TravelRe: UK Spouse Visa/Appeal Process-part2 by jude2rome: 10:27am On Sep 16, 2016
@Adanewbie1290, it actually happened late last year in November. Although he recently won the appeal, but according to him, when the appeal was going on, the HO lawyer stressed that he lied to the court despite taking an oat by not declaring that he was married. However, when he made his wife's application, he submitted the divorce nisi absolute, which his lawyer was able to convince the judge that if he was hiding that he was married, he wouldn't have submitted the divorce nisi absolute. They acknowledged during the appeal that it was a mistake on his part. This is how he summarized his situation. His previous wife was not contacted.

@Lexusgs430, Good morning. Thanks a lot for responding to my inquery. Yes my divorce was finalised 2years ago and divorce nisi absolute was issued. The documentations (court marriage certificate with the mistake) submitted was for visit visa and it was not a success. We have not put in her settlement visa application. My concern is if the HO will have a record of the court marriage certificate with the mistake when she applied for the visit visa.
As we submitted the divorce nisi absolute to the court, will it not be appropriate for the court to re-issue a marriage certificate with a cover letter if need be? or just a cover letter with the marriage certificate we currently hold? We want to make a straight forward application as the money is high to loose. hence my worry.

Hello everyone.
This forum as been very informative for me after reading from the very page 1 to 198. All thanks to the gurus such as justwise, portsmouth86, lexusgs430 and a lot of others (pls don't be offended if your id is not mentioned). It took 6 days of careful eading and jotting of relevant info as if I was sitting for an examination. This really made it very easy for me to gather all documents required to file for my wife's settlement visa. However, I have an issue which to me, on a good day, is not meant to be an issue. The gist is:

I'm divorced, and got married in lagos - court, traditional and church marriages respectively. the issue I am having is that, on our court marriage certificate, my status was put down as Bachelor prior to the court wedding instead of divorcee. I own up to this mistake as I may have indicated Bachelor on the form when I completed it. A friend of a friend's wife settlement visa was denied because of this mistake, and he was informed by HO that his passport will be taken from him as they view his previous marriage as sham. Now, I have informed my wife to correct this mistake with the registry where we wedded. The person that wedded us has requested that my wife should see her. They also asked my in-law (who is helping us with the correction) if the embassy has seen the current marriage certificate, which they were told no. I do know that HO keep record of documents submitted. My wife had previously applied for visit visa three twice with the certificate and was refused visit visa base on other reasons, and not because of my status on the marriage certificate. I have advised my wife to be truthful by telling the registry that the embassy have seen the marriage certificate before. Now, they are making the whole thing to seem complicated as they are saying that if the embassy has seen this certificate, that there is not point of issuing another, instead they will write a letter addressing the mistake. I just want to ask will writing this letter be appropriate? We don't know what the content of the letter will be.In my opinion, it's meant to be correction of details where we apply for the correction of details, and they follow the process of issuing another marriage certificate with a letter advising the reason if need be. What do you think?

I read about some people asking what is been asked if you are to be interviewd. I came across this blog which I believe with help someone.
