Generally those that make settlement visa applications should get a response within 3 months, although they have noted that it can take up to 6 months on the UKBA website. The update your receiving at the moment is not unusual.

We can confirm that the Tribunal has received an appeal and the reference number is quoted above.  We can also confirm to you that the payment has now transferred successfully into our Tribunal’s bank account.
 
The Immigration & Asylum Chamber will send notification to all parties to the appeal confirming the immigration status in due course.
 
Please be advised that an appeal to the Immigration & Asylum Chamber can take 6 to12 months to be concluded.

It normally takes them about a couple of weeks from when the payment has been registered on their system to then send the bundle to Sheffield. They haven't mentioned when they received this payment so I would advise that you give the Tribunal office a call mid next week to find out if they can give u an indication of when or if your appeal has been sent for consideration. You should receive the acknowledgement letter with the deadline a few days after your case has been sent to Sheffield.

To God be the glory and Special Thanks to Justwise, Girlfio, Ebeano49 and all forum mates who has helped me through out my appeal process. May the good lord continue to bless you guys . I pray God should answer the prayers of the rest of the forum mates that are still waiting and favour them

Will dey see it has a new evidence for a new application... Just worried.
No, it's not new evidence, as long as its a report on the suitability of the accommodation noted on the initial application it'll be fine. All is well.

comfortmuniru: hi people, am here again, i just got a mail from sheffield that they have reached a decision that my sponsor should send a a big size envelope to them so they can post the supporting documents to him. that they have reached a decision. and my application is just 1 month old. i dont think i got it, because it seems really fast. normally i hear it take like 3months.that they wont dispatch my passport till i send in envelope. so my hubby has gone to send the envelope to them. please did anyone get a spouse visa in one month.
Our initial application was refused after one month so I was under the impression that generally the quicker the response the less likely it is that the application is successful. That was until I started seeing people get refused after 3 months. I've also helped out friends that made spouse applications in the UK and got their visa approval within hours. In a nut shell, it's just not possible to suggest that the answer is not favourable based on the time they take. Just believe the best until u know otherwise. I pray that it all goes well, keep us updated.

Do u get update email from them when the passport is sent back to Nigeria ?
Do you have to call lekki VAC for the update ?

We didn't receive any update. Once your passport gets to Sheffield, they should send it back to Nigeria within a week. Best thing to do is email Sheffield about a week after delivery to confirm that it's been sent back. Give it a few days after its been sent back, if Lekki VAC don't contact u, just turn up at their office with the email from Sheffield, it should then be available for u to pick up.

I could be wrong but I was under the impression that all refusals with limited appeal rights can be put forward by the applicant for reconsideration. If not it might still be worth sending, they have been known to do the unexpected. You could reapply at the same time which will give u some options.

Due to the type of visa your rights of appeal are limited to breeches in human rights or ECO misunderstanding of your submitted documents. Your option at this stage is to go down the route of an administrative review. You cannot submit any additional documents but what you will need to do is point out where the ECO needs to reconsider his decision based on the information you've already provided. All you have to do is put together an email to the visa office where u submitted your application requesting an administrative review of your case. List each of the points of refusal and note how your submitted documents support your case. Draw their attention to the fact that the applicant has a good immigration history, highlight his ties to Nigeria. You also need to focus on where it makes clear that funds are available to him from the business accounts. This process can take up to two months.

Alternatively you can apply again making sure u provide all the necessary documents that will meet the points of refusal. Since he has a good immigration history, its less likely that they will find something else to refuse him on.

I'm not sure about the British consulate route, maybe someone else on this forum knows about it. Might be worth your husband going down there, if nothing else to find out if there is anything they can do.

I pray this all works out well for u and your family in the end.

I was looking at your previous post and I can see that you've confirmed with Leicester that they've received your appeal forms, just waiting for the payment to be processed. Now, it can take them a couple of weeks after the money has come out of your account for it to be registered on their system. I would have thought that as the applicant, they would respond to your emails, if not then its probably worth getting the sponsor to either email or just give them a quick call. They may be able to verify for you that payment has been taken but not registered.

Sheffield will not have a record of your case at this stage. About a couple of weeks after your payment is registered with Leicester, your bundle will be sent to Sheffield, at which point u will get your notice of appeal with the 19 week deadline. I'm not sure what forms your lawyer is talking about, maybe they are referring to the appeal notice. The tribunal should already have details of the representative and sponsor from the appeal form.

All you need to do now is confirm with Leicester that your appeal has been logged and that they are processing the payment.

thething: Hi everybody. I just turned in my Admin Review for my tier 4 visa Monday at the British High Commission in New Delhi India. Does anybody know where the Admin Review is done, is it sent to the UK? How long should I should expect this process to take, is the 28 days a realistic expectation?
The UKBA website stipulates to not send your admin review request to any immigration tribunals in the UK as they are not dealt with by HM Courts and tribunal services. I expect then, that even if the decision was made in the UK, like Sheffield for Visa applications made from Nigeria, that the process is facilitated by the office where the initial application was made. In terms of timings, someone on this forum put in their admin review in August and got their visa in October. It however, all depends on the case. It might be worth checking out a visa forum for New Delhi applications to get a better picture of how these reviews are currently being managed.

Don't worry, that happened to me a couple of times. They do usually get back to you on the same day but sometimes they can delay. Just send them another quick email and note that you have not had a response. It's unlikely that they'll b looking at your case just yet so they may give u a generic response but you've got less time ahead of u than behind. I pray that, if not before, this time next month we'll be getting ready to receive your good news.

Hi Ebeano, they didn't take very long to get the passport back to my husband. It arrived in Sheffield on the Monday and was back at the Lekki VAC in Lagos by the following Monday, so it took them about a week to process it. My husband didn't get the phonecall from Lekki. We emailed Sheffield on Tuesday, they confirmed that the passport should have been received, my husband just turned up at their office and collected it. I would say that you should email them next Monday, confirm that your passport has been sent back. If it has been then just give it a couple of days, even if you haven't received a phonecall from Lekki just turn up at their office with a copy of your email from Sheffield confirming that it has been sent.

Ebeano49: It is with indescribable joy that I inform the house that my wife received an email from Sheffield this evening advising that her refusal has been overturned!! We will be forwarding her passport to Sheffield first thing tomorrow morning via DHL. I thank everyone in this forum for all your advise, support and prayers. We are yet to log this appeal on our system if we have received the bundle from the Courts and Tribunals Service.  When it is received and logged it will be reviewed by and ECM before the closing date in December.

Still doesn't make any sense, the only way you can have a deadline date is if your appeal has been logged on the Sheffield system. It might be worth just sending them another email. Give them your name, date of birth, appeal ref number. Ask them to confirm your deadline date for ECM review. If they still say its not on their system then go back to the Tribunal to confirm when/if your bundle has been sent.

Your 19 week period will start from the date that your bundle is received by the Sheffield office. Once you've received notification that its been sent you can send them just a quick email to confirm they've received it. They usually tend to have the ECM review cases at around the 14 week period.

Hope you get a positive response when you get in touch with the Tribunal office.

About 2 weeks after the payment is processed you should then receive a notice of pending appeal which will give you the 19 week deadline date. This is sent after the bundle is posted off to the Sheffield office for ECM review. Have you called the Leicester Tribunal office to find out if your bundle has been sent?

Not sure why your emails are not getting through. Maybe check the address u are sending it to. If u miss one of the full stops, it won't go through properly. Try again by copying and then pasting the Sheffield email address I noted in my previous message. Let me know if u still have problems.

Ok. First you need to confirm that the £140 appeal payment has been made. Once you have evidence of that call the Leicester office (Tribunal office) on (0044) 0300 123 1711. If they do not recognise your appeal reference they should be able to do a search on the applicants name/date of birth. Let them know that you have evidence of payment and want to confirm that your bundle has been forwarded to Sheffield. The Sheffield office do not have an advertised telephone number so I'm not sure which office you've been contacting. You should get an automatic reply confirming delivery of your email, the address is visasheffield@homeoffice.gsi.gov.uk. As long as you can prove at this stage that payment has been made they should then be able to track the whereabouts of your appeal.

jenni1108: Thanks all for the well Wishes – my husband’s passport has been sent to Sheffield via DHL today (we don’t waste time) should be there by next Tuesday they advised. So now how long will it take for him to get the visa issued and sent back to him in Nigeria, do they send it to Lagos even thou he applied at the Abuja office.
When I emailed them to find out how we would get my husbands passport back they replied that all passports are sent back to the Lekki Vac in Lagos. I would have thought that they would have a solution for those that applied in Abuja though, might be worth sending them an email. It takes about a week for them to send the visa back to Lagos after they receive the passport.

When you emailed Sheffield did u include your appeal reference? If so, I would advise that you reply with a copy of the notification that you received noting the 19 week deadline. Ask them to confirm that your appeal bundle has been received and will therefore be scheduled for ECM review.

We didn't receive notification of payment, maybe that's something they've recently started. I expect by now that they should be getting ready to send your bundle to Sheffield. Might be worth your spouse calling the Leicester office for an update. Once it's sent to Sheffield, the representative noted on your appeal form will receive a notification which will include your 19 week deadline date.

Might be worth checking with Sheffield first, unless the rules have changed, I read somewhere that if you've made an application outside of the UK and you happen to be here when your application is accepted you have to go back to the Nigeria to send and receive your passport. I could be wrong but it might be worth checking out.

My husband has just received an email from the UKBA informing him that the initial decision has been over turned and he should send his passport to Sheffield.

Can he send it to me and I forward it or should he send it directly.

Your husband needs to send the passport directly from Nigeria to Sheffield, we used DHL, they won't accept the passport from a UK address.

Its normally during this period that they start looking in to your case, then all things being well you should then hear from them about the 16th week. Not sure if this is always the case but it appears to be whats been happening recently. I know how difficult it is at this stage, for me those last few weeks felt like it was never going to end but you've provided them good evidence to support your case. It shouldn't matter about the first 4 months, as long as you simply explained that your relationship was casual at the start and therefore communication during this period was minimal.

God is with you and He shall confidently walk you through the last steps of this journey.

This timeframe has passed and I am wondering where I go from here as the email I sent required someone actually doing some work so was wondering if this is the reason or if this is a usual thing.
The same thing happened to me when I sent the same sort of email. Its likely that what they've done is forwarded it on to the ECM for consideration but they won't tell you that's what they've done. Just send them a quick follow up email and ask if your request has been forwarded on for consideration.

If they refuse your application under 320(11) listing aggravating circumstances then you'll need to do one of two things, either produce evidence that proves you did not do it or explain your reasons why the offense was committed. Don't worry too much about the appeal at this stage, focus on building a really good application, if you get refused then you'll know what your dealing with and can then respond appropriately. This process can be long and sometimes painful but it has purpose, the past is the past but remember you are now investing in your future. It will all work out in the end.

Funkybaby has given you some amazing advise. The most important thing here is that you provide evidence that determines your relationship, his income and where you will live. The ECO will look to refuse your application based on immigration policy 320 (11), stating that your actions have frustrated immigration law. I suggest that you copy and paste this policy from the UKBA website as below and note that although you have frustrated immigration law by overstaying you have no aggravating circumstances that would allow them to apply this breech to your case (for the list of aggravating circumstances follow this link http://www.ukba.homeoffice.gov.uk/policyandlaw/guidance/ecg/rfl/rfl7/.

Focus on putting together a strong application with all necessary documents and put your faith in God that He will make ALL things possible. God did it for me, he'll do the same for you.

RFL7.1 When can I refuse under 320 (11)?

This is a discretionary refusal where an applicant has:
been an immigration offender or in breach of UK immigration or other law; and / or
received services or support to which they were not entitled;

and where there are aggravating circumstances.

It is not sufficient to have been in breach of immigration law or to be an immigration offender. There must be aggravating circumstances as well.
