Only the chief judge can set up the panel

When the chief judge is by his side there is absolutely nothing the court can do
The chief judge is neutral sir. Remember, he tried suspending him. The chief judge will set up a panel and that's his only role

If they are sure of themselves, let them reconvene and made law for Rivers State.
They will anytime today or next week. As you are supporting illegality, I hope you won't mind if it backfires

Ruled on what exactly?

Before this ruling was there a consolidation of all existing cases ? does this means other cases challenging their status ceases.
As of today, Amaewhule is speaker by virtue of the appeal court ruling and remains so until the apex court reverses

Their seat has declare vacant by then legally recognised Speaker Edison Ehie. I still put it to you, please share a link where a judge has set that aside or any injunction against that.
Lol, Who made Edison speaker? Edison was suspended firstly and a 4 man assembly is powerless. The appeal court has recognized Amaewhule and that's final

Let me repeat what the other guy saying.

1) According to Supreme court intervention on defection, once you left your party that sponsored your candidacy, you've lost your sit.

2)This is the reason why no court has ever said that their sit is not vacant.

3) The same reson they ran back that they didn't defect.

4) Wike on National TV even denied and says he's not Aware they defected 🤣( wrong advice 1 but later denied)

5) The same wike ask his two parties PDAPC not to contest.( wrong advice 2)

6) My brother, concerning the 27 group of friends working for a man instead of the state, no amount of argument on this platform will bring them back.

7) The recent Judment only talking about the budget that happened before their defection.

cool Able Governor Fubara has file an appeal to supreme, the judgment won't do nada because 2024 budget will expire by December.
Note: Fubara already preparing 2025 budget and to be presented to the Authentic house ( either 1 or 3) next month November.

It's good to be loyal to your godfather but it's wrong to do it fulishly

Shalom
For now, the appeal court has recognized them so they remain lawful

Impeachment? All fubara needs is the chief judge and that's the end... That's even if he looses the house
Once the house serves him an impeachment notice and tells him to set up a panel, he is gone as the panel will find him guilty

you did not see that they defected in the house and read out letters? Or you are not aware that in one of the cases there is a sworn Affidavit by that he and his co-travelers have joined the APC?
Where is the evidence that they defected in the house? Are you in position of the letters of defection? The case where they swore affidavits have been abandoned and dead.

Oga, you have spoken well but in most cases, common sense is not applicable in Law. Please, can you share link and highlight a place where a judge has ever ruled that the seat of the 27 law makers are not vacant or they have not defected, bearing in mind that injunction, experte order and stay of executions are not court rulings ? When you share that, we can continue with this debate
You lie... Can you rather share with us where a federal court declared their seats vacant? Are you aware that injunctions and exparte orders are binding and have force of law. Until a court declared their seats vacant, they remain legal

See what you wrote and na you dey call people stupid.

Question 1:

Did Amaewhule and his colleagues officially switch their political party affiliation to the APC during a legislative session?
Question 2:

Has there been a written declaration from Amaewhule and his associates stating they have joined the APC ?

Question 3:

Considering these actions, is Amaewhule still a recognized member of the current legislative body?
No to all three questions

Ofunaofu:
The Appeal court judgement Recognize the Amaewhule faction as what?

Please be consistent
The appeal court clearly said the governor should represent the budget to the Amaewhule led assembly....
The high court earlier this year said there is no evidence of defection.Do you have a letter of defection to the pdp or to the speaker?
PoliticsRe: Amaewhule: Defected Lawmakers’ Seats Remain Vacant – Rivers Government by Okpebholo1: 10:27am On Oct 11, 2024
Ofunaofu:
The constitution is very clear. You don't need the court to give effect to that. Going to the courts is just an avenue to buy some more time but the truth remains that they are no longer members of Rivers state house of assembly. Any action taken by the former lawmakers remains null and void and of no effect
The court which interprets the constitution has already recognized the Amaewhule faction. It is people like you that misled obi in court...can you even prove that they defected?

The Nigerian constitution

Section 109(1)(g) of the 1999 Constitution, mandates that lawmakers who switch political parties loses their seats.
True but only the court can give effect to that not you or I. When saraki and others defected, where they removed? The only defected lawmakers that was sacked was in 2019 by the supreme court.

How will they do it?

They are no longer members of the Rivers State House of Assembly, the reason being that they defected from the PDP and as such automatically lost their seats.

You don't put something on nothing and expect it to stand. It won't work.
Who declared their seats vacant? You or the governor. By now, you should know how politics and law works, leave emotions. Only a federal court can declare their seats vacant
The appeal court clearly said the governor should represent the budget to martins Amaewhule which means in the eyes of the law, he remains speaker

By the time the Supreme Court rules on the matter, 2024 must have gone. By then it will become an academic exercise.

And as for the former lawmakers, having defected from the PDP to the APC, they automatically lost their seats, and those seats remain vacant until INEC conducts a by-election; unfortunately for them, the party they claimed to have defected to said that they are not their members. Too bad for them because they allowed Wike to deceive them.

Their political career ended abruptly.
Before then, they will impeach the governor

Armaggedon:
Ofcourse the judgement of the court of appeal yesterday was about the budget. The status of the defected lawmakers was not a subject of determination. Nullification of the budget was based on the fact that Fubara withdrew his case earlier at the federal high court as a result of the peace agreement and cannot appeal it. But the judgement itself is an academic exercise since the 2024 financial year would have ended by the time supreme court concludes it.
Their status was decided sir. The appeal court clearly stated that the governor should represent the budget to the Amaewhule led faction

PoliticsOluwatoyin Babalola: Protesters Storm INEC Office, Demand Removal Of Ondo REC by Okpebholo1(op): 9:18am On Oct 11, 2024
Scores of youths have demanded the immediate removal of the Resident Electoral Commissioner (REC) in Ondo State, Oluwatoyin Babalola.

The youths, who stormed the office of the Independent National Electoral Commission (INEC) in Akure, on Wednesday, accused Babalola of ‘fraternizing’ with some politicians ahead of the governorship election in the state.

INEC had announced November 16 for the off-cycle governorship election in the state, with the participation of 17 political parties.

Wielding placards with different inscriptions, the aggrieved youths said the continued stay of Babalola as the state chief electoral officer could undermine the process of the election.

Ijanusi Olawale, who spoke on behalf of the protesters, alleged that Babalola had compromised by ‘romancing’ the members of the ruling All Progressives Congress (APC) in the state.

Olawale, who accused the Ondo REC of being a card-carrying member of the APC, said Babalola must leave the commission to allow a free and fair process of the governorship poll.

He asked the Chairman of INEC, Prof. Mahmood Yakubu, to transfer the REC outside the state while demanding the appointment of a neutral and unbiased chief electoral officer for the election.

The compromised position of Mrs Oluwatoyin Babalola is further undermined by her activities and alliance with members of political parties within the state, and this clearly is a conflict of interest.

“The interest threatens to undermine the foundation of our democracy and imperil the trust of the people of the state in the electoral process. So, we are here demanding that she must go. Let her leave this state and go somewhere else. We can’t trust any process under her.

“Even, her association with notable politicians in Ondo State, especially the members of the All Progressives Congress (APC), indicates the polarization of the electoral process, leading to loss of faith in the democratic system,” he said.

All efforts by Daily Trust to get the REC’s reaction proved abortive as her mobile was switched off.

But the administrative secretary of the commission in the state, Biodun Amosun, told our correspondent on the phone that the allegations raised by the youths would be addressed.

Amosun, however, assured that INEC remained an unbiased electoral body and would ensure all votes count in the upcoming election.

“Let us assure you that the issue will be handled by the INEC Chairman. The Chairman will look into the demands and allegations.

“We will look at the various issues. We can assure you that the issue will be adequately flogged. But one important thing is that votes will count in Ondo State,” he added.

Mr. Man, what you're seeing as mundane, may not be mundane to others. Issue of election is a serious issue and cannot be mundane to those that needed materials to prosecute their case and one party will be delaying their finding, when issue of election is time bound. By tomorrow they must submit their petition to the tribunal and a party that claimed to have won the election, dragging them back not to meet with time and you're calling it a mundane issue. I am sure if it was APC that lost the election and such act was exhibited against APC, your tune won't be the same and it won't be a mundane issue.
You now changing words. I thought you claimed it was the judge that says they should start with voters' register. It is now that the parties present agreed that they should start with voters' register and it was only PDP that disagreed. Double words on a single issue.
Just I had said, respondent or judge cannot tell the petitioner cannot tell how he should go about his investigation. He may decide to investigate the voters' register or not. The judge own is to scrutiny whatever the petitioner brings to them.
Oga, all parties got the tribunal order to inspect the bvas including APC so majority carries the vote. Either they start with register or nothing

The court will never tell which aspect of inspection to begin first. Stop manufacturing words to justify nonsensical behaviour exhibited by APC on this particular matter.
Did you even read the portion of the news where the APC chairman said, he didn't bring his copy of voters' register but you mischievously manufacture lie to support their madness. Please don't lose your conscience because of politicians. After the inspection they will go home with millions of naira if not dollars while you and I will just spit and spit on the net.
Oga, that is what the accord party lawyer even said which is the most reliable being a neutral party. Assuming the court didn't specify, the voters register comes before any other material commonsensically. Besides majority of the parties present agreed that they must start with voters register. Only pdp is the one disagreeing. Imagine calling someone mad over such mundane issues. It clearly reveals your mental state

The petitioner may even decides not to access the voters' register if he so wished. Should that bug the respondent?
