Properties / Handwritten Wills And Legal Challenges: Lessons From Aretha Franklin’s Estate by ChukwuedOkwuobi(m): 12:08pm On Jul 13, 2023
When Aretha Franklin, renowned as the Queen of Soul, passed away in 2018, it was widely reported that she had not left behind a will, despite her estimated $80 million wealth. However, it was later discovered that she had indeed made estate plans. In May 2019, two handwritten wills were found in her home—one from 2010, located in a locked cabinet, and another from 2014, discovered in a notebook amidst her couch cushions.

These wills became the subject of a legal dispute involving Franklin's children. Edward and Kecalf, her sons, argued that the 2014 will should prevail, while another son, White, claimed that the 2010 document was intended to be Franklin's true will. Clarence, another son with special needs represented by a legal guardian, did not participate in the lawsuit. The 2010 will distributed the estate more or less equally among Franklin's sons. However, the 2014 will outlined that three of her sons (excluding Clarence) would benefit from the estate, including sharing income generated from her music. Additionally, Kecalf would inherit his mother's Michigan home valued at over $1.1 million, as well as her cars.

The legal proceedings surrounding the wills took several years before finally being heard in a Michigan courtroom. The trial itself lasted only two days, culminating in a jury ruling that the 2014 document should be recognized as Franklin's will.

The wills in question were handwritten, also known as holographic wills. The authenticity of Franklin's writing was not disputed by any party. Instead, the disagreement centered on whether the 2014 will met the requirements to be considered a valid will under Michigan law. It's important to note that not all states recognize handwritten wills, and even in states that do, there may be certain limitations on their validity.

The discovery of this handwritten will years after the death of the superstar and the ensuing legal battles, highlights several important legal lessons:

Formality of Wills: The incident underscores the importance of following proper legal procedures when creating a will. Many jurisdictions have specific requirements, such as witnesses or notarization, to ensure the validity of a will. Failing to meet these formalities can lead to challenges and disputes.
Execution and Storage: Proper execution and safe storage of a will are crucial to its enforceability. It is recommended to have an attorney assist in the drafting and execution of the will to ensure compliance with legal requirements. Additionally, keeping the will in a secure and accessible location can prevent issues arising from its discovery or loss.
Evidence and Burden of Proof: In cases where a handwritten will is discovered long after the person's death, the burden of proof often falls on those seeking to establish the validity of the document. They must provide sufficient evidence to demonstrate that the will is genuine and meets the legal requirements.
Presumption of Revocation: Depending on the jurisdiction, the law may presume that a will has been revoked if a subsequent will is found. The burden of proof may then shift to those asserting the validity of the earlier will. This emphasizes the need to regularly review and update one's estate planning documents.
Estate Planning with Professionals: Engaging an attorney experienced in estate planning can help avoid potential pitfalls. Legal professionals can assist in drafting a clear and comprehensive will that meets all legal requirements, reducing the likelihood of disputes and legal battles.
Regular Updates: It is essential to review and update a will periodically, especially in the case of significant life events such as marriage, divorce, births, or deaths within the family. Regular updates can help ensure that the will reflects the testator's current wishes and reduces the chances of a later challenge based on outdated provisions.
Remember, the specific legal lessons drawn from this situation may vary depending on the jurisdiction and the unique circumstances of each case. It is always advisable to consult with a qualified attorney to understand the legal implications in your specific jurisdiction.

Phones / HOW REGISTERING A BUSINESS WITH THE CAC CAN MAKE YOU RICH. by ChukwuedOkwuobi(m): 5:09pm On Aug 29, 2022
Registering a business can potentially make you rich in several ways:

1). Limited Liability: When you register a business, you create a separate legal entity that is responsible for its own debts and liabilities. This means that your personal assets are protected from business losses and lawsuits, which can help you preserve your wealth.

2). Tax Benefits: Registering a business can provide significant tax benefits, such as lower tax rates, deductible business expenses, and the ability to carry over losses to future years. By minimizing your tax burden, you can keep more of your profits and reinvest them in your business or personal investments.

3). Increased Access to Capital: Registering a business can make it easier to raise capital, as investors may be more willing to invest in a separate legal entity with limited liability. This can help you grow your business and increase your wealth over time.

4). Branding and Credibility: Registering a business can also help you build your brand and establish credibility with customers, suppliers, and other stakeholders. This can lead to increased sales and profits, which can help you become rich over time.
Jobs/Vacancies / On Attracting Success by ChukwuedOkwuobi(m): 8:50am On Jul 19, 2022
I've done my own share of studying and deep searching and what I've found so far is that you must sacrifice some part of your life if you really desire to be relevant and successful.

Until you're ready to let go of that image you so long cling to, success will keep hiding from you.

Some gave up mothers, some spouses, some pleasure, while others gave up schooling.

What are you willing to give up for success today?

Business / How To Setup A Pos Business In Nigeria by ChukwuedOkwuobi(m): 12:18pm On Jan 10, 2022
The POS business began in 2013 after the Central Bank of Nigeria released its guideline on the operations and management of the business. Since then, it has remained one of the retail channels of several commercial banks to make their banking services reach a large number of people.

POS business is a legitimate way to make money in Nigeria. However, it’s more profitable in communities with no banks and places where ATMs are not enough to serve the community’s financial needs.

POS (Point of Sale) business offers services like funds transfer and withdrawal, airtime sales, bill payments like GOTV, DSTV, Startimes, PHCN, and other utility bills. It is used in several places where goods and services are sold/rendered; places like retail shops, offices, supermarkets, fuel/gas stations, pharmacies, eateries, etc.

It is also called agent banking business, and it’s an extension of the services offered by financial institutions to enable easy service offering to a wide range of customers.

By creating easy access for financial transactions in different localities, the POS business has given individuals and business owners additional income.

How POS Agents Make Money
1. Commission; Banks pay agents commission based on the volume of transactions carried out on their behalf.
2. Service Charges; By rendering service to customers, you can also charge them a particular amount especially on bills payments, taxes, and subscriptions.
3. Float; Depending on your cash management policy, you can also make use of cash deposits, net of withdrawal for your primary business.

How To Start POS Business In Nigeria
Step 1: Register a Business with the CAC
Financial services are a sensitive area of life to deal with and this is why the Central Bank of Nigeria has taken several precautions to ensure the integrity of those who will qualify to be agents. One of such requirements is that you must have a registered existing business of any type with the Corporate Affairs Commission and have a shop or office from which you operate.
Registering your business with the Corporate Affairs Commission is quick and affordable and the lawyers at www.paulokwuobilegalpractice.business.site can get the process completed for you within 2-3days regardless of your location.

Step 2: Approach A Bank
Virtually all Nigerian banks allow agent banking services. As soon as you decide on the bank of your choice, the next thing is to approach the bank and get details of their requirement. The CBN guide allows being an agent for as many banks as you can serve.
You will need to fill some documents/agreement forms on the transaction conditions. Then, the bank reviews the application in line with CBN, internal criteria and agrees with you if you meet all requirements.

Some of the required documents include;
Valid means of identification e.g Driver’s license, National ID card, International passport or voter’s card.
BVN
2 passport photographs
2 current account references
Evidence of business registration (CAC Certificate)
Tax Identification Number (TIN)
Memorandum and Article of Association.
Credit Bureau Report
A minimum working capital of N50,000

Step 3: Get The Equipment
Once your application is considered, the bank then supplies the needed tools and equipment for the business. The following materials are usually provided by the bank:
Point of Sale Terminal; a portable device that facilitates payments of goods and services at bank agent locations using payment cards.
Card reader
Barcode scanner to scan bills for bill payment transactions
Personal identification number (PIN) etc.

Step 4: Location
To thrive in the business, it’s advisable to choose a location with limited banks or places with few ATMs. Also, choose strategic locations such as bus stops, public markets, event centers, etc. All of these factors will affect your daily profit.
Once you have a good location with enough spaces for swift movement for you and the customers, have a banner displayed at the entrance to show the retail banking services you offer.
As soon as you have these, the next step is to start providing the following services;
• Cash deposit and withdrawal
• Balance inquiry
• Funds transfer services (local money value transfer)
• Bill payment (taxes, utilities, tenement rates, subscriptions, e.t.c)
• Generation and issuance of mini statement
• Cash disbursement and cash repayment of loans
• Agent mobile payments/banking services.

By operating this business, you are not only increasing your stream of income, but you are also serving the needs of the people in your community.

Investment / What You Must Know Before Investing In Cryptocurrency by ChukwuedOkwuobi(m): 1:56pm On Nov 24, 2021
When it comes to cryptocurrencies, one of the biggest challenges for investors is not getting caught up in the hype. Digital currencies have quickly risen to a place of prominence in the portfolios of many retail and institutional investors. At the same time, analysts have continued to caution investors about their volatile nature and unpredictability.

If you've decided to invest in the cryptocurrency market, as with any other investment, it's important to do your research before you hand over any money. Below, we'll explore the things you should know before you invest.

1. Consider Why You Are Investing in Cryptocurrency.
Are you interested simply because of the trendiness of the cryptocurrency craze? Or is there a more compelling reason for an investment in one or more specific digital tokens? Of course, different investors have various personal investment goals, and exploring the cryptocurrency space may make more sense for some individuals than for others.

2. Get a Feel for the Industry
it's essential that they develop a sense of how the digital currency world works before investing. Take time to learn about the different currencies on offer. With hundreds of different coins and tokens available, it's crucial to look beyond the biggest names, like Bitcoin, Ether, and Ripple.

3. Join an Online Community of Cryptocurrency Enthusiasts
Because the digital currency space is such a trendy area, things tend to develop very quickly. Part of the reason for this is that there is a robust and very active community of digital currency investors and enthusiasts in communication with one another around the clock.

4. Read Cryptocurrency White Papers
More important than word of mouth, though, is the specifics of a digital currency itself. When you're considering an investment, take the time to find the project's white paper. Every cryptocurrency project should have one, and it should be easily accessible (if it's not, consider that a red flag).

5. Timing Is Key
After diligent research, you've likely developed a feel for the cryptocurrency industry and you may have determined one or more projects in which to invest. The next step is to time your investment. The digital currency world moves quickly and is known for being highly volatile.
Finally, remember that digital currencies are a highly speculative area. For every overnight bitcoin millionaire, there are many other investors who have poured money into the virtual token realm only to see that money disappear. Investing in this space means taking a risk. By doing your homework before making an investment, you help to give yourself the best chances of success.
