You must have seen excision in process under the title of some land land fliers or advert. What does it really mean? You will find out shortly just keep reading. An excised land is a land that has been released by the government to the indigenes of the area who originally owned the land before the government acquired it. This means that the land is no longer under government acquisition and processing of C of O (Certificate of Occupancy) is possible. In simple terms, excision is process can be defined as a series of stages in which the owner of the land takes in order to get the land excised. There are about 14 stages involved which can take months to years to be finalised. Back to the question is excision in process a fraud? No, it's not. It shows that the owner of the land has begun the excision process which can take time as stated earlier. You can purchase a land with an excision in process title after you must have done your due diligence and made sure the land is free from acquisition. Yes, there are people out there to defraud you who use this title that is why it is always advisable you gather all necessary information before you make any commitment. Not everyone is out to defraud you so, don't be too quick to judge. Most real estate companies sell lands with deed of assignment, registered survey or excision in process title because there want such land to be available to the general public. You need to read this if you don't want to be a victim in future. Last week, we spoke about 2 titles/documents a land can have (deed of assignment & registered survey). Today, we will discuss the rest so just reflex and read on. The other documents/titles are: • Excision: land use decree on the 28th of march 1978 vested all land in every state of the federation under the control of the state governor. The land use act coupled with other laws made it possible for the Governor who was now the owner of all lands in the state to actually have the power to acquire more lands compulsorily for its own public purpose to provide amenities for the greater good of the citizens. Fortunately, the government recognises that indigenes of different sections of the country have a right to existence and a right to the land of their birth. Hence, it is customary for a state governor to cede a portion of land to the original owners(natives) of each area. An excision basically means taking a part from a whole and that part has been excised and will be recorded and documented in the official government gazette of the state. Gazette: a gazette is an official record book where all special government details are spelt out, detailed and recorded. A gazette will show the communities or villages that have been granted excision and the number of acres or hectares of land that the government has given to them. It is within those excised acres or hectares that the traditional family is entitled to sell its land, to public and not anything outside those hectares of land given or excised to them. A gazette is a very powerful instrument the community owns and can replace a certificate of occupancy to grant title to the villagers. A community owning a gazette can only sell lands to an individual within those lands that have been excised to them and the community or family head of that land has the right to sign your document for you if you purchase lands within those excised acres or hectares of land. Certificate of Occupancy: a C of O issued by the state government officially leases the state land to you the applicant for 99 years. As already indicated above, all lands belong to the government. A C of O however is the officially recognized document for demonstrating right of a land. What happens after 99 years? That question is still subject of debates among experts. Most have adopted a wait and see attitude, other postulate that as the new owner of the land, you the buyer can renew the C of O when it expires. We can only wait and see. There have been several stories of people who have lost their lands due to documentation issues. What I will be sharing with you today is really important especially if you are about to acquire a land. You can call me Chibuzor your real estate guy. Acquiring a land is serious business and shouldn't be taken likely, which means you need to invest your time to make sure you are given the best deal and also the right document. You need to make sure those documents were not fraudulently acquired and it can be used in a court. If you have difficulty verifying the document you can seek the assistance of a property lawyer to assist you, but the most important thing is do your due diligence before purchasing a land even if you trust the company you are purchasing from. It's better safe than sorry. There are about five documents/title that a land can have. Note: the land doesn't need to have all five of them. Below are the documents/title: Survey plan: this is a document that measures the boundary of a land to give an accurate measurement and description of that land. It is handled by surveyors who are regulated by the surveyor general of a state. A survey plan must contain the following: - the name of the owner of the land surveyed, - the address or description of the land surveyed, - the size of the land surveyed, - the drawn out portion of the land surveyed and mapped out on the survey plan document, - the beacon number, - the surveyor who drew up the survey plan and the date it was drawn up and - a stamp showing the land is either free from government acquisition or not. Deed of assignment: is an agreement between the seller of a land or property and a buyer of that land or property showing evidence that the seller has transferred all his rights, his title, his interest, and ownership of the land to the buyer. It has to be recorded in the land registry to show proof that the land has exchanged hands and the public should be aware of the transaction. I know of a man whose father bought a land back in the days in Lekki. His father laid a few blocks, but it wasn't up to a bungalow and left if for some years. He came back to his land to continue from where he stopped only to find out that he structure was taken down and another was erected. He made some enquiries and found out that the person who sold the land to him( an omonile) resold it to another person for a higher price. Today, he is still in court over the issue. The truth is an omonile doesn't care if he/she sold the land to you once he/she finds out that nothing is being done to the land it will be sold to another buyer. He/she doesn't mind as long as money comes into their pocket. You must have experienced such or know someone who has. This guys are ruthless that's why you need to flee from them. In recent years, estate developers and real estate companies have come up hence reducing the ability of omonile to take advantage of people. Acquiring a land from an estate company puts your mind at ease because you know nothing would happen to your land. Even if the company tries to play funny, once you are correct and have done all things necessary you can sue them. Trust me, no company wants to be sued. It costs them a lot of money and their reputation is on the line. I know I said it's advisable to buy a land from a real estate company but do your due diligence and make sure the company is a reputable one.
