The Court of Appeal, Port Harcourt Division on Wednesday confirmed that the All Progressives Congress (APC) in Rivers State will not field any candidates during the 2019 General elections when it dismissed the appeal filed by the factional Rivers State APC Governorship Candidate, Mr Tonye Cole. he Court of Appeal, Port Harcourt Division also confirmed the judgment of Justice Chinwendu Nwogu that Rivers State has no ward executives, local government executives and State Executives as it dismissed the appeal filed by Sacked Rivers State APC State Chairman, Mr Ojukaye Flag Amachree. The Court of Appeal Port Harcourt Division Special Panel Chaired by Justice Abubakar Yahaya dismissed the two appeals for lack of merit. The third appeal which centred on the judgement by Justice Chinwendu Nwogu was dismissed because it was filed out of time and therefore statute barred. Delivering his judgement Justice Yahaya,said the appeal against the Justice Chinwendu Nwogu High Court judgement on the party Congress crisis lacks merit, adding that the application for joinder failed to observed the 14 days rules of Appeal. While delivering judgement on the substantive appeal number CA/PH/198 that bothered on Justice Nwogu’s judgement, the panel ruled that the Ojukaye faction failed to seek leave of court before appealing against the judgement. Justice Yahaya ruled that the judgement delivered at the lower court was a consent judgement, adding that Ojukaye faction should have done the needful legally before approaching the court. Counsel to Ibrahim Umar and 22 others, Mr Patrick Luke said that the rulings of the Court of Appeal confirm that the judgement by Justice Chinwendu Nwogu remains valid and is still subsisting. Counsel to Ojukaye Flag Amachree, Emenike Ebete noted that the court heard the three matters and in her wisdom arrived at the rulings confirming the judgment of Justice Chinwendu Nwogu. He said: “Arguments were taken but the Court in its infinite wisdom held that in appeal 461, that is the substantive appeal, that the consent judgement of the High Court of Rivers state and by provision of the constitution, we ought to have sought leave of court to appeal against that consent judgement. That is their own decision and they struck it out. “The one for the candidates and the party state excos, we were dismissed on the ground that it was a pre-election matter, that we did not bring the application within 14 days after decision was delivered on October 10. What that means is that, we will approach the Supreme court to contest the judgment “. It will be recalled that on October 10, 2018, a High Court in Port Harcourt nullified the nomination of Mr Tonye Cole as the Governorship Candidate of the All Progressives Congress (APC) in Rivers State on the ground that his nomination is a function of illegality and unconstitutional acts. The Court also nullified the the Rivers State APC Senatorial, House of Representatives and House of Assembly Primaries conducted on the premise of the illegal ward congresses. The High Court further nullified all the elections of Rivers APC Ward Executives, Local Government Executives and State Executive Committee that arose from the illegal ward congresses. As Obesere labels K1 traitor By Benjamin Njoku and Rotimi Agbana Fuji music exponent, Alhaji Abass Akande Obesere,PK1st, has lampooned fellow fuji musician, Alhaji Wasiu Ayinde a.k.a K1 De Ultimate, over his stance on the current crisis that has engulfed ruling APC in Lagos State, describing him as an ingrate who does not always care to bite the fingers that fed him. Obesere spoke against the backdrop of the recent video released by K1 De Ultimate on Instagram, where he shared his opinion on the best governors Lagos State has ever had, omitting the name of incumbent Governor, Akinwunmi Ambode, further stoking the raging fire of controversy that Ambode truly may have fallen out of favour among the stalwarts of the party ahead of the 2019 gubernatorial election in the State. The relationship between the two musicians over the years has not been as cordial as music fans all over the world will expect it to be, while so many questions have been asked to ascertain the cause of their frequent feuds. Speaking on the latest development in a statement made available to E-daily, Alhaji Obesere was quick to place it on record that while he is having nothing personal against his colleague, he is always averse to his uncharitable conduct and dishonest attitude, adding the latest preposterous position and outburst against Ambode in his trying period is a clear testimony that ‘Alhaji Wasiu Ayinde is nothing but a serial betrayal.’ He bares it all by going down memory lane: “I want to state clearly that I have nothing personal against Alhaji Wasiu Ayinde but looking back to some of his conducts and attitude over the years, I think I have been proven right to stay away from dealing with him. I don’t like to deal with an ingrate who doesn’t care to bite the fingers that once fed him, “he began defiantly. “As musicians, we are people’s property and I am free to support anybody that I like but I won’t come out in the open to smear the character of anybody – not to talk of someone I have benefited from in one way or the other. What is happening in Lagos State is pure political issue and should be left to the politicians to resolve. For, Alhaji Wasiu Ayinde to suddenly change gears because of the travails of Governor Ambode is not only ungodly, slanderous and disrespectful, but it shows that he is a real traitor. “ “You will recall that the same man betrayed our legend in the Fuji Music industry, late Alhaji Ayinde Barrister some years back. He came out in the open to deny the man who was his benefactor and called him all sorts of names. He once rubbished another amongst our highly respected seniors in the business, Alhaji Ayinla Kollington, and I can go on and on to relay some of his past ignoble actions that portrayed him as someone who cannot be trusted. And that exactly has been the crux of our disagreements overtimes. The latest one against Governor Ambode is quite unfortunate and as a stakeholder and someone who doesn’t love to hide his feelings, I think we should all let him know that, what comes around, goes around and what is not good is not good. A vintage fender guitar owned by legendary Nigerian musician, King Sunny Adé, was on Sunday auctioned at N52.1 million in Lagos. The guitar which was auctiond by Dr. Jogun Onabanjo, Certified Auctioneer and Chief Executive of Onabanjo and Onabanjo & Co, is known to have been designed by Nigerian artist Victor Ehikamenor. The glittering artistic piece was revealed at the King Sunny Ade‘s 70th birthday concert tagged Sunny on Sunday, which had an audience comprising of Nigeria’s richest and top celebrities. king Sunny Ade The starting bid of nine million Naira was followed by a very competitive bid by the well-heeled audience consisting of influential businessmen such as Alhaji Aliko Dangote and Mr. Femi Otedola, and more closing at N52.1 million. While the bid was in progress, the asking price for the guitar doubled to N17m under two minutes before exceeding the N50m benchmark in 15 minutes. The winner of the auction is yet to be revealed.
