Leaders of All Progressives Congress (APC), in Kogi East Senatorial District has nominated Mr Mohammed, 43, first son of Late Prince Abubakar Audu, to replace him as the party’ s governorship candidate.

The leaders, stakeholders and delegates who made this known in Lokoja on Thursday after a marathon meeting, said they arrived at the decision after due consultations.

Their spokesman, Mr Daniel Isah, the Vice Chairman of APC in Kogi East, said they have resolved and are determined to back Mohammed to replace his father if the National Working Committee orders fresh primaries.

Isah thanked the Independent National Electoral Commission and the national leadership of the party for the opportunity given to them to find a replacement for Audu who died on Nov. 23 at Ogbonicha, Ofu Local Government.

He appealed to the national leadership of the party to give their decision utmost consideration and approval in the overall interest of the party and the state.

Present at the meeting were Alhaji Lincho Ocheje, Hon. Hassan Omale, Hon. Benjamin Ikhani, and Sen. Emmanuel Dangana, among others.

Inec shouldn't make the mistake of taking audu off the supplementary elections...even if they are notified of the death, it should have been before the elections started.

The electoral act says that can only happen if the elections has not been started. He was alive when it started.

Even if it takes 1-month to complete the election, so far as he was alive when it started, he can't be taken off as a contestant.


If they call for another election, which law will they base their decision on?

I am not a lawyer, but I think the best decision here is to go into the supplementary election with audu as the candidate, since there was is no basis to take him off...if he wins, the section that takes care of death of an elected official without certificate if return be invoked.

The Independent National Electoral Commission says the All Progressives Congress has yet to inform it about the death of its Kogi State governorship candidate, Prince Abubakar Audu.

It however promised to apply available legal provisions to the last Saturday’s governorship election in Kogi State.

Deputy Director of Publicity and Voters Education of the commission, Mr. Nick Dazang, stated this in an interview with journalists in Abuja on Monday.

He said in informing the commission of the death, the party must present a copy of the certificate of death of the deceased.

Dazang said, “The APC has to do proper notification and accompany it with the certificate of death issued by a medical doctor.”

Audu, who had polled a higher number of votes than the Peoples Democratic Party’s candidate and the incumbent governor of the state, Capt Idris Wada, in the election, which was declared inconclusive by INEC, died suddenly on Sunday in his home at Ogbonicha.

He was buried on Monday according to Islamic rites.

Dazang said INEC would apply the relevant laws and make a pronouncement on its position on the election immediately it received official notification of Audu’s death from the APC.

He explained that there were legal provisions to address such incident in the country’s electoral process.

The INEC director added, “When something like this happens, the party on which platform the candidate contested will need to notify the commission; of course, we have heard and read like everyone else but we need to be notified.

“Once the commission is notified, it will look at relevant clauses of the 1999 Constitution as amended, the Electoral Act 2010 as amended and also the Constitution of the APC itself.

“All these relevant laws will be looked at with a view to determining what to be done to ensure that whatever is done subsequently is done within the ambit of the law.

“INEC as a law-abiding body will do everything prescribed by the law.

“Thankfully, we have a consortium of Senior Advocates of Nigeria that provide counsel to the commission. We also have a very vibrant legal service department, headed by a SAN.”

Dazang stated that before the report of the death of Audu, INEC, on the directive of its chairman, had started making plans for a supplementary election in Kogi State.

He added that the commission would follow the constitution and not the opinion of people on the election, saying there were legal provisions for such incident.

He said because of the urgency of the issues involved in the supplementary election, INEC would prepare itself to commence consultation.

Dazang expressed the hope that the commission would come out with its position about the election before the end of the week, adding that the Electoral Act prescribed 14 days for the conduct of a supplementary poll.

He, however, said whatever the situation would be, Kogi election would not affect the Bayelsa State governorship poll as the commission had the capacity to handle the two elections.

“Assuming the two states’ elections coincide, the commission has the resources to conduct them. Don’t forget we have conducted national elections before and we are just talking about election in two states,” he stated.

On the efficiency of the card reader for the Kogi election, he said available statistics showed that less than one per cent of the deployed card readers failed.

According to Dazang, about 53, out of the 6,066 card readers deployed in the state, malfunctioned during the exercise.

APC leaders meet in Abuja, consult legal experts

Leaders of the APC will converge on Abuja on Tuesday (today) to deliberate on the way out of a likely constitutional crisis created by the death of Audu.

The PUNCH reliably gathered on Monday that the meeting, which will be attended by members of the party’s National Working Committee, may direct the APC National Secretary,Mai Buni, to formally write INEC on Tuesday (today), informing the commission about the death of the Kogi governorship candidate.

Other national leaders of the party may attend the meeting, which will explore legal options to the crisis.

A leader of the APC, who confided in The PUNCH, explained that the APC would seek legal advice on the next line of action following Audu’s death on Sunday, shortly after INEC declared the governorship election held on Saturday inconclusive.

According to him, legal officer of the APC and other senior lawyers will advise the APC on the alternative to the deceased candidate and the decision of INEC to declare the poll inconclusive.

The commission had said there would be rerun in 91 polling units in the state.

The APC leader stated, “What I can tell you is that we are meeting tomorrow (Tuesday) and the secretary may be directed to write INEC informing it about the death of Audu.

“We will be waiting for the commission’s response, but on our own, we will invite some senior lawyers for advice on the issue.”

Audu’s death has led to a constitutional crisis as neither the electoral act nor the constitution specifies what should be done if a candidate dies before the result of an election is declared.

Section 37 of the Electoral Act, which deals with the withdrawal of candidates, merely explains how a candidate can be replaced if such a candidate dies after nomination.

The section states, “If after the time of the delivery of nomination paper and before the commencement of the poll, a nominated candidate dies, the Chief National Electoral Commissioner or the Resident Electoral Commissioner shall, being satisfied about the fact of death, countermand the poll in which the deceased candidate was to participate and the commission shall appoint some other convenient date for the election.”

Also, Section 181 (sub-sections 1 and 2) explains what should be done if a candidate dies after he has been elected.

It states, “If a person duly elected as Governor dies before taking and subscribing the Oath of Allegiance and Oath of Office, or is unable for any reason whatsoever to be sworn in, the person elected with him as Deputy governor shall be sworn in as Governor and he shall nominate a new Deputy Governor who shall be appointed by the Governor with the approval of a simple majority of the House of Assembly of the State.

“Where the persons duly elected as Governor and Deputy Governor of a State die or are for any reason unable to assume office before the inauguration of the House of Assembly, the Independent National Electoral Commission shall immediately conduct an election for a Governor and Deputy Governor of the State.”

The Deputy National Publicity Secretary of the APC, Timi Frank, confirmed that leaders of the party would meet in Abuja on Tuesday.

He said, “Yes, we will be meeting tomorrow (Tuesday). The party will take a decision at the end (of the meeting).”

APC is studying INEC’s guidelines

The APC national secretary, Buni, in a statement on Monday, said the party was studying INEC’s regulations, adding that it would come up with a position on the commission’s declaration of the election as inconclusive.

The party described the situation in Kogi State as a test case for the rule of law, pledging that it was committed to its promise to a sustainable democracy in the country.

It stated, “On INEC’s position that the November 21, 2015 governorship poll in Kogi State was inconclusive, APC is studying the declaration of the Returning Officer, Prof. Emmanuel Kucha, who is the Vice-Chancellor of the Federal University of Agriculture, Makurdi, based on Section M, Paragraph 4(Page 22) of INEC Approved Guidelines and Regulations for the Conduct of the 2015 General Elections.

“APC believes in the rule of law, strict adherence to the 1999 Constitution and Electoral Act 2010(as Amended). Our government is a product of the rule of law, we have absolute faith in the nation’s law and we will not in any manner undermine the law. Our observations and position will be within the laws of the land.”

Meanwhile, the APC in the statement mourned the death of Audu, describing him as one of its stars and, a democrat par excellence.

It said the governorship candidate was a development-oriented leader and a beacon for the liberation of Kogi State from its apparent decay.

According to the APC, Audu was a prince of hope, a symbol of peace and an apostle of unity and reintegration of Kogi State.

It added, “We commiserate with his family and the great people of Kogi State for having a strong belief in Abubakar Audu’s capacity to redeem the state.

“The demise of Prince Abubakar Audu has no doubt created a big vacuum in Kogi State and the APC but we take solace in the fact that God gives, God takes. He might have physically transited but he will forever be spiritually and politically relevant not only in Kogi State but in Nigeria.”

The APC appealed to the people of the state to see Audu’s death as an act of God, adding that there should be no recourse to lawlessness or vindictiveness in whatever form.

It said, “The only honour will can do Prince Abubakar Audu is to remain peaceful and resolve to be undaunted in preserving the adorable ideals he lived for. It was evident to all that he ran a good race, he played his part well and he earned a rare rating as an exemplary leader.

“We will not abandon Prince Abubakar Audu even in death because his legacies are timeless, his virtues can withstand all seasons and his vision remains immortal.

“APC urges its members and supporters in Kogi State and nationwide not to allow their spirit to be dampened by the sudden passage of the great Prince Abubakar Audu. Rather, the party should be united in mourning and be encouraged to effect the desired change in Kogi State through the ballot anytime, any day.”

No hope of getting married someday. Afraid and depressed.

I have a very pretty young lady that goes into seizure monthly, sometimes weekly. I've watched her in seizures many times in public; inside danfo bus, on pedestrian bridge, in church, at the beach, etc.

I had to restrain her from the kitchen as she has had many bruises from broken dishes, hot oil, etc during seizure.

The best way to take care of people like that is to show them love, care and understanding. When they are in seizure, just let that moment pass and protect them from injury.

Then after, let then rest well. Pray for them and hug them often. Many of them suffer in silence. Never run away from them!

Edo State Governor, Adams Oshiomhole, on Monday said he is not afraid of telling the truth about Chief Gabriel Igbinedion, the father of a former governor of the state, Lucky.

Oshiomhole vowed to publish activities of the former governor in office.

Lucky Igbinedion ruled Edo State from 1999 to 2007.

Oshiomhole spoke when thousands of women dressed in white attire marched through the streets of Benin City, demanding an apology from Chief Igbinedion to the people of the state.

The women carried placards with inscriptions such as – “Esama leave Oshiomhole alone.” “Chief Igbinedion stop using youths and women to cause trouble,” “Edo people must move forward,” “Oshiomhole, Edo people are proud of you” and “Igbinedion, go and pay Land Use charge.”

Some women who dressed in red attire known as “Ododo” last week protested to the Emotan shrine about Oshiomhole’s invectives on the Esama and his policies.

Monday’s protesters were drawn from the three senatorial districts in the state.

Those who spoke to journalists said Oshiomhole has brought infrastructural development to the riverine areas.

“We have seen your good work. We came to tell you not to be afraid. We heard what people are saying but we are behind you. Nothing will happen to you,” they stated.

Oshiomhole on his part said he would be ashamed to talk in public if two of his children were convicted for corruption and money laundering.

Ahead of the December presidential deadline for the nation’s armed forces to end the activities of the Boko Haram sect, the Presidency has said Nigeria will not seek the help of foreign mercenaries.

The Special Adviser to the President on Media and Publicity, Mr. Femi Adesina, disclosed this in an interview with our correspondent on Saturday.

He was responding to a question from our correspondent on whether or not President Muhammadu Buhari would ask the military to seek external help in view of recent attacks by the sect.

Adesina, said it was uncharacteristic of the President to direct the military to seek external help in form of mercenaries.

He said Buhari’s position had always been that the nation’s military has the capacity to end insurgency in the country, having performed creditably well in peace-keeping missions in many countries.

Adesina insisted that while the President would appreciate foreign support in terms of equipment, trainings and intelligence, he would not be favourably disposed to mercenaries.

The presidential spokesman said, “The position of the President has always been that he believes the military has the capacity to fight terrorism.

“President Buhari has always made it clear that Nigeria will appreciate support in terms of equipment, training and intelligence. The support the President is seeking is definitely not in terms of manpower or what you will call mercenaries.”

Meanwhile, the United States’ government has described the President’s goals towards countering terrorism and ending Boko Haram insurgency in the North-East as ambitious.

This was stated during a recent briefing at the Washington Foreign Press Centre in the US.

According to the US Acting Assistant Secretary, Bureau of Political-Military Affairs, Todd Chapman, America will continue to support Nigeria to counter Boko Haram.

Chapman said, “We have had some security assistance programmes that have been very active. We just completed some training through our Global Security Contingency Fund, which is a $40m effort to help counter Boko Haram. The Obama administration authorised the use of presidential drawdown authority to provide another $45m in support to the countries fighting Boko Haram. And this is all on top of an additional $50m that we had already provided to the region to help with equipment training and logistics systems.”

He added, “President Buhari has set ambitious goals for himself. I’ll leave it up to others to determine whether or not those goals can be met. But we are committed to supporting them as they counter the threat. We heard many stories while we were there (in Nigeria) of some of the horrors that are being perpetrated in the North-East and elsewhere in Nigeria. And clearly, this government, the Buhari administration is committed very strongly to doing all that they can to defeat Boko Haram.”

Speaking at the briefing, another US official, Deputy Assistant Secretary, Bureau of Democracy, Human Rights, and Labour, Steven Feldstein, noted that there was more to be done than defeating the insurgents on the battlefield.

Chapman and Feldstein who visited the country recently pointed out that the issue of human rights protection remained critical in addressing the current crisis in the North-East.

“A lot of the rhetoric of what the regime and what the president has said when it comes about the importance of linking human rights protection, civilian protection, with the fight against Boko Haram and other elements is something that we view as essential pillars and cornerstones. And so for us to be able to have these important conversations with our military counterparts but also with civil society groups, with human rights activists, other government counterparts,’’ Feldstein said.

Operatives of the In­spector General Of Police, Special In­telligence Response Team (SIRT) has arrested the leader of the gang behind the recent bank robbery in Agbara In­dustrial Estate, Ogun State, which led to the death of a nursing mother and a mobile police officer.

Suspected militants num­bering about 20 and dressed in military camouflage last Thurs­day held the town under seige as they raided about three banks before escaping through the waterways to the creeks.

The suspect simply identi­fied as Kelly Rotor was tracked down yesterday and arrested amid heavy shootout between detectives and three members of his gang at Sapale, Delta State. The shootout also led to the death of a police officer.

Kelly and others were said to have also participated in the Festac, Ikorodu and Lekki bank robberies in the past.

On their arrest, Sunday Sun learnt that IGP Solomon Arase in attempt to bring their reign of terror to an end drafted the special elite squad to track and arrest the suspects who have held Lagos under siege in re­cent times.

According to sources from the police, Kelly, after getting his own share of the loot trav­elled down to Sapale to attend a wedding where detectives who had been on his trail incident ar­rested him.

On realizing that the game was up, Kelly and some of his members, who were with him at the scene started shooting at the police. He was later arrested with gun injuries.

Efforts are still on to arrest the rest of the gang who are now on the run.

Malian Internal Security Minister, Salif Traore said on Friday, all the hostages held by Islamists at a Malian hotel have been released.

At least three people had been killed in the initial attack, some hostages escaped under their own steam while others were freed after showing they could recite verses from the Koran, Traore said.

The raid on the hotel, which lies just west of the city centre near government ministries and diplomatic offices, came a week after Islamic State militants killed 129 people in Paris.

This has raised fears that French nationals were being specifically targeted.

Twelve members of Air France flight crew were in the building but all were extracted safely, the French national carrier said.

German Foreign Minister, Frank Steinmeier, said on Friday that two Germans had been released after suspected Islamists attacked Radisson Blu hotel in Mali and took 170 people hostage.

It is not immediately known if there were other Germans in the hotel, Steinmeier added.

The attackers, a group of men, had driven to the hotel in a car with diplomatic plates and took 170 people hostage.

So far, more than 80 of the 170 hostages have been freed in an attack that involved different nationalities.

Islamist violence usually affects Mali’s north, which has been volatile since separatist rebels and later, al-Qaeda-affiliated militants took control of the region after a 2012 military coup.

French and African military operations dispersed the militants and restored government control over the area.

Clashes between rebels and the army have persisted in some places.

Our tough-talking President Muhammadu Buhari is apparently feeling helpless about Nigeria’s worsening economy. He is telling anyone who would listen that Nigeria is broke. In other words, we should not expect much from his government.

Meanwhile, Nigerians are still hopeful— even expectant —of the Buhari dividend. And critics are already flailing away about his non-performance.

The Peoples Democratic Party chieftains and other party faithful are virtually taunting the retired general to deliver on his promises. They have charged that he is talking down the economy with his apocalyptic statements about the economy, which scare away prospective foreign investors.



Even non-partisan critics are coming down hard. A headline in the Washington Times last Monday read, “Nigerians disenchanted as new president ‘too slow’ to deliver on lofty campaign promises.” And a headline in The Punch declared that body language is no longer enough. It was an allusion to the fleeting improvements in electricity supplies and some other services that were attributed to the Buhari aura.

But let’s face it, it is Buhari’s bad luck to assume office at this time. It would take a miracle to reverse Nigerians’ plight any time soon. Sure Buhari didn’t do Nigeria any favours by lingering over the formation of a government even as the economy worsened.

Still, if he seems helpless, it is because the forces dragging down the economy are beyond him.

So, should Nigerians just sit back and expect nothing from a president they elected with much fanfare and hopefulness. Definitely not. It is still necessary to put the fire on the administration’s feet. After all, Buhari was aware of the worsening economy when he was making lofty campaign promises.

However, more than ever before, Nigerians will find relevance in these words of American moral philosopher Reinhold Niebuhr: “God grant me the serenity to accept the things I cannot change, the courage to change the things I can, and the wisdom to know the difference.” Sure, a philosophical view is not a substitute for food on the table, nor does it ease hunger pangs. But it should put things in perspective and allay misguided expectations.

Here’s the reality. Last year June, Nigeria’s economic mainstay, crude oil, was selling at about $105 per barrel. Today, it is selling at about $48. This is a reduction of more than 50 per cent. To put this in perspective, imagine that your income is cut in half. It means suddenly having to afford less than half of your routine expenses: food, supplies, rent, mortgage, etc. That’s essentially Nigeria’s situation.

And though no one has a grasp on when the prices will stabilise and begin to rebound, the most optimistic projection is the ending of 2016. The only thing that may bring about a quick boost in oil prices would be a decision by the Organisation of Oil Exporting Countries to sharply reduce production. And even that would require compliance by OPEC members and the solidarity of non-OPEC members. From all indications, none of this is likely.

Hopeful Future

Still, there is long-term hope for countries such as Nigeria and Venezuela which are experiencing severe financial crunch because of the fallen oil prices. For one thing, the current glut may result in skyrocketing prices down the road. The Saudi vice minister of oil, Prince Abdulaziz bin Salman, told a meeting of Asian energy ministers recently that up to $200 billion of investment in the oil exploration was cancelled this year and as much as five more per cent more will be cancelled next year.

“The potential impact of current cuts in expenditure on future oil supplies is both substantial and long-lasting,” the French News Agency quotes Abdulaziz, as saying. “A prolonged period of low oil prices is unsustainable as it will induce large investment cuts and reduce the resilience of the oil industry, undermining the future security of supply and setting the scene for another sharp price rise.”

Another hopeful sign for the industry is the prospect that several non-OPEC members will decide to join OPEC, boosting the cartel’s leverage on oil prices. If nothing else, the price crisis is bringing OPEC and non-OPEC countries into greater dialogue. But cooperation on oil will be checkmated by political tensions among some major oil-producing countries, especially Saudi Arabia on one hand and Russia and Iran on the other.

Given this prospect, the best that Buhari can do is to try to ease Nigerians’ distress. And even in this regard, his options are limited.

When confronted with a similar situation of a rapidly deteriorating US economy in 2008, newly elected President Barack Obama adopted the strategy of infusing the economy with much capital. His administration bailed out financial institutions and auto companies that were teetering on bankruptcy. It invested in infrastructural improvements to provide job opportunities.

It boosted auto purchases through a “cash-for-clunkers” programme that offered owners of old cars cash-incentives to purchase new ones with the dual goal of stimulating auto sales while also reducing pollution. And it pursued a similar programme to forestall foreclosures on people’s homes and simultaneously rescue the mortgage industry.

Obama’s capital-infusing strategy was easy for him to do, relatively speaking, anyway. With the world’s most robust economy even at the worst of times and a currency that is universally attractive, the United States can borrow virtually infinitely. Nigeria can’t.

The closest thing to the Obama strategy so far in Buhari’s approach is the proposed programme that would pay the unemployed and the very poor N5,000 monthly. That is, of course, a tall order in a country where governments and businesses don’t regularly pay their employees.

In fact, with an already bloated bureaucracy, Buhari is necessarily adding to the unemployment problem by shrinking the federal workforce. The cut in the number of ministries, for example, will add to unemployment, though it didn’t go far enough to accomplish the goal of shrinking the bureaucracy.

Despite the downside, however, more of such shrinkage is necessary. The savings can go into productive expenditures and ensure that the existing workforce is properly remunerated and motivated to provide competent service.

These can contribute to making Nigeria more attractive to foreign capital, which should spur further industrialisation, which will reduce the dangerous dependence on one product.

With prudent policies by the government and forbearance and resourcefulness by the people, the Nigerian economy should emerge from this crisis much more robust and resilient than ever.
