True legitbachelor. Hahaha disguy1 no mind that smartkitty. I was quoting a VJ experience. The thing is can you engage a woman who is still legally married? So it will be considered a sham. We are withdrawing the petition for future petition filing. It makes sense that you cannot engage a woman who is not legally divorced. I engaged her when she hasn't filed the divorce on her first visit. Worst case scenario that will be going in the visa officer's mind; we both conspired so you could divorce your husband. Since the time of engagement was not after the divorce and was even on the first visit.

```ANOTHER NEWS,

I got an letter from my senator Barbara Boxer. Because I got her office involved into the case.

New Delhi visa cheif emailed her office and said the same story that visa was refused and petition

was sent back to NVC. But addition to that they also said the visa was refused because "There were serveral

areas of concerns including that Ms.__________had first met the petitioner in 2008 when he had not yet divorced his first wife. So that make our relationship invalid".```


Shit!!! I saw this on visa journey. My petition was invalid from the start. I got her engaged on the 27TH of August 2018 and her divorce was final 21st of February 2019. Lol please don't make this mistakes guys!!! We are withdrawing our petition.

212(A)(5)(A) INADMISSIBILITY DUE TO LABOR CERTIFICATION

Its stated goal is to "protect U.S. workers and the U.S. labor market by ensuring that foreign workers seeking immigrant visa classifications are not displacing equally qualified U.S. workers".[1]```


The consular officer saw on my DSform that I'm a graduate of psychology and the year of graduation was stated. So he maybe felt its a coincidence that I'm getting out of the university and entering the United States on the basis of marriage. Most skilled workers are denied visa application that are not centered on working visa's. They feel it's a sham.

However, myself and fiancé wants to appeal on IMMIGRANT WAIVER Section 212(k) provide for a waiver where the foreign national is able to demonstrate that he or she did not know and could not have known a labor certification was required and otherwise holds a valid immigrant visa.

Just be calm ,it was more like a interactive /conversation settings kind of interview ,they ask questions u give them answers but trust me they wont ask you questions outside what you guys wrote in your letter(statement about meeting) but trust me those guys are trained psychologists so they can detect a lie or something.. just make sure all you say/answers correlate with the letter your fiance filled and know every detailed information about him or her.. i wish you best of luck.. cheers

My visa was denied today. I really don’t know why. But before the co called my name, he was going through my documents, and then printed the refusal paper and kept on his table before he called me. He just asked me who petitioned for me, where does he work, has he been married before, have I been married before? He then asked if he has come back to Nigeria since the last time he visited.( my fiancé is not a Nigerian. He came to Nigeria once for the first time to see me, and he stayed for 8 days. ) I told him I went to his country when his mum passed. And I stayed with them for 2 weeks. He then ask what I do for a living. And asked me what kind of work I’ll like to do in America. I told him my main aim of going is to get married. He asked if I don’t want to do any work when I get there. I told him I want to get married. Asked me how I met my fiancé, and then he looked at my past application in 2013 and asked who’s Ojo? I told he was my ex he asked if I was married to him, I said no, but we lived together. I’ve never been married. Asked when I met my fiancé and when he came to Nigeria. Didn’t ask for any evidence. And then issued me the letter he printed out earlier on.

Please must I come on 24th Dec to pick it because it means spending Christmas in Lagos or can I pick it in January before my interview. Please someone advise...

Like I said, the best response to that question is the truth. If these responses posted by a vj member is the truth for Disguy1, then he can provide it as his answer if asked. However if its not, the CO might find out he's lying and that could affect his approval. The CO' s are experts at probing if they suspect sth fishy.

For instance, if they suspect you said sth that's not true, they can probe further by asking leading questions. The first option given by the vj member is to "test waters". The CO might ask why are you testing waters if you truly love her. They might also ask why don't she come to Nigeria to "test waters" since its much easier for her to come to Nigeria (since she is both Nigerian and American) than for you to go to America. Options 2, 3 and 4 doesnt apply to you since you are a guy. But even if you want to reverse it, they can still probe further by asking why. For instance, if you say you want her family in the States to get to know you, they will ask why not she also come to Nigeria to get to know your family....you get my drift?

Concerning frypuffpuff's suggestion, they can ask why don't she first come to Nigeria to meet your parents? They know the Nigerian customs and know that our customs value both parents of the bride and groom. They know that your parents are meant to see the bride and give their blessings as well. So they can probe along that line.

So, like I said earlier, there is no standard answer to that question. The only standard answer is the truth and nothing but the truth. If the truth is that you feel america is the best place for you and your future wife because it has a better economy than Nigeria or better security than Nigeria. Then go-ahead and say it. If the truth is that you also want to study in the US after marriage then say it. As long as you truly love your fiance, you are fine, the CO can't come in between your love for her. They can't deny two love birds coming together to get married. But if you don't love her, then.....I have nothing to say :-x. I trust you do love her.

If you have a big Nigerian wedding and pay the same as for a Nigerian wife, then the US government believe more, it is the real love and marriage.

If you marry in US, the government and even your American wife see as you don't want to make any effort, you are not valuing the American wife the same as a Nigerian one, even you could be or will marry traditionally a Nigerian woman and the American marriage is just the formality for you for to get your green card.

I would like to see 1-2 years from now all of you who arrive now to US. How many of you are still married to your American wife / husband and how many of you are cheating, travelling back to Nigeria to visit and how many of you have a traditional wife in Nigeria or will have.

Back to the question @disguy1. It's simple. Like thoughtful people have said before, the VO/CO know the cultures in Nigeria. Simply put, I will tell them; "my fiancée wants a traditional wedding. And we both have agreed to do the traditional wedding and go the court afterwards. She wants to experience the Nigeria traditional wedding. And I believe sir and ma that you're conversant with the Nigeria culture that a traditional wedding must be held in the parents house of the wife-to-be. As our tradition stands to be, myself, family and few relatives will honour her greatest wish"

Although, this answer is applicable for male k1 applicants with a female USC. Where una don see traditional wedding wey na for the man house dem dey do am? She wants a traditional wedding, and we have agreed on a traditional wedding and later on go to the court.

First week! Oboy! Few days to go.lol when January reach by God's grace. My own anxiety will kick in. Now my only concern is beating this Lagos traffic. I planned on using ORide! Lagos for now is a mess cause of these roads construction and coming from the mainland will be hectic. You'll do fine. Congrats in advance girl.

*24th June 2019* - my fiancee filed,

*3rd Oct 2019* - it got to NVC,

*29th Oct 2019* - I was asked to apply for the K1 cause they were ready to process,

*21st January 2020* interview.

*This is my own calculations, just checked my mails*
