the Chief Executive of the NPA, advised all terminal operators not to demand the collection of a N20 million bank bond, with a promise to liaise with the relevant government agencies for a downward review of prevailing charges on carriage of containers. In line with this decision, movements would be streamlined to reduce congestion and possible threat to ocean going vessels. The Barge Operators Association of Nigeria, BOAN has collaborated with the Maritime Workers Union of Nigeria, MWUN to enhance waterways transportation, seaports decongestion, and strengthen interface with the government and regulatory bodies. BOAN is working with National Inland Waterways Authority, NIWA, Nigerian Maritime Administration and Safety Agency, NIMASA, Nigerian Navy, Nigeria Police, Lagos State Waterways Authority, LASWA and Nigerian Ports Authority (NPA), in collaboration with regulatory agencies would engender better coordination of movement of crafts and barge operations as well as other third parties plying the waterways.

The President of BOAN, Mr Edeme Kelikume, said that the collaboration has become necessary for a better management of barge operations and activities on the waterways. He said, “We have been working tirelessly to put in place all that it takes to achieve maximum operational activities within our waters. We are training our men, while we secure the partnership of insurance companies to mitigate risks; we ensure safety and boost confidence. “We need to have the right navigational aids. Security is very key; with the Navy and Marine Police, we can have a secured waterway,”

Also, Mr. Ernest Udeze, the Public Relations Officer of BOAN, said the association was working on mobile software to ease engagement and communication on the waterways. Udeze said that with the software, barges could be tracked in real-time as they leave the jetties. It presents an opportunity to build a strong, database for the industry, thus improving insight and enhance swift decision making and projections.

The President-General of MWUN, Mr. Adewale Adeyanju, said the partnership among the organizations would assist in becoming formidable in reaching its goals. Adeyanju said that the synergy would strengthen their interface with the government and regulatory bodies. He, also said the partnership would transcend beyond Lagos, adding that MWUN had engaged stakeholders across the country.

transition from physical to digital/online seemed novel to them.

The maritime industry was immensely affected by the disease outbreak, many port operators, freight forwarders, truck drivers, helmsmen, sailors were made to stay at home in order to curtail the spread of the virus. In fact, port operations nationwide were shutdown as the novel virus put people in a frantic situation. This pandemic has launched a major brunt for the maritime industry in Nigeria and worldwide as well.
Here are some of the effects of COVID-19 on the shipping industry in Nigeria;
1) A downturn in importation and exportation: There was massive decline in importation and exportation due to the pandemic as majority of the stakeholders in charge were at home self-isolating or quarantining and this affected the level of income and the economy.
2) Economic Recession: Port closures, a shutdown of port operations across the country, the ban on entry and exit of vessels, to contain the spread of the virus, had an adverse effect on the economy as monies accrued from port operations were no longer forthcoming.
3) Health Impact: The pandemic affected the health of port players, crew members, stakeholders and others in the sector. With some being diagnosed of the disease, many others had to quarantine and stay home to prevent the spread of the virus.
4) Decrease in the demand for cargoes: There has been a decrease in importation and exportation due to the curtailing of the spread of the novel virus. There are now stifled regulations for the transportation of freights and this has led to a decline in the demand of certain goods. There’s also been a delay in the transportation of goods due to the lengthy process of clearance which has negatively affected import and export in the country.

3) More testing and the introduction of the vaccine: Workers health and safety should be paramount. So, government need to carry out more COVID-19 testing and also try to make the vaccine available to port operators and other workers in the maritime sector.
4) Simplifying the cargo clearance process: The cargo clearance process needs to be simplified and made less stressful in order to encourage the importation and exportation of more goods that were before now slowed down due to the cumbersome clearance process that resulted from the outbreak of COVID-19.
5) Introduction of the Intermodal Transportation System: An introduction of the intermodal transportation system will help reduce traffic congestion and the gathering of huge number of people that can pose a risk through further spreading the virus

It provides that the jurisdiction of the Federal High Court includes the following; Jurisdiction to hear and determine any question relating to the property interest in a ship or aircraft or any maritime claim; Any other admiralty jurisdiction being exercised by any other court in Nigeria immediately before the commencement of this Act;
Any jurisdiction connected with ship or aircraft which is vested in any other court in Nigeria immediately before the commencement of this Act; Any action or application relating to any cause or matter by any shipowner or aircraft operator or
any other person under the Merchant Shipping Act or any other enactment relating to a ship or an aircraft for the limitation of the amount of his liability in connection with the shipping or operation of aircraft or other property;
Any claim for liability incurred for oil pollution damage; Any matter arising from shipping and navigation on any inland waters declared as national waterways;
Any matter arising within a Federal port or national airport and its precincts, including claims for loss or damage to goods occurring between the off-loading of goods across space from a ship or an aircraft and their delivery at the consignees' premises, or during storage or transportation before delivery to the consignee;
Any banking or letter of credit transaction involving the importation or exportation of goods to and from Nigeria in a ship or an aircraft, whether the importation is carried out or not and notwithstanding that the transaction is between a bank and its customer; Any cause or matter arising from the constitution and powers of all ports authorities, airport authority, and the National Maritime Authority; Any criminal cause or matter arising out of or concerned with any of the matters in respect of which jurisdiction is conferred

Merchant Shipping Act

The Merchant Shipping Act 2007 contains the body of maritime laws and policies for merchant shipping and other related matters in Nigeria. Under Section 2, it provided that the agency of government established and responsible for maritime safety, administration and security shall be the implementing agency.

The Act established provisions to ensure that all ships trading in Nigeria must obtain a Certificate of License. Section 5 of the Act provides that “no ship shall operate commercially in or from the waters of Nigeria unless the ship is;

A registered Nigerian ship.

Provided with a certificate of foreign registration or other documents similar or equivalent to the required by the Act. Registered by the law of the country other than Nigeria as a ship of that country and is by the law of that country exempted from registration. Exempted from registration. A licensed Nigerian ship operating solely within the waters of Nigeria”. The law also gives the power to the Minister to exempt generally or specifically by notice, a licensed Nigerian ship or a class of Nigerian ship from registration when operating outside the waters of Nigeria.

The Merchant Shipping Act is also the principal law that governs collisions in Nigeria. Section 338-344 of the Act makes provisions for the liability in collision cases. Under the rules as to the division of loss in collision cases, Section 340 provides that “where the fault of two or more ships, damage or loss is caused to one or more of them, or to their cargo or freight or to any property, the liability to make good the damage or loss shall be in proportion to the degree in which each ship was at fault”.

The Act also provides for the limitation of actions for maritime claims in Nigeria. Section 343 provides that “no action shall be maintainable to enforce any claim or lien against a ship or its owners in respect of any damage or loss to another ship, its cargo, freight, or any property on board or damages for loss of life or personal injury suffered by any person on board, caused by the fault of the former ship, whether such ship is wholly or partly in fault unless the proceedings in respect of the damages are commenced within two years from the date where the damage or loss or injury was caused or the salvage services was rendered”.

The Nigerian Maritime Administration and Safety Agency Act 2007 (NIMASA) Act

The NIMASA Act is another law that governs maritime-related matters in Nigeria. It was established to promote maritime safety and security, protection in the maritime environment, shipping registration, and commercial shipping and maritime labour. The Act also established the Nigerian Maritime Administration and Safety Agency (NIMASA) in Section 3 of the Act, as the agency responsible for executing the provisions of the Act.

The functions of the Agency (NIMASA) are highlighted in Section 22 as follows;

The Coastal and Inland Shipping (Cabotage) Act No.5, 2003

The Cabotage Act was established to restrict the use of foreign vessels in the domestic coastal trade, to promote the development of indigenous tonnage, and also to establish a reserve for the commercial transportation of goods and services within Nigerian coastal inland waters to vessels flying the Nigerian flag and owned by persons of Nigerian citizenship. It was also established to ensure that indigenous shipping companies are protected from any form of incapacitation that would arise from the domination of carriage of cargo within the Nigerian waters by foreign vessels.

Section 2 of the Cabotage Act defines cabotage as "(a) the carriage of goods and passengers by vessel and any other mode of transport from one place in Nigeria or above Nigeria waters to any other place in Nigeria or above Nigeria waters, either directly or via a place outside Nigeria and includes the carriage of goods in relation to the exploration, exploitation or transportation of
mineral or non-living natural resources of Nigeria whether in or under Nigerian waters.

(b) the carriage of passengers by vessel from any place in Nigeria situated on a lake or river to the same place, or to any other place in Nigeria either directly or via a place outside Nigeria to the same place without any call at any port outside Nigeria or to any other place in Nigeria other than as an in-transit or emergency call either directly or via a place outside Nigeria, engaging by vessel, in any other marine transportation activity of a commercial nature in Nigerian waters and;

(d) the engaging, by vessel in any other marine transportation activity of a commercial nature in Nigeria waters and the carriage of any goods or substances whether or not of commercial value within Nigerian waters".

The operation shall have due regards to ISPS Code; 13. That all accruable revenue to the Authority shall be paid as at when due; 14. This approval is for twelve (12) calendar months after which you shall seek renewal in writing to the undersigned. The renewal of your Licence shall be subject to the outcome of the quarterly oversight review of your operations by the Standing Committee to ensure you have addressed ALL observations of the inspection team particularly issues of safety in operation; 15. The Operator shall indemnify the Authority against all aspects of the operation; 16. The Operator shall indicate acceptance of offer within five (5) working days from the date of receipt of a license; and 17.
