Story of Aunty Londoner

Sisi Londoner, as we often call her, is a chop-life babe that always looks like she has no business with aging as she always looks way younger than her age.



She is the only female in my Mum's family that has refused to be called "Iya Lagbaja" even after giving birth to 3 grown-up guys, she would still insist that you call her by her name.


To all her Nieces and Nephews, Aunty Risi is the Best Aunt because you can easily vibe with her without feeling awkward because of the generational difference.




Aunty Risi is the typical "I can not come and kill myself person", she doesn't like stress at all. So she did all she could to make sure she traveled out immediately after her first degree and since then refused to come home, hence we nicknamed her Sisi Londoner.



Recently, Sisi Londoner came home for Grandma's burial and invited us (her nieces and nephews) to a pool party hosted in her new Duplex in Lekki.


While helping her supervise the vendors she had hired, we got talking about her new house, how lovely it is, the price, and what she likes most about the house.



What caught my attention was when she said "Babe, you know me now, I can't stress my head with Land wahala, so I opted to buy a house instead".



I immediately asked for clarification and it dawned on me that she had opted to buy a house simply because she doesn't want to go through the stress of land verification.

Haa! Aye mi!
Se this woman did not hear what we have been saying abi that house she purchase hanging in the sky. I thought to myself.



After some interruption from the vendors, I made her understand that buying a house just to skip property verification is doing her a disservice for 2 reasons.



The first is that we can’t take the developer’s word for it because developers are human too and are prone to mistakes as well. Secondly, it is more expensive to lose a house than to lose a plot of land. So it means you decided to take a higher risk to protect yourself against a lower loss.



Just then another set of vendors arrived and that was how our little chit-chat ended till after 2 days when I saw her call while I was getting off work.

We received a call requesting us to design a 5 floors L-shaped contemporary architectural design of a hospital with stunning landscape, 50 car parks and lots of technical facilities... all to be seated on a 2372.263sqm of land.

We agreed on a meeting to inspect the site and to get other details from the client, a Doctor businessman in Lekki, Lagos.

Within just 5 days after the meeting, we were able to produce the draft architectural plan and 3d visualisation design of the project, and the client was wowed but then...

We couldn't agree on price so we were dismissed.

No lie, we were sad �.

Well.

First, the urgent demand of the client that made us slow down other design projects just to meet up with his 5 days emergency demand as a result of his travelling itinerary. Usually, our Draft Presentation for infrastructure designs is around 10 working days unlike residential ones that we could pull off in 5 days but hey, we did it.


Second, this Draft Presentation is only possible when the client pays the service fee's first tranche, and in a few cases, we allow the client to just pay a commitment fee, small money- before we proceed with our task. In this very case, this client didn't pay a dime because of the person recommending him.


Now, imagine getting dumped after such sacrifice despite being 100% satisfied with our delivery.

Very common right? But as common as it is some people still don’t know why they need a survey plan other than for documentation purposes. E shock you too?

Well, you need the survey plan for the following purpose:

1. Establishing boundary lines: Often, property sellers would only point out a landmark around the boundary lines of the property, and on a few occasions, some would have put a beacon on the boundary.

The survey guides you in identifying the exact line that marks the beginning and the end of your property. Thereby preventing you from trespassing into another person’s property and also preventing you from dashing out part of your land.

2. Identify the shape of the land. In most cases, land does not have regular shapes. So the survey is needed to determine the exact shape of the land and to guide the architect in his designs.

3. Confirm the size of the land: Sometimes the size of the land may be unclear and when it is clear, one should also try to affirm that it is as stated.

4. Easements, and Rights-of-Way: all conditions imposed by the law should reflect on the survey.

For instance if your property blocks your neighbour's access road, there may be an old agreement (called an easement) that gives your neighbour the right to walk across your compound

Other things you should know about the survey includes:

1 . The survey must be carried out by a registered Surveyor

2 . The survey plan should contain the full name of the owner of the land correctly spelled, the precise address of the land, the land size, date, plan number, and a stamp showing that the land is FREE FROM ACQUISITION.

Documents: Grant of Probate and Letter of administration

Baba Efe passed on leaving his 3 children with 5 properties in different locations.

He has a will wherewith he had assigned 3 out of the 5 properties to each of his children. But the remainder was not even mentioned in the will, probably because he just acquired them and hasn't updated his will, so the family head decided that his wife should have them.

So, Madam Uloma, a regular property investor like you with eyes for good things, when she heard that two of Baba Efe's properties were put on a distress sale.

She quickly jumped on thee offer, contacted her agent and closed the deal.

Madam Uloma was happy that she got a good deal and she decided to perfect her title immediately.

Only then did she find out that two documents are missing.

Those documents are what we are going to discuss under this post:


1.Grant of Probate: this is a legal document that gives an executor of the estate of a deceased the legal right to administer the estate, where the deceased has a will.

In layman terms, the grant of probate is needful when the deceased has relinquished the right to possess and manage his property to another person in his will. It accords the benefactor the legal right to manage such property.


2. Letter of Administration: in a situation where the deceased has no will, an administrator/ representative agreed upon by all members of the family would then apply for a letter of administration.

Like the Grant of Probate, the Letter of Administration also confirms the administrator's authority to deal with the deceased person's property


In our introductory story Madam Uloma could not perfect her documents because there is no legal document that gives whoever sold Mr Efe's property the right to do so.

Invariably, there was a break in the chain of things as the name on the property document is different from that of the Deed of Assignment.

You see most investors skip this phase in their verification and this is one of the reasons why some buildings are being demolished.

Some people have land expanses with excitement while the authorities are waiting for the right time to penalize. What many don't know is that even on a typical land expanse with the title C of O, within that same expanse are zoning for different purposes, wait for it.

Here are things you would find out when you engage a town planner:

1. Land Use:
Do you know that the Government is concerned about your uses for the land you intend to pay for?
Did you say “but why?”

Why not when for every bush, village, and city you see, there are both the state and the federal master plan executed on them. For Agric? Residential? Commercial? Industrial? Recreational? Waste? etc.

There are already designated land uses planned, sane and well-organized chunks that can protect us and give us balanced access to amenities.

And this plan must be conformed with if you must have a real estate investment without regret.

How would you know about land use? Ask the Town planner.


2. Find out about road encroachment and setbacks: Sometimes, buyers buy land whose actual perimeter falls within the road even though the survey states something otherwise. Other times, a part of the land is encroaching the road setbacks. How will you know this? Ask the Town Planner

Land size is a critical factor in property negotiation, knowing the exact land size would guide you to avoid paying too much for a whistle.

And when we are talking about land size, we are referring to the number of plots here, even though this is what most property buyers understand as land size.

A plot of land is a marked out portion of land, this can be as large as 1 hectare or as little as a quarter plot. We can describe it as a piece of cake out of the whole.

The land size we would discuss here is the type that shows the differences in 2 plots of land. To determine the exact size, the land would be measured by a surveyor or other real estate professionals.

= 18.3m x 36.6m
By approximation
60x120ft = 18x36m

And in Squaremeter(sqm), you will multiply the length in meters by the breadth in meters.
I.e (18*36)sqm = 648sqm

Let’s begin with what each of these terms means

1.Rectification from the word “Rectify” means to correct a huge mistake in a document. In this instance, the mistake could be the wrong spelling of name, omission, wrong date, etc in any of the Instruments used for executing a land title.

2.Ratification which is also known as regularisation means getting formal consent to a contract or agreement. This is usually necessary in the case where the landed property does not have a registered title already or was revoked, then ratification would be the step to get the Government to consent to the transfer of such property.

Now, let’s look at the processes required for the Rectification and Ratification of land titles.

1.Rectification can be achieved in two ways depending on whether the instrument with the error has been registered or not.
In cases where the instrument has not been registered, then the parties involved would get a lawyer to prepare another document on which the corrections would be effected and the previous document would be rendered void.
On the other hand, if the document bearing the error has been registered at the ministry of land before the error is detected, then a deed of rectification must be prepared and submitted alongside some other documents like an application letter, an affidavit with a passport photograph, Valid means of identification and newspaper publication at the ministry of lands.

2.Ratification can be done by buying the land again from the state Government, that way it would be issued a certificate of occupancy. The steps include obtaining a regularisation form to be submitted with a survey (where necessary), proof of payment of the required amount, and other documents as required.
It is worthy of note that land can only be ratified if these two basic conditions are met;
The land is not in a Government committed area
It aligns with the Urban and Regional Planning standards and regulations.

On getting there, Baba Mutiu could not Identify me but after I introduced myself, he was able to remember me and he confirmed that it was true that I bought the said land from Baba Lamu, that Baba Lamu had even given him my receipt while he was on his sick bed.

I was so happy, hoping my worries are over since I now have proof of payment.

However, Lamidi seems unsatisfied, he accused Baba Mutiu of colluding with me to steal his father’s land and threatens that he would harm me if I ever get close to the Land.

Baba Mutiu assured me that I can go and start planning on starting the site work and that he would calm Lamidi down.

I thanked the man and left the community.

2 weeks later, I started my site work, we sped up the work and it was almost at lintel when I got a contract and had to divert my funds to it.

So, the project was on hold for about 10 months, after which I decided to visit the site and plan on completing the project.

To my surprise, on getting to the site the building was fully finished and people had started living in the house.

Haaa!

I couldn’t believe my eyes, I walked into the compound, and saw a young lady who told me her father bought the property about 7 months ago and was quick to finish it up so they could move in last December which was about 2 months ago at that time.

That moment, everything went blank, the next time I opened my eyes, I was in the hospital.

After I was discharged, my father’s Lawyer suggested that I file a court case but I wasn’t ready to go through another trauma and stress of court wahala.

And that’s how I lost so much money alongside my zeal and passion for real estate investment.

While speculating , I had started saving up for my dream house. I kept contact with the man that sold the land to me, who in all of his updates would assure me that my land was safe.

Then, after a while I couldn’t reach him anymore, so I decided to visit him, get my receipt from him and also check out my land.
On getting to his house I was told Baba Lamu as we call him has passed on 3 months ago.

Hmm…

What should I do? My father who was a familiar face in the community was no more and Baba Lamu is dead too.

I ask to see Baba Lamu’s eldest son to discuss my ordeal with him, but he insisted that he did not know me and since I do not have a proof of payment to his father, he can not give me his father’s land, just then I remember Baba Mutiu, Baba Lamu’s friend who was present the my father and I went to visit him.

So I told Lamidi Baba Lamu’s first to take me to him.

What happened next? Was Mr F able to meet Baba Mutiu? Did he recognize him? Was he able to get his land back?
