The Rwandan government said on Tuesday that its controversial migrant deal with the UK did not stipulate the return of funds, following the decision by Britain's new government to scrap the scheme.

"The agreement we signed did not stipulate that we should return the money. Let this be clear, paying back the money was never part of the agreement," deputy government spokesperson Alain Mukuralinda told state television.

The Rwandan government said Tuesday a multi-million dollar migrant deal with Britain that was scrapped by the incoming Labour government on the weekend contained no stipulation about repaying funds.

Britain has already paid Kigali £240 million ($307 million) since the scheme was announced in April 2022, and Rwandan President Paul Kagame had earlier suggested money could be returned if no migrants came -- though he also said there was no obligation.

The UK's new Prime Minister Keir Starmer announced on Saturday that the plan forged by the previous Conservative government to deport asylum seekers to the East African country was "dead and buried".

The deal had already been bogged down in legal challenges in the UK that had prevented it from ever getting up and running.

"The agreement we signed did not stipulate that we should return the money," Rwanda's deputy government spokesperson Alain Mukuralinda told state television on Tuesday.

"Let this be clear, paying back the money was never part of the agreement."

Mukuralinda said the UK had approached Rwanda and requested a partnership, which was "discussed extensively".

"The agreement went to the courts, and it was even amended after the results from the courts," he said.

A spate of legal challenges had dogged the controversial scheme, with the UK Supreme Court ruling in November last year that it broke international law.

Earlier this year, former prime minister Rishi Sunak pushed through legislation that deemed Rwanda a safe country, clearing one hurdle for the flights despite concerns about human rights laws.


"It went to the parliament and eventually became a treaty between two countries. A treaty provides an exit clause," Mukuralinda said.

It follows Rwandan President Paul Kagame's comments in January that the money was "only going to be used if those people will come. If they don't come, we can return the money".

However, he later specified there was "no obligation" to do so.

The Labour Party said before the July 4 election that it would ditch the scheme, which the Conservative government had said was designed to deter migrants trying to get across the Channel to the UK on boats from northern France.

Following the leftwing party's landslide win earlier this month, Starmer announced in his first press conference that the scheme would be scrapped.

"The Rwanda scheme was dead and buried before it started," he told reporters.

"I'm not prepared to continue with gimmicks that don't act as a deterrent."

Starmer said previously that Sunak's policy was neither a deterrent nor value for money, instead pledging to tackle the issue "upstream" by smashing the people-smuggling gangs behind the crossings.

Earlier Tuesday, three asylum seekers who brought court action to block the UK's attempt to send them to Rwanda had their cases resolved.

Immigration has become an increasingly central political issue since the UK left the European Union in 2020, largely on a promise to "take back control" of the country's borders.

Rwanda, home to 13 million people in Africa's Great Lakes region, claims to be one of the most stable countries on the continent and has drawn praise for its modern infrastructure.

As part of the ongoing probe of the N2.6 billion allegedly spent on Nigeria Air, the Economic and Financial Crimes Commission (EFCC) has debriefed top officials of Ethiopian Airlines on some of its findings on the botched project.

According to a report on The Nation yesterday, during the interface, the team led by Group Chief Executive Officer of Ethiopian Airlines Mesfin Tasew claimed that the Ministry of Aviation owed them $211,000.

The team also alleged that the terms of the “pact” entered into with the Aviation Ministry during the tenure of former Minister Hadi Sirika were “brazenly breached.”

Tasew was quoted by an EFCC source as saying that “The Nigerian government lost interest in partnering with a foreign airline” because of the manner the project was handled by the ministry.

The EFCC official did not say when the Ethiopian Airlines officials visited Nigeria on the invitation of the anti-graft agency.

He, however, explained that the claim on $211,000 debt was ‘’another dimension to the probe of Nigeria Air.’’

He said: “As part of our investigation, we want to find out how about N2.6 billion was allegedly spent on the botched Air.

“So far, we were able to uncover N1,326,731,470.97 allegedly spent on a Consultancy contract for Nigeria Air. This is already an issue before a court.

“In the course of findings, our operatives also discovered that the Ministry of Aviation was indebted to Ethiopian Airlines.

‘’Some officials of Ethiopian Airlines were in the country for interaction. We debriefed them and they explained the details of the Nigeria Air project.

“They confirmed that the implementation of the agreement was faulty because the Ministry of Aviation did not keep to the terms.

“They also said the ministry owed the airlines about $211,000. We have been inviting some past and present officials on the nature of the debts.

“Our operatives are digging deeper.”

Sirika, his daughter, son-in-law- inlaw and a firm, Al Buraq Global Investment Limited, are being prosecuted by the EFCC over corrupt practices involving about N2.7 billion.

The former minister unveiled Nigeria Air on May 26, about 72 hours to the end former President Muhammadu Buhari’s tenure.

According to the agreement on Nigeria Air, Ethiopian Airlines had a 49 percent equity stake; Federal Government, five percent; and a consortium of three Nigerian investors, 46 percent .

The deal however collapsed leading to the withdrawal of Ethiopian Airlines from Nigeria Air.

EFCC investigation indicated that before the pact collapsed, about N2.6 billion was sunk into the project in alleged “questionable circumstance.”

Aviation and Aerospace Development Minister Festus Keyamo recently affirmed that Nigeria Air remained suspended.

Keyamo said: “It remains suspended. It was never Nigeria Air. It was not Nigeria Air. That’s the truth. It was only painted Nigeria Air.

“It was Ethiopian Airlines trying to fly our flag. If it is so, why not allow our local people to fly our flag? Why bring a foreigner to fly our flag? So nobody should dispute that it was Nigeria Air.

“Nigeria Air must be indigenous, must be wholly Nigerian, and must be for the full benefits of Nigeria, not that 50 percent of the profit is for another country.”
