You're being naive, the law says until there's a crisis at the national body of a party not state. Those that drafted the law knew that it's easy for politicians to create artificial crisis at the state chapter for personal gains that's why the emphasis is at the National body. e g Abure vs Apapa factional case in Lapour party.
