A Federal High Court sitting in Benin, Edo State, has ruled that inmates of prisons in Nigeria have the right to vote in all elections conducted in the country, PM news reports. The court, presided over by Justice Mohammed Lima, gave the ruling in a suit instituted by Messrs. Victor Emenuwe, Onome Inaye, Kabiru Abu, Osagie Iyekepolor, Modugu Odion for and on behalf of inmates of Nigeria Prisons, against Independent National Electoral Commission (INEC) and the Controller-General of Nigeria Prisons Service, also directed the Defendants to ensure that the Applicants are not disenfranchised The plaintiffs had in an amended Originating Summons, asked the court to determine “whether having regards to the provisions of section 25 of the Constitution of the Federal Republic of Nigeria 1999, as amended in 2011, and section 12 (1) of the Electoral Act 2010, the plaintiffs are not entitled to be registered as voters by the first Defendants”; Other reliefs sought by the plaintiffs were that the court should determine whether having regard to the provisions of Section 77 (2) of the Constitution of the Federal Republic of Nigeria 1999 and Section 12 (1) of the Electoral Act 2010, the plaintiffs are not entitled to cast their votes at any election; and whether the failure of the first defendant to make registration and voting provisions for the inmates in the custody of the 2nd Defendant does not constitute an infringement on their rights as citizens of the Federal Republic of Nigeria as enshrined in section 14 (1) (2) (a) (b), section 17 (2) (a), section 24 (b), (c), section 39 of the 1999 Constitution of the Federal Republic of Nigeria, Article 13 (1) and Article 20 (1) of the African Charter on Human and People’s Rights. Justice Lima declared in his judgement that “any act by the 1st Defendant to deny inmates the right to vote is unconstitutional, illegal, irregular, unlawful, null and void and of no effect whatsoever; that the Defendants do not have the constitutional right to deny the claimants their voting rights; that being an inmate is not an offence that impedes their registration and voting right under section 24 of the Electoral Act; and that the exclusion of inmates in elections conducted in Nigeria is illegal, ultra vires and null and void.” The judge then made an order of mandatory injunction restraining the 1st Defendant to update and include in the National register of voters names of citizens in the custody of 2nd Defendant and an order of mandatory injunction directing the 1st and 2nd Defendants, a body totally known to the Constitution, have the constitutional mandate, capacity or authority to include the Plaintiffs and make the environment comfortable for them to exercise their franchise. Counsel to the Plaintiffs, Barrister Aigbokhan President, lauded the judgment and stated that erosion of inmates’ rights to vote creates dangerously fragile environment for overall human rights in the reign of 365 days of human right being the theme of human right in 2014. He opined that “the judgment is a wedge on the slippery slope of creating second class citizens in Nigeria.” |
Being a statement released by Prince Tonye Princewill on his 2015 gubernatorial ambition: After extensive consultation on the next steps to follow, I and my team have decided that we no longer have a future in PDP and that win or lose, going forward, we will now be building our future here in the Labour party. Just as we refused to return to APC having since left it’s parent organisation in 2010, our departure from PDP is also final. It was not an easy decision to make, I made many friends there and I still have a lot of respect for many men and women within the party, just as I do within the APC, but this is not the reason I entered politics. I came to change the politics, not to maintain the status quo or make friends. I no longer feel I have enough allies or a willing platform to achieve this goal and so I must move on. The struggle continues. Some have asked that I maintain a dignified silence and remain within the PDP or that I should quit politics altogether. But I need to be able to look my children in the eye. This is not the Nigeria, I can defend, because this politics and its conduct are the very foundations on which this nation are built. I refuse to give up on Nigeria and so I can not give up on its politics. Politics as I say time and time again is too too important to be left to politicians. I only wish more of us appreciate this and join me where I think we really can make a difference. This pattern truly is not sustainable, the status quo will no longer hold. I have to do this for the sake of our children. I would like to thank the Labour Party and its national leadership for giving me a reception fit for a King and the warm way the state leadership have embraced our arrival. I always complain that our political parties lack ideology and do not have an identity of their own but that position can not be levelled at Labour. With a social democratic ideology, a detailed manifesto and policies that closely mirror mine, I feel most at home here. Politics does not always have to be about just winning. It can be about doing the right thing as well. Finally, unlike previous political decisions that I took with only my political family, this consultation cut across all walks of my life. I want to thank you all for your contributions. From social media to private communications and the political equivalent of smoke filled rooms, you took the time to lend us your voice. I want to thank you for all your contributions. Even when we disagreed. With the help of the BOT Chairman, our able Chairmen at national and state levels and the executive of the party here in Rivers state, I want to use this opportunity to reach out to all aggrieved PDP and APC aspirants who have their people’s interests above their own, potential aspirants who never thought politics would give them a chance and opinion leaders who are left everyday to pick up the pieces of bad governance to come and join the next government of Rivers state. The Bible says, “When the righteous rule, the people will rejoice.” I make bold to say, the right people have arrived. Stop wasting your time on politics as usual, and come and rejoice here with us. The All Progressives Congress (APC) and Peoples Democratic Party (PDP) in Rivers State have traded blames over yesterday’s bombing of the State High Court, Ahoada and a fire incident at another court in Okehi. Interim Chairman of APC, Mr Davies Ikanya, in a statement, said that those behind the act were allegedly rattled by the recent ruling of Justice Charles Wali of the state High Court in Ahoada which ordered member representing Ogu/Bolo state constituency, Evans Bipi, as Speaker of Rivers State House of Assembly. He said: “It is very unfortunate and sad to note that the state High Court in Ahoada, was bombed this morning (yesterday) by agents of undemocratic elements. Those that perpetrated this act may not be far from those who are not comfortable with the ruling by Justice Wali, of December 16, 2013 barring Bipi, leader of the G6 rebel members of the Rivers State House of Assembly, from parading himself as Speaker of the Assembly”. On its part, PDP, in its statement, blamed those allegedly against the High Court sitting to reverse its decision on Bipi as being behind the explosion. State Chairman of the party, Mr Felix Obuah in a statement signed by his media aide, Jerry Needam, said those behind the explosion at the state High Court, Ahoada, also wanted to create the impression of an insecure Rivers State. “The case that temporarily restrained Bipi from parading himself as Speaker, Rivers State House of Assembly, was to come up today (yesterday) at the court. Our team of lawyers made up of over 10 Senior Advocates of Nigeria from Abuja and Lagos arrived the state high court, Ahoda, this morning (yesterday) to argue for the vacation of the interim order, and saw the senseless and barbaric destruction of the court. “The PDP makes bold to suspect that the reported bombing was carried out by agents of Rivers State Government to prevent the court from sitting, so that the court would not be able to vacate the interim order made by Justice Wali” |

Akwa Ibom State Governor, Godswill Akpabio, on Monday maintained that disrespect for the office of the President of Nigeria is central to the crisis in the party. Seven aggrieved Peoples Democratic Party governors had during the last mini convention of the party in Abuja stormed out of the venue to form the "New PDP." They had protested against alleged lack of internal democracy in the party and demanded for the sack of the party's National Chairman, Bamanga Tukur, among other demands. Speaking with State House correspondents in Abuja on Monday, Akpabio said that governors can only get respect from people and institutions under them only when they respect people and institutions above them including the office of the President. Asked when the problem and demands of the aggrieved governors would be finally addressed, he said, "Well, I've seen newspapers clips where they said the rebellious governors, the G-7 and so on and so forth. In any rebellion, we can resolve it through dialogue and I think that that's what the President is doing, that's what the PDP leadership is out to do to see how it can dialogue and bring the situation to a close." "But, you see, it all depends. But for me, I believe that you cannot be a good leader unless you're a good follower and I believe also strongly that leadership comes from God. So the question of rebelling against leadership does not occur because if I rebel against the leadership at the federal level, I should expect somebody also to rebel against my leadership at the state level, may be from my own local government or thereabouts," he added. |
The spokespersons of the Peoples Democratic Party (PDP), Olisa Metuh, and the party's candidate in the Anambra governorship election, Tony Nwoye, were not at Metuh's Special Assistant, Richard Ihediwa, said November 25 in Abuja that some elements purporting to be directors of Tony Nwoye Campaign Organisation had been making infantile remarks, suggesting that Nwoye and Metuh had disagreement with each other over the PDP candidate's position on the controversial poll. "We wish to state categorically that there is no problem between the National Publicity Secretary and the PDP candidate in the Anambra election, Comrade Tony Nwoye. Chief Olisa Metuh participated actively in his campaign and was physically present at Awka to coordinate the situation room on the day of the election," he said. Ihediwa advised the acclaimed directors - who he called "loathsome characters behaving like planted agents" - to rather focus on how to mobilize PDP support for the supplementary election, scheduled by Independent National Electoral Commission (INEC) for November 30. Last Friday, November 22, Nwoye joined his counterparts from the All Progressives Congress (APC) and Labour Party (LP) Chris Ngige and Ifeanyi Ubah respectively, to reject the result of the governorship election. The trio insisted that the poll was characterised by malpractices, adding that they would boycott the supplementary polls. Ihediwa also noted that thanks to their "immature, inexperienced and irresponsible advice," the purported directors allowed Nwoye to attend a joint press conference with Ngige where Nwoye, despite being the leader in the election results announced so far, played second fiddle to the APC candidate. "This gave rise to the manipulation of the APC in leading our candidate not to actively participate in the Sunday election in Obosi, wherein the APC candidate surreptitiously mobilised his people to vote; a situation which enabled him to bridge the gap of the total number of votes cast," Ihediwa stressed. Metud's assistant explained that Nwoye had been in constant communication with the PDP's leadership on the Anambra election, adding that "he spoke severally to the National Chairman through the National Publicity Secretary before the National Working Committee took its final position on the election last Monday." He further said the NWC communicated its final decision to Nwoye before making it public. Therefore, it was unfortunate that Nwoye's handlers chose to plant fabrications in the media, suggesting that the PDP and its candidate were singing discordant tunes on the election. Besides, Nwoye confirmed Speaking in a telephone interview on Monday, that despite media reports, the relationship between him and Metuh remained "cordial." Anambra gubernatorial poll that took place November 16 has been surrounded my many controversies since then. Some parties have called to cancel the results, while INEC declared the election inconclusive and ordered supplementary election in 208 polling units. |
