A Federal High Court sitting in Abuja on Friday granted an order of stay of proceedings in a suit challenging the plan by the Independent National Electoral Commission to use the smart card reader for the conduct of the forthcoming general elections. Justice Adeniyi Ademola’s order of stay of proceedings is to subsist pending the determination of an appeal by the All Progressives Congress and some other defendants challenging a March 13, 2015 ruling of the court. The APC had appealed against the decision of Justice Ademola abridging the time within which parties are to respond to the suit. Apart from APC, other respondents in the suit are the Civil Empowerment and Rule of Law Support Initiative and the Fiscal and Civil Rights Enlightenment Foundation. Only INEC did not appeal against the March 13 ruling of the judge. But the two groups had, in addition to filing their appeal against the court’s ruling, filed separate applications for stay of proceedings before Justice Ademola. Former Rivers State Commissioner of Police and current Assistant-Inspector General of Police in charge of Zone 2, Lagos, has said he was misquoted by reports that he ordered policemen to kill 20 civilians for every officer killed in the coming general elections. Mbu in a statement signed by the Zonal Police Public Relations Officer, Mr. Olugbemiga Adeoye, explained that he only “advised his policemen not to be cowardly but to be guided by Force Order 237 on the use of their firearms.” According to him, the firearms are not only meant to defend themselves but also others “including fellow police officers when their lives are in danger.” The AIG, who said he was quoted out of context, believes that reports on the issue have been fraught with political undertone. He said such reports were geared towards portraying him in a bad light and as an officer who does not uphold the rule of law. The statement said, “Although policemen are not to be seen with firearms within a specific radius of the polling area, quick response squads will be created to respond to distress calls. “There is no society in the world where policemen will be killed by hoodlums and the perpetrators will be allowed to escape justice.” He said he was also quoted out of context on the alleged order to arrest governors at polling units. “What he (Mbu) said was that no highly placed individuals in the society who have police escorts and other forms of personal guards will be allowed within the voting area accompanied by such retinue of escorts,” the statement said.http://www.punchng.com/news/mbu-denies-order-to-shoot-civilians/

About 34,000 members of the National Youth Service Corps who recently passed out would be deployed to participate in the forthcoming general elections scheduled for March 28 and April 11, the Director-General of the NYSC, Brig-Gen. Johnson Olawumi, has said. He also stated that the NYSC had put in place a watertight strategy to guarantee the safety of corps members taking part in the elections. Olawumi spoke on Friday in Abuja during a news conference ahead of President’s NYSC Honours Award ceremony scheduled for Monday, March 2 which has been approved by President Goodluck Jonathan. At the event, Olawumi put the number of corps members that have been mobilised by the scheme since its establishment in 1973 at 2.8 million. “As at the last passing out, we have 2.8 million (corps members) that have passed through the scheme since its establishment,” he said According to him, out of the 168,000 corps members that were trained by the Independent National Electoral Commission to participate in the elections, 34,000 have passed out and can no longer participate as corps members but as ad hoc staff. He said, “We have 168,000 (corps members) that registered for participation in the election. The 2014 Batch A that registered passed out on February 19. Our plan was to use them for the elections; but because of the postponement of the elections, we realised that we can’t use them again as that would amount to breaching NYSC rules. “They were about 34,000. We wrote to INEC to explain that they would be passing out and that we could not hold on to them. Because they were passing out, it wouldn’t be right for them to participate as corps members. Some socio-cultural groups in the country on Thursday warned against extra-judicial killing and police brutality during the rescheduled general elections. They asked the police and other security agencies that would be involved in the election process to see themselves as part of the larger society whose interest and peace should be promoted. The groups’ warning trailed the threat by the Assistant Inspector-General of Police in charge of Zone 2, Mr. Joseph Ibu, that the police would kill 20 civilians in place of one policeman killed. But the groups asked the police to demonstrate robust tolerance even if provoked, instead of turning their weapons against the civilians. A pan-Yoruba organisation, the Afenifere Renewal Group, particularly warned the police against impartiality and intimidation of hapless civilians during the polls. According to the group, such practices can create a platform for breakdown of law and order. The ARG Publicity Secretary, Mr. Kunle Famoriyo, said the police should complement the effort of the civilians who are interested in making the conduct of the elections peaceful by ensuring that their lives are protected. Famoriyo, who spoke withSaturday PUNCHon the telephone, said the police or any other security agency that spilled the blood of any law-abiding Nigerian during the polls would be held responsible for the act. He said, “From the look of things, it appears that the police and the military are going to make the election tension-soaked. “A lot of Nigerians are determined to vote, but they are asking the security personnel not to intimidate them; the police and the military should endeavour to shun the repeat of what they rehearsed during the last governorship election in Ekiti State. They did something similar to it in Osun State, but the people resisted them and went out to vote. “The security agencies should be held responsible for anything that will prevent peaceful election in Nigeria because they have the history of intimidation in Ekiti and Osun states.” Also, the Founder of Oodua People’s Congress, Dr. Fredrick Fasehun, asked the police to first appreciate the fact that they swore to an oath to protect the citizens and their property while supervising the elections. Fasehun said, “In as much as they are Nigerians and swore to protect the rights and property of the citizens, they are duty-bound to remain impartial no matter the number of attempts to induce them. “They should not be seen favouring one party or candidate against the other; they should be meticulous in handling sensitive issues to prevent violence.” The Northern apex group, Arewa Consultative Forum, not only backed the call on the police to limit their role to the protection of law and order, it said the military had no responsibility in the electoral process.
