Marital rape is explicitly excluded from the definition of rape in the Northern Nigeria Penal Code provided the spouse has reached puberty (Section 282(2)),[50] and likewise excluded from Section 357 of the Nigerian Criminal Code (applying to the southern states).The Sexual Offences Act of 2010 in Nigeria does not explicitly state that marital rape is a crime. The Criminal Code Act also doesn't define consent in a way that requires free and voluntary agreement. |

Kobojunkie: There does not need to be a law specifically on marital rape since the rape law is all that is necessary. For instance, if a woman in a non-marital relationship is enabled by law to accuse even her boyfriend of rape, then a woman in marriage— equally a relationship— is equipped by the same law to do the same— again, these are individuals. A separate marital rape Law becomes necessary if and only if the law specifically states that married individuals lose their right to bodily autonomy. In the Nigerian case, this is not the case.

Kobojunkie: That is simple! Because in marriage you have two individuals under the law still. Marriage does not make you into God. You are still two individuals under the eyes of the Supreme Law. 
2. A child is an individual and a citizen under the eyes of the Supreme Law. Under your criminal code, physical assault against another individual is a criminal offense, is it not? 
As for abortion laws in Nigeria, I am not too certain where it is given Nigerians have yet to make a clear decision on such things as far as I know it.  You’re being intentionally vague and intellectually dishonest. Are you talking law personal beliefs? If you’re talking law the the answer to the list is No because there is no law on marital rape in Nigeria (correct me if I’m wrong). You obviously diagree with the law so this entire conversation is based on personal beliefs. Your personal beliefs. Stop conflating it with the law. Do you think it is ok for parents to beat their child? Is it ok for a woman to abort a baby? |

Before you ever dreamt of marriage, you were an individual in the eyes of the Law. You expected under the Law. Even after marriage, you remain an individual under the Law, only with a marriage tag/status ticked in your profile. 
2. Government is the party responsible for ensuring crimes reported are properly investigated and prosecuted. That is the world of Government, not individuals. Rape is a crime with marital rape is equally rape, a violation of the right of an individual.  We are having two different conversation. I’m focused on the government involvement part.
