BitMEX bitcoin Exchange confronted with $300m investor law suit

The world most famous bitcoin exchange, BitMEX, is currently being confronted with  a $300m lawsuit brought against it by the former JPMorgan dereivative trader.
In line with the filing with the Superior Court of the State of California located in San Francisco dated Dec. 4,2019, Frank Amato and RGB Coin are now pursuing legal action against BitMEX, its CEO Arthur Hayes and the owner of HDR Global Trading.

Amato alleges that he was among the first potential investors in BitMEX in 2015, contributing about $30,000 on the understanding and expectation that he would later receive equity in the company and that till now, he is yet to see that happen.

Sequel to Amato’s initial investment, the exchange purportedly received another $30,000 from startup accelerator SOSV, which ought to have triggered Amato’s contracted equity conversion. However, the filing avers that Hayes “sought to conceal information” from Amato specifically to “prevent recognition of his equity.”

According to unofficial estimates, Amato’s share of the company is now worth about $50 million. In total, the investor is seeking a giant $300 million settlement , that is, $50,000 000 equity settlement and a punitive damage of $250,000 000.

In a nutshell, the court pleadings provides as follows:
“Through this action, Plaintiffs seek damages representing the value of their equity interest in BitMEX, which is conservatively estimated to exceed $50,000,000, together with punitive damages of $250,000,000. Plaintiffs also seek injunctive relief and other remedies, together with their attorneys’ fees and costs.”

DISBARMENT: LAWYER ACCEPTS DISBARMENT FOR DROPPING CLIENT AND ACCEPTING OTHERS

A Tucson, Arizona, lawyer has agreed to disbarment for his conduct while working as an independent contractor for a law firm.

Zachary Schon was disbarred effective May 13, according to a press release by the State Bar of Arizona. He was admitted to law practice in 2007. The Arizona Daily Star and the Associated Press have stories.

Schon was handling criminal matters for the law firm when he stopped communicating with clients and missed court hearings, according to the press release. The missed court dates affected clients, who had warrants issued for their arrests and their driver’s licenses suspended. In some cases, trials were rescheduled without notice.

Schon also accepted clients without notifying or compensating the law firm.

The firm met with Schon and suggested he withdraw from the practice of law. Schon agreed to stop practicing and said he would reimburse the firm for $36,000 in financial losses, but he didn’t follow through with the promise to pay, according to the press release.

From the above, it is obvious that a lawyer who is an employee of a law firm accepting and dealing with a client without the knowledge of the law firm will amount to professional misconduct.

MEDICAL MALPRACTICE: DEFINITION AND LEGAL IMPLICATIONS OF MEDICAL MALPRACTICE
Medical malpractice simply means a misconduct, malpractice, or misbehavior in a medical field. Medical malpractice occurs when a health care professional or health care provider neglects to provide appropriate treatment, omits to take appropriate action as at when necessary, or gives substandard treatment that causes harm, injury or death to a patient.

Medical malpractice or negligence normally involves a medical error in diagnosis, prescription of medication and dosages, health management, treatment or aftercare.

Medical malpractice law serves as a tool for patients to recover compensations from any harm that results from substandard treatment.

It should be noted that a medical practitioner/professional is not liable for all harms a patient suffers. He is however liable only where the patient suffers or experiences such harm because the health provider deviated from the quality of care expected of a professional or the quality of care expected in a similar situation.

Medical malpractice comes in the following forms:

failure to provide proper and expected standard of care: It should be noted that the law requires every health professional or health care provider to adhere to certain standard, failure of which he will face an accusation of negligence.
An injury results from the negligence: Failure to provide a proper standard of care does not ipso fact  render a medical professional or health care provider liable to negligence.A medical practitioner is thus liable when such negligence results to injury to the patient. So for a plaintiff to be entitled to damages here, he must prove not only that there was a negligence but also that such negligence resulted to injury to him or her.
The said injury must have a damaging consequences . The said injury or harm must have resulted to a considerable damage.
INSTANCES OF MEDICAL MALPRACTICE:

Failure to diagnose or misdiagnosis
unnecessary or incorrect surgery
failure to order appropriate test or act on results
prescribing the wrong medication or dosage
forgetting things inside the patients body after surgery.
It is noteworthy that if the patient fails to give informed consent to a medical professional, the doctor or health professional may be liable if the procedure results in harm or injury, regardless of how perfect it was carried out.

ESSENTIAL ELEMENTS TO BE ESTABLISHED BY A PATIENT/PLAINTIFF IN A MEDICAL MALPRACTICE OR MEDICAL NEGLIGENCE CASE

The plaintiff is expected to prove the following:

that a duty was owed by the health care provider or the hospital. ( this is just like in other negligent cases)
breach of the said duty
the said duty resulted in an injury or the injury was a probable consequence of the failure.
considerable damage resulted for tye patient, physically, emotionally or financial

Two workers in the Federal ministry of Youth and Sports by name Salisu Sabiu and Ibrahim Yola have been nabbed by the operative of the National Agency for the Prohibition of Trafficking in person for allegedly raping a 13-year-old girl in Dutse Area of the federal Capital Territory, Abuja, Nigeria.

The culprits Salisu, a 55-year-old man and Yola, a 51-year-old man were said to be living in the same street with the victim in Dutse and they were arrested by the operatives of the anti-trafficking agency when an alarm was raised by a resident who learnt of the criminal and dastard act being committed against the innocent underage girl.

According to Naptip, the two two federal government workers have confessed to the crime and will consequently be prosecuted under the Violence Against Persons(prohibition)Act 2015.

It should be noted that the offence of rape is a serious one under the criminal code, not to talk of when it involves a minor as a victim.  Sections 357 and section 282 of the criminal code and penal code respectively provides for the offence  under the Nigerian Law.

Research suggests that children whose families follow a daily routine may be healthier, better behaved and could even perform better at school. Just having dinner together every night helps a family get to know each other, and a bedtime routine is essential for build a good sleep pattern in your child.

Whilst set times for waking, meals, shared chores, bath, TV time and bedtime might fill you with horror, with the right routine you could find you use your time more productively. Your child will find structured family life reassuring and, just as with House Rules, it’s easier to function as a whole when everyone knows what’s expected of them.

You don’t have to write it up and stick it on the fridge, but this will help if you are hoping to engage your children in the routine. Otherwise, take a quiet moment to write out the ideal routine for your family and commit it to memory.



How to set up a routine:

1. Start to build the routine around the times people wake, eat and sleep.

2. Be realistic and allow enough ‘dither time’ for your children to wash and dress, especially if this is new for them.
3. Add in extras to the routine which you know your family needs; chore time, one-to-one time if you have more than one child, homework time and any out of school clubs or classes for older children.
4. Pay close attention to night time: if bags are packed, sports stuff is ready, school clothes are laid out and water bottles filled there’ll be less to do in the morning. School age children can help with all of these things. You could even set up a specific Bedtime Routine.
5. If you can, remember to rotate duties with your partner, especially the bedtime routine as this will increase your child’s trust in both parents.
6. Get as much input as you can from your family and talk it through with other carers. A routine which works for everyone will be much easier to stick to.

7. If there's one activity, like toothbrushing, which is a nightly sticking point, set up a Reward Chart to deal with it, or add this chore to your child's existing chart.
8. When you first start the routine, talk your family through every step (even if you’re tired of the sound of your own voice). Within a few weeks, your child could be reminding you ‘Seven o’clock, Mum, you should be reading me a story!’
