An invention is patentable in Nigeria if;
a) it is new, results from inventive activity and is capable of industrial application; or
b) it constitutes an improvement upon a patented invention and also is new, results
from inventive activity and is capable of industrial application.
An invention is capable of industrial application if that invention can be manufactured
or used in any kind of industry, including agriculture.
Patents cannot, however, be obtained in respect of (i) plant or animal varieties or
essentially biological processes for the production of plants or animals (except
microbiological processes and their products); (ii) inventions the publication or
exploitation of which would be contrary to public order or morality; or (iii) principles
and discoveries of a scientific nature.
The Applicant may be the inventor or his Assignee who may be an individual or a corporation. The right to a patent in respect of an invention is vested in the statutory inventor, that is to say, the person who, whether or not he is the true inventor, is the first to file or validly claim a foreign priority for a patent application in respect of the invention.
The invention must be novel that is to say, no publication or use of the invention in Nigeria or elsewhere before the date of application.
Regarding the examination of the invention, no substantive examination of the invention is carried out. Examination is as to form only. This means that once the documentation is complete and in order, the Patent is granted without further examination.
The term of the patent grant is for twenty (20) years from the date of filing. Pls note that the patent registration is renewable annually. It can still be renewed within six (6) months after grant but with a penalty.
