The Nigerian Constitution provides a democratic and lawful method for removing a sitting president, but many citizens misunderstand how the process works. Nigerians do not have the power to directly impeach a president through a public vote or mass action. Instead, the Constitution places this responsibility on elected lawmakers in the National Assembly. This system is designed to protect stability and prevent chaos while still allowing the people to influence the process through peaceful, legal civic engagement. Under Section 143 of the 1999 Constitution, a president may be removed only for “gross misconduct,” which includes serious violations such as abuse of power, corruption, mismanagement of public funds, or any actions that endanger Nigeria’s wellbeing. If approved by the House, the Chief Justice of Nigeria appoints a seven-member investigative panel made up of reputable, non-partisan Nigerians. The panel has three months to examine evidence, invite witnesses, and allow the president to defend himself. If the panel concludes that the allegations are false or unsupported, the impeachment process is terminated. If the allegations are confirmed, the panel submits its report to the National Assembly for final action. The final decision lies with the Senate. To remove the president, two-thirds of all senators must vote in favor of impeachment. If this vote succeeds, the president is immediately removed from office, and the Vice President is sworn in to continue governance. This layered system ensures fairness, due process, and national stability.
