It's very simple. River Niger is controlled by the countries under whose borders it falls.

International waters do not fall in any country's border. Rather, countries are given up to 200miles footprint on the waters.

International waters simply means body of water that is not under the control of any country. River Niger is controlled by the individual countries it passes through. There is no part of River Niger that is not controlled by one country or the other
