The immediate past National Security Adviser, Col. Sambo Dasuki (retd.), has filed a fresh application to stop his trial for charges of alleged diversion of about $2.1bn, part of funds meant for procurement of arms, before Justice Baba Yusuf of a Federal Capital Territory High Court in Maitama, Abuja.

The judge, however, on Thursday, fixed Friday (today) for the commencement of trial of Dasuki and his other co-accused. Others who were on December 14, 2015 arraigned along with Dasuki on the same set of 19 counts are a former Director of Finance and Administration in the Office of the NSA, Shuaibu Salisu, and a former Director of the Nigerian National Petroleum Corporation, Aminu Baba-Kusa.


Aminu-Kausa’s two firms – Acacia Holdings Limited and Reliance Referral Hospital Limited – are also part of the accused. It could not be ascertained whether the judge would be willing to take the fresh application filed by Dasuki on Friday (today).


The provisions of the Administration of Criminal Justice Act 2015 which is the law guiding criminal proceedings prohibits the hearing of any interlocutory application aimed at halting a criminal trial.

The new law in its sections 306 and 396 stipulate that such interlocutory applications having to do with the merit of the charges filed should only be considered at the stage when the substantive issue in the case is being addressed.


Section 306 of the ACJ Act reads, “An application for stay of proceedings in respect of a criminal matter before the court shall not be entertained.” Section 396 (1) and (2) of the law reads, “The defendant to be tried on an information or charge shall be arraigned in accordance with the provisions of this Act relating to the taking of pleas and the procedure on it.


“After the plea has been taken the defendant may raise any objection to the validity of the charge or the information at any time before judgment provided that such objection shall only be considered along with the substantive issues and a ruling thereon made at the time of delivery of judgment.”

But our correspondent learnt on Thursday that the fresh application filed by Dasuki, through his lawyers, was predicated on grounds different from what used to be the basis for such motions usually filed by high profile suspects to terminate a criminal trial before the coming into force of the ACJ Act.

The Lagos State Police Command has arrested a 42- year-old cleric, Pastor Chidiebere Ikpa, for allegedly raping his stepdaughter, Ngozi (pseudonym), in the Surulere area of the state.

Ikpa, who denied the allegation, told PUNCH Metro that it was a neighbour, whom he identified only as Richard, that defiled the 14-year-old girl, but he decided not to report the matter to the police because he (Ikpa) had a forgiving character.

However, Ngozi, a Senior Secondary class 2 pupil, who eventually reported the incident to the police last Friday, January 15, insisted that she was raped by the pastor on several occasions. She added that whenever she told her mother about it, she usually shouted her down, and refused to take any action on the matter.

Our correspondent learnt that Ikpa, who hails from the Bende Local Government Area of Abia State, was arrested by policemen from the Isokoko division, while Ngozi was taken for medical examination at the Mirabel Centre, Ikeja.


The test reportedly confirmed that the girl’s private parts had been “tampered with.” A police source told PUNCH Metro that Ngozi reported that Ikpa had allegedly been sleeping with her since she was 10 years old and was the one who deflowered her.

She said, “The victim claimed that the suspect deflowered her when she was 10 years. He had allegedly been sexually molesting the girl since that time.

“The victim’s mother is culpable because she knew about the abuses. The girl said it was when her mother failed to take concrete steps that she came to the police.”

The Independent Corrupt Practices and other related offences Commission on Thursday re-arraigned a former director at the Federal Ministry of Niger Delta Affairs and governorship aspirant in Nasarawa State on the platform of the Peoples Democratic Party, Yusuf Agabi, before a Federal Capital Territory High Court in Maitama, Abuja, on charges of alleged N605m fraud.

Agabi was re-arraigned along with four others on 46 counts of fraud before Justice Adegboyega Adeniyi. The accused persons, who were at various times Directors of Finance and Deputy Directors of Finance in the Niger Delta Ministry, allegedly siphoned the total sum of N605m from the Constituency Project account of the ministry under fraudulent claims. Apart from Agabi, the other co-accused are, Akpore Okeroghene (Deputy Director of Finance), Abibu Ayinla (Director of Finance), Idowu Adewale (Deputy Director Accounts) and Ngozi James (Deputy Director Accounts).


The case was re-assigned to Justice Adenyi following a petition by some of the accused persons to the Chief Judge of the FCT High Court, Justice Ishaq Bello, accusing the former trial judge, Justice Baba Yusuf of bias in his handling of the case. The prosecution had already called one of its witnesses before the case was transferred to Justice Adeniyi.

The accused persons all pleaded not guilty to the 46 counts when they were re-arraigned on Thursday. The prosecution alleged that the accused persons fraudulently withdrew the total sum of N605m from the Constituency Project account of the ministry without authorisation.

It also alleged that the accused persons perpetrated the fraud using fictitious claims through payment vouchers containing false information. Some of them were said to have used the proceeds to build private houses.

After the arraignment on Thursday, Justice Adeniyi ordered that the accused persons should conitinue to enjoy the bail earlier granted by Justice Yusuf. The matter was subsequently adjourned

In a telephone interview with our correspondent on Wednesday, the former Minister of Transport said that any Nigerian found culpable of looting public funds should be brought to justice.

Maintaining that the ongoing war against corruption by the Buhari-led administration was becoming selective, however, Babatope said the Federal Government must be careful not to make Nigerians see the anti-corruption campaign as a witch-hunt.

He explained that the PDP members currently on trial for receiving various sums of funds from the immediate past National Security Adviser, Col. Sambo Dasuki (retd.), would not have done so if they knew that the funds were meant for the purchase of arms.

Babatope said, “I wish Buhari the best of luck in his war against corruption but I don’t understand the nature of the anti-corruption war. When he was a military Head of State, he jailed politicians for allegedly embezzling security funds. Are we not on the same path again?

“No politician would take the money meant for securing the lives of Nigerian soldiers battling Boko Haram if they knew where the money was coming from.”

The party chief condemned the manner the National Publicity Secretary of the PDP, Chief Olisa Metuh, was brought in handcuffs into the Federal High Court premises in Abuja, on Tuesday.

“Buhari owes Nigerians and the world an explanation about the manner Metuh was brought to court. It’s enraging. We must be careful in this country. We all must support Buhari’s anti-corruption war but it must not be a witch-hunt,” he said.

Babatope, however, said that Metuh should be tried if funds from the Office of the NSA were traced into his private account but he added that bringing him into court in handcuffs was victimisation.
