Most investors and some agents confuse these two terms. They use them interchangeably, which is not meant to be because they do not mean the same thing.

So, what exactly does Government Acquisition mean?

We have mentioned several times on our page that according to the Land Use Act of 1978, all land in the state is vested in the Governor of the state, who then administers it to the citizens accordingly.

This means that either there is a proposed Government project for the land or not, the land remains Government Property.

However, when there is no specified proposed public project intended for the expanse of land, then the land is said to be Government Acquisition or General Acquisition Land.

Understand clearly that the situation here is when there is no SPECIFIED PROPOSED PROJECT and the land is just marked out as Government Acquisition.

In this case, investors can apply for ratification after purchase.

Now, let's talk about Committed Acquisition.

In this case, the Government has earmarked a particular parcel of land for a specified proposed public project.

Let's say "proposed Ibeju Lekki General Hospital" or " Proposed Lagos State College of Education"

The land has been named for a specific project. You should not buy such land because when you do, you are simply putting the Government in a position to either alter their plan or remove whatever structure you put up. Do we need to remind you that the former is usually prioritized over the latter?

I was just 10 when my Father passed on. My mother, who was a very hard-working woman, did all her best to make sure we all had the best education with the support of my maternal grandma. None of my father’s family gave us any support.

As a child I missed my father so much, I remember that during one of my outings with him, we visited a large expanse of land and he said to me “Son this is your inheritance, this land belongs to you and your sibling”.

I once asked my mother about it and she said my Uncle Akanji had sold my father’s land. I was extremely angry within me but there was nothing I could do.

Another 20years later, we were arranging the house after my mother passed on, we found a document that says that a piece of land was allocated to my father. We hired a researcher to help us find out all there is to know about the land.

After we got the report, it was still obvious that we can get the land back if we fight for it. So we filed a court case against my Uncle and we won. The land was given to me and my siblings, the court also had to revoke the C of O of those that bought land from my Uncle, and they have also filed a court case against my Uncle for defrauding them. I hope they win.

“Government can not just wake up one day, demolish a house that I built with my hard money and I’ve been living in with my family for the past 10 years, then moved on as though nothing has happened”

This was Madam Comfort ranting in her lawyer’s office about her demolished home and how she deserves some compensation for her loss.

She couldn’t believe that her home was gone and her family was now homeless. Though, they have been squatting in her sister’s house who is only managing in a mini flat.

Madam comfort who has been holding it all together got more furious and agitated when she heard that her name was not on the list of those to be compensated because she does not qualify for it.

As if that wasn’t enough, her lawyer just added a ton of salt to her wound when he told her that filing a court case on this issue is tantamount to barking up the wrong tree.

Haaa!
All hell just broke loose!

Her lawyer tried to calm her down and explain to her that the reason she can’t get compensated is that she has not taken step to register her purchase document, not to talk of perfecting her title in her name.

After realizing she had shot herself in the leg, she calmly asked what could be done to salvage the situation.

Then her lawyer explained that she can parley with the former owner whose name is already registered with the Government to get compensation from the Government.

Part 1: What They Tell You Versus The Truth.

When you ask homeowners about the title document they have for their landed property. You will hear something like “It’s only the purchase receipt that they gave us and we have owned the property for over 10 years now” or “My property has a deed of assignment that is over 10 years old”.

""When the developer company or an individual buyer wants to buy from the claimed "Omo-Onile Family land” and the title is Allocation, it’s time to bounce out of the deal.""

""When someone is selling an "Allocation" to you and you ask for his/her root of title then you get a reply like "the person I got it from bought it from the Baale of that community"... R.U.N.""

Are properties with such a title as "allocation" considered to be a good buy?
Yes and No.

YES under the following conditions:

1) If you're buying from the original government allottee or the root of title is traceable back to the original allottee.

2) If the land use on the allocation letter tallies with your intending use. Agric allocation is different from industrial, residential is different from commercial, be guided.

3) If all the documents necessary to get the C of O for the said property are tidy.

4) You have a way to authenticate the actual allottee.

5) You correlate the site coordinates with the documents of the property.

6) You're not buying it from the "Omo-Onile" and neither is the seller's root of title traced to them.

Uncle Akin was very close to the Ajisafe family; one would think he is Mrs. Ajisafe’s eldest child and only son. Uncle Akin, who was just a tenant in the compound, had been there for the family since the death of Mr Ajisafe over 4 years ago. He would take up every manly chore in the compound including minor repairs in the Ajisafe's apartment.

Soon, Mrs Ajisafe traveled out with her two daughters, leaving Uncle Akin in charge of the entire compound.

6 years later, Mrs Ajisafe started making money in the U.S and thought of acquiring more landed property investments in Nigeria. She spoke to Uncle Akin about it, who in turn helped her secure 4 plots at 3 million each, and also requested that she send some money so that he could help her erect a fence and perfect her papers too. Mrs Ajisafe joyfully obliged and requested that the documents be scanned and picture evidence of the erected fence be sent to her, which Uncle Akin did.

Months later, Mrs Ajisafe was gisting with her brother who lives in Nigeria about the development. Curious to see what his sister had paid for, Mrs Ajisafe’s brother decided to visit the property.

He went visiting with uncle Akin and behold a part of the fence was demolished and a massive building was under construction that span all the 4 plots and more, extending to another 2 plots beyond the fence side that was demolished.

Agitated, they called someone from the state land ministry who told them that the parcel had been allocated by the government to the person doing the construction, that he owns the 6 plots and his document is registered after acquiring the property.

Uncle Akin was sad and dumbfounded, he couldn't believe he had been duped.

Mrs Ajisafe was devastated and sorrowful, there is little she could do to recover her lost money.

Now, let's examine what could be wrong.
1) Uncle Akin might just have concluded the deal solely based on trust instead of seeking professional advisory (very common amongst investors; major source of scam and manipulation)

2) He might have gone there with an "expert" and had been told that the land is "free", a popular language amongst field surveyors which in reality is an acquisition, but a non-committed one.

3) While it might have shown under "free" on the acquisition map, a scheme officer might have allocated it to someone else (very common in Lagos state), you'll be shocked.

4) The land could have been under an existing government scheme. In this case, the purchase price would have been far lower in order to give room for ratification with the government.

5) The land could have been an allocation and sold by either "Omo-Onile" or other persons that are not the original allottee.

6) The documents presented might be fake.

7) They might not have done Search at the state land bureau which would have revealed certain information about the property.

They might have done Search but the document presented might be different from the actual site (common site manipulation practices unknown to many investors).

9) They might also have relied on the coordinates presented by the seller or through the survey documents instead of picking their coordinates on the site and charting it through the surveyor general of the state.

10) There might be ownership impersonation.
… and many more reasons.
