An Akure High Court has ordered the immediate and unconditional release of three detained Ugbo indigenes, Prince Adefemi Mafimisebi, Prince Wemimo Mafimisebi and Prince Alfred Okun from the custody of the police or from wherever they are being detained.



This judgement was given on Wednesday 18th July, 2018 by Hon. Justice W. A Akintoroye. The judge also declared their arrest and detention since April 6, 2018 as barbaric, unconstitutional, illegal oppressive and violation of their constitutional rights to freedom of movement, right to personal liberty and right to dignity of human person.


The judge also pronounced that the detained persons are entitled to move freely within the Federal Republic of Nigeria including Ode-Ugbo which is their place of birth. Instructively, the judge gave an order restraining the Inspector General of Police and Ondo State Commissioner of Police from further arresting all the seven applicants in the case namely Dr. Adebanjo Mafimisebi, Prince Adefemi Mafimisebi, Prince Wemimo Mafimisebi, Prince Alfred Okun, Prince Otelo Mafimisebi, Prince Zion Leke and Prince Oriola Ajimosun.



Meanwhile, Justice W. A Akintoroye equally awarded damages of ten million naira10,000.000. against the Inspector General of Police, Ondo State Commissioner of Police and Obateru Akinruntan, the Olugbo of Ugbo, who were all respondents in the case. The judge has also ordered the three respondents to tender public apology to the detained Ugbo indigenes in at least two daily national newspapers for their unlawful arrest, unlawful detention and unlawful violation of their rights to personal liberty and dignity of their human persons.



However, It was alleged that the police acted on instruction of Obateru Akinrutan by forcibly broken into the houses of Prince Adefemi Mafimisebi, Prince Wemimo Mafimisebi and Prince Alfred Okun between the hours of 3am- 5am on April 6, 2018 at Ode-Ugbo in Ilaje Local Government Area of Ondo on false allegation that they killed one Adebowale Ebiwano. The three Ugbo indigenes that did not commit any capital offence were reportedly picked up amidst gun powder by the foot soldiers of Obateru, mercilessly beaten with logs of wood and marched naked in the full glare of onlookers to the residence of Obateru Akinrutan from where they were moved to Akure. They were kept in detention at Akure for 36 days before they were moved to Abuja where they have since spent 66 days and prevented from seeing or communicating with their family members.

Despite the court judgment , for over 8days the IGP remain adamant of their release.
