The law is well codified when it comes to the relationship between the Landlord and Tenant. The question then becomes - What Does Their Tenancy Agreement Say Concerning The Consequence Of Non-Payment Of Service Charge(s)?

Assuming, without conceding that the Tenancy Agreement between them provides that the LANDLORD COULD LOCK UP THE PREMISES FOR DEFAULT OF PAYMENT OF SERVICE CHARGES – Which is very possible, wouldn’t the Law Court honour such condition in favour of the landlord? To put the answer mildly and succinctly, it would. The court respect contractual agreements between parties, EXCEPT where fraud is imputed in such agreement.

"WHEN Mukaila Ajadi was ejected from the house he was living in by his landlord’s children, little did the landlord’s family know that this directive did not go down well with their tenant, as a fight resulting from a reaction to the quit notice ended the dreams and aspirations of one of the lanlord’s son, 42-year-old Musiliu Sogunro on February 8, 2012.

Ajadi, a 51-year-old father of three was reported to have packed into the house at Sanyo area of Ibadan, Oyo State in 2007. His landlord died in January 2011 and since then, he was alleged to have refused to pay his house rent, owing the landlord’s family a year’s rent. Not only this, another female tenant who was brought into the house by Ajadi was also owing some rent.

When all overtures to make the two tenants pay up the money failed, the landlord’s children decided to give them quit notice but Ajadi was alleged to have refused to quit the one room he was living in with his wife and three children, saying that he would remain there until he would be able to secure another accommodation.

The female tenant however decided to comply with the landlord’s children’s directive and started packing her things in bits. At a point, she had moved all her belongings from the room she occupied, leaving behind her mattress. Miffed by the action of the woman who continued to lock the room she occupied, Sogunro, on sighting her in evening of the fateful day, challenged her on this, demanding to know why she locked the room up, unknown to him that her mattress was still in the room.
Tempers flared between Sogunro the woman and in no time, they started exchanging hot words with each other. It was at that point that Ajadi, who was around at the time, interjected the quarrel. However, his contribution did not go down well with Sogunro and before anyone knew what was happening, a fight ensued between the duo. The outcome was that Sogunro slumped, covered with his own blood which was flowing from different stab wounds on his body.

According to information gathered by Sunday Tribune, Ajadi claimed that it was Sogunro who brought a bottle, broke it and injured him on the back of his hand with it. In annoyance, Ajadi claimed he wrested the broken bottle from Sogunro but did not know that he stabbed him until he saw his picture with the different points where he was stabbed on his body.

When Ajadi saw that his landlord’s son had slumped, he went to Sanyo Police Station to report that he and someone fought and stabbed themselves. He was advised to go and treat himself. It was after he left that the deceased’s wife came to report at the station that Ajadi had killed her husband. The woman was said to have informed the police that she received a call from an unknown person who told her to come and see her injured husband. On getting home, she was shocked when she met her husband on the ground, stone dead.

The police at Sanyo police station had reportedly traced Ajadi to the hospital where he went to treat himself and promptly arrested him. Sunday Tribune further gathered that his case was transferred to the State Criminal Investigation Department (SCID), Iyaganku, for further investigations, after which he was charged to court. He is currently being remanded in Agodi prisons while his case has been adjourned."

First and foremost, what purpose does this ‘NOTICE TO QUIT’ serve?

‘NOTICE TO QUIT’ or ‘QUIT NOTICE’ as sometimes called has one main aim –

‘to terminate the tenancy relationship
between a landlord and his tenant.’


The essence is to ensure the property or premises in question reverts (returns) to the landlord. But then, the position of the law is that where the Tenancy Agreement between the parties is for a fixed term (fixed period), a Notice To Quit is unnecessary.

All that is required by the landlord under the law is to proceed with the Seven (7) Days Notice.

Now, the question is – How do you (as a tenant, I suppose) identify a proper Notice to Quit?

It should be noted that there is no special form (style) required by law that a Notice To Quit must appear. However, while no special form is prescribed by law, a valid Notice To Quit must contain the following:

a. The name of the landlord;
b. The name of the tenant;
c. The nature or type of tenancy, i.e. whether a monthly, half-yearly or yearly tenancy;
d. The fact that the addressee resides in the premises as a tenant to the landlord;
e. A brief description of the property or premises; and
f. The date the tenant is required to quit and deliver up possession of the premises.

It's really a pathetic situation!

From the stand point of the law, cases of this sort begins with: "DID U ISSUE A TENANCY AGREEMENT TO THE TENANT(S)?" "WHAT ARE THE CONDITIONS RELATING TO EVICTION IN THE AGREEMENT?" and so many other salient questions that present themselves.

More so, it might interest you to know that ur NOTICE TO QUIT ought to have come (may be weeks or months)before the expiration of the tenancy. For instance, if the Tenancy says u're to give a 2 MONTHS NOTICE TO QUIT TO THE TENANT, then, ur 2 months notice... MUST BE SERVED before the expiration of the tenant's rent.

In respect of ur case, even if u get to a tribunal or court, and ur tenant secured the services of a lawyer that's worth his salt, then u'll be so bittered to embrace d reality of him staying for years on the premises without paying a dime - SORRY, IT DOES HAPPEN!

However, if no Tenancy Agreement, and for a yr's tenancy, then, d law says the tenant is entitled to 6MONTHS NOTICE TO QUIT (Putting into consideration the above condition). Until this is done, u stand to be in default.

The next step is to issue a 7 DAY NOTICE OF OWNER'S INTENTION TO APPLY TO THE COURT TO RECOVER POSSESSION, after seven day, and the tenant remains on the premises, all that is required, go to the court or Rent Tribunal to ask for SUMMONS against the tenant. U'll find clearly on the summons, a date slated for ur case against d tenant to commence.


If on d date of 'hearing' in court or at d Tribunal, d tenant fails to appear, the court (most often) could decide to enter judgment in ur favour; otherwise, the case would commence and ONLY GOD & THE JUDGE KNOWS WHEN IT WOULD END.

POSSIBLE SOLUTION:

1. Since ur uncle stands to be in default (from ur case), contact a Mediator or a lawyer that doubles as both to
mediate b/w ur uncle and the tenants.

2. If there is an Agreement to leave at d nearest possible time, he should prepare a MEMORANDUM OF
UNDERSTANDING & tactfully get them to sign.

3. If the tenant(s) defaults at the expiration of the agreed date on the MEMO..., simply use the MEMO...as one of ur
'WEAPONS'Exhibits) at the Tribunal or court and wait for judgement - of course as the case progresses.

experiences have shown that Nigerians are good at conceiving ideas and making sure those ideas see the light of the day.

Interestingly too, because of the perceived prospects flowing from such ideas, they call a couple of friends to form a partnership by jointly registering a business name that would serve as a flagship to the desired future of the business. Not too long after that business union, cases of secrecy and embezzlement would begin to rent the air; making the entire business partnership a lump of soured union.

But the above experience could have been averted if the partners considered that MAN, by nature, if not God conscious, could turn a different leaf tomorrow - making his partner regret the day he ever considered such a union.

For the purpose of this discourse, a BUSINESS PARTNERSHIP AGREEMENT, as the name implies, is an Agreement that spells out IN CLEAR TERMS the responsibility of each partner to the growth of the business and by way of caution, includes clauses that restricts each partner from carrying out extraneous activities to the detriment of the joint ownership of the business.

It is for your own 'legal' good - as where there is no Partnership Agreement, and you sue a partner, your case MAY LIKELY not see the light of the day since the court would have no document to interprete such relationship.

Hi everyone,

experiences have shown that Nigerians are good at conceiving ideas and making sure those ideas see the light of the day.

Interestingly too, because of the perceived prospects flowing from such ideas, they call a couple of friends to form a partnership by jointly registering a business name that would serve as a flagship to the desired future of the business. Not too long after that business union, cases of secrecy and embezzlement would begin to rent the air; making the entire business partnership a lump of soured union.

But the above experience could have been averted if the partners considered that MAN, by nature, if not God conscious, could turn a different leaf tomorrow - making his partner regret the day he ever considered such a union.

For the purpose of this discourse, a BUSINESS PARTNERSHIP AGREEMENT, as the name implies, is an Agreement that spells out IN CLEAR TERMS the responsibility of each partner to the growth of the business and by way of caution, includes clauses that restricts each partner from carrying out extraneous activities to the detriment of the joint ownership of the business.

A good BUSINESS PARTNERSHIP AGREEMENT is expected to have, as part of its content, the following CLAUSES:

1.  Each Partner shall devote his whole time and attention to the business of Partnership and shall use his utmost
     endeavours to further the interest of the Partnership business.

2.  Neither partner shall without the written consent of the other:

     (a)  Engage in or be concerned or interested either directly or indirectly in any business, other than that of the
           Partnership.
