Good day house .my husband has been waiting for our additional document to be posted back to him .we paid for the returned delivery via Royal Mail and it's been over 3week now and nothing yet . I have sent a mail twice to sheffield and .royal mail hasn't received it as well.
Please can I have a phone no I can call in Sheffield . This additional documents contain all our original certificate etc . Thank you house

@justwise and @Karen . Thank you for your response ...I submitted over 30 photographs all encompassing as you stated above ..But we don't have a strong call logs mostly chats on bbm and whatsapp . ..

Aside from the relationship status . I don't understand why they refused us on financial issues . If was like they didn't even go through our documents . I even highlighted on my husband bank statement with a marker his salary payment received . From his present and previous employees

He also worked per time with an agency so we have

• CONFRIMATION OF EMPLOYMENT letter from the agency



And he exceed the 18,600 requirement

Dear people.  Please i have been refused a spouse visa based on the following attached reasons. I wish this uk vias people could understand how many heart they break and the stress beyond stress that they cause .
Am very sure we submitted all the documents but we are going to appeal . My questions are as follows :

What is the appeal process  and estimated duration ? as in how long does it take form putting in my appeal to my hearing to judgement to getting an approval to sending my passport for the spouse visa to etc
(Someone told me it takes like 3 years)

2)can we appeal from Nigeria (Although my husband is getting a lawyer from UK )
3) I have been advise to get a good white lawyer as they are taken seriously than nigerian uk lawyers . (What's your thought on this?)

4)can i apply for a visiting visa while the appeal is going on

@johnwerk , lamosy and mirabeelz:thank you so sos so much for your response , I am in nigeria and my husband is in uk . I submited his p60, letter from his acctountant , his work bank statements , his personal bank statement , what's I didn't submit that the embassy noted washis payslip and that his company acct statement was for one year which ended april 2012,(I asked my husband why its 2012 and he explained that one full year ends at april in uk)how ever the money he put as his income per annum doesn't cover it (hence we need to add the new evidence) we thought the embaasy would investigate his account and notice the increase after the next tax year(not sure am using d rightword)after reading the ECM we notice what we have was new evidence not additional , the only additional evidence we can add would be an employment letter and payslip , which we can't create since he own his company and can't give himself payslips and an employment letter . Pls pls advice me , we are also working on getting a lawyer, as my 28days is almost over , we got the letter 2 weeks late

"There is a distinction to be made between new evidence and additional evidence.

New evidence:

New evidence which postdates the decision cannot be considered by the ECM.  This evidence should be acknowledged in the Review and the ECM should indicate that this should be used to support a fresh application.

Examples of new evidence

These are common examples and are not an exhaustive list.

Unexpected increase in funds postdating the decision.
Sponsor obtains new employment that was not engaged in / expected at the date of decision.
An offer of accommodation which was not available at date of decision.
A new sponsor appears in the grounds of appeal. This is not reasonably foreseeable.
Additional evidence:

If evidence relating to the initial application is submitted with the appeal this should be taken into account by the ECM. The most common instances of additional evidence will be documents that the appellant omitted to include with the application.

Examples of additional evidence

These are common examples and are not an exhaustive list.

A bank statement issued after the date of decision that shows a satisfactory balance on or leading up to the date of decision.
Satisfactory evidence of accommodation submitted by the sponsor relevant to the decision.
Evidence of employment at the date of decision which was omitted from the original application.
A birtFFh certificate evidencing the relationship of parties which was not produced at the time of decision."

According to dis what I have is new evidence not additional evidence ad , so I guess I must reapply according to my husband , even if he submits the old doc payslip its not strong enough to exceed d finiacial requirement. Pls advice

"according to ECM guide states there should not be any change in circumstance and these evidence are considered as omitted during original application.additional evidence are considered during appeals and examples of these are birth cert to prove dad n child relationship,a bank account or payslips from dates before decision was made,please do not add any payslips after decision date,"

Dear meerbelz , does this mean that I can't add additional uptodate payslips or bank account , that anyadditional doc must be within the period of my application? Eg , if my application was in jan , I can't appeal with feb statement of account . The reason am asking this is , my husband earned more more after the application so , if the court was right with us not being finacially stable. The additional documents such as updated statements may help. Pls what do u think ?

My husband said maybe we should reapply (to make it faster)what do you think my issue is I don't have updated payslips because I have stopped working .do you think this would affect me if we reapply or we should just Appeal

@lamosy I praise The Lord for you.i was drawn to your story had to sign in to nairaland to just talk to you. At a point i was so scared for you that you waited for so long .i spent hours reading the chats until midnight yesterday when ,i even cried when i saw your good news . u are a woman of courage and i pray God gives me your strength .I was just refused a settlement visa this week based on grounds that my husband didn't submit his payslip what they failed to acknowledge was that my husband is self employed and he doesn't give himself payslip and to the embassy his statement of account was not enough. We are going to appeal .pls what advice can you give me to speed it up . I don't think I have the strength to wait for 3 months talkless of 5 - 8 months . Pls @johnwary is there anyway to write to Sheffield to speed this up . I would really appreciate your response.i haven't seen my husband in over 5yrs and another 3-8 . Plsssss help .i wouldn't really appreciate Ur emails
