HOUSE OF REPS AND DINO MELAYE {MATTERS ARISING}


It would be recalled that on tuesday the 7th of december, dino melaye and his group of progressives, a pressure group
in the house of representative, in company of a court bailiff had attempted to gain entrance to the National Assembly
Complex, but were prevented by group of armed police men who security sources say were sent by the house leadership
to prevent dino melaye and his group from gaining access to the complex.

The crux of this piece is to look at the jurisprudence of law in this whole issues arising, the issues that have
arisen are; whether the filing of a stay of execution by a defendant constitute a stay in itself when it has not been
heard by the court.
on this issue, the house of representatives, through its spokesman, Hon Eseme Eyibo has said;relying on the vatswani
brothers case, that the stay of execution which has been filed alongside a notice of appeal constitutes a stay.i beg
to disagree with the Honourable that in the case of Okafor v Nnaife, the court held that "a winning plaintiff or party
has a right to the fruits of his judgment and the courts will not make a practice at the instance of an unsuccessfull
litigant of depriving a successful one of the fruits of his judgment in his favour untill a further appeal is determined".

The court then went further to state that an unsuccessful litigant applying for a stay must show "special circumstances"
or "exceptional circumstances" eloquently pleading that the balance of justice is obviously weighted in favour of a stay"
in the instant case, though i have not seen a copy of the motion, the house of representatives have not been able to show
the special circumstance why thier motion should be granted. the irony of the spokesman to the house of representative's
argument that the res needs to be preserved.the res so called, which is the sit occupied by the suspended
honourable members is perishable, because the people being represented by those members have been denied representation for a long
time now and their tenure running to an end,that makes it even more perishable.

And secondly, on the role the police played in the whole saga; it is most petiable, i personally think that they should
have been on the side of the honourable members in enforcing that judgmen. worse case scenerio, play the role of a
neutral arbital.

And in conclusion, i think for flouting the ruling of a court with competent jurisdiction, amounts to contempt.
and as femi falana, counsel to the plaintiffs has said, it is a disregard of the judiciary.it is contemptous and should
not be encouraged by Nigerians, in upholding the principles of seperation of powers and the rule of law.

The Ranch which is 24 square kilometre in size is at an altitude where view is breathtaking and the air is fresh and clean. There is also the spectacular grotto (a natural swimming pool with its sparkling pure water)

There are also birds and pigs that produce eggs and pork respectively, in commercial quantities.

Walking through numerous waterfalls, horse riding, squash and tennis nature beckons at you. A nine hole golf course has been constructed alongside a club house containing a gym. The ranch also has a Health Centre and a Police Post, natural small swimming pool with a mini waterfall .

For a while now, i find it difficult to put pen to paper,but this is an issue that has struck my heart with
the emergence of the super falcons as African women's champion for the sixth time or thereabout, as most of us know,
the team consists basically of a mono ethnic group, it therfore goes to say, that those who can do the job should be
given the opportunity to do so as Nigerians and not on the basis of Federal Character or zoning. it goes further to prove
that the inefficiency of the super eagles today, is a result of these twin evils.
The Federal Character arrangement is provided for in the constitution of the Federal republic of Nigeria, 1999,
it is provided for in the establishment of some certain government agencies like the army, specifically, section 219.
In my humble opinion, the many problems of our dear country Nigeria is a result of Federal Character and zoning.
in many
Federal Government Agencies, merit has been sacrificed on the alter of federal character principle. equality, which
is the
pillar on which the rule of law is founded, is a good thing, but merit must not be substituted for it. merit equals
productivity.
a good case in poit still remains the performance of the super falcons.
This twin evils are gradually suffocating us as a country, and am sure, this is what the late chief Awolowo saw when he
looked into the crystal ball and said that Nigeria is like a ship which is moving towards a rock in terriffic speed.
in order to forstall this prophesy by the late sage, the National Assembly must look at this issues critically: which has also
crept into the political landscape, and has seen political parties codifying it in thier books.

I was treated for that, and it was gone, and i had also done malaria treatment so many times b4 this occurence. The fever gets worse at afternoons and when am tensed and under preasure or thinking hard. Dnt know what to do, am currently on ciprotab, and parecetamol, it tends to reduce it though. I need help.
