Crime / Two Fathers Raped Their Daughters;one Got 60 Days In Jail, The Other 1503 Year by kerijhison: 8:21am On Oct 25, 2016
Earlier this month, a Montana man who repeatedly raped his 12-year-old daughter was sentenced to 60 days in jail.

Last week, a California man who repeatedly raped his daughter when she was a teenager was sentenced to 1503 years in prison.

Comparisons of the two cases were quickly drawn. Brock Turner's six-month sentence for sexually assaulting an unconscious woman outside a Stanford University frat house was also thrown into the mix.

Just as Judge Aaron Persky, of Santa Clara County, California, found himself besieged by critics over Turner's light sentence, so did Judge John McKeon, of Valley County, Montana, after he handed down a two-month jail sentence to the 40-year-old man who pleaded guilty to incest.

"The victim only had the justice system on her side, and it failed her," reads an online petition calling for McKeon's impeachment.


"Judge McKeon failed her."

Compare that to the reaction to the gargantuan sentence imposed by Judge Edward Sarkisian of Fresno County, California, on the 41-year-old man who raped his daughter for years.

Readers who commented on stories about the case thanked Sarkisian, a California Superior Court judge since 1987.

"This Judge always give great rulings," a Fresno Bee reader commented after Rene Lopez received what amounts to multiple lifetime sentences.
"This is great. This judge set(s) a very good example of all judges to follow," wrote another.

"Bravo. We need to clone this judge," one reader wrote on the Facebook page for the group Justice For Children Without Voices.

"A judge that gets it!!" another said.

Several factors could explain the sentencing disparity between the two rape cases.

For one, the father from Glasgow in eastern Montana pleaded guilty to only one count of incest to receive a lighter sentence. Two other counts were dismissed as part of the plea deal.

Rene Lopez, of Fresno, was found guilty by a jury of 186 felony charges, including 22 counts of rape of a minor and 163 counts of rape. The trial lasted 11 days, court records show.

Lopez could have received a much lighter sentence.

Prosecutors offered him a plea deal twice, the Fresno Bee reported. The first offer could have secured him a prison sentence of 13 years, at most; the second, 22 years. But Lopez rejected both offers and chose to go to trial instead.

According to the Fresno Bee, Lopez raped his then-teenage daughter from May 2009 to May 2013. She was raped two to three times a week, on Christmas and other holidays.

The horrific crimes ended when the girl, who is now 23, moved out. Lopez was arrested in November 2013, after she reported the abuse to police, the Bee reported.

During the trial, jurors were read entries from a diary in which the victim chronicled the crimes against her.

The Washington Post generally does not name victims of sexual abuse.

The Post also is not naming the convicted man from Montana, as it could expose the identity of his victim, who is still a minor.

Testimony given at the sentencing hearings for the two men likely played a significant role in how they were punished.

In a statement explaining his decision, McKeon, the Montana judge, said the victim's mother and grandmother wrote letters asking for the defendant to not be sent to prison, the Associated Press reported. While his actions were horrible, the man has two sons who love and need him, the women wrote.

Nobody spoke on the victim's behalf, according to the AP.

In Lopez's case, the victim testified about the abuse during the sentencing hearing.

"When my father abused me, I was young; I had no power, no voice - I was defenseless," she said, according to the Fresno Bee.

Sarkisian, the judge, called the victim a "courageous young woman."

Lopez, who did not testify at his trial, wrote a letter to the judge saying his daughter lied. He also did not show any remorse, his daughter said in court.

Sarkisian found him to be a serious danger to society. After his daughter moved out, Lopez left love songs on her answering machine and drove by her new home, the judge said.

When she got pregnant, he paid for her abortion, the Bee reported.

In Montana, prosecutors did not challenge a psychosexual evaluation's findings that the defendant could be safely treated and supervised in the community, the AP reported.

McKeon explained that although the plea agreement recommended a sentence of 25 years, it also provided for a lesser sentence depending on the results of the psychosexual evaluation. Under Montana state law, defendants may not face the mandatory 25-year prison sentence for incest involving children age 12 and younger if an evaluation finds that they can be rehabilitated.

Montana's sentencing policies "encourage and provide opportunities for an offender's self-improvement, rehabilitation and reintegration back into a community," McKeon wrote in his statement, according to the AP.

A clinical social worker also testified that the defendant is not likely to commit a similar crime if properly treated. Public defender Casey Moore said the man is remorseful and has cooperated with law enforcement, according to the Glasgow Courier.

McKeon's sentence requires the defendant to register as a sex offender and to communicate regularly with a probation officer. He's prohibited from having any contact with the victim or any minor and from accessing pornographic material.

Prosecuting lawyer Dylan Jensen told the Glasgow Courier that he was "shocked and disappointed" with the 60-day sentence.

But while Jensen said he respected McKeon's decision, the public's fury likely will not dissipate anytime soon: The online petition calling for the judge's impeachment has been signed more than 100,000 times.

It's unlikely to make a difference, however: McKeon is retiring next month.

And according to the National Centre for State Courts, a judge may be only impeached by a two-thirds vote in the state legislature. The state's judicial standards commission also can make a recommendation to the state Supreme Court.

US presidential nominee Donald Trump has again come under pressure as more women claim to have been sexually abused by the billionaire businessman from New York.

The allegations were reported on Wednesday by The New York Times, The Palm Beach Post and Yahoo News.

This comes after the release of a 2005 tape in which Trump is heard making vulgar comments about women and having a conversation about trying to have sex with a married woman.

One woman told the Times she was seated next to the Republican nominee during a flight to New York some three decades ago, and Trump started groping her suddenly.

“He was like an octopus,” Jessica Leeds, now 74, told the paper. “His hands were everywhere. It was an assault."

Another woman, Rachel Crooks, also told the Times that he kissed her without her permission. “I was so upset that he thought I was so insignificant that he could do that,” she said.

The Trump campaign has denied many of the allegations made against him, and called the Times article "a completely false, coordinated character assassination."

"It is absurd to think that one of the most recognizable business leaders on the planet with a strong record of empowering women in his companies would do the things alleged in this story, and for this to only become public decades later in the final month of a campaign for president should say it all," Trump spokesman Jason Miller said in a statement.

"To reach back decades in an attempt to smear Mr. Trump trivializes sexual assault, and it sets a new low for where the media is willing to go in its efforts to determine this election,” the statement added.

“None of this ever took place,” Trump told the Times on Tuesday night, and threatened to sue the publication if the paper went ahead to run the story.

“You are a disgusting human being,” he told the reporter, who contacted him before publishing the story. "I don't do it. I don't do it,” he said.

And in a letter to New York Times editor Dean Baquet on Wednesday night, Trump’s lawyer said the article is an attempt to damage Trump's presidential campaign.

“Your article is reckless, defamatory and constitutes libel per se. It is apparent from, among other things, the timing of the article, that it is nothing more than a politically-motivated effort to defeat Mr. Trump’s candidacy,” Marc E. Kasowitz wrote.

After The Washington Post released a recording last week that shows Trump making vulgar remarks about women, Republican officials, including governors, senators and congressmen across the US have disavowed the billionaire.

Trump’s apology for the remarks also failed to quell the unprecedented controversy over his comments, prompting growing demands by Republicans for him to quit the race.

Even Trump’s vice presidential candidate Mike Pence refused to defend the billionaire politician on Saturday, saying that he was “offended” by the obscene comments.

On Monday, however, Pence reiterated his support for Trump, saying he expressed remorse for his controversial comments.

Sometimes it's a good idea just to give somebody a refund.
On Thursday a French Apple store refused to give one of its customers his money back, and boy did he get his revenge.
He went into the store with a steel ball and calmly began destroying iPhones and a Macbook Air while onlookers froze with shock.
He placed the smartphones flat on the table and smashed them with the ball, one after another.
In a video posted to YouTube, he speaks in French about his rights as a customer and said he was unhappy with how Apple handled his case.
The Independent reports the man said "Apple is a company that violated European consumers' rights.

"I told them 'give me my money back' they said 'no'," the man said.They refused to reimburse me".
"So you know what is happening? This is happening."
He then proceeds to smash the expensive phones.
It is believed he caused almost $60,000 worth of damage in the store.
After leaving his trail of destruction, he was dragged away by security.
He later attempted to fight off the security guards but was arrested and placed in custody.

Daniel Patrick Wozniak could have postponed his wedding.
He could have found a cheaper venue. He could have waited until he and Rachel Buffett, his fiancee, had enough money for a proper honeymoon. The community theatre actor, living in Los Alamitos, Calif., could have done a great many things to remedy the fact that he couldn't afford the ceremony for his upcoming nuptials.
Instead, he chose to kill his neighbour Sam Herr, an Army veteran who served in Afghanistan, to steal Herr's combat pay.
He chose to saw off Herr's head, arm and hand, to make a positive identification of the body more difficult.
He chose to murder a young woman named Juri "Julie" Kibuishi, in hopes of throwing police off his trail by making it appear that Herr had raped and killed her.

It all began in 2010, a week before Wozniak was scheduled to marry Buffett.For these choices, 32-year-old Wozniak was sentenced to death on Friday in the Orange County Superior Court after a jury deliberated for just about an hour, the Associated Press reported.
The young actor had just landed the lead role in a local production of the musical "Nine," as People noted, but it didn't pay enough. He needed money, or he needed to downgrade or even postpone his wedding and his honeymoon.
"He wanted to do both with style and was willing to kill two young friends to accomplish this selfish goal," Judge John Conley said at Friday's sentencing, according to the Los Angeles Times.
Wozniak knew that his neighbor Sam Herr had at least $50,000 saved up, money he earned from fighting in Afghanistan with the U.S. Army.
He wanted that money.
So, before an evening showing of "Nine," he asked Herr to help him move some furniture in a theatre attic at the Los Alamitos Joint Forces Training Base.
Herr was happy to lend a hand.
The friends entered the attic there together. As Herr knelt down to pick up a piece of furniture, the Los Angeles Times reported, Wozniak shot him in the back of the head. Herr didn't die, though. Instead, presumably not understanding what was occurring, he asked Wozniak for help.
"Something hit me," Herr said, according to Wozniak's recorded police interview. "It felt like an electric shock."
Wozniak reloaded his weapon and shot again.
After killing Herr, Wozniak performed in a staging of "Nine," before returning to the attic.
Using an ax and a saw, he beheaded Herr's corpse. He also cut off his hands and one of his arms, which displayed a tattoo.
In an attempt to keep police off his trail, Wozniak scattered Herr's body parts in Long Beach's El Dorado Park.
The plan failed, though - Herr had "Mom & Dad" tattooed across his chest, which police used to identify the body, the OC Register reported.
Wozniak stole the man's ATM card, but decided to further attempt covering his tracks before withdrawing any money.
Using Herr's cellphone, Wozniak lured 23-year-old Juri "Julie" Kibuishi, Herr's friend, to Herr's apartment.
When she arrived, Wozniak fatally shot her. Then, he arranged her body to make it appear as if she had been sexually assaulted. He also stole Herr's passport, hoping police would assume Herr had sexually assaulted and killed Kibuishi before fleeing the country.
It almost worked.
A few days after the murders, Herr's father Steve Herr began to grow concerned - it wasn't like his son to not call. Steve visited Herr's apartment in Costa Mesa and let himself inside.
There he found Kibuishi's body bent over the bed. Her pants had been ripped and pulled down around her ankles. An expletive was written across her back, and a tiara rested on her head.
Police immediately considered Herr a suspect, though his father couldn't believe it.
"Immediately I said, 'Sam would never do this,'" Steve told the Los Angeles Times.
Within the week, Herr's head was discovered in the park. That same week, police found a 16-year-old boy with Herr's ATM card, which had been used to withdraw $400 at several different ATMs.
The boy told police that Wozniak had given him the card and ordered him to withdraw money for him, the OC Register reported.
Two days before Wozniak's wedding, he was arrested at a sushi restaurant during his bachelor party.
In a police interview following the arrest, which was filmed and played during the trial, Wozniak confessed to the murders, claiming "it was all just about the money, 100 percent."
"I killed Julie, and I killed Sam," Wozniak said in a video interview played at his murder trial Tuesday, according to the OC Register.
Added Wozniak, "I'm sorry. The truth is I've been slowly going crazy and becoming a pathological liar, and I find it hard to tell the truth."
At one point, as the video obtained by KABC showed, police asked Wozniak, "What was going on in your head as you were dismantling the body?"
He responded, "I was actually smiling and laughing."
The families of both victims attended Friday's sentencing.
"I have no forgiveness in my heart," Sam Herr's aunt, Miriam Nortman, told reporters.
"This will never heal and go away," Kibuishi's mother, June Kibuishi, said. "Julie will never come back to us. All our family can do is try to move forward one step at a time."
Steve Herr offered a victim statement in which he directly addressed Wozniak.
"You, Dan, are a coward and a poster boy for the need for an effective death penalty in California," Herr said, People reported. "My only regret that this state won't let me kill this coward myself."
Wozniak will be transferred to San Quentin State Prison, where he will await his execution.

When Tony Hoang was 13, he wasn't lying to his schoolteacher about not finishing his homework, or running late to footy practice because he'd missed the bus.
Instead, the teen was part of one of Sydney's most notorious Asian gangs as an up and coming drug dealer, "making between $7000 - $10,000 each week".
Mr Hoang's path into a life of crime was a slippery slope - and a ride that eventually saw him in youth detention before his 14th birthday.
By then time he was 19 he had been shot at and six of his friends had either been murdered or died from drug overdoses.
At 21 he had a heroin overdose.
"My cousins were part of a major gang in Cabramatta," Mr Hoang told news.com.au.
"They would recruit from high schools, you were either in or you were out. That was Cabramatta in those times, and a lot of us got stuck."

Mr Hoang, whose story is told in the new book Doin' Time, said his parents were always working and never home, so he took to the streets and developed criminal behaviour in their absence.Mr Hoang, who is now 34 and has a family of his own, survived eight years of drug addiction, dealing and violence around Sydney's "drug capital suburb" of Cabramatta.
"At 13, I joined a gang, and by 14 I was locked up," he said.
"When I turned 16, my best friend had a drug overdose, and was just one of a number of people very close to me to die from drugs and drug dealings over the years."
While Mr Hoang wasn't specifically a street dealer, he would run drugs through houses and have older men, such as his sister's boyfriends, deal drugs on the street.
"I got kicked out of four high schools in the area by 15," he admitted.
"When I got into a different school, I'd attend but I was constantly buying everything up.
"I had about seven cars by the time I went into detention the first time [14], and I bought a motorbike even though I couldn't ride it. I just bought everything, even my parents a $20,000 car - and it was all from drug money."
At 14 he had even bought himself a gun.
At the time, Mr Hoang felt he had it all. The more money he made, the less he felt "stupid" or "dumb", which is how his abusive father made him feel from a young age.
"It destroys something in a little boy," Mr Hoang said of his father's constant verbal and physical abuse.
"The only man I had to look up to was abusive and certainly wasn't a role model. He would beat me, call me names which made me have a lot of resentment towards him. So, I found the acceptance I wanted in a gang."
When Mr Hoang turned 19, he was thrown into jail again. After being released, he re-entered the party scene - when a near shooting occurred that triggered a drastic change in his lifestyle.
"One time, it was about 4am in the morning ... everyone was there [in the club] in this kind of world, and then this gang member pulled out a gun right there on the dance floor in front of me," Mr Hoang said.
"He fired two shots and then everyone started scattering around. I thought I was gone. We were new faces in that club, and I guess they wanted to find an excuse to stir up some trouble."
While Mr Hoang didn't receive a bullet would, the horror of being back on the outside made him desperate to turn things around.
"Living this life I looked like I had it together, but I was after peace," he admitted.
"I walked around with gangs, but I was at a point where I wouldn't even sit in a restaurant with my back to the door. I was so messed up, and drugs were only making it worse.
"I was robbing other drug dealers in the area, I had so much money I didn't know what to do with it - but everything I had came at a cost."
By 21, about six of Tony's friends had died - either by drug overdoses or murder. Having been to rehab, working with psychiatrists and even counsellors - the desperation turned Mr Hoang back to what he once knew - his faith.
"I thought, if God made me then he can fix me," he wrote in Doin' Time.
"I went there [to the local church], got down on my knees and wept for a good 15 minutes."
Crying out to God, Mr Hoang said he was at the point of suicide and "needed a sign" to continue on.
"The next day I walked out into the streets and there were people from the church singing," he said.
"One handed me a flyer that read 'If you are looking for a sign from God, here it is'."

Authorities in Georgia are searching for two suspects in a home invasion in which a woman opened fire on armed intruders - swapping gunfire with them, then fatally shooting a third suspect in self-defense, police said.
Surveillance video released by the Gwinnett County Police Department shows the incident unfold in the early morning hours Sept. 16 when authorities said at least three intruders broke into an Atlanta-area home. A woman, who has not been publicly identified by police, appears to emerge from a bedroom still wearing her pajamas, shooting at the suspects running from the gun-smoke-filled scene.
"She has every right to defend herself," Gwinnett County Police spokeswoman Cpl. Michele Pihera told The Washington Post in an email. "She is to be commended for not only saving her life, but also the life of her roommate."
The woman, a business owner in the restaurant industry, told police that about 4 a.m.

Police said she saw three men - who were armed - walking through the front door during what police think was an attempted robbery. She fired multiple rounds, police said, striking 28-year-old Antonio Leeks, who died of his injuries.she and a male housemate heard a possible intruder, so she pulled a handgun and went to search the home, police said in a statement.
The two other suspects fled from the scene. Police described the two men, who are estimated to be about 20 to 30 years old, as "armed and dangerous," and are asking for public's assistance in finding them.
"We want to get these people off the streets as quickly as possible," Gwinnett County Police Cpl. Deon Washington told CBS affiliate WGCL. "As you'll see, they are very, very dangerous individuals who are very bold and brazen."
Washington told ABC affiliate WSB-TV, "It's not common that we receive this caliber of surveillance video showing the crime unfold, an actual home invasion."
He said that because the suspects did not have their faces covered "we're highly anticipating someone watching the evening newscast will recognize these people."
No criminal charges were expected against the woman.
"She exercised her right to defend her livelihood and property," Washington told WSB-TV.

Ryan Lawrence, 25, pleaded guilty last week to first-degree murder in a plea deal with Onondaga County prosecutors.
Lawrence admitted beating to death his 21-month-old daughter Maddox outside Syracuse in February.
Authorities say he burned the girl's body in a fire pit, then tied the remains to a cinder block that he dumped in Onondaga Creek in Syracuse.

The child's body was found by police divers about 36 hours after an Amber Alert was issued for the missing child.
Authorities issued an Amber Alert for Maddox on February 21 after Lawrence disappeared with her.

When she returned home, Morgan Lawrence said, she found a message from him that indicated he might harm Maddox and himself.Maddox's mother, Morgan Lawrence, told police her husband was supposed to pick her up from her job at the Destiny USA shopping mall the night of February 20 but instead left the car and keys for her in a parking lot.
She called police, touching off the Amber Alert and a massive search by several law enforcement agencies.
On February 22, police got a call from a thrift shop employee who recognised Ryan Lawrence in the shop in Baldwinsville, 16km northwest of Syracuse, authorities said.
Police found Lawrence walking on a nearby street, wearing a disguise, and took him into custody, they said.
He confessed and led authorities to his daughter's body, TWC News reported.
Maddox had already beaten eye cancer, CBS 5 reported.
Onondaga County District Attorney Bill Fitzpatrick told the station in February that "she had been fighting a very unusual form of cancer, and all indications were that she was successful.
"But it was expensive, the treatment, and it was time-consuming. If that contributed to her demise, I don't know."
Fitzpatrick told the station at the time: "Without going into too much detail, [Ryan Lawrence's] statements allude to almost a sense of jealousy about the attention that this child was getting, as opposed to the attention that he was getting."
