By Gabriel Enogholase A Benin High Court presided over by Justice Alero Edodo-Eruaga has awarded the sum of N4million as general damages to a hearing impaired man, Mr. Kingsley Eromosele. Mr. Eromosele had dragged the First Bank of Nigeria and two of its staff, Messers Jerry Osoleaso and Adetola Busari to court for damaging his car and assaulting him. He had asked the court to grant him N70,000 being cost for the repair of his car, N1m for his damaged vehicle, the sum of N10m for the assault, dehumanizing treatment, shock he suffered and the sum of N1m as Solicitors fees in respect of the proceedings. In her judgment, Justice A. Edodo-Eruaga held that evidence before the court proved that the defendants failed to exercise the duty of care due to the claimant as a user of the Benin- Lagos express Road. Justice Edodo-Eruaga awarded the sum of N4m to the claimant for ill-treatment, harassment and hardship meted to him by agents of the first defendants. The Judge refused to grant the claim of N1m as general damage for the claimant’s car and awarded N700,000 as counsel fees for the prosecution of the case. Justice Edodo-Eruaga struck out the claim for N70,000 being cost for the repair of the vehicle and dismissed the counter claim of the defendants as being frivolous and lacking in merit. Reacting to the judgment, Eromosele who spoke through an interpreter said he opted for legal redress to tell the world that physically challenged persons have right to live in the society.

Governors Isiaka Abiola Ajimobi and Rauf Aregbesola of Oyo and Osun states have appealed for calm over the reopening of Ladoke Akintola University of Technology (LAUTECH), Ogbomoso.In a joint statement the duo signed, they said the prolonged closure of Ladoke Akintola University of Technology, Ogbomoso, is deeply regretted. They added that academic activities have been put to a halt as a result of the industrial action embarked upon by the academic and non-academic staff of the university. This, according to them, is consequent upon the challenges faced by the owner states in fulfilling full salary obligations to categories of workers in the institution.They went further: “This is not due to lack ofwill on our part but the dire financial headwinds in the country, affecting all tiers of government, putting strain in paying salaries of workers in the two states, including the university.
“It is important to state that the State Governments of Oyo and Osun have reaffirmed their commitment to the joint ownership of the institution, including its continued funding and comprehensive review of its finances.“It was in this regard that a Visitation Panel headed by Chief Wole Olanipekun, SAN, wasset up in October last year. While waiting forthe report of that panel, we want to appeal to students, parents and guardians to resist the temptation to result to self-help and or any action that might precipitate disruption of law and order.“With the steps already taken by the two owner governments, we are confident that the unfortunate situation in the institution will soon be resolved.”

Group warns of more trends in 2017 A cyber security group, Cyber Security Experts Association of Nigeria (CSEAN) has estimated that Nigeria loses about N127 billion to cybercrimes yearly. It said several cases of cyber crime activities in the country, many of which have resulted in financial losses by individuals and organisations, had been widely unreported. The CSEAN said the country might face even greater odds in cybersecurity threats this year. It, however, identified five cyber crimes that will dominate Nigeria this year based on the current trends as CEO e-mail scam, ransomware, online- assisted kidnapping, cyber bullying and online impersonation. CSEAN President, Remi Afon, who said that the year 2017 would witness more ransomware than ever seen before in Nigeria, stated that with the rise of ransomware-as-a-service, cyber criminals could now purchase a user- friendly kit they could deploy with little or no cyber know-how from the dark web. He described ransomware as a type of malware that infects a machine when a user clicks on a seemingly legitimate link and unknowingly downloads a malicious file. The virus will then encrypt the user’s files, share drives and servers, leaving them inaccessible unless the victim pays for the decryption key usually in crypto currency. He said: “That kidnapping is on the rise in Nigeria is no news. What many people don’t know is that kidnappers are being assisted by their victims’ social media online activities and geolocation data on their smartphones. Geolocation data is information that can be used to identify an electronic device’s physical location.” According to him, using smartphones’ built-in Global Positioning System (GPS) functionality allows location- based services (or geo-location) to locate and publish information about smartphone owners’ whereabouts. He also identified online impersonation, which he categorised into two, as another top cyber crime to watch out for in 2017. He said while the first category impersonates politicians and religious leaders on social media by creating fake profiles with the aim of scamming their victims, the second usually creates fake profiles with attractive fake pictures so they can engage in what is called ‘romance scam’. Afon stressed that cyber criminals were mainly interested in targeting foreigners, claiming they were in love with them and establishing a love relation to be able to swindle them.

Abraka - A human rights lawyer says three
convicted criminals have been secretly
executed in the first hangings in Nigeria since
2003. The executions breach a seven-year
moratorium on the death penalty here.
Chino Obiagwu of the Legal Defence and
Assistance Project says three men who had
been death row inmates for 20 years were
hanged in Benin Prison in southern Edo state
on December 23. All had been convicted of
armed robbery.
Obiagwu tells The Associated Press that his
organisation wrote to the Edo state governor on
December 21 warning that the men had
outstanding appeals, making the hangings "an
unlawful act".
Edo state executed four convicted criminals in
2013, breaching Nigeria's 2009 moratorium on
the death sentence.
Officials in Edo did not respond to requests for
comment.

The African Union (AU) says it is investigating two separate incidents in which its troops allegedly killed 11 civilians in Somalia. An AU armoured vehicle reportedly crashed into a house killing a mother and five children in the southern port of Marka on Sunday. Earlier, soldiers allegedly fired into a minibus killing six passengers. Thousands of AU soldiers are in Somalia to help the government fight Islamist militant group al- Shabab. Although some residents say five people died in the incident in Marka, the governor says six people were killed. "An Amisom vehicle ran into a family house killing a mother and five children," Marka district governor, Hassan Omar Moalin told the BBC Somali service. He said the incident occurred after an explosion had targeted the AU convoy. In the first incident, one resident said soldiers had opened fire on a minibus killing all six passengers in Qoryooley town in the Lower Shabelle region on Sunday. "AMISOM notes with concern the unfortunate incident in Qoryooley where civilians lost their lives in an attack," the mission said in a tweet. Amisom added that it was "investigating the allegations against its troops and gathering further facts and information before releasing a comprehensive statement". appears set to resume in
January as the owner states
of the university consider the
report of a panel they set up
on the crisis that has kept
students away since June.
Multiple sources, however,
told PREMIUM TIMES that a
key recommendation of the
panel is an increase in
tuition and other fees to
shore up internally generated
revenue as a solution to the
recurrent funding challenges
of the university.
Another recommendation,
said the sources, would be to
share out the faculties to the
owner states under a new
funding arrangement.
The Academic Staff Union of
Universities, Non-Academic
Staff Union, and Senior Staff
Association of Nigerian
Universities in the university
had declared a strike on June
9 to protest inadequate funds
to run the institution and pay
the workers.
LAUTECH is jointly owned by
Oyo and Osun, the two states
that constituted old Oyo State
before Osun was excised in
1991 to form a separate state.
PREMIUM TIMES can
exclusively report that the
visitation panel set up by the
governments of the two states
has concluded its work and is
about to submit its report.
A member of the committee,
who pleased anonymity,
confirmed the development.
The spokesman of the
university, Lekan Fadeyi, in a
chat with PREMIUM TIMES
said there was confidence the
protracted crisis was coming
to a close and that the
management was waiting for
the directive to reopen the
university.
Mr. Fadeyi cited the visitation panel as a
demonstration of the seriousness Oyo
and Osun state governments attached to
resolving the crisis.

The leadership of the House of Representatives has declared that Nigeria had no choice but to borrow money to fund the 2017 budget. Recall that President Muhammadu Buhari had on Thursday last week laid a budget size of N7. 298tn before a joint session of the National Assembly for 2017 . According to the Green Chamber , the government must spend money to reflate the economy and invest heavily in infrastructure to exit the recession . The Majority Leader of the House , Mr. Femi Gbajabiamila , gave this stand in Abuja, while speaking on the activities of the legislature in the last 12 months. But , the budget of “ economic recovery and growth” came with a deficit of N2 . 36tn . Its projected revenue of N 4. 9 tn is far less than the expenditure projections . To finance the deficit , Buhari had said that he would borrow N 2. 32 tn . Out of the loan , N1 . 06tn will be external loan. Another N1 . 25tn will be sourced within Nigeria. Gbajabiamila explained that Nigeria must borrow because the country was not making money like before . He said , “ Nigeria can’ t do without borrowing, especially when you run a deficit budget . “ There is a lot we need money to spend on, but we are not making the money as before . “ The oil we rely on, has gone down. We must now go out and borrow. ”

Friday morning, PREMIUM
TIMES can report.
Details of the attempted
assault on Mr. Ezegwu, a
major general, by troops
attached to ‘Operation Rescue
Finale’ in Sambisa Forest,
came a day after he denied
our report about a mutiny on
the battlefront.
The troops were enraged over
poor welfare arrangement
and alleged deceit by their
commanders, our sources
recounted.
Specifically, they accused the
commander of leaving them
to fight for two days without
food. The incident occurred
in Sambisa Forest on
Friday morning, as this
newspaper reported.
Most of the soldiers involved
in the mutiny were deployed
to Sambisa from 21 Brigade
in Bama, Borno State.
PREMIUM TIMES obtained
new details of the incident on
Saturday, that show that the
soldiers went from 9:00
a.m. on December 14 till 6:00
p.m. on December 15 — more
than 24 hours — without
food.
When Mr. Ezegwu eventually
arrived in a helicopter
bearing foods and other
supplies on Friday morning,
the troops swooped on him
and scavenged the snacks,
food and water he brought.
They removed all the
supplies, including parts for
operational vehicles and
other equipment, before
moving towards the GOC in
an attempt to attack him, our
sources said.
“The GOC escaped being
lynched because he was
immediately shoved into an
aircraft and whisked away
from the area,” a source said.
With their target having escaped, the
troops began sporadic firing, sources
said. They also rained curses on their
commander.
