(REAL ESTATE REVEALATION SERIES 9).*


The only way to go about it is to conduct a Land search,before purchase the land,ask for the survey plan,the Coordinate inside the survey plan that will give you the information you need about the land,this is what you will take to the Land Registry,this what you will need to confirm whether the land is fit or not fit for Purchase .

The following are the Land that are not fit for buying:

✅ *LAND THAT IS COMMITTED BY THE GOVERNMENT FOR PUBLIC USE:* Land that are under committed acquisition, that is government have committed it for a particular project or purpose,That shows such land have been committed to build schools, hospitals, Roads or Railway,If buy such land your money is as good as gone.
If you see Town Planner Officers or Government Agency mark Some buildings for Demolition that show the land is under Government Acquisition but encroached by Land Encroacher for there selfish Interest,This normally happen when people buy land without doing any Due Diligence.

So if you want to buy Land do your Due Diligence,Go to Land Registry to check the status of the land,the title of the land,the document,Chart the coordinates of the lands to confirm whether that the late is safe and free to invest in,Once you make payment for committed land, your money is as good as gone.

✅ *LAND BELONGING TO SOMEONE WHO IS NOT ALIVE AND IS CAUSING A DISPUTE IN THE FAMILY:*

What is a survey plan Document ? A survey plan is used to show the location and the size of the landed property with the description and Coordinates on the survey document.
A survey plan is a Document that measures the boundary of a parcel of land to give an accurate measurement and description of the land.

*Types of Land Survey Document in Nigeria*
There are two types of survey plan.

1 *. Provisional Survey*:The provisional Survey plan is not a legal document. It is only used in place of survey of a particular boundary and can be used to create a building plan. The Provisional Survey contains the size of the land, boundary and coordinates.Provisional survey cannot be use to get a building plan approval.

2 *. Registered Survey Plan*:This is a legal document. This type of Survey is carried out by a Registered surveyor which is lodged or Recorded in Cadastral Records department of the office of the surveyor- General.This kind of survey have the following features:
Starting Point,Beacon number and Identification number,Land boundaries ,distance and Land marks, Surveyor's Name and signature, Survey plan no and Registration of survey plan with Government

*Features of Survey plan*
✅ The Title of Survey plan ( the name of the owner)
✅ The address and description of the land
✅ The Size of the land surveyed
✅ The drawn out portion of the land surveyed.
✅ The Beacon number
✅ The name of the surveyor who drew up the survey plan and the date it was drawn up.
✅ A stamp showing the land is either free from Government Acquisition or not.

As a Land or Home Owner you need to understand it so that you can have something to Prove you are the Real Owner of a Property.

A lots of people have been scammed because some of them did not understand the Documents that must have before they can call themselves the real owner of a property,some people will buy a land they will only give them family receipt. The following documents are the necessary documents you must have before you can claim a property.

1 *.Receipt* :The Receipt of purchase of Real Property is a document that acknowledges that Real estate company or land owner has received payment for a land or building following the sale of real property.
*Features of a Receipt*
✅ Full name of the seller
✅ Address of the seller
✅ Full name of the buyer making payment
✅ Address of the buyer that made the payment.
✅ Description of the land
✅ Amount paid and balance (if any)
✅ Date of payment
✅ Space of append signature of buyer and seller

2. *Letter of Acknowledgement:* An acknowledgement letter is a Document used by business to formally acknowledge the receipt of a real estate transaction.
It is used to confirm the payment of Real estate transaction between the buyer and Real estate company.

*Sample of letter of Acknowledgement*
I,Ojo Hassan Adesope of No 52,Odoguyan street, Ojota,Lagos, Nigeria hereby acknowledge the receipt of the sum of #2,000,000(two million naira).
The payment was made Olowolagba Adesewa of No 27,biodun lawal street,Ikeja, Lagos, Nigeria as full payment for the purchase of all that Property described as follows:

A plot of land measuring 50ft by 100ft situated in Idado village, Ibeju-Lekki L.G.A Lagos, Nigeria.
The payment was made outright on 2nd October,2021

3. *Contract of sale*:This shows that a transaction has taken place between the Subscriber or Land purchaser and Real estate Company or land owner

*Features of contract of sale*
✅ Full details of the parties(name and address)
✅ Location of the Property
✅ Structure of payment,may be outright or 6 months payment plan or 12 months.
✅ Balance and Interest on unpaid purchase sum where the payment is to be paid in installments.
✅ Risk and Insurances
✅ Completion date of the transaction
✅ Provisions for fixtures and fittings
✅ Specific terms,risks e.t.c

Where a contract of sale has been excecuted between parties an equitable right to the title is passed to the buyers as vendor still retains legal title to the land and holds the same in trust for the buyer.
A vendor cannot transact with the land contrary to the agreement in the contract and no party can rescind the contract without being liable for a breach of contract.

*Important of contract of sale*
✅ In a contract of sale,the vendor is committed to the transaction and the purchaser has sufficient time to investigate the title before the final completion of the transaction.
✅ The death of either party to the transaction does not terminate the contract as personal representatives can proceed with the contract of sale.
✅ A contract of sale prevents last minute withdrawal would amount to a breach of the contract.
✅ A contract of sale protects the equitable interest of the purchaser.
✅ It crystallizes the position of the parties as terms have been expressly agreed upon.
✅ The vendor cannot unilaterally and subsequently increase the purchase price has already been fixed in the contract
✅ Payment of lesser stump duties.

4 *Deed of Assignment*:This is a legal document that shows that seller or the Real company has transferred the property to purchaser and it is always given after conclusion of the property transaction between the buyer and the seller.

It is legal instrument executed between a buyer and seller upon the negotiation and Completion phase of a sale of land transaction, subject to perfection.It is usually demanded by the buyer of the real property at the conclusion of the property transaction as the final legal documents that transfers the interest of title without any conditions attached beyond the payment of the consideration price of the property.
*In a deed of assignment,the nomenclature of parties changes from vendor to Assignor and from Buyer to Assignee*

Upon the execution of a deed of assignment between parties, there is a permanent transfer of legal title and owner to land from the assignor for a consideration paid and accepted by the assignee.

*Difference between Deed of Assignment and contract of sale*
In contract of sale,the buyer only acquire equitable interest in the property while the seller retains the legal interest in trust for the buyer *while* In the deed of assignment,the assignee or land purchaser acquires legal interest in the property .

5. *Survey plan*:This is also an important property Document that helps to reveal the ownership status of the property.It spelled out the size of a parcel of land, with survey plan you can know if the property is committed or not.
*Features of survey fee*
✅ The title of the survey (the name of owner)
✅ The address and description of the land
✅ The size of the land surveyed.
✅ The drawn out portion of the land surveyed
✅ The beacon numbers
✅ The surveyor who drew up the survey plan and date it was drawn up.
✅ A stamp showing the land is free from acquisition or not.

*6.) Title Documents* : This can be Certificate of Occupancy Documents or Governor's Consent Documents, or Gazette Documents ,all this documents are necessary to protect your land from Land Grabbers.

*What is Land Title:* Land Title may be defined as the rights or ownership claim a person has over a property. it simply means for you to claim land title you must show other people the right you have over that land.
*TYPES OF LAND TITLE IN NIGERIA*
✅ Excision
✅ Gazette
✅ Certificate of Occupancy
✅ Governor consent
✅ Freehold

✅ *EXCISION:* An Excision means basically taking a part from whole land and that part that has been excised will be recorded and documented in the Official government gazette of that state.
For example:In 1981, Victoria Island, Ikoyi and Lekki were all part of one big commonly joined together called Oniru and it had no separation to know which area is called Ikoyi, Lekki or V.I then and it has a approximately total area square meters estimate of 100,000 Square meters and the Government is interested that area and decides to take 70,000 square meters for its self, for its own personal use as an urban Area or public Purpose.

✅ A Gazette is an official record book where all special government details are written and recorded.

A Gazette details or show the number of acres of land retained by the government for public use and the number given to the local communities or real estate company.

Furthermore, A Gazette will show the communities or villages or real estate company that have granted excision and the number of acres or hectares of land that the government has given to them. It is within those excised acres or hectares that the traditional family or Community or real estate company is entitled to sell to the public and they will not go beyond the one that is excised to them.

*THE DIFFERENCE BETWEEN EXCISION AND GAZETTE*
To excise a land means to cut it. This is the process whereby the Government releases a parcel of land back to the Indigenous owners of such lands for the purpose of residential and commercial developments.when this excised parcel of land is published in government official gazette and announce in the newspaper such a land is said to have Gazette as Title.

Excision and Gazette are very good Titles for a piece of land,such lands are safe to buy and develop.

✅ *CERTIFICATE OF OCCUPANCY*
A certificate of occupancy, also know as the C of O is a document issued by state governments in Nigeria to landowners and property buyers as a legitimate proof of Ownership.This document explained what the land can be used for, may be residential, Commercial or mixed development.

The government is constructionally mandated to issue the Certificate of Occupancy because all lands in the state are vested in the Governor of the state. This is clearly spelt out in the Land Use Act of 1978.

✅ *Benefits of Certificate of Occupancy*
�It makes the person named on the document the exclusive owner of the land.
�It Prevents a situation where a single Property is claimed by multiple owners
�It is an acceptable as a security or collateral for loans from banks and other financial institutions.
�It is widely used to resolve land disputes that arise from ownership tussle.
�It is a very crucial document during mortgage transactions.

*✅ What is Governor's Consent:*
A Governor's Consent can only be processed on a land with either Gazette or an Existing certificate of Occupancy ( C of O), if a person has a land with certificate of Occupancy decides to sell his land,the only Documents that can give the new buyer or every other subsequent buyer's the right of occupancy or ownership is *Governor's Consent*

✅ *Freehold*
Freehold can be defined as an Estate or property which is free from hold of any entity,that is it is free from Government Acquisition. Hence the owner of such Property can enjoy free ownership for life and it can be used for any purposes (whether Commercial or residential purposes).

This kind of land or Property can be transfer through Deed of Assignment.
