BusinessRe: Court Orders AMCON To Pay Capital Oil And Gas N26 Billion by lordoddy(op): 9:06pm On Oct 06, 2016
BusinessCourt Orders AMCON To Pay Capital Oil And Gas N26 Billion by lordoddy(op):
In what could be described as an epic judgment a Federal High Court in Abuja on Thursday ordered the Asset Management C‎orporation of Nigeria (AMCON) to pay Capital Oil and Gas Limited the sum of N26Billion as contained in the consent judgment delivered in 2013.
The court presided over by Justice Abdul Kafarati in his judgement held that the court has powers to enforce its judgment or the verdict of any lower court in the country.

Justice Kafarati also restrained AMCON from exercising any powers over Capital Oil and Gas Limited and its assets and from processing any assignment and transfer among others.

He further advised to live up to its statutory responsibility of reviving the nation's economy through positive supports for businesses to thrive.

The court went further to grant all the reliefs of the plaintiff and made the following orders:

"An order compelling the defendant (AMCON) to comply with obligations to restructure the plaintiff's debt and to provide Trade Finance Facility in the sum of 16 Billion Naira for revamping of the plaintiff's business and to pay the plaintiff's trade creditors.

"An order compelling the defendant to comply with the consent judgment and to make the additional sum of N10, 590, 000, 000 Billion naira available to the plaintiff for the payment of sundry creditors who continue to threaten the plaintiff's business.

"An order of injunction restraining the defendant from exercising any powers over the plaintiff and its assets and from processing any assignment, transfer or other demise whatsoever or requesting for statutory consent or other approvals for the transfer or other demise of any rights in the assets of the plaintiff," Justice Kafarati said.

In his reaction shortly to the judgment, counsel to the plaintiff, Ajibola Oluyede, described the verdict as a "landmerk decision" that is rooted in the vision of the founding fathers of AMCON, urging AMCON to adhere to the position of the court by living up to its statutory billing in providing the needed support for businesses to flourish with the ultimate goal of creating jobs for the citizenry.

It would be recalled that a Federal High Court, Lagos Division, had on May 6th struck out the suit commenced by AMCON against Capital Oil and Gas Industries Limited on the grounds that the suit was premature and seeks to circumvent existing suits in different courts on issues relating to the alleged indebtedness of Capital Oil and Gas which is currently under dispute.

This was the basis of an order by the judge, Justice Idris, striking out a petition filed in the court by AMCON for the freezing of Capital Oil and Gas’ accounts and winding up of Capital Oil and Gas Ltd for its alleged inability to pay the disputed debt.

In the ruling delivered on 6th May 2016 in Suit No. FHC/L/CP/506/2016, the judge upheld the contention of Capital Oil and Gas’ counsel, Ajibola Oluyede, represented by Michael Damiari, that the winding up proceedings filed by AMCON against Capital Oil and Gas was intended to circumvent the existing actions in suits FHC/ABJ/CS/430/15; FHC/ABJ/CS/514/15 and FHC/L/CS/1529/15 where-in live issues pertaining to the consent judgment in FHC/ABJ/CS/714/2012 which is the subject matter of the winding up petition are pending.

According to the court “until the issues raised in those suits are determined, it will be premature to say the judgment debt has crystalized as provided in clause 2.4 of the consent judgment”.

According to the court “until the issues raised in those suits are determined, it will be premature to say the judgment debt has crystalized as provided in clause 2.4 of the consent judgment”.

In defence, Capital Oil and Gas, in its Respondent’s Counter Affidavit of 91 paragraphs deposed to by Nsikan Usoro in opposition to AMCON’s petition, had contended that AMCON grossly violated the terms of the consent judgment entered between the two parties. It was argued that AMCON failed, refused and/or neglected to inject the requisite funds into Capital Oil and Gas as agreed and contained in the terms of the consent judgment despite Capital Oil and Gas fulfilling all its obligation of transferring assets valued at over N150 billion to AMCON. It was also contended that Capital Oil and Gas, which is a going concern and also a company of strategic national importance responsible for a great percentage of petroleum products distributed nationwide, is not insolvent, not indebted to AMCON, neither was it unable to pay its debt as the company has assets worth over N300 billion, far in excess of any alleged debt to AMCON or any other creditor.

It was further argued that AMCON is indebted to Capital Oil and Gas to the tune of over N150 billion, arising from economic losses and damages inflicted on Capital Oil and Gas by AMCON, through the gross mismanagement of Capital Oil and Gas’ prime facilities and business interests during the two years of AMCON’s ill management of Capital Oil and Gas, which is the subject matter of suit no. FHC/ABJ/CS/430/2015 and in other various claims pending before different courts.

The court agreed with the argument of Capital Oil and Gas in its preliminary objection and struck out the petition. The court also set aside all the interim orders made by the court therein.

SportsWestham Storms Nigeria For Talent Hunt, technical Discussion With FC Ifeanyi Ubah by lordoddy(op): 9:23am On Oct 04, 2016
Fast rising NPFL side and first African partner of West Ham United FC of England, FC Ifeanyi Ubah will this week host their London-based partners, West Ham United FC in Lagos and Nnewi in a bid to take the partnership between both football clubs to the next level.

Top executives at West Ham United led by the Managing Director, Angus Kinnear and President of FC Ifeanyi Ubah, Dr. Patrick Ifeanyi Ubah will on Wednesday unveil the blueprint that will guide the hunt for the next Nigerian superstar. The project which aims to identify talented kids between the ages of 6 - 15 will kick off in December with coaches and scouts of West Ham United in regular attendance to offer technical support throughout the duration of the project. Selected kids will be enrolled into Ifeanyi Ubah football academy with the aim of harnessing their talents, thus providing West Ham United with a pool of talented players to pick from on a quarterly basis.

Recall that FC Ifeanyi Ubah recently signed a long term partnership with West Ham United back in August that will see the two football clubs join forces on a number of football-related projects led by FC Ifeanyi Ubah, from best-practice coaching initiatives to establishing grass roots football programmes in Nigeria, all with a view to improving the standard of football across the region.

Speaking to newsmen at the weekend in Lagos, Dr. Ubah explained the aim of the 'Talent Hunt Programme' and how that will metamorphose to a football Academy run by both West Ham United FC and FC Ifeanyi Ubah. "Our discussions since the unveiling of this historic partnership has always been centred on football development, with the discovery of future football stars in a country so rich in football talents waiting to be harnessed top on the priority list. West Ham are known to have one of the best academies in the world having produced players like Sir Trevor Brooking, Frank Lampard, Rio Ferdinand, Michael Carrick to mention a few and they are eager to identify and handpick talented African players that they can develop. The search for the next Lampard, Payet, Kanu and Okocha just begun and we believe this talent hunt will help us achieve our goal".

Dr. Ubah further revealed that many more details on the next level of the collaboration between FC Ifeanyi Ubah and West Ham FC will be unveiled during the week in Lagos when executives from the London Club will be entertaining questions at a World Press Conference. There will also be a dinner in honour of contingent from West Ham and major football stakeholders and personalities will be in attendance in Lagos.

A group of women sparked surprise outside Argentina's national congress when they shed their clothes and strolled around completely nak*d in a protest about objectifying women.

The members of the Urbanudismo campaign are calling for the acceptance of the nak*d female form, saying their actions are neither s*xual or provocative.

The protest lasted several minutes until police were called because it was making passers-by 'uncomfortable' - including one man who looked especially awkward when approached by a naked woman.

I, Hon. Onyebuchi Offor, a representative of the highly respected Offor family in Ekwusigo LGA and by the grace of God, Minority Leader, Anambra State House of Assembly, bring you salutations from the Offor family.
Our attention has been drawn to recent publications by Sahara Reporters which are evidently designed to defame Sir Emeka Offor, a most illustrious son of Igboland.
Given the patent falsehood running the gamut of the said publications, we consider that Sahara Reporters has constituted itself the orchestrator and purveyor of a targeted smear campaign against Sir Emeka Offor, possibly for economic gain and at the behest of certain unscrupulous elements.
There is no gainsaying the fact that Sir Emeka Offor is one of the most industrious and accomplished Nigerians of his generation. He has attracted and enjoyed God’s entrepreneurial and pecuniary blessings for over three decades. He has in turn consistently channeled those blessings toward the betterment of his fellow man (and woman and child) by remarkable acts of philanthropy. Notable among the plethora of honours and recognitions that he has received in that regard is the award by the Rotary Club International for his immense contributions towards humanity and the global war against polio.
We wish to make clear that contrary to Sahara Reporters’ libelous assertions, the following is the true and unimpeachable position with regard to Sir Emeka Offor:
Sir Emeka Offor is hale and hearty.
Sir Emeka Offor is a happily married man with beautiful children whom he loves abundantly and who love him very much in return. .
Sir Emeka Offor’s multinational businesses continue to thrive and prosper by the grace of God. Similarly, his personal wealth continues to endure for the benefit of the multitudes who have benefited from his legendary largesse, munificence and altruism.
Planning by the family for the burial of our late father, Pa Offor, continues apace. We find it disgusting that Sahara Reporters chose to disrespect the memory of Pa Offor by bringing him into their odious publications.
Sir Emeka Offor’s contributions to the local community are innumerable; permit us to enlighten Sahara Reporters on a few:
Sir Emeka Offor contributed over 50% to the building of Oraifite Civic Centre which stands as one of the best civic centres in the South-East of Nigeria.
Sir Emeka Offor has run a remarkable university scholarship scheme for over twenty years with the provision of a car and automatic employment for beneficiaries graduating with first-class degrees. Thousands of Nigerians have been proud beneficiaries of this scheme to date.
Sir Emeka Offor runs a widows’ cooperative society with over 3,000 members as of today. Under the auspices of this cooperative society, he sent a significant number of the widows to India for training on managing a cooperative society. They have subsequently been able to establish a microfinance bank and other thriving microenterprises.
Sir Emeka Offor built and fully equipped one of the best Anglican churches in the South East of Nigeria, located in Oraifite.
Sir Emeka Offor singlehandedly constructed a major community road (off Onitsha/Owerri road to Oraifite /Nnewi border). This project was executed by renowned civil engineering and contracting firm, MCC.
Sir Emeka Offor built Ekwusigo LGA Central Police Station .
Sir Emeka Offor provided a free water scheme for the four quarters of Oraifite (Unodu, Ezumeri, Irefi and Ifite).
Do we talk about the various skill acquisition programs undertaken by youths of Ekwusigo LGA under Sir Emeka Offor’s Youth Empowerment Scheme? Just last year, Sir Emeka Offor not only trained over one hundred youths in various skill acquisition programs but also empowered them financially to start their own businesses on completion of their training .
Sir Emeka Offor is a serial job creator with over 3,000 Nigerians under his payroll, indirectly creating over 10,000 jobs in addition.
Apart from within his conglomerate, Sir Emeka has helped innumerable people secure jobs in Nigeria and abroad. The breadwinners of many families are gainfully employed today through the efforts of this great member of the Offor family.
Sir Emeka Offor’s star of charity shines far beyond his immediate community.  Again, we wish to mention but a few of his national and international works of benevolence:
Partnering with a U.S. based NGO, Sir Emeka Offor has through his eponymous Foundation donated books, reading materials and computers worth over $22 million to schools and communities in more than 18 countries in Africa including Nigeria.
Sir Emeka Offor has established a glaucoma research centre at the Department of Ophthalmology, University of Mainz, Germany and in conjunction, established a Nigerian fellowship for cataract surgery and glaucoma management at the university.
Sir Emeka Offor donated $2 million, which was matched with a grant of an additional $4 million from the Bill and Melinda Gates Foundation, to support the Global Polio Eradication Initiative launched by the Rotary International, the World Health Organization, UNICEF and the U.S. Center for Disease Control.
Sir Emeka Offor, through his Foundation, entered into a long-term agreement with The Carter Centre to eliminate river blindness (‘onchocerciasis’) in Nigeria. Pursuant thereto, Sir Emeka Offor provided a $10 million grant to the Carter Center, the largest grant ever received by the Center, to facilitate the Center’s efforts in eliminating river blindness in Nigeria.
In light of the above, we wish to ask Sahara Reporters some pertinent questions:
What do you intend to achieve by the malicious publications? To increase the traffic to your website or to advertise your skills as character-assassination experts available for hire?
Why have you never reached out to Sir Emeka Offor, in keeping with the ethics of journalism, directly or through his conglomerate’s media relations’ representatives, to get his own side of any of the stories you wished to peddle?
How much have you been paid to deliberately and recklessly foment a campaign of calumny against Sir Emeka Offor, including but not limited to bringing emotional and psychological distress to his family and loved ones by exposing them to ridicule and odium?
Sahara Reporters has published over seven sensationally libelous articles on Sir Emeka in the last thirty days.  The lack of objectivity in your intentions is self-evident in your relentless and ungrounded focus on one individual.  We continue to wonder who might be the sponsors to whom you have lent your connivance and instrumentality. We are aware that like any successful businessman, Sir Emeka Offor has competitors who would benefit from his being brought to disrepute.
We want to assure Sahara Reporters however that we will not sit back and watch you continue your attempts at discrediting our brother. We intend, as a family, to take advantage of all legal and equitable remedies available to us in domestic and international law against Sahara Reporters IF WITHIN SEVEN (7) DAYS, you fail to tender an unreserved apology to Sir Emeka Offor and his family for your defamatory publications and character assassination.  We also demand that Sahara Reporters cease and desist henceforth from making any other or further defamatory publications against Sir Emeka Offor or any member of the Offor family.
Thank you.
Hon. Onyebuchi Offor
(Minority Leader, Anambra State House of Assembly)
For the Offor family of Oraifite, Ekwusigo Local Government Area of Anambra State

EducationA Must Read For Parents: How Pre-schools Harm Your Kids by lordoddy(op): 2:36am On Sep 08, 2016
Parents have the best of intentions when they send their kids off to preschool. For the most part, they also have certain expectations that their kids will learn the “important” skills necessary to succeed in kindergarten and beyond.
And that’s why so many preschools today focus on academically minded activities, like prereading and the practice of sorting, counting, and coloring. And that type of environment is likely to yield students who test above average in writing and math.

The only thing is, it’s the wrong approach and it’s setting our children up for failure.
Angela Hanscom, a pediatric occupational therapist, believes children, her daughter inclusive are struggling with social and sensory issues at an increasingly young age and sees it as “a growing epidemic” that will only get worse the more we as parents and educators push for academic readiness too early.

Some signs of these issues? She interviewed a respected pre-school director who listed them: They are more easily frustrated, often crying at the drop of a hat.

They frequently fall out of their seats several times a day They are less attentive They run into each other and even the walls They have difficulty paying attention They can’t control their emotions and use poor problemsolving methods They have a hard time with basic social interactions “It is so strange,” the director noted.

“You never saw these issues in the past.” But now they are rampant, and although research points directly at the reason — that “young children learn best through meaningful play experiences” — preschools are still transitioning from play-based learning to becoming more focused on academic achievement.

“As parents and teachers strive to provide increasingly organized learning experiences for children, as I had once done, the opportunities for free play — especially outdoors is becoming less of a priority,” Hanscom wrote in the Washington Post.

“Ironically, it is through active free play outdoors where children start to build many of the foundational life skills they need in order to be successful for years to come.” And instead of letting these children engage in wholebody sensory experiences on a daily basis, they are seated at rows of desks and tasked with assignments involving pencil and paper.

As Hanscom points out, we can teach academics at any time, but once children reach the age of 7, it’s nearly impossible to course-correct sensory, motor, and cognitive development — skills that shouldn’t have to be taught at all. Her recommendation is simple: “Children just need the time, the space, and the permission to be kids.

Let the adult-directed learning experiences come later. Preschool children need to play!” Simple, yes, but will parents and preschools come together to do something about it?
