Story of Aunty Londoner Sisi Londoner, as we often call her, is a chop-life babe that always looks like she has no business with aging as she always looks way younger than her age. She is the only female in my Mum's family that has refused to be called "Iya Lagbaja" even after giving birth to 3 grown-up guys, she would still insist that you call her by her name. To all her Nieces and Nephews, Aunty Risi is the Best Aunt because you can easily vibe with her without feeling awkward because of the generational difference. Aunty Risi is the typical "I can not come and kill myself person", she doesn't like stress at all. So she did all she could to make sure she traveled out immediately after her first degree and since then refused to come home, hence we nicknamed her Sisi Londoner. Recently, Sisi Londoner came home for Grandma's burial and invited us (her nieces and nephews) to a pool party hosted in her new Duplex in Lekki. While helping her supervise the vendors she had hired, we got talking about her new house, how lovely it is, the price, and what she likes most about the house. What caught my attention was when she said "Babe, you know me now, I can't stress my head with Land wahala, so I opted to buy a house instead". I immediately asked for clarification and it dawned on me that she had opted to buy a house simply because she doesn't want to go through the stress of land verification. Haa! Aye mi! Se this woman did not hear what we have been saying abi that house she purchase hanging in the sky. I thought to myself. After some interruption from the vendors, I made her understand that buying a house just to skip property verification is doing her a disservice for 2 reasons. The first is that we can’t take the developer’s word for it because developers are human too and are prone to mistakes as well. Secondly, it is more expensive to lose a house than to lose a plot of land. So it means you decided to take a higher risk to protect yourself against a lower loss. We received a call requesting us to design a 5 floors L-shaped contemporary architectural design of a hospital with stunning landscape, 50 car parks and lots of technical facilities... all to be seated on a 2372.263sqm of land. We agreed on a meeting to inspect the site and to get other details from the client, a Doctor businessman in Lekki, Lagos. Within just 5 days after the meeting, we were able to produce the draft architectural plan and 3d visualisation design of the project, and the client was wowed but then... We couldn't agree on price so we were dismissed. No lie, we were sad �. Ask us why. Well. First, the urgent demand of the client that made us slow down other design projects just to meet up with his 5 days emergency demand as a result of his travelling itinerary. In this very case, this client didn't pay a dime because of the person recommending him. Now, imagine getting dumped after such sacrifice despite being 100% satisfied with our delivery. Now, it is time for us to talk about the roles of Town Planners in Landed Property Verification and then we will stop this series. Not because that's all property professionals involved in verification, just continue reading first and you'll see our reason. Back to engaging the Town Planners. You see most investors skip this phase in their verification and this is one of the reasons why some buildings are being demolished. Some people have land expanses with excitement while the authorities are waiting for the right time to penalize. What many don't know is that even on a typical land expanse with the title C of O, within that same expanse are zoning for different purposes, wait for it. Here are things you would find out when you engage a town planner: 1. Land Use: Do you know that the Government is concerned about your uses for the land you intend to pay for? Did you say “but why?” Why not when for every bush, village, and city you see, there are both the state and the federal master plan executed on them. For Agric? Residential? Commercial? Industrial? Recreational? Waste? etc. There are already designated land uses planned, sane and well-organized chunks that can protect us and give us balanced access to amenities. And this plan must be conformed with if you must have a real estate investment without regret. How would you know about land use? Ask the Town planner. 2. Find out about road encroachment and setbacks: Sometimes, buyers buy land whose actual perimeter falls within the road even though the survey states something otherwise. Other times, a part of the land is encroaching the road setbacks. How will you know this? Ask the Town Planner 3. Conformity of the actual Site execution with the Approved building plan or the approved Layout. How would you find out? Ask the Town Planner. These are just a few highlights (not all) of what a town planner will do for you in your complete verification process. And there's a disclaimer, if you must hire a town planner, he has to be very experienced. This is because professionals make mistakes and their years of experience are a great consideration to minimize their error risk. As stated earlier. In this instance, the mistake could be the wrong spelling of name, omission, wrong date, etc in any of the Instruments used for executing a land title. 2.Ratification which is also known as regularisation means getting formal consent to a contract or agreement. This is usually necessary in the case where the landed property does not have a registered title already or was revoked, then ratification would be the step to get the Government to consent to the transfer of such property. Now, let’s look at the processes required for the Rectification and Ratification of land titles. 1.Rectification can be achieved in two ways depending on whether the instrument with the error has been registered or not. In cases where the instrument has not been registered, then the parties involved would get a lawyer to prepare another document on which the corrections would be effected and the previous document would be rendered void. On the other hand, if the document bearing the error has been registered at the ministry of land before the error is detected, then a deed of rectification must be prepared and submitted alongside some other documents like an application letter, an affidavit with a passport photograph, Valid means of identification and newspaper publication at the ministry of lands. 2.Ratification can be done by buying the land again from the state Government, that way it would be issued a certificate of occupancy. The steps include obtaining a regularisation form to be submitted with a survey (where necessary), proof of payment of the required amount, and other documents as required.
