PoliticsCourt To Rule On Tompolo’s Fundamental Rights Suit On July 14 by CheapSunglass(op): 6:42am On Jun 20, 2017
A Federal High Court in Lagos on Monday, further adjourned till July 14, to deliver judgment in a fundamental rights suit filed by Government Ekpemulopo, alias Tompolo.

Tompolo, who had been declared wanted since Feb. 12, 2016 by the Economic and Financial Crimes Commission (EFCC), is seeking court’s protection against prosecution over an alleged N45.9 billion fraud.

Joined as respondents are the Inspector-General of Police, Chief of Army Staff, EFCC, Chief of Naval Staff and Chief of Air Staff.

The case earlier slated for judgment on Monday was re-slated for July 14, following the absence of the trial judge, Justice Mojisola Olatoregun, who is said to be attending a workshop.

At the last sitting, counsel representing the applicant and respondents had adopted their processes before the court.

Adopting his originating processes, counsel to the first and second respondents, Mr T.A Mofolu, had argued that the provisions of the Administration of Criminal Justice Act provides for speedy criminal trials.

According to him, the law provides that an accused has a right of appeal where he is not at satisfied with the decision of a court.

He said in this case the respondent was aware of an appeal filed by the applicant.

Mofolu had also objected to the attachment of a newspaper publication in the applicant’s further affidavit dated June 16, 2016, on the grounds that such piece of evidence was secondary and ought to be certified at the National Library.

He had therefore urged the court to dismiss the application for lack of merit.

Counsel to the EFCC, Mr Rotimi Oyedepo, had submitted that the applicant in question is a “fugitive” in law and should not be allowed to seek redress from the court until he submits himself for trial.

He argued that given the materials placed before the court, it was clear that the applicant was in clear contempt of the order of a brother judge, Justice Ibrahim Buba.

The counsel said that Buba had earlier compelled Tompolo’s attendance in court to answer charges preferred against him.

Oyedepo described the application as an abuse of court process, saying “it is trite that a party who is in contempt of court cannot seek redress” and urged the court to throw out the application for lack of merit.

He said that in his originating processes, the applicant had “ridiculously and in contradiction of his claims” annexed a copy of his notice of appeal signed personally by him.

“If the applicant feigns ignorance of the charge, how then was he able to brief his counsel on the charge for an appeal to be filed.

“The issue leading to the criminal charge against the applicant borders on fraud, in which billions of naira was lost by the Federal government.”

He had therefore urged the court to dismiss the application and award “heavy” costs against the applicant for abusing the court’s time.

In response to the arguments of the respondent’s counsel, Tompolo’s lawyer, Mr Ebun-Olu Adegboruwa, said the application was brought in pursuant to the provisions of the African Charter of Human rights, the 1999 Constitution, as well as the inherent jurisdiction of the court.

He had argued that in criminal law, service of a charge was personal and could not be presumed, adding that there was no evidence before the court showing that exhibit A (charge) was served on the applicant.

On the issue of contempt, Adegboruwa submitted that the applicant could not be cited for contempt, adding that since the beginning of the proceedings, the applicant had not breached any court order.

He insisted that it was the constitutional right of the applicant to apply to court for the enforcement of his rights and urged the court to uphold it.

After listening to the submissions of counsel, Justice Olatoregun had adjourned for judgment.

The EFCC had filed a 40-count charge against Tompolo and nine others before Justice Ibrahim Buba of the same court.

Following the absence of Tompolo in court since the arraignment of his fellow accused, Justice Buba had issued a bench warrant for his arrest and production in court.

The court had also on Feb. 19, 2014, ordered a forfeiture of property belonging to Tompolo after an application was moved to that effect by the EFCC.

Justice Buba had held that the Administration of Criminal Justice Act 2015 empowers the court to seize properties of an accused who refused to face trial.

The court recalled that though Tompolo refused to appear in court, he briefed his lawyers and through them sought to vacate the order for his arrest.

Consequently, he ordered forfeiture of properties belonging to Tompolo pending when he appears in court.

Properties affected by the forfeiture order included a River Crew Change Boat named MUHA – 15, the property known as “Tompolo Dockyard”, and the property known as “Tompolo Yard” in Warri.

Others are the Diving School at Kurutie at Escravos River, the property known as “Tompolo House” at Oporaza Town, and any other property discovered by the EFCC moveable and immovable.

Meanwhile, Tompolo is seeking an order restraining the respondents from further proceeding with the charges slammed on him.

Tompolo contends that Sections 221 and 306 of the Administration of Criminal Justice Act, 2015 which prohibit him from seeking a stay of proceedings in his trial infringed on his constitutional rights to fair hearing.

Tompolo also wants the court not to only nullify Sections 221 and 306 of the ACJA but to also restrain the respondents from invoking the sections of the law against him.

He insists that Sections 221 and 306 were in conflict with Section 36 of the Constitution which guarantees his right to fair hearing. (NAN)

Let me first say how honoured I am by the visit of all of your royal highnesses today for this Iftar. And just as you-(Sultan of Sokoto) said, it involved a bit of movement back and forth; the Sultan just arrived this morning from a trip abroad and he is still able to make it here.

So, I am really grateful for your consenting to come to join us at this Iftar but also to wait till tomorrow despite the plans that you may have made.

Our nation requires the kind of maturity, the kind of leadership that you have displayed and I want to thank you for that leadership and for that maturity.

It is heartwarming to know that we have leaders especially traditional leaders, who are prepared to make sacrifices, who are prepared to make concessions and compromises for the good of our nation and I want to thank you for that great leadership.

In particular, I want to thank the Sultan for always being there, for always being ready to offer advice and in many times to offer an alternative view to what might appear to be the popular view and I am extremely grateful to you for all of that support.

The Presidency has reacted to Arewa youths letter to Acting President Yemi Osinbajo, urging him to allow agitation for Biafra to succeed through peaceful means.

According to the Presidency, the ongoing consultations with leaders of thoughts and traditional rulers from the North and Southeastern regions of the country, following the escalation of ethnic tensions occasioned by the agitation for Biafra and the vacation order issued by Northern youths for Igbo to quit the North, was the best way to approach the issue.

A top presidential source who pleaded not to be named told Daily Sun that, “our response is the ongoing consultations, Mr. Acting President is engaged in with leaders of thoughts from both regions, it is the best way to get everyone to see reason. The Presidency doesn’t want to escalate the matter by responding to individual groups. The ongoing parley is the best approach.”

The coalition of northern youth groups that recently gave all Igbo persons resident in the north three months ultimatum to vacate region had in a letter on Monday urged Osinbajo to allow agitation for Biafra to succeed through peaceful means.

The group, in an open letter to the acting president urges him to take “steps to facilitate the actualization of the nation in line with the principle of self-determination as an integral part of contemporary customary international law”.

The coalition while commending Osinbajo for initiating series of discussions with leaders from the north and south east, however, said going by recent events, the talks would not yield any positive results.

The letter, which was signed by five leaders of the group insisted that the principle of self-determination has, since World War II become a part of the United Nations Charter which states in Article 1(2), that one of the purposes of the UN is “to develop friendly relations among nations based on respect for the principle of equal rights and self-determination of peoples”.

“We submit that this protocol envisages that people of any nation have the right to self-determination, and although the Charter did not categorically impose direct legal obligations on member States; it implies that member States allow agitating or minority groups to self-govern as much as possible,” they said.

[s]These are the reasons why I believe Biafra will not succeed and igbos have no way to succeed in creating their own country. In fact, if eventually igbos are given their own country, it will be so full of hunger, division, and conflict that they may eventually beg for the northerners to return and rule over them.

When you hear northerners begging the FG to let igbos go, consider the below reasons. Pay close attention at no. 4!

1.) if Biafra is to happen, it will be limited to five states. Nigeria will not hand over the Niger delta to the igbos even if the south south will eventually get its own independence on a different date and separately. What the north will not have, the igbos cannot get.

2.) Niger deltans either do not want to be part of Biafra or will eventually not want to remain in Biafra. That means conflict and even bloodshed. If the igbos think their Biafra will be a mini version of Nigeria where they will have hegemony over the Niger delta, and its oil, that is Satan dreaming of making it to heaven.

3.) the international community have nothing to gain from Biafra. And it will never want bloodshed and conflict that will send oil prices skyrocketing due to conflict between igbos and Niger deltans.

4.) if Nigeria is to allow the five Igbo states to conduct referendum today and give them independence, Biafra will literally be like Lesotho. A country within a country. (If you do not know how Lesotho looks like, please check you world map. It is a country inside South Africa; and Nigeria or neighbors won't be to Biafra what South Africa is to Lesotho). Nigeria can close its borders with a thick fence and close its airspace to Biafra of five Igbo states. Literally, your clamor for independence will end up being cries of siege. It will be hunger and poverty.

5.) igbos of five states clamoring for independence is not geographically feasible. It is like kanuris in parts of the north asking for independence. Your landmass is poorly situated. It's not even about the size. Your Biafra of five states is inside another country if your dream ever come to pass.

6.) the north can feed itself and Biafra cannot. Arable land is in abundance in the north and the north has been a bastion of agriculture.

7.) the north is a big market economically. It's landmass and population means big business. It is a big consumer market. That is money.

With your independence turning into a siege, you're literally finished. No agriculture of the north and no Niger delta oil for you and in an hostile environment, you are doomed. And this doom will also affect others. Therefore your Biafra project is aimed at destruction for everyone. To bring down the house on everyone's heads; and that is why many will stand against it to prevent such destruction from happening.

And far from being peaceful, no partition goes smoothly in places with ethnic and religious divisions and rivalry. Take example of India and Pakistan.

The best bet for igbos is to forge alliances across the nation and even go as far as mending fences with the north. People like okorocha and Amaechi have done well in that line of building bridges with the northerners.

You can clamor for restructuring or whatever it is called. Division of Nigeria will not end with a Biafra of anything more than five states. It will witness multiple divisions in both the south and the north. It could see continuos wars, famine and starvation which will be rampant in the north. Five states with 30 to 40 million igbos will be too populated with little sustenance or means for survival.

You will definitely not eat your cake and have it after asking for division. And that's where the north is hitting hard by asking igbos to leave. Such divisions means igbos starting from ZERO. You can't ask for your country and still try to live, and work elsewhere and want to control lands of other minorities.

As Nigeria is, it is not a land of a majority. It is a land of minorities. Add the biggest three ethnic groups, and the minorities will end up being more in terms of numbers.

And if the inevitable happens, igbos will be on their own. Both the middle belt and the south south or the Niger delta will not come to the help of igbos or want to die for igbos to have a country to dominate. Whether in Nigeria, in Biafra or in small independent countries, those ethnicities in the Middle East belt and in the Niger delta will remain minorities. Corruption cuts across ethnic groups. So what would they really stand to gain by dying for igbos? The igbos will end up besieged and beaten again if the inevitable (war) happens and may God forbid that.

Those few voices outside the five Igbo states cheering the igbos to secede will be no where to be found if the worst happens. The northerners will literally have a picnic in the south east, again! It will be really messy for igbos and they may never ever recover or survive as a group again. In fact, after such loss and dent to their image, anything Igbo may end up being treated like pariah. So those with much adrenaline flowing in their blood should think well before following the loud mouth of Kanu who may well end up proven to be an empty barrel.

Secession and partition are not child's play. I fully believe that self determination is human right. But in time of conflict, human right is abused. And how worse if the abuses and divisions are a never ending spiral? More or less a Pandora box! Half bread is better than none. Greed is a vice not a virtue.l[/s]

The Anambra State Government, on Monday, confirmed that a nursing student was killed by Lassa Fever, while 65 others were being monitored.

Director of Public Health, State Ministry of Health, Dr. Emmanuel Okafor, told newsmen in Awka that the deceased (name withheld) was a student in one private nursing school in Nkpor, Idemili North.

Okafor said that the lady was admitted at the Chukwuemeka Odumegwu Ojukwu University Teaching Hospital, Awka, on June 11.

According to him, she was immediately transferred to the General Hospital, Irua, in Edo for diagnosis where she died on June 17.

“She was initially admitted at Amaku in Awka before she was transferred to Irua and was placed on admission there.

“She was bleeding from the gums, nostril and vagina and was confirmed Lassa Fever victim in Irua.

“The moment it was confirmed that she had Lassa fever, we started contacts tracing.

“As of now, we have about 65 we are following up, two of them have developed fever and their samples have been taken to Irua.

“We are still tracking others and we have advised them on what to do to ensure they do not transfer it to their loved ones,” he said.

Okafor urged residents to keep their surroundings clean and keep their foods free from rats. (NAN)

ABUJA – Erstwhile National Publicity Secretary of the Peoples Democratic Party, PDP, Chief Olisa Metuh, who is facing trial over allegation that he received N400million prior to the 2015 general election, on Monday, insisted on calling the detained former National Security Adviser, NSA, Col. Sambo Dasuki, retd, to testify on his behalf.

Metuh, via a letter he wrote through his team of lawyers, asked the Department of State Service, DSS, to allow Dasuki who is currently in its custody, to appear before the Abuja Division of the Federal High Court on Tuesday as his witness.

The letter with Ref. No. EESE & C/01/19/06/17, dated June 19, 2017, followed refusal of trial Justice Okon Abang to stay further proceeding in the matter.

In two separate rulings, Justice Abang directed Metuh to continue his defence to the seven-count criminal charge the Economic and Financial Crimes Commission, EFCC, preferred against him and his firm, Destra Investment Limited.

The trial Judge who anchored his decision on a ruling the Supreme Court delivered on June 9, further rejected Metuh’s request for the court to release his international passport to enable him to travel to the United Kingdom for a medical surgery.

Justice Abang noted that the apex court had in the said ruling, validated the provision of section 306 of the Administration of Criminal Justice Act, 2015, which prohibits trial courts from staying proceeding in cases involving financial crimes.

Metuh’s trial was stalled since December 16, 2016, owing to his interlocutory application for Justice Abang to temporarily hands-off his case to await the apex court’s decision.

At the resumed sitting on Monday, Justice Abang stressed that the Supreme Court ruling had cleared the coast for Metuh’s trial to resume in earnest.

The defendant who has already called six witnesses that testified on his behalf before the high court, is seeking to call the former NSA, Dasuki, as his seventh witness.

EFCC had in the charge, alleged that the defendants received N400million from the Office of the National Security Adviser, ONSA, under Dasuki, without executing any contract.

It said the fund was electronically wired from an account ONSA operated with the Central Bank of Nigeria, CBN, to Metuh, via account no. 0040437573, which his firm operated with Diamond Bank Plc.

However, Metuh insisted that the money he got was on the order of ex-President Goodluck Jonathan.

The former PDP spokesman, through witnesses he produced before the court, admitted that fund was allocated to his office for media campaigns.

Justice Abang earlier rejected an application for a subpoena to be issued on Dasuki to appear before the court as a defence witness in the matter.

Metuh maintained that Dasuki was a key element in the charge against him, saying his appearance was critical for the case of the defendants.

Rather than grant the application, Justice Abang asked Metuh to forward his request to the DSS which has Dasuki in its custody.

Consequently, Metuh, in his letter to the DSS, a copy of which was sighted by Vanguard on Monday, sought appearance of Dasuki in court on Tuesday.

The letter entitled ‘Re: Further Notice to Produce Col. Mohammed Sambo Dasuki (Rtd) Before the Federal High Court Coram; Hon Justice Okon Abang on June 20, 2017’, was signed by Metuh’s lawyer, Mr. Emeka Etiaba, SAN, and forwarded to the Director General of the DSS, Mr. Lawal Daura.

It read: “May we by this letter inform you Sir, that the trial between the Federal Republic of Nigeria Vs Chief Olisa Metuh & Anor in Charge No. FHC/Abj/CR/2016, continues tomorrow 20/6/2017 at 9am prompt.

“Pursuant to the earlier letter written with respect to the production of the former NSA, Col. Mohammed Sambo Dasuki (Rtd) in court to testify on behalf of Chief Olisa Metuh, we inform you that his presence shall be needed tomorrow before the Federal High Court. We thank you for you for your cooperation.

Metuh equally copied the letter to the chief registrar of the Federal High court.
