DEED OF SURRENDER

When a Tenant walks away from a lease, the legal relationship does not automatically end.

Without the right document, you may still be tied to a lease you thought had come to an end.

Many Landlords and Tenants believe that handing over the keys is enough to end a lease. It is not.

Unless the tenancy is properly brought to an end, issues can arise over unpaid rent, service charges, repairs, possession or other duties even after the Tenant has left.

That is why a Deed of Surrender is important. It is the legal document with which a Tenant, with the Landlord's consent, voluntarily gives up the unexpired duration of a lease before its agreed expiration date.

Once well prepared and signed, it lawfully terminates the lease, returns possession of the property to the Landlord and releases both parties from their continuing duties under that lease.

But a poorly drafted Deed of Surrender can create more problems than it solves.

Important issues like rent owed, caution fee, repairs, fittings, service charges, handover and the actual date the lease ends, must be clearly addressed.

Missing these details can result in avoidable disputes.

So engage a trusted Property/Real Estate, and Business/Commercial Lawyer to prepare or review al Deed of Surrender and ensure your rights are fully protected.

At Apex Chambers, we advise persons in Nigeria and abroad to end property transactions the right way to avoid wahala.

WHEN BUYING LAND/BUILDING IN NIGERIA, GET A PROPERTY LAWYER

One expensive mistake you can make when buying a land/building in Nigeria is not paying too much; it is paying for a problematic land/house.

Many hardworking Nigerians at home and in the diaspora lose millions of Naira because they trusted glossy brochures, agents with sweet mouth and land sellers assurances.

By the time they discover the truth, their money is gone, disputes have begun and the dream of owning land/house has failed.

Buying land or house is a financial and legal transaction.

So before you pay even one Naira, get a trusted Property and Real Estate Lawyer in Nigeria to conduct thorough investigations to confirm who truly owns the property, whether it is under Government acquisition, a subject of Court case, under mortgage, affected by disputes or having any other legal issues.

Also important is the preparation of the correct legal documents, as a wrong or poorly drafted document can leave you with possession but not legal ownership.

So let the Lawyer draft and prepare the right legal document like Deed of Conveyance, Deed of Assignment or any proper document.

These will save you legal troubles.

The Realtor and Surveyor have important roles, but only a competent Property and Real Estate Lawyer will protect your legal interests.

At Apex Chambers, Barristers and Attorneys in Nigeria, we advise that every land/building purchase needs careful legal investigation and well prepared purchase documents.

DEED OF REVOCATION

Changing your mind does not automatically cancel your legal obligations.

Many people know how to sign a written Agreement, but not many know what it takes to legally end one.

A Deed of Revocation is the legal document used to lawfully cancel an earlier Agreement that expressly permits revocation, restoring the person's rights.

But revoking a document is not just by changing your mind. If it is done wrongly, the original Agreement may remain legally effective, exposing you to issues, losses or court case.

Many people assume they can withdraw from a written Agreement/Contract by writing a letter or by word of mouth. The law does not work that way.

A valid Deed of Revocation must be well drafted and signed in accordance with the law. Every word matters because a mistake can affect property ownership, contract obligations, business interests or future transactions.

Whether the original Agreement relates to land/real estate, business or another legal obligation, be careful.

So consult a good Property/Real Estate and Business/Commercial Lawyer before attempting to revoke any Agreement.

An reliable Lawyer will determine whether the Agreement can legally be revoked, prepare the correct documents and ensure your rights are fully protected.

At Apex Chambers, we understand that protecting your rights is not only about creating legal documents; it is also about bringing them to a lawful end when the circumstances require it.

Cancel Agreements the right way.

DEED OF TRUST

The best inheritance may not even be what you leave behind, but the certainty that your loved ones will receive it without conflict.

Many people spend years building wealth, buying properties and growing businesses, yet make the mistake of leaving the future to chance.

Sadly, families that should be united are torn apart by bitter disputes because there was no proper legal structure protecting those assets.

A Deed of Trust is a smart legal document for protecting wealth.

It allows a property owner to appoint trusted persons to hold and manage his assets for the benefit of chosen beneficiaries.

It helps preserve property, ensures your wishes are carried out, reduces disputes and provides a smoother transfer of wealth.

A poorly prepared Deed of Trust can create confusion instead of protection.

Vague clauses, wrong trustees or an improperly drafted document can frustrate your intentions and expose your family or business to expensive legal battles.

Whether you live in Nigeria or abroad, if you own property or run a business, do not rely on oral promises or internet downloads.

Protect what you have worked so hard to build, with a properly drafted legal document.

Let a Property and Business Lawyer who understands the law and the practical realities of protecting assets, draft a Deed of Trust for you.

At Apex Chambers, we advise that the right legal help can preserve your legacy for generations.

DEED OF VESTING ASSENT

When a loved one dies, grief is hard enough.

Losing an inheritance intended for you because the law was not properly followed makes it even harder.

Many people believe that once a Will has been read, the beneficiaries automatically become the legal owners of inherited property. That is not correct.

The law requires another step before ownership can legally pass to the beneficiary. That step is the drafting of a Deed of Vesting Assent.

A Deed of Vesting Assent is a legal document with which the Executor/ Administrator of a Will transfers ownership of a late person's property to the beneficiary named in the Will.

The document gives legal effect to the transfer and ensures the beneficiary's ownership is legally recognized.

Without a proper Deed of Vesting Assent, a beneficiary may encounter issues in registering his ownership, selling the property, obtaining financing or proving ownership.

If not well handled, an inheritance can become a frustrating legal challenge.

Preparing this document requires legal help and strict compliance with the law, as a mistake can create disputes or complicate the transfer of property.

So never assume that inheriting property ends with the reading of a Will.

Apex Chambers advises that a good Property and Business Lawyer will ensure your inheritance is transferred lawfully, your rights are protected and your loved one's final wishes are fully honoured.

DEED OF RELEASE OR DISCHARGE

Before you celebrate paying off a debt, be sure you have been legally discharged.

Many people believe that once a loan is repaid or a duty is settled, the matter automatically ends.

The law does not always work that way.

Until the proper legal document is prepared, signed and witnessed, a debt, mortgage, claim over a collateral may still create problems long after you believe it has been resolved.

This is why a Deed of Release or Discharge is important.

A Deed of Release/Discharge is a legal document that officially frees a person or property from a debt, mortgage, claim or other legal obligation.

It serves as clear evidence that the liability has been settled and that the person who should enforce it has formally given up that right.

Without this document, you may struggle to prove that a duty has been discharged.

A property may still be tied down, a transaction may be delayed or an old claim may unexpectedly resurface, placing your property or business investments at risk.

When you have a land/building or business transaction, know that payment alone will not give you complete legal protection.

It is the right legal documentation that closes the chapter.

A good Property and Business Lawyer will ensure the Deed of Release/Discharge is properly drafted, legally valid and fully protects your rights and interests.

True legal protection is not only about creating rights, it is also about bringing a legal duty to an end.

WHEN BUYING LAND/BUILDING IN NIGERIA, CONSULT A LAWYER

Before you pay for land and/or building in Nigeria, let a good Property and Real Estate Lawyer confirm that you are buying it safely?

Buying land/house is a big financial decision, yet many buyers spend weeks negotiating the price but fail to spend a few hours with a good Property Lawyer.

This mistake has left countless people with fake documents, disputed ownership, court cases and painful financial losses.

A property transaction is far more than paying money and collecting papers. The real question is: are you buying a property that the law recognizes as yours?

A good Property and Real Estate Lawyer protects you even before you pay.

He will verify ownership, investigate the property's history, identify hidden legal problems, draft/prepare the right legal documents and ensure the transaction complies with law.

Whether you are in Nigeria or in the diaspora, never assume that because a land/house looks genuine, it is legally safe.

A convincing seller, a trusted agent or impressive documents are not substitutes for proper legal due diligence.

The cost of engaging a Lawyer is little compared to the cost of buying the wrong land/building. Once your money is gone, recovering it can be difficult or impossible.

At Apex Chambers, we advise that the safe property purchase is the one backed by sound legal guidance from the very beginning.

Before you buy any land or house in Nigeria, consult a sound Lawyer.

Avoid wahala.

NEVER BUY A LAND/HOUSE IN NIGERIA WITHOUT A PROPERTY LAWYER

One of the easiest ways to lose your money is to buy land/building without your Property Lawyer.

A beautiful land/house, a friendly seller/realtor and a tempting price can make you eager to pay.

Fraudsters know this. Many people lose millions of Naira because they bought land/house without first consulting a trusted Property/Real Estate Lawyer.

Buying land/house is not just about paying money and collecting documents.

It is about confirming that the seller truly owns the property, that no one else has a legal claim to it, that Government regulations have been complied with and that the transaction will stand the test of time.

A Property Lawyer carries out full legal investigations.

He examines ownership documents, verifies the property's history, identifies unseen legal issues, prepares the appropriate legal documents and ensures your investment is properly protected.

Never rely solely on the assurances of an agent, Surveyor, friend or family member.

They have important roles, but none can replace the legal protection a good Property Lawyer provides.

Many people only look for a Lawyer after they have been defrauded. By then recovering the money or property can be difficult, expensive or impossible.

At Apex Chambers, we believe every land/building purchase deserves solid legal protection. Do not wait until problems arise; prevent them.

Before you buy any land/house in Nigeria, get a Lawyer.

LETTER OF ADMINISTRATION

A loved one passes away and instead of peace, the family is thrown into confusion.

Bank accounts are frozen. Land/houses cannot be sold or transferred. Businesses become stagnant.

Everyone believes they have a right, but no one has the legal authority to act.

This is where you need a Letter of Administration.

A Letter of Administration is a court-issued document that authorizes qualified family members to legally manage and distribute the property/assets of a person who died without leaving a Will.

Without it, dealing with the late person's property, investments or business interests can become difficult, delayed or even unlawful.

Many families make the big mistake of relying on oral agreements or family meetings.

But the law does not recognize emotions as legal authority. It recognizes properly issued legal documents.

The process involves strict legal requirements, court procedures and supporting documentation.

Whether you are in Nigeria or in the diaspora, if a loved one dies without a Will, do not rush into sharing or selling his/her property.

First, get proper legal guidance.

An experienced Property and Business Lawyer will guide you through the entire process, protect the estate from complications and ensure the assets are lawfully administered.

Apex Chambers advises that estate administration is about preserving families, protecting legacies and ensuring that what a loved one worked for does not become the cause of lasting conflict.

WHEN YOU NEED A DEED OF PARTITION

Many people inherit land/building together, buy property with friends or invest alongside business partners.

At the beginning, everyone is okay because there is trust. Years later, things change.

One person wants to sell, another wants to build, while someone else refuses to cooperate.

Before long, the property that was meant to create wealth becomes a source of endless issues.

That is why you need a Deed of Partition.

A Deed of Partition is the legal document that divides jointly owned land, building or other property amongst co-owners, converting joint ownership into separate ownership.

It protects each person's property rights by stating exactly what belongs to whom, making future sales, development and ownership easy.

However, it should not be copied from the internet, but prepared by a Lawyer.

A poorly drafted Deed of Partition can create fresh disputes, overlapping interests, registration challenges and avoidable court cases.

If you own property jointly with anyone, do not wait until relationships break down before putting your affairs in order.

An experienced Property and Business Lawyer will ensure the document is legally valid, properly structured and capable of protecting everyone's interests.

Apex Chambers emphasizes that the best legal documents are the ones that prevent disputes.

Protect what is yours.

POWER OF ATTORNEY

A Power of Attorney is a legal document that allows another person to step into your shoes and act as if they were you. But it should be carefully prepared.

By signing a Power of Attorney, you authorize another person to make decisions or carry out specific acts on your behalf.

Depending on the powers you grant, that person may deal with your property, business or other important matters.

That is why every Power of Attorney deserves careful attention.

A Power of Attorney may be revocable or irrevocable. A Revocable Power of Attorney can be cancelled with a well prepared Deed of Revocation.

But an Irrevocable Power of Attorney, if granted in exchange for something valuable (like money), may not be easily withdrawn just because you have changed your mind.

So do not assume that every Power of Attorney offers the same level of legal protection. It does not.

A poorly drafted document can give away more authority than you intended, expose your assets to unnecessary risk or trigger expensive legal issues.

Before granting or accepting a Power of Attorney, consult a reliable Property and Business Lawyer.

The right legal help ensures that the document reflects your intentions, protects your property and business interests and eliminates mistakes.

Whether you are in Nigeria or abroad, get a Lawyer to prepare a legally sound Power of Attorney that gives you maximum legal protection.

WHEN YOU NEED A SUB-LEASE AGREEMENT

A lot of Tenants assume they can just hand over part of their rented property to another person. It does not work that way.

If you hold a valid lease for 3 years or more, the law is that you can transfer part of your leasehold interest with a Deed of Sub-Lease.

But do not forget that even after creating the sub-lease, you remain legally bound to your Landlord.

If the sub-tenant breaches the agreement, you may still be held responsible under the original lease.

That is why a Deed of Sub-Lease is very important. It is the legal document that defines the rights, interests and duties of the Landlord, Tenant and sub-tenant.

If it is not properly drafted, misunderstandings over rent, maintenance, possession, duration, liability or termination can quickly get out of control.

Do not rely on promises or documents downloaded online.

Every property transaction is different, and a poorly prepared sub-lease can expose you to financial loss and avoidable wahala.

So before you grant or accept a sub-lease, get an experienced Property and Real Estate Lawyer to prepare the document properly and solidify your legal position.

Whether you are in Nigeria or living abroad, a very good Lawyer will provide you with practical, legally sound solutions that protect your interests and give you confidence in every property transaction.

Get a Lawyer.

DIFFERENCE BETWEEN GROUP OF COMPANIES AND CONGLOMERATE

Many business owners focus on registering a company but pay little attention to how it should be structured.

That can affect investment, taxation, expansion, risk management and the future of your business.

One confusing area is the difference between a Group of Companies and a Conglomerate.

A Group of Companies are related or complementary businesses operating under one parent company.

They support one another and often serve the same market. An example is a real estate company, a construction company and a property management company under one parent.

A Conglomerate, on the other hand, owns businesses in completely unrelated industries.

One company may own a bank, a manufacturing business, a hotel and a farm.

The right structure is not just a business decision; it is a legal one.

It affects ownership, regulatory compliance, taxation, governance, liability and long-term growth.

Choosing the wrong structure can create expensive legal and financial challenges for you later.

Before setting up a holding structure or expanding into new businesses, speak with an experienced Business, Corporate and Commercial Lawyer.

Proper legal guidance from the beginning will help you avoid making expensive mistakes.

At Apex Chambers, we advise people in Nigeria and in the diaspora to build business structures that are legally sound, commercially viable and built for sustainable growth.

NEVER BUY LAND/HOUSE IN NIGERIA WITHOUT A PROPERTY LAWYER

The day you buy land/building in Nigeria wrongly, you lose your peace of mind.

Good intentions do not give legal protection.

If you are buying land/house in Nigeria, engage an experienced Property Lawyer before you pay any money.

A beautiful land/building can have a faulty ownership. Genuine-looking land/building documents may still have court case, Government acquisition, unpaid obligations or competing claims.

Even a trusted seller or realtor will not give you the legal protection that only proper due diligence (investigation) can.

An experienced Property Lawyer looks beyond what your eyes can see and verifies ownership, investigates the property's legal history, conducts searches, uncovers risks, negotiates on your behalf, drafts/prepares proper purchase documents and guides you through all legal requirement until your ownership is secured.

Dodging this to save money may become the most expensive mistake you can ever make as a buyer.

Many people have lost so much money by buying land/building with legal issues that could have been discovered before payment.

Whether you are in Nigeria or anywhere in the world, never let pressure, excitement or a "limited-time offer" stampede you.

Buy smart. Let the law protect your investment before your money leaves your bank account.

At Apex Chambers, we always emphasize that the best property deal is not the cheapest or the quickest, but the one that is legally safe.

COMPANY SHARE CAPITAL

Did you know that your company's future can be decided before your business even begins operations?

One big mistake entrepreneurs make is treating company share capital as just another registration requirement.

How you allot share capital determines who owns your company, controls it, earns from it and how it grows.

Share capital is the money invested in a company in exchange for ownership rights. It determines the percentage each shareholder owns, their voting rights and financial entitlements.

Choosing the wrong share structure can trigger ownership issues, investor conflicts and expensive legal troubles tomorrow.

It also affects your company's ability to attract investors, secure financing and meet important legal and regulatory obligations. You do not want that. Do you?

A poorly structured company may struggle to grow, raise capital or properly utilize business opportunities.

So do not see company registration as mere routine.

Get a trusted Business, Corporate and Commercial Lawyer to structure your share capital to reflect your business goals, protect your interests and provide room for future expansion.

Whether you are starting a business from Nigeria or investing from the diaspora, be intentional.

Start your business on a legally sound footing.

At Apex Chambers, we advise entrepreneurs and investors to structure and register companies that are built for growth, compliance and long-term success.

WHEN BUYING LAND/HOUSE IN NIGERIA, GET A PROPERTY LAWYER

One wrong land/house purchase can wipe out your years of hard work in the blink of an eye.

That is why you should never rely on promises.

Before you pay for any land/building or other property in Nigeria, consult an experienced Property Lawyer.

Buying land/house is one of the biggest financial decisions, yet many buyers rush it because the seller sounds convincing, the estate agent/realtor appears trustworthy or the price is irresistible.

Sadly, legal problems are not visible during inspection.

They are revealed through proper legal due diligence (investigation) by a Property Lawyer who will investigate the ownership, verify the authenticity of the land/building documents, check for Government acquisition, court cases, mortgages, disputes, issues and other legal risks that could threaten your property investment.

The Property Lawyer will also prepare the purchase documents to ensure your interests are fully protected before you pay any money.

Without these, you run the risk of losing millions of Naira to fraudsters, defective ownership or avoidable litigation.

Many buyers only discover serious problems after payment, then recovering their money becomes difficult or impossible.

Whether you are in Nigeria or the diaspora, never allow pressure, excitement or attractive pricing to replace sound legal advice.

At Apex Chambers, we urge you to protect your investments with legal due diligence and legal guidance.

WRITE A WILL NOW

One of the greatest gifts you can give your family is not wealth alone, but a legally protected plan for that wealth.

Too many families are torn apart after the passing on of a loved one because no valid Will was prepared.

Then assets become trapped in disputes, businesses suffer and relationships that took decades to build are destroyed so fast.

A Will is your voice after you are gone. It gives binding legal instructions on how your properties, businesses, investments and debts should be managed and distributed.

It also allows you to appoint trusted executors and make provisions for loved ones.

Without a valid Will, the law (not you) may determine how your properties will be shared.

That may not reflect your wishes and can cause costly delays, court cases and serious family quarrels.

So do not copy a Will from the internet or written without the legal guidance of a trusted Property/Real Estate and Business Lawyer who will ensure your Will complies with the law, reflects your intentions, protects your assets and reduces the risk of future challenges.

Whether you live in Nigeria or abroad, if you own land, buildings, businesses or other valuable assets in Nigeria, making a Will is a wise legal decision.

At Apex Chambers, we advise that property planning is about protecting your legacy and your loved ones.

Do not leave your family's future to uncertainty.

Write a Will now, let your final wishes be carried out exactly as you intended.

WHEN SUB-LETTING, HAVE A SUB-TENANCY AGREEMENT

One careless sub-letting decision can drag a Landlord, Tenant and sub-tenant into unnecessary issues.

That is why you need a Sub-Tenancy Agreement.

A Sub-Tenancy Agreement is a legal contract with which a Tenant rents out part or all of a rented property to another person, known as the sub-tenant.

When well prepared by a Property Lawyer, it sets out the rent, duration, duties, rights and remedies of everyone involved, giving each party solid legal foundation.

Many people wrongly assume that an oral agreement or a handwritten note is enough.

A poorly drafted or incomplete document can create confusion over rent, repairs, possession, liability for damage and even who has the legal right to stay in the property.

Those mistakes frequently end in costly disagreements and litigation.

Before any tenant sublets a property, the terms of the main tenancy should first be examined.

In many cases, the Landlord's consent may be required. Ignoring this step can amount to a breach of the tenancy and exposes the Tenant and Sub-Tenant to avoidable legal consequences.

Get an experienced Property Lawyer to prepare or review your Sub-Tenancy Agreement.

At Apex Chambers, we emphasize that every agreement should be carefully prepared, in order to protect your interests, reduce legal risks and help prevent disputes.

Sublet without running into avoidable issues.

WHY YOU NEED A TENANCY AGREEMENT

Whether you are a Landlord or a Tenant, never treat a Tenancy Agreement as just another document.

It is the legal foundation of tenancy and a strong tool for preventing tenancy problems.

A well prepared Tenancy Agreement clearly states the rent, duration of the tenancy, payment terms, rights, duties and remedies available to the Landlord and the Tenant.

It ensures that they understand their roles before the tenant pays one Naira or moves into the property.

Without a Tenancy Agreement drafted by a Lawyer, avoidable misunderstandings can quickly get out of hand.

Disputes over rent increase, repairs, caution fee, damage to the property, termination of the tenancy or recovery of possession often arise because the parties failed to set out clear terms from the beginning.

So every Landlord and Tenant should engage a good Property/Real Estate Lawyer before making or signing a Tenancy Agreement.

The Lawyer will prepare a comprehensive agreement, ensure it complies with law, protects your interests, anticipates issues and provides practical legal solutions before problems arise.

At Apex Chambers, we believe that legal disputes are best prevented.

A proper Tenancy Agreement gives both Landlord and Tenant certainty, confidence and the legal protection they need from the very first day of the tenancy.

Tenancy should be enjoyed, not endured.

HAVE A TENANCY AGREEMENT

Many Landlords and Tenants believe promises and trust are enough when renting a house. Wrong.

A tenancy without a comprehensive Tenancy Agreement prepared by a reliable Property/Real Estate Lawyer will lead to disagreements over rent, repairs, possession, unpaid bills, property damage or wrongful eviction.

A Tenancy Agreement is a legally binding contract between Landlord and Tenant.

When prepared by an experienced Property/Real Estate Lawyer, it states the rent, duration of the tenancy, rights, duties and legal remedies available to both parties.

It removes uncertainty and ensures everyone knows exactly where they stand, before money is paid or possession is given.

Whether you are a Landlord (in Nigeria or living abroad) or a Tenant, never move into or hand over a property without a well drafted Tenancy Agreement.

A poorly written document or one copied from the internet will not protect your interests when problems arise.

An Property/Real Estate Lawyer will prepare legal documents, ensure the agreement complies with law, reflects the parties' intentions, anticipates issues and provides strong legal protection if disagreements occur.

Apex Chambers believes that preventing legal disputes is always better than fighting them.

The right Tenancy Agreement gives Landlord and Tenant covering to begin the relationship on a clear, secure and legal foundation.

Have that Tenancy Agreement, for your own good.

DO THIS WHEN BUYING LAND/BUILDING WITH C OF O

When buying land/house with a Certificate of Occupancy (C of O), do not stop at signing a Deed of Assignment.

Many people feel that once they pay for land with a C of O, they automatically become the owner. This mistake expose many people to avoidable disputes, losses and long years in court.

When you buy land covered by a C of O in Nigeria, an experienced Property/Real Estate Lawyer should prepare a Deed of Assignment for you, to legally transfer ownership from the seller to you.

But the process does not end there. With the Deed of Assignment, the Lawyer will apply for and obtain the Governor's Consent and complete registration, as required by law.

These steps strengthen your legal ownership and make your interest in the property secure.

Skipping any of these legal requirements can create serious problems. You may face difficulties proving ownership, selling the property, using it as collateral for loan or defending your rights.

This is why every person, whether in Nigeria or living abroad, who wants to buy land/building in Nigeria, should get an experienced Property/Real Estate Lawyer before paying.

Your Lawyer will conduct proper due diligence (findings), draft the correct documents, process the Governor's Consent, complete registration and ensure your investment is fully protected.

Apex Chambers advises that you acquire land/property the right way, with your ownership legally secure for now and the future.

Buy right.

REGISTER THE RIGHT BUSINESS STRUCTURE

A wrong business structure can expose your personal funds to business problems. That is an issue many entrepreneurs have.

Many people rush to register a business without first knowing the most suitable structure. The structure you choose can affect liability, investor confidence, access to funding, taxation, management and long-term growth.

In Nigeria, business registration is not merely about obtaining a CAC registration certificate. It is about creating a legal framework that protects your interests and supports your goals.

A structure that is perfect for one business may be completely unsuitable for you. The wrong structure can expose you to personal debts, court cases and legal liabilities.

It can also discourage investors, lenders and clients/customers who prefer dealing with properly structured organizations.

The right business structure helps protect your personal assets, enhances your credibility and creates a stronger foundation for your expansion. It sends a clear message that the business is serious, organized and prepared for growth.

So you need a Business/Corporate Lawyer before registration, to assess your objectives, identify potential risks and recommend the structure best suited to your business model.

At Apex Chambers, proper business structuring is treated as a strategic decision.

Build your business correctly from the beginning, for lasting success.

HOW TO AVOID BUYING LAND/HOUSE WITH COURT CASE

One court case can turn your choice property into your biggest mistake.

Imagine paying millions of Naira for land/house, only to discover that the property is tied to a case. Your money may be lost or development plans stalled.

One mistake land/building buyers make in Nigeria is focusing on location, price and documents, ignoring litigation search.

A land/building may look perfect on paper, but if ownership is being challenged in court or a judgment exists against it, the effect can be bad.

Many buyers wrongly assume that if a seller presents documents or an estate agent gives assurances, the property is safe.

Court records often reveal disputes that neither the buyer nor the agent knows about. Buying such property can expose you to losses, legal issues, demolition or years of uncertainty.

So begin a property transaction with legal due diligence. An experienced Property Lawyer will investigate ownership, conducts litigation search, review court records and identify legal risks and prepare land/house purchase documents.

This advice also applies to Nigerians in the diaspora who rely on relatives, friends or agents.

Trust alone cannot uncover a court case. Only full legal investigation will.

Do not pay first and investigate later. Get a reliable Property/Real Estate Lawyer early.

At Apex Chambers, legal due diligence is an effective tools for helping you avoid property mistakes and buy land/building with legal protection.

WHAT TO DO WHEN BUYING LAND/HOUSE FOR YOUR CHILD

Did you know that in Nigeria a person below 21 years may not validly buy or own land/building?

Sadly, this legal rule is often overlooked, creating problems that may only surface years later.

The law is designed to protect young people from complex land transactions.

Land intended for a person below 21 years is expected to be held through a trustee, guardian or legal representative.

If where the land is acquired through inheritance, the ownership may be legally valid.

A parent may buy land in the name of a child without obtaining proper legal advice and years later issues may arise as to the validity of the transaction.

What looked like a a simple purchase can become a legal headache.

Parents buy land as investment for their children, believing they are securing their future. While the intention is admirable, it is proper that you use the right legal structure.

A very experienced Property/Real Estate Lawyer/Barrister will advise you on the safe and legal method of buying and holding property for a person below 21 years.

Proper legal guidance will help protect the investment, prevents future disputes and ensure that the property is enjoyed without avoidable legal complications.

Do not rely on assumptions, but on professional legal advice. At Apex Chambers, clients are regularly guided through these.

When buying land/house, good intention is not enough.

Use the right legal structure and avoid issues.

THE REALTOR BELIEVES THE VENDOR. SHOULD YOU?

One mistake in property transactions is assuming that because an estate agent believes the seller, you should too.

Many realtors rely on the information provided by the seller. They may not know the true ownership history of the land, whether the property is in dispute, affected by Government acquisition or has legal issues.

Sadly, when problems emerge, it is the buyer who bears the loss.

This is why legal due diligence (investigation) is important. Before paying for any land/building in Nigeria, get a Property Lawyer to investigate it thoroughly.

A competent Property Attorney does not rely on assurances but on facts, verified documents, official searches and legal verification.

A proper investigation will reveal whether the seller truly owns the property, ownership documents are genuine, whether there are existing disputes and any Government interest affects the land.

These are issues that cannot be known by trust, appearances or promises.

The risk is the same for Nigerians abroad who depend on relatives, friends or agents to handle property transactions on their behalf. One mistake can result in years of court cases and loss of investment.

As a land/building buyer, know that trust should never replace verification.

This is consistently emphasized by Apex Chambers.

When buying land/house, get a reliable Property Lawyer to check for issues before they become expensive problems.

Investigate that land/building now.

WHEN BUYING LAND/BUILDING IN NIGERIA, CONSULT A PROPERTY LAWYER

The most expensive mistake in land/house transactions is not paying too much; it is buying the wrong property.

Hardworking Nigerians and those in the diaspora lose millions of Naira because they bought land or house without first consulting a Property/Real Estate Lawyer.

By the time they discover ownership issues, forged documents, Government acquisition or hidden issues, their money is gone.

When buying land/building in Nigeria, the right approach is to consult a Property Lawyer before paying.

He prepares purchase documents, verifies ownership, conducts due diligence (investigation), confirms the authenticity of documents, investigates the property's legal history, checks for Government interests and identifies risks that a buyer may never notice.

Many buyers rely on estate agents, family members, friends or the seller's assurances.

Sadly, trust alone cannot secure an investment. A property may look genuine, be fenced or even have documents and still have serious legal problems.

For Nigerians living abroad, distance makes it difficult to personally verify facts on ground, making legal representation important.

A Property Lawyer ensures that you know what you are buying, who owns it and whether it can legally be transferred to you.

Smart buyers investigate before they pay, not after they have been scammed.

Buy smart. Consult a Property Lawyer before buying land or building in Nigeria.

TRUST IS NOT A LEGAL STRATEGY

Trust can make you comfortable, but only proper legal protection can keep your property and business safe.

Everyday people lose valuable properties, businesses and investments because they relied on friendship, family ties, promises or goodwill instead of proper legal documentation.

Trust is not a legal strategy.

In property and business transactions, what protects you is not what someone promised you. It is what can be proven and enforced tomorrow.

Many people buy land/building from friends, enter partnerships with relatives, lease properties based on verbal discussions or invest in businesses without proper legal documentation.

Everything may seem fine until disagreements arise. Then memories will differ, promises are denied and relationships break down.

A properly prepared Agreement states the rights, duties, timelines, payment terms, ownership interests and remedies available. It removes uncertainty and reduces the risk of fraud, disputes, losses, and lengthy court cases.

Property and business transactions should be handled or reviewed by a Property and Business Lawyer.

This also applies to Nigerians in the diaspora who fund transactions they cannot physically supervise.

pex Chambers reminds you that that legal problems are easier and cheaper to prevent than to fight. Before you pay, buy, sign, invest, partner, lease or transfer ownership, have an enforceable written Agreement.

A well prepared legal document will speak for you.

IMPORTANCE OF LEASE AGREEMENT

Many property and business owners discover their mistakes only after a dispute begins.

A businessman leased a warehouse for five years based on text messages.

At first everything went smoothly. Then the Landlord increased the rent unexpectedly.

The tenant objected. Both parties insisted they were right, but neither could show the terms they had agreed on.

What should have been a profitable business relationship quickly became an expensive conflict.

In Nigeria, a Lease Agreement is not a mere formality. It is a legally binding document that contains the rights and duties of both parties.

The law is that when land or building is rented for three years or more, a Lease Agreement must be prepared.

It should clearly state the duration of the lease, rent amount, permitted use of the property, maintenance duties, renewal rights and other key terms.

Many people make the mistake of downloading templates, copying Agreements or relying on non-Lawyers to prepare legal documents.

Sadly, a poorly drafted Agreement can create serious legal and financial problems.

Whether you are a landlord, tenant, investor or business owner in Nigeria or the diaspora, get a competent Property and Business Lawyer to ensure your interests are fully protected.

Apex Chambers emphasizes that proper legal drafting helps you avoid issues, reduce risks and have solid agreements.

A well-drafted Lease Agreement does not merely record a transaction; it fully protects you.

IMPORTANCE OF ILLITERATE JURAT IN WRITTEN AGREEMENT

A missing clause can invalidate an otherwise valid written Agreement.

An elderly man agreed to sell his land. The price was paid, documents were signed and everyone believed the transaction was complete.

Much later, a dispute arose. The seller claimed he never understood what he thumb printed because he could not read the document.

What looked like a concluded transaction suddenly became a serious legal problem.

This is why the law requires an illiterate jurat in property and business agreements involving a non-literate person.

An illiterate jurat is a written endorsement that the document was read and explained to the illiterate person in a language he understands before he put his thumbprint in place of a signature.

Many people believe that a thumbprint alone is enough. It is not.

The law wants evidence that the person understood the nature and effect of the transaction before consenting to it.

Without a properly drafted illiterate jurat, a document may face legal challenges. A party may later argue that the agreement was not explained or that consent was not properly obtained. Such issues can threaten valuable land transactions and business arrangements.

This issue affects Nigerians at home and in the diaspora.

So involve an experienced Property and Business Lawyer from the beginning. He will ensure that every legal requirement is complied with, and that the agreement is valid and enforceable.

HOW TO AVOID BUYING GOVERNMENT ACQUIRED LAND

A land/building purchase deal can look perfect now and become a legal disaster tomorrow.

A man living abroad was excited when he found a piece of land with building in Nigeria through a trusted contact.

The location was attractive, the price seemed reasonable and the seller had documents that appeared genuine.

Without carrying out proper legal checks, he paid for the property.

Months later, he got to know that the land had been acquired by Government. His money and dream project gone.

One big mistake land buyers make is assuming that documents alone prove that a land/building is safe to buy. A land may have documents and still carry serious legal problems.

A buyer who fails to investigate the true status of land/house risks losing money and the property. Developments on the land may be demolished.

So get a good Property/Real Estate Lawyer before paying. He will conduct official searches, examine ownership records, review survey documents and identify legal risks.

This advice also applies to Nigerians in the diaspora who rely on agents, relatives or friends when buying land/building in Nigeria.

To be safe, do not buy and then investigate later. Carry out proper legal due diligence before committing your money.

A Property Lawyer will help you avoid mistakes and secure genuine ownership.

A prudent property investor seeks legal guidance from reputable Lawyers/Law Firms.
