It’s a non immigrant visa, if you don’t marry your fiancé and adjust status you can’t become an immigrant. But will they treat it as a non immigrant visa for the purpose of this ban? We have no clue. Pls let us know what they say when you call. How is a K1 applicant even meant to prove hardship for the waiver when you aren’t even considered as a family member yet. I tire!

It will be extremely difficult to prove hardship for k-1 visa but it’s possible! Please read up on other cases in regards to people under the 2017 proclamation!

Update: I went to Dhl this afternoon, they said my passport wasn’t ready, I drove back home and within 1hr I got a text to pick up my passport! So I will go back on monday

What I really don’t understand is whether K-1 is immigrant or non-immigrant! Its confusing! Cus it is issued as a non-immigrant visa but processed by the immigrant section of the embassy! I will personally call them on monday

Attend your interview! If the ban doesn’t affect k categories, all will be well; however, if it does, then irrespective of the VO’s decision, your case will go into Administrative processing until the ban is called off!

This is from Ustraveldoc website! It clearly states that K-1 visa is a non immigrant visa� Remember,some people might get to America and decide not to marry their finances anymore! There is not need to sweat my people! Besides, if Burma Embassy already confirmed it, then so be it! All the best my people

they've not sent it yet but I think it's ready, we've not called to get it though, so many people with same NOA1 date as mine on vj have theirs already, this ban really stole the fun away from the process for me. I'm still hopeful and positive

Mine was ready in 5 business working days(with weekend makes it 1week)but the norm is within 10 working days(max) it ll be ready,keep tracking once it reads issued you can go pick it up or put a call through to ustraveldocs after 5days to check status of the visa(if the status when tracking is not changing)once it reads issued go pick it up,cos pick up email&texts comes in rather late @times for some pple

I'm not a legal expert but I think it doesnt affect those who hold a valid immigrant who are arriving after 21st. This is because of the word "and". That is, the reason why one woild be denied entry is if he or she is outside the States, have no valid visa and does not qualify for a visa. Once he or she has a valid visa OR is already in the States OR qualifies for visa on entry then the rule doesnt affect the person.

Lol...it is unlawful to marry twice. If you must apply for a student visa, do so with a married status. If you travel to the US with a single status and try to remarry your wife, it may backfire. American immigrations abhors irregularity/consistency. I am sure the status of your wife who is an American citizen is married, so how does she explain to the authority she wanna remarry without divorce?

She can file for a spousal visa for you, the only thing is you don't know when it will be approved.

I think all you need now is patience , don't let desperation make you do things that you will later regret.
