Supreme Court Upholds President’s Power To Declare Emergency Rule, Suspend Elected Officials
Justice Mohammed Idris held that the Constitution empowers the President to deploy extraordinary measures to restore normalcy where emergency rule is declared.

The Supreme Court has upheld the power of the President to declare a state of emergency in any state to prevent a breakdown of law and order or degeneration into a state of chaos or anarchy.
In a split decision of six-to-one, the apex court held that the President, during a state of emergency, can suspend elected officials, but that such suspension of elected officials must be within a limited period.
In the lead majority judgment, Justice Mohammed Idris held that Section 305 of the Constitution empowers the President to deploy extraordinary measures to restore normalcy where emergency rule is declared.
Justice Mohammed Idris noted Section 305 was not specific on the nature of the extraordinary measures, thereby granting the President the discretion on how to go about it.
The judgment was on the suit filed by Adamawa State and 10 other Peoples Democratic Party-led states challenging the propriety of the state of emergency declared by President Bola Tinubu in Rivers State, during which elected state officials, including Governor Siminalayi Fubara, were suspended for six months.
Justice Idris, in the earlier part of the judgment, upheld the preliminary objections raised by the two defendants against the competence of the suit.
In upholding the objections raised by the Attorney General of the Federation (AGF) and the National Assembly (the defendants), Justice Idris held that the plaintiffs (the 11 PDP states) failed to establish any cause of action capable of activating the original jurisdiction of the apex court.
He struck out the suit for want of jurisdiction, proceeded to also determine the case on the merits, and dismissed it.
However, Justice Obande Ogbuinya dissented and held that the case succeeded in part.
Among others, Justice Ogbuinya held that although the President could declare a state of emergency, the President could not use such power as a tool to suspend elected state officials, including governors, deputy governors, and members of parliament.
The thing most of them fail to remember or understand is that your Hajj is void if you can’t provide enough for your family to feed on while you are in Hajj. Taking a loan for Hajj is not allowed in Islam, I understand they might say no interest on the loan but Hajj is not compulsory if you are not capable and it might become a sin if not done properly.

Pilgrims pay the Federal Government, through the National Hajj Commission (NAHCON) for their pilgrimage.
The government's role (through the National Hajj Commission and the National Christian Pilgrimage Commission) is to receive money from pilgrims and help them organise the pilgrimage. The government helps the pilgrims to negotiate with airlines and get a good deal (discounts, etc), but the airfare is paid by the pilgrims. The government provides consular services to ensure that the registered pilgrims can enter the Holy Lands and that they are safe there, etc. but the cost of the pilgrimage is borne by the pilgrims.
The National Hajj Commission has set a deadline of December 5th for pilgrims to pay for the pilgrimage, but the Kebbi State Government says that some of its citizens will not be able to pay by that date and so it is giving them a loan, that is, it will pay on their behalf and then they can repay the state government later.

In 2024, KEBBI STATE generated ₦16.97 billion in Internal Generated Revenue (IGR).
In 2025, KEBBI STATE provides ₦10 billion intervention to support intending pilgrims ahead of the 2026 Hajj.
If Kebbi State were to fund the 2026 Hajj with its 2024 IGR, that would mean spending approximately 60% of its IGR on Hajj [intervention].
The level of ignorance and unprofessionalism being displayed by this account is disgraceful. What Kebbi state did was to loan this amount of money to Hajj commission and before April of next year that amount of money will be paid in full. It’s a business venture they invested into which will yield 1- profit 2- community appreciation and ease access to subscribe through installments.
