The African continent is growing ever more obese.

Rapid urbanization, population growth and expanding economies which swell the ranks of middle-income families, are leading to more Africans indulging in fast foods.

And like seen in more advanced economies, this has led to an increasing overweight and obesity levels across Africa. Health systems that aren’t equipped to deal with the challenge are already being stretched.

A new report from the Malabo Montpellier Panel, a group of international agriculture experts, says African children are increasingly exposed to high-sugar, energy-dense, processed foods that are cheap in cost but lower in nutrients. Obesity among 7- to 11-year-olds increased from 4% in 1990 to 7% in 2011 and is expected to reach 11% in 2025.

The change in eating habits is also seen among older middle-class Africans, who are increasingly desk-bound and are not engage in much physical activity such as sports. The Malabo Panel said there was an “urgent need to raise awareness and to address the emerging burden of obesity among segments of the African population.”

Africa now has the fastest growing middle class in the world with current trajectories showing they will grow to 1.1 billion by 2060. Over the last few years, big fast food brands like Burger King, McDonald’s, KFC, Pizza Hut, and Subway all set shop in the continent in the hope of taking advantage from the expanding middle class who have disposable income and a palate for processed food. Given that, an obesity epidemicis now unraveling in countries like Egypt, Ghana, South Africa, and Nigeria. Surprisingly, malnutrition and obesity also co-exist in the same households sometimes, with stunted children living alongside overweight adults, who themselves manifest multiple micronutrient deficiencies.

As diets laden with sugar, meat, and carbs grow, the prevalence and impact of diabetes are also growing. And with healthcare in Africa long focused on communicable diseases like malaria and HIV/AIDS, national health systems are not well developed to treat diabetes or its long-term consequences like heart attacks, kidney failure, and strokes. Hypertension has also risen as a critical problem. And besides the consumption of junk food, adults in Africa are increasingly consuming less fruit and vegetables, while smoking and drinking a lot.

In a continent with 233 million hungry people, poverty and undernourishment are still a daily fact. And while parts of the populations have expanding waists, the Malabo experts note that government agencies need to act on stopping food wastage, balance food production, and ensure a minimum dietary diversity for children and adults alike.

The Minister of Information and Culture, Alhaji Lai Mohammed said on Thursday in Calabar that Nigeria was gradually moving toward technological independence.

The minister stated this when he inaugurated the ultra-modern Digital Set Top Box manufacturing plant, owned by the Gospell Digital Technology and located at Calabar Export Free Zone. The plant, regarded as one of the country’s largest electronic manufacturing and assembly, is capable of manufacturing TV decoders, prepaid electricity meter, smart phones. It is also capable of manufacturing TV main boards, tablets computers and all kinds of electronic devices.

The minister commended the investors and the managers of the plant for exhibiting absolute confidence in the future and economy prosperity of the country and in the Digital Switch Over (DSO) programme. He challenged Gospell Digital Technology and other manufacturers of Set Top Boxes/Decoders to produce a multi-purpose television set that would help in transforming the TV experience of Nigerians. “The average home today, in order to have access to the various types of entertainment, will require a television, a Set Top Box and a VCD/DVD player.

“This era is about to end. I am challenging the industry to move to one device in the home – the television. “Give us a TV with a built-in decoder and the requisite middle-ware inside it. ”And please not for the rich, but for every Nigerian home. “With that, we would have succeeded in the reduction of the cost of access to television, information and education,” he said. Mohammed hoped for an era in the country where viewers would be able to access Nollywood releases, with or without the internet and with a remote control that could convert the TV into a computer.

The minister said that the transition from analogue to digital broadcasting in the country was to give Nigerians total television viewing experience, transform the life of the people and change TV viewing forever. Gov. Ben Ayade of Cross River, in his speech, expressed satisfaction with the manufacturer for locating the plant in Calabar He promised to buy 5000 Set Top Boxes and encouraged the investors to engage people from the state in its employment as a way of supporting the growth of the company.

The Group Managing Director of the company, Godfrey Ohuabunwa, said the plant marked a new dawn in the electronic and IT manufacturing sector in Nigeria He said in addition to manufacturing of DTT and DTH boxes, the plant had three Surface Mount Technology Automatic Chip Placement lines and four pneumatic Assembly lines. According to him, the lines has the capacity of placing 2500, 00 components per hour.

He said the plant was also capable of producing 20,000 Set Top Boxes per month, manufacture 100,000 printed circuit boards per month and would generate not less than 500 job opportunities. The Chairman, Senate Committee on Information, Sen. Suleiman Adokwe, Senators Shehu Sani, Samuel Anyanwu; Mao Ohuabunwa and the Director-General, National Broadcasting Commission (NBC), Malam Is’haq Modibo-Kawu attended the occasion. (NAN)

The management of Erisco Foods has announced that it will collaborate with some Asian firms to build a tomato factory to be used as a base for exportation of tomato paste to all African countries.

The Chief Executive Officer, Erisco Foods, Chief Eric Umeofia, stated this in Lagos on Wednesday at a press briefing.

He attributed the feat to the ban on tomato paste by the Federal Government, adding that the ban had achieved two things: it caused his sales to increase by 20 per cent; and made some Asian firms hitherto importing the product into Nigeria to come together to build a tomato mega factory in Katsina State so that they could export from there to the whole of Africa.

The Erisco CEO however lamented that local manufacturers were still facing a lot of frustration in the country due to poor implementation of government’s policies meant to grow the manufacturing sector.

He alleged that all the efforts of the government to improve the lot of local manufacturers were still being frustrated by the Central Bank of Nigeria, government’s Ministries, Agencies and Departments.

According to him, the apex bank gave huge amounts of foreign exchange to importers of fish heads, frozen fish, corn, tomato paste in retail packs and others.

Although the Acting Director, Corporate Communications, CBN, Mr. Isaac Okoroafor, denied the claims when our correspondent contacted him, saying that the apex bank was not responsible for issuing forex, Umeofia insisted that the bank still allocated huge amount of forex to importers of 41 items restricted from getting forex at official rate.

The petroleum statistics on crude oil production and oil refining reflected that a total 32.70bn barrel of crude oil valued at N118.49trn has been produced between 1961 and 2014.

BrandSpur Ng reports that the NBS collated its report between 1961 and 2014 with the assistance of the Nigerian National Petroleum Corporation (NNPC).

The highest barrels of crude production was recorded in the year 2005 with 918.66m barrels valued at N6.14bn while the lowest was recorded in 1961 with 16.80m barrels valued at N18.73mln.

The yearly domestic crude oil refining data from 1997 to 2014 also reflected that 844.19m of crude oil has been received and 835.58m processed within the period under review.

INTRODUCTION

With the unfortunate alarming spate of rape incidents all around now, I decided to exploit this aspect of the rape phenomenon which happens but attracts little or no attention. Interestingly, this article was also borne out of a legal argument with some female colleagues at work. After the start of the writing, it was also the deliberate subject of a discussion among some other young lawyers in my circle. It was the opinion of the ladies that the Nigerian legal system does not protect male victims of rape; that it is unimaginable women can rape men or better still, it is unimaginable that one woman can rape one man. This opinion is rooted in the moral, male ego and male-dominated society’s viewpoints. While this position is tempting, I am swayed by Aristotle who said, “Law is reason free from passion,” to assert dispassionately that this opinion cannot withstand legal scrutiny.

OLD TESTAMENT

A few years ago, male rape was unknown to our laws. It was even believed that men would enjoy being ‘victims’ of such an ‘offence.’ So when it happened, victims had no legal redress in court. This is because the law only contemplated females as capable of being victims of rape but not culprits of same. This is reflected in the wordings of the law providing for the offence. Section 357 of the Criminal Code defines rape in this way:

“Any person who has unlawful carnal knowledge of a woman or girl, without her consent, or with her consent, if the consent is obtained by force or by means of threats or intimidation of any kind, or by fear of harm, or by means of false and fraudulent representation as to the nature of the act, or, in the case of a married woman, by personating her husband, is guilty of an offence which is called rape.”

The Penal Code, which is operative in the North, in section 282(1), has a similar provision.

With the specific use of the words “woman” and “girl“, it is crystal clear that the drafters of the law did not envisage male rape or did not believe in the ability of a woman to rape a man. But that is not surprising. The Criminal Code was first enacted in 1916. It would have been unheard of at the time that a woman raped a man. However, the law may move slowly in comprehending modern realities and developments, it is not eternally fixed.

THE NEW AGE

New realities have shown that male rape is possible. Even the Nigerian legal system has shifted base in recognizing same. One of the legal exploits of Goodluck Jonathan’s presidency was bringing to a successful conclusion the 14-year-long social and legislative advocacy championed by women’s groups and gender activists (WACOL). The administration enacted the Violence Against Persons (Prohibition) Act, 2015. The Act, by its long title, is to eliminate violence in private and public life, prohibit all forms of violence against persons, and to provide maximum protection and effective remedies for victims and punishment of offenders. The Act which outlaws Female Genital Mutilation (section 6), emotional, verbal and psychological abuse (section 14), stalking, [YES! STALKING] (section 17), has expanded the scope of rape to cover men.

Section 1 of the Act provides that:

“A person commits the offence of rape if- (a) he or she intentionally penetrates the vagina, anus or mouth of another person with any other part of his or her body or anything else; (b) the other person does not consent to the penetration; or (c) the consent is obtained by force or means of threat or intimidation of any kind or by fear of harm or by means of false and fraudulent representation as to the nature of the act or the use of any substance or additive capable of taking away the will of such person or in the case of a married person by impersonating his or her spouse.”

The Act therefore makes a novel provision for rape through oral and anal sex and the argument that Nigeria does not protect male victims of rape seemingly looks settled. Therefore, gleaning from the above provision, penetration of the anus or mouth of a man in circumstances contemplated by paragraphs (b)-(c) above will amount to rape. That is as far as that goes.

THE HOLE

However, the provision for male rape in this Act has left a loophole for penetration. A conspicuous, dicey and vital loophole. Let me reproduce a part of that section 1 for a better understanding of this point.

“A person commits the offence of rape if- (a) he or she intentionally penetrates the vagina, anus or mouth of another person with any other part of his or her body or anything else;…”

From the foregoing, the Act only states three (3) parts of the human body that can be penetrated to ground a conviction for rape – the vagina (female), anus and mouth (both genders). Even a cursory look shows that the major male reproductive organ, the penis, is not mentioned. This is understandable because, let us ask ourselves, how can the penis be penetrated?

But then, this understandable omission with no provision to cover for it has left a hole in the law. For instance, as a lawyer, I have listened to unbelievable arguments in Court and I know that many lawyers mostly look out for loopholes in laws in order to escape liability for their clients. Though this in one way is good for the advancement of the law but it leaves a sour taste in its mouth.

As a result, it will not be surprising if a lawyer comes to Court to represent a female accused person charged for rape and the former argues that the requisite elements to prove the offence of rape of a man do not include anything about a female ‘penetrating’ the penis. This may sound ridiculous but you only need a sound lawyer to put an absurd reasoning into an applausive argument. If upheld, it may be ludicrous to laymen who do not know that to ground conviction for an offence, you only need to prove beyond reasonable doubt the elements stated in the law that provides for the offence.

MY THOUGHT

It is my candid opinion, however, that there is a way around it. This Act was enacted to cure a mischief: the mischief of no provision for male rape. As a result, in interpreting this provision, the Courts might have to employ the mischief rule of interpretation, overlook the omission of the “penis” and consider if there was actual sexual intercourse without the consent of the man. If there was, the Courts may be moved to decide that the offence has been sufficiently proved. This is my thought but we await the time the Courts will interpret this provision one way or the other to put the controversy to bed.

Nevertheless, I am afraid the provision on male rape will suffer same or even worse fate compared to female rape with few or no reportage due to fear of stigma, especially from the male ego perspective.

It is noteworthy, however, that whatever direction the interpretation of the section sways, the provision is still not of national coverage as the Act in section 47 provides that “this Act applies only to the Federal Capital Territory“. As a result, until all the States make similar law, male rape is still a foreign phenomenon nationally.

MY PLEA

As a lawyer, if I find myself handling a rape case, professional duty requires me to dispassionately offer my service. However, as an emotional being, it is unimaginable what pushes and drives people, both men and women, to decide that the next thing to do is rape another person. No amount of intense “konji” and no level of indecency is powerful or tenable a reason enough to drive a man to plot to rape a woman or a woman to rape a man. So this is my plea, shelve your rod in its sheath. If you cannot control it, seek help from appropriate places. Do not leave a permanently damaging mark on another person. Do not ruin the future of another person!

PenCom to lawmakers, others: don’t undermine pension reform

Pension fund assets under the Contributory Pension Scheme (CPS) has hit N6.6 trillion, the National Pension Commission (PenCom) Acting Director-General, Mrs. Aisha Dahir-Umar, has said.

She made this known a paper titled: “Position paper on the Bill for an Act to Amend the Pension Reform Act, 2014 to Exclude Some Government Agencies from the Application of the (CPS) she presented at the Public Hearing organised by the Committee on Pensions, House of Representatives on the proposed controversial pension bills in Abuja.

She lamented that despite these achievements, there had been  measures aimed at undermining the pension reform.

She said there was need to consolidate the gains of the CPS and avoid policy reversals and that this could undermine public confidence and impact the  economy and Federal Government’s change agenda and economic recovery plans.

Mrs Dahir-Umar, who said the total pension fund assets hit N6.42 trillion by last March, added that the fund grew by about N30 billion.

She said the total pension assets were equal to about six per cent of the Nigerian rebased Gross Domestic Products (GDP).

Similarly, the number of registered contributors grew to 7.4 million as at March, representing about 7.45 per cent of total labour force  and 3.95 per cent of total population.

She pointed out that the pool of pension fund generated by the CPS has aided the deepening of Nigeria’s financial sector and provided a platform for attaining strategic programmes of government in infrastructure, housing and the development of the real sector of the economy.

Besides she said, the CPS has simplified the payment of retirement benefits by issuing effective regulations and guidelines.

She further said over 184,979 retired under the scheme during the period under review and are receiving pensions as and when due with an average monthly pension payment of N6.7 billion during the same period.

She added that the pension reform has gained public confidence and acceptability within the short period of its implementation.

The private sector, which hitherto was apprehensive of the CPS as a ploy by the public sector to raise funds to address its huge pension liabilities, has come to accept and is  implementing the reform. About 200,000 private sector employers are implementing the CPS and have contributed about 60 per cent of the total pension fund assets, she added.

She said: “The CPS has also introduced transparency and integrity in the pension administration system. From inception of the reform to date, there had not been a single incidence of fraud or mismanagement of the pension funds and assets under the Scheme among other achievements.

“In spite of these achievements, however, there have been recent actions, both legislative and administrative, aimed at undermining the pension reform in Nigeria. Exempting some government agencies would lead to divestment from FGN securities before maturity, which would have ripple negative effects on not only the finances of government, but on the entire financial system.”

The Acting DG said another negative impact of exempting these agencies is the erosion of the pool of long-term investible funds accumulated under the CPS, suitable for economic development of any nation as illustrated in other jurisdictions, including developed economies.

She observed that this would undermine the process of attaining development initiatives in the infrastructure, housing and real sectors of the economy, hinged on the utilisation of a portion of the pool of pension fund assets.

It used to be almost impossible to know how Nigerian tech companies are doing. But thanks to the openness of some of the foreign investors, we are now able to have a better understanding of how they are performing. This time, it is ecommerce giant Jumia.

Rocket Internet recently released its results for the first half and second quarter of the year. It also published figures that gave an idea of how Jumia is performing.

Jumia sold goods worth EUR 74.5 million in the second quarter of the year which is a great when compared to the Q2 of last year when it sold EUR 58.1 million worth of goods and services. The report also revealed that more people are using Jumia’s services for purchases among others as the company recorded over 64% growth in the number of completed orders that rose to 1.5 million in the quarter against 900,000 in the same period last year.

As the end of the first half of the year, Jumia said it has 1.8 million online shoppers against 1.6 million the previous year.



The company’s revenue also grew within the period to over EUR 18 million from EUR 14.6 million the previous year.

But it wasn’t all good news for Jumia has its capital expenditure reduced just EUR 400,000. It is worthy to note that capital expenditure is calculated as purchase of property, plant and equipment plus acquisition of intangible assets. Within the same period last year, Jumia spent EUR 600,000. The company has successfully cut down on its expenses in a bid to minimise loss and approach profitability.

The company’s net working capital also increased marginally to EUR 12.2 million from EUR 11.1 million the previous year. Net working capital by the way, is calculated as inventories plus trade and other receivables plus prepaid expenses minus trade and other payables.

Even though the company recorded 25% revenue growth, its gross profit reduced. But expert analyses concluded that the company is in a good shape and should continue to lower its expenses while rolling out new ways to generate more revenues, maximise and increase profits.

In the summer of 1988, John Landis’ romantic comedy, Coming To America, was released; quickly becoming a commercial success, while simultaneously inflicting on the world a painfully one-dimensional representation of Africa and Africans.  

Now, it looks like that beloved but hugely problematic film will be getting a sequel penned by Black-ishcreator and Girls Trip screenwriter, Kenya Barris – inadvertently misinforming a whole new generation along the way.

The original film followed Akeem Joffer (played by Eddie Murphy), the crown prince of Zamunda (just one of the 111 fictional African countries Hollywood has created for us), who moves to the United States with the hopes of finding a woman he can marry.

While news of a sequel has been circulating all year, this is the first time we are actually getting something concrete. The sequel will be directed by Jonathan Levine (50/50), while Barris will be working from a draft by the writers of the 1988 original.

The only element left in the air is whether Eddie Murphy will be returning, According to The Hollywood Reporter, Murphy is “expected to star,” but hasn’t actually signed any kind of deal yet. Anyway, let’s hope the movie is less problematic this time around.

With the launch of latest Pay TV operator in Nigeria, TStv Africa, DStv, StarTimes and other existing service providers are unsettled by the immediate response of the Federal Government in granting a three-year tax relief to the newly inaugurated Pay TV operator in the country as well as tax-free dividends to all investors in the company.

The development has already triggered panic among old operators who have been competing for market shares in the face of harsh economic environment in the country.

Their fear is not unconnected to the belief that the new operator would before long break the strength of monopoly they have been riding on over the years.

A reliable source from one of the Pay TV service providers, who preferred anonymity, told INDEPENDENT that steps are being taken by the existing operators to request for a better deal from the Federal Government.

According to him, “You don’t expect those who have laboured hard in the country for people to enjoy this unique service to just be ignored like that. It will not be a fair deal if significant relief is given to a new entrant into the market without the same or better consideration extended to us who have the taken the industry’s heat over the years.”

On Sunday night, at a dinner to mark the official unveiling of TStv Africa in Abuja, Lai Mohammed, Minister of Information and Culture, announced the three-year tax relief for the new company.

During the official unveiling of the new company and its products which promises to operate on Pay-As-You-Consume model, the minister said the tax reliefs were in line with the pioneer status recently granted to the creative industry by the government.

He congratulated the Chief Executive Officer (CEO) of the company, Bright Echefu, and his team for liberalising and breaking the monopoly of Pay TV in the country.

The minister said: “The important thing about what Echefu has done today is that he has redefined the pay per view television industry; and from today, that industry will never remain the same again. What he has done is to democratise the media and entertainment industry and make it possible for even a peasant farmer to have access to the best entertainment and news in the world.

“It is a great opportunity for me to be the one to unveil TStv, because, just like a Nigerian made history by crashing the cost of telephony in Nigeria, I am glad that another Nigerian is now coming forward to crash the cost of Pay TV,” he said.

Wholly Nigerian-owned, the frenzy about the Pay TV has been spreading in the last few days before the official launch because of the anticipated refined offerings of novel unclassified Pay Per View subscription and complimentary internet services the operator is promising potential customers across the country.

With the commercial launch, industry watchers have posited that it would win over a lot of customers who have been itching for a pay-as-you-watch subscription plan from the likes of DStv, StarTimes, Consat and others in the past years without a positive response.

When INDEPENDENT contacted the National Broadcasting Commission (NBC) spokesperson, Maimuna Jimada, if other Pay TV operators would be considered for the relief measure, she said the commission cannot comment on the development.

“It is the minister of information and culture that made the announcement. He is the one that can explain better,” she quipped.

Mohammed commended the courage of the investor for coming from the Diaspora to invest in his country and for believing in the government’s seriousness about diversifying the economy.

He said the company had also demonstrated that government alone could not do all things but needed the participation and synergy of the private sector.

The minister also stated that the government was aware of the huge contributions of the creative industry to the nation’s economy and would continue to support the sector.

“I want to assure that this administration will continue to assist you and other investors in creating the enabling environment for businesses to grow,” he added.

In his remarks, the Chief Executive Officer of the company, Bright Echefu, disclosed that TStv Africa, which had gone through a lot of challenges, was birth to liberalise Pay TV in the country, make it affordable to every Nigerian with added values.

Echefu said for the first time, Nigerians could now enjoy Pay Per View because with TStv, “subscription runs as you watch and it has the facility to pause your subscription when you travel”.

He said that TStv for a start has 70 premium channels model with the cheapest pay TV in Africa with maximum subscription fee of N3,000 only. The Pay TV has a model that accommodate subscription as low as N200 and N500 for a period of time.

Echefu said that once a customer subscribes to TStv, he or she will also get complimentary internet service, enabled Wi-Fi, as well as video calls and video conferencing services.

TStv has an array of amazing TV channels with premium entertainment, educative programmes that cut across all genres which include news, music, general entertainment, documentary, movies, religious, sports, health, kids, fashion and lifestyle that better define the uniqueness of Nigeria’s diverse culture and traditional values.

The minister has, however, identified contents and the lack of objective audience measurement as major challenges that had retarded the growth of TV and advertising industries in the country.
