Hello Nairalanders, today we’ll be explaining the different types of land measurements. Often times some interested buyers of properties are often confused as to how these lands are measured, their differences and how to understand the parameters used in measuring.

It is very possible that you reading now have also at one point in time wondered, what is the size of a plot of land? And what could that be in square metres? Some also wonder how does a plot compare with an acre or hectare? These are some frequent questions often asked by real estate buyers in Nigeria. These questions are sometimes replied with varying answers depending on who you ask.

There are various terms which are currently in use across Nigeria to denote or measure the actual size of a land or property. We believe that it is important that you have a good understanding of these terms in order to make better informed decisions and get the best properties for the best prices.

Majority of the people in Lagos and Abuja prefer to use the square meters as a way of measuring in the official land documents: but often times, sellers and agents alike are more accustomed to the use of terms such as plots, acres, hectares and square feet. However these units of measurement can be easily converted to one another, depending on who is transacting. Furthermore, we intend to help you understand some of these measurement terms and how they compare to one another.



A plot of land

The first thing you will need to understand about these widely used term for measurement is that there is no existing standard size. As the measurements used in respect to plots defer from place to place.

A plot is traditionally known as a term that is used to describe any piece of land. The term “A plot” can be used flexibly when referring to various land types, either for building a home or for farming. When looking to buy land, it is wise that you ask the developer or agent “what is the size of this plot in question”?

However the typical plot of land in Nigeria usually measures between 100 ft x 100 ft = 30 m x 30 m = 10,000 square feet = 900 square meters. In which, a half plot can be considered to be 50 ft x 100 ft = 15 m x 30 m = 5000 square feet = 450 square meters.

Although these measurements may vary from state to state in Nigeria, there can be variations to the sizes of a plot: 18 m x 30 m (540 sqm) and 18 m x 36 m (648 sqm; Lagos) are also common plot sizes. This is why it is essential that you always request sizes in square meters, for such things as ease of comparison.



Usually the size of a plot can be measured using various measurement units such as acres, hectares. Also it can be in square feet or square metres. These units are widely known as international standards of measurements: Imperial (feet, acres) and metric (meters, hectares).

The term acres and hectares are bigger measurement units which are mostly used for larger areas of land like forests and farmlands, while units like feet and meters are mostly used to describe smaller plots of land, like in cities, where you may want to build a house.

So therefore In Nigeria, a plot is usually in reference to smaller parcels of land. As Nigeria primarily uses the metric system of measurements, which is also the reason why these plots of land are usually measured in square meters.

Also these are the reasons why official land documents in Nigeria are also documented with sizes in square meters.


6 Common units used for measuring land in Nigeria


Meter (m)

The meter is a basic unit of length used in the metric system. It is also the equivalent to 100 centimeters or 39.37 inches.


Foot (ft)

A foot, which is actually the of singular feet, is another unit used for measuring length. It is used in the imperial system of measurement. It is also the equivalent to 30.48 centimeters or 12 inches.

Square meters (sqm)

A square metre is fundamentally the metric unit of area. While a square meter is the area of a square which has sides that measure 1 meter in length. It has a symbol m². It is also used for measuring areas of anything from rooms to houses to land.



Square foot (sq ft)

The square foot, which is the singular of square feet, is an imperial unit of area. 1 square foot is also defined as the area of a square which has sides that measure 1 foot in length.


Acre

The acre is another unit of area commonly used in land measurement in Nigeria, typically a large expanse of land. 1 acre is equivalent to 4046.86 sqm. An acre is approximately 40% of a hectare and is roughly the size of a standard football field.



Hectare

A hectare is a unit more commonly used for measurement of a very large tract of land i.e A vast expanse of land to be used for large scale farming or the building of an industrial project (like a big factory). 1 hectare is equivalent to 100 m x 100 m or 10,000 sqm. A hectare can also be represented as 2.47 acres.

Hello dear readers, our article today will be centered around a term that many first time Real Estate Investors often here about but might not know its meaning or importance, and it is the much talked about C of O. A Certificate of Occupancy (C of O) is an important land title document in Nigeria. This piece of document along with others like the survey plan and the deed of assignment, are very vital in the process of land acquisition and transfer of ownership. It also serves a fundamental purpose, which is to help to prove the rightful ownership of a land. In this article, we’ll try to expand on this in detail.





What is a Certificate of Occupancy?

A Certificate of Occupancy (C of O) is basically a land title document that is issued by the government to land owners. It serves primarily as a legal proof of land ownership in Nigeria. Without the possession of the C of O, a person/landlord can have their land confiscated or property demolished (i.e During road construction) without any form of compensation from the government.

The C of O in Nigeria has been a very vital document that every landlord must possess ever since the Land Use Act 1978 was introduced and it helped to standardized land administration in Nigeria, by vesting all urban land within a state, in the state governor (rural land is administrated by the local governments in which they are found). This legislation gave the state governors the power to grant “statutory rights of occupancy” as they deemed appropriate. In addition, this act introduced the concept of land use (residential, commercial, mixed use etc.).

With the introduction of this act, came the abolishment of all existing freehold systems, which was replaced with a lease hold system. These leases are usually granted for a maximum period of 99 years – after which the landlord must apply for renewal.



Things usually contained in the C of O includes:

Certificate of Occupancy no.
File no.
Plot no.
Location (district details and cadastral zone)
Plot size
Survey plan or graphic (plot shape)
Date of issue
Lease term
Initial annual ground rent fees
Land use purpose
Terms and conditions


What is the Difference between Right of Occupancy and Certificate of Occupancy?

A Right of Occupancy (R of O) document is basically an offer to a said plot of land, while a Certificate of Occupancy (C of O) is the better recognized official right of ownership over that parcel of land.

The R of O is actually good but a weaker title when compared to the C of O — as with the former, you can be stripped off your title even without any form of compensation, whereas in the case of the C of O, which is by far a superior title, compensation must be paid for any compulsory government acquisitions or demolition. This is the reason behind lands/properties with C of Os having a higher market value than those without it.

To put it in plain terms, it is important that Right of Occupancy holders perfect the title on their land to Certificate of Occupancy as soon as possible.







Who needs a Certificate of Occupancy?

Below are a number of reasons why you should strive to get a Certificate of Occupancy:



During Property development

It is important to note that, in order to get approval for building construction projects, a Certificate of Occupancy is one of the title documents needed.



Converting a property

This is not a common knowledge amongst many out there. That when you want to change the primary use of a property, a C of O is usually required. For example, a commercial warehouse being converted to blocks of flats for residential purposes.



Change of ownership

Whenever you intend to change the ownership of a property; either one given to you as a gift or an inheritance pass down to you. Regardless of the type of property involved. A new certificate of occupancy may sometimes be required.

Having said all this, some cities in Nigeria such as Abuja do not readily give out new certificates. But as an alternative, raising and registering something like a power of attorney — in favor of the new land or property buyer, also serves the same purpose.

The Lagos State Government has recently announced its decision to reduce Land Use Charge (LUC). The Commissioner for Finance, Dr. Rabiu Olowo stated that the LUC reform is necessary to address the housing challenges of Lagosians and to reduce the financial pressure on citizens.



According to him, “As we are aware, in 2018, there was an increase in LUC rate and at the same time a revaluation of property; this twin-shock had a sporadic increase in LUC assessment. The soon to be revealed reforms will among other things, reverse the rate to pre-2018 rate”.


He further explained that the intention of the State government is to keep economic activities strong, without necessarily causing any untold hardship that will further aggravate the present financial challenges confronting all sectors of the State’s economy, majorly caused by the Covid-19 pandemic.

This move has been applauded by many Real Estate experts to be a step in the right direction. As it will go a long way in cushioning some of the effects of the pandemic.


The finance commissioner also recalled that Governor Babajide Sanwo-Olu had in January this year, signed the Issuance of N100bn Series III Bond (the largest Bond Issuance ever raised by any Sub-National entity in the country) under its N500 Billion Bond Issuance Program, meant to assist the State meet its huge infrastructure needs in critical sectors across Health, Environment and Roads, among others.

1.Certificate Of Occupancy (C of O)

A C of O is primarily known as the officially recognized Land Document for demonstrating Right to a Land/property. It is a Land Document issued by the State Government which officially leases any land under the state to the applicant for 99 yrs. As previously known, all lands belong to the Government.


2. Deed Of Assignment/Conveyance
This is another important document that must be demanded and given to a purchaser after the conclusion of any land/property transaction between such Buyer and the Seller of the property in question.

The Deed of Assignment contains very important information for every real estate transaction. For example, it spells out the date when the ownership of the property transfers from one owner to the other. The deed also gives a specific description of the property that is included in the transfer of ownership.



3. Deed Of Mortgage
This document is seen by law as a security for a loan with an undertaken for repayment . The common types of mortgage transactions are; Equitable Mortgage and Legal Mortgage

Legal mortgage is known as a type of mortgage which transfers the legal interest one has in the property, whether leasehold or freehold in consideration for loan advancement while Equitable Mortgage transfers just an equitable interest in the property to the mortgage.



4. Survey Plan
This piece of document helps to clearly show the boundary measurements of a parcel of land and also gives an accurate measurement and description of that land. It reveals the true ownership status in any properties’ transactions. It also helps to reveal if such land is not under any government acquired or committed lands/area.

Professionally trained Surveyors are the people who handle survey plans and they are also regulated by the office of the Surveyor-General of the state where the property is located.



5. Land Certificate
This is a document of title as to the ownership of a piece or large parcel of land. Prior to the promulgation of the Land Use Act of 1978, it was usually issued by a government’s land registry for registered freehold or leasehold lands in Nigeria. Land Certificates were issued to owners of landed properties when the Property Conveyance Law of 1959 was still in effect.



6. Deed of Lease
It is also known to many people as Governor’s Consent. This land document is obtained whenever you buy a land with C of O. It’s the land document that lets the office of the Governor and the general public; know that the land in question has changed ownership.



The Deed of Lease was majorly used to transfer property especially government properties in Ikoyi, Surulere, Victoria Island axis of Lagos state during the mid-70s and 80s after the promulgation of the Land Use Act. These lands were mostly federal government lands at the time and also high profile lands. It was also the first foray into the issuance of the certificate of occupancies for the first time to people.



7. Deed Of Sub-Lease
This is another important legal document duly signed and stamped indicating land and landed property transaction between a leaseholder of land sub-leasing his/her unexpired lease term to a third party.

Tyler Perry’s 26-year-old nephew, Gavin Porter was found dead in his cell on Tuesday night Feb. 25th at a prison facility near St. Helena Parish in Louisiana.

Prison officials told the filmmaker’s family that the deceased hanged himself with a bedsheet while in solitary confinement. It was gathered that Gavin was placed in solitary confinement after getting into a fight with another inmate of the correctional facility last weekend.

When checked on by 6pm, the prison officials found nothing of concern. He was however found dead after the guards came back by 8pm.

Beyonce and Jennifer Lopez honored Kobe and Gigi Bryant with their nail art as they attended their memorial ceremony.

The memorial ceremony for Kobe Bryant and Gigi Bryant held on February 24 at the Staples Center in Los Angeles.
Beyonce, who performed to open the event, had her nails done to honor Kobe and Gigi. On the nails one of her hands was written the word “Kobe” and on the other hand, “Gigi” was spelt out. She also painted her nails in purple to reflect one of the Lakers’ team colours.

A married nursery worker had sex with a 13-year-old boy and had his baby, a jury heard today.20-year-old Leah Cordice from Windsor, who was studying child care while working at the local nursery drunkenly walked into the boy’s bedroom where he was playing computer games and pulled down his trousers before having sex with him, the court heard.


It was also claimed that she continued having unprotected intercourse with the child twice a month for a year, even while she was pregnant and after she gave birth to a girl. Her husband believed the child was his but a later DNA test showed that the schoolboy was actually the father, Reading Crown Court heard.
