The trial of PDP spokesman, Olisa Metuh continued today, April 8 – At the resumed hearing, a new lawyer was announced for Destra Investment Limited, Metuh’s company – The new lawyer, Tochukwu Onwubufor will be taking over from Onyechi Ikpeazu, Metuh’s lead counsel The trial of the spokesperson for the Peoples Democratic Party (PDP) Olisa Metuh took a different turn today, April 8, when a new lawyer announced appearance for the second defendant, Destra Investment Limited. At the resumed trial, Emeka Etiaba holding brief for Onyechi Ikpeazu, Olisa Metuh’s lead counsel announced to the court that his team is withdrawing appearance for the second defendant, Destra Investment Limited. Following this, Tochukwu Onwubufor, a senior advocate of Nigeria said he was appearing for the second defendant. Onwubufor said he brought a letter before the court to announce his first appearance but the letter was rejected by the prosecution counsel and the court registrar. When asked if he was ready for argument today, April 8, Onwubufor said no. “My lord in the first place, I have not been served of any of the processes neither have I been responded yesterday,” Onwubufor said. He also said he does not have any document relating to the case before the court. “I have not received detailed briefings from the second defendant about his position in the matter. I have not received previous proceedings of the matter that has transpired to enable me file my case adequately. “The issue with this letter is that I was just briefed late yesterday and was only able to bring it to court this morning,” he said. Citing Section 36 (6) a, b and c of the 1999 Constitution as amended, he further urged that the matter be adjourned to give him time to prepare for the matter. Onwubufor said: “Therefore my lord, the second defendant is not ready to proceed with the matter.” He also said that it is immaterial that another counsel has been appearing for his client. The constitution allows for an accused person to choose his counsel at anytime within the trial or proceedings. He said the counsel is also expected to enjoy all the right allowed by Section 36 of the Constitution. But Sylvanus Tahir, counsel for the prosecution – the Economic and Financial Crimes Commission (EFCC) in a reply said he was approached by Onwubufor with a letter. “This morning my lord, the counsel approached me with a letter which content I just got to know now,” he said. Tahir said an application seeking for an adjournment on the grounds that a new counsel had been made to take over from the previous counsel was improper. He said section 349 subsection 7 and 8 of the Administration of Criminal Justice Act stipulates procedures for disengagement of a counsel on a brief, adding that the act allows for a notice of not less than three days should be given for disengagement of a counsel. Tahir said: “There was no notice of disengagement from either or any of them on the team.” He also said that the first defendant is an entity of the second defendant and the counsel on record – Ikpeazu’s team – is bound by the act to continue with the case. But Etiaba said it will be unprofessional and unethical for him to announce appearance for an unwilling client as demanded by the prosecution. The More Details of the Judgement: The supreme court has come up with reasons behind its Rivers election verdict that affirmed the election of Nyesom wike as the validly elected governor of the state DAILY POST reports that the crux of the judgment is that the trial tribunal and the lower appeal court were wrongly swayed by INEC guideline on the use of card readers for the election. The court also said that the trial tribunal denied Wike fair hearing when it was hearing the petition. It held that while it commends INEC for the introduction of card readers, the innovation, however, cannot supersede the voters register. The court said that extant laws of the federation provides for the use of voters register but the card reader irrespective of its importance does not have a place in any extant law of the land. Hence it said that the tribunal was wrong to base it judgment on non compliance with the use of card readers. It advised INEC to approach the National Assembly for an amendment to incorporate the use of card readers in the law of the land. On the issue of allegation of violence and hijacking, the court held that Dakuku was not able to prove beyond reasonable doubt because he failed to bring in witnesses from all the polling units to substantiate the claims. The court also held that for peterside to prove non accreditation, he ought to have tendered the voters register and then demonstrate it. The court said that the voters register could not be jettisoned for the card reader because it has a place in law while the card reader doesn’t. The court also held that the tribunal and the lower court were unduly swayed by INEC’s directive on card reader usage during the election, adding that it cannot supersede the voters register. However, the court while noting that INEC is empowered to make subsidiary regulations as regards election, said the regulations must not go contrary to constitutional provisions. On the evidence of INEC staff known as PW40 who described the election as a sham and a mockery of democracy, the court held that his evidence cannot take the place of voters as he himself under cross exermination did not say that he personally witnessed any violence but depended on hearsay. Finally the court held that to warrant nullification of an election, a petitioner has to prove that there was substantial non-compliance in all polling units, adding that they failed to bring the issue within this parametre. Jonathan Constructed More Roads Than Any Other Nigerian President – Fashola Our Reporter December 9, 2015 Babatunde Raji Fashola , Nigeria’s Minister for Power, Works and Housing on Tuesday while unveiling his plans praised the achievements of former President Goodluck Jonathan. Fashola during his first news conference tagged “Setting the Agenda for Delivering Change” said that Goodluck Jonathan has constructed more roads than any president ever in Nigeria. He also acknowledged that the Transformation in the power sector is above 50 % and that he would try to build on it. Minister of State for Works, Adebayo Adeyeye, also said that Jonathan’s administration has recorded more success in the provision of motorable roads than any other administration in the history of Nigeria. Adeyeye, who spoke as a guest on Channels Television’s Sunrise Daily programme on Monday, insisted that the Jonathan administration has made considerable progress in the road sector, more than any of the governments that have administered the country. Panic has gripped the Federal Government Girls’ College, Efon Alaaye in Ekiti State as no fewer than 300 of its students have been rushed to the General Hospital in the community. This followed the outbreak of a disease suspected to be cholera epidemic in the school. Parents and guard ians have since the incident which had seen the pupils in and out of the hospital in batches, besieged the school to ascertain the state of things. The Principal of the College, Mrs Grace Ogunyomi, was said to have reported the case to the state government on Wednesday for necessary action. Sources said indications that all was not well started on October 10 when some students vomited and stool uncontrollably, sparking fear among the staff and students. No fewer than 31 of the pupils were said to be receiving treatment at the hospital as at press time while others had been discharged. Consequently, the state governor, through the Health Commissioner, Dr Olurotimi Ojo, had deployed health professionals and drugs to help in stemming the tide of the epidemic. Ojo, however, allayed the parents’ fear, saying it was an infection popularly called diarrhea. The Permanent Secretary, Ministry of Health, Dr Folakemi Olomojobi, who spoke on behalf of the commissioner, said that about 20 of the pupils were still being attended to while others had been discharged in batches. The commissioner said the ministry of health had brought in environmental health officials, while many professionals were still being deployed to ensure lasting solution. He said: “We had alerted the water corporation to chlorinate their water. They have about six bore holes and we have got them chlorinated because we know, as professionals, that the water could be a source. “We are trying to look into their environment, so that we can get where such could have broken out. We want to know how they dump their waste and how they dump their sewages. “We have taken the blood samples of students infected to the hospital and preliminary test shows that it was not cholera. A 25-year-old man, Benjamin Ibehmonic, on Friday appeared in a Makurdi Magistrate’s Court for alleged rape of a 13-year-old boy through his anus. The Prosecutor, Cpl. Omaye Ujata, told the court that one Christian Ornguga of No. 39 Off Vandeikya Street, High-Level Makurdi, reported the case at B Division Police Station. Uajta said that Ibehmonic of the same address raped the informant’s younger brother through the anus while he was coming back from an errand. She told the court that the complainant told the police that he sent the victim to buy him recharge card. The prosecutor said that Ornguga told the police that the accused called him into his room, tied his mouth, legs, hands and had sexual intercourse with him through his anus. The accused was arrested during police investigation and he voluntarily confessed to the crime. She said that investigation into the matter had been completed and applied for a date for hearing. The prosecutor said the offences contravened Section 284 of the Penal Code and the accused admitted committing the offence. The Magistrate, Ibrahim Mohammed, granted bail to the accused in the sum of N20, 000 with one surety in like sum. Fayemi to Nigerians: don’t expect miracle from govt For those expecting immediate dividends to validate confidence in newly elected government, former Ekiti State Governor Dr. Kayode Fayemi yesterday warned them to desist. Government, the minister-designate said, needs time to deliver such dividends to their people. Fayemi, who spoke as guest speaker at the 2015 Akintola Williams Distinguished Lecture Series in Lagos, said long-term visioning and succession planning were essential to avoid failed leadership. He presented a paper titled: “Leadership factors and good corporate governance: Key to national growth and development”. He warned politicians who often make “wild promises” before they are voted into office. Participants at the lecture included the renowned chartered accountant in whose name the lecture was held, Mr. Akintola Williams, former Head of Interim National Government Chief Ernest Shonekan, Ogun State Governor Ibikunle Amosun and one- time Lagos State Commissioner for Finance, Mr. Wale Edun. Fayemi said people want immediate results from their elected officials, but governments must realise that succession planning takes time. “The electorate tend to want immediate and tangible dividends to validate their confidence in their elected governments. Politicians, especially in our clime, are prone to crude populism, often making wild promises to perform immediate miracles once they are voted into office. The result is often mutual disappointment,” the former governor said. He added: “Successful development planning, like succession planning, is a long-term endeavour. The economic miracle of Southeast Asian nations was built on the back of long-term planning. “China’s emergence, which is perhaps the most talked about and analysed development story of recent time, was nurtured over the course of 30 years. These are the countries we want to emulate.” Fayemi suggested that Nigeria’s long-term plans must be protected from negative political influences, such as those exhibited by certain African leaders, who continually perpetrate themselves in power. He said: “We simply cannot afford to legitimise the reasons given by some of our African leaders for perpetuating themselves in power indefinitely. “In this regard, it has to be said that Africa’s legacy of developmental under-achievement has something to do with lack of careful succession planning. What we see in Uganda, Rwanda and Burundi today in terms of the pursuit of perpetuation of power clearly attests to this.” He praised the Buhari administration for its commitment to transparency and accountability in government. Fayemi noted that the Nigerian National Petroleum Corporation (NNPC), for the first time in many years, published details of its earnings, adding that openness now characterised incomes generated from the oil and gas industry. “These are some of the transformational acts that signify a new dawn in the relational dynamic between leaders and those that are led,” Fayemi said. He urged the public sector to place merit above issues such as ethnicity, state of origin or religion in recruitment, as “only a public service populated and led by our best and brightest can justly and efficiently provide the public goods such as education, healthcare and housing that will achieve the developmental aspirations of our people”. Fayemi urged Nigeria to tread cautiously in the area of privatisation, as authentic economic growth is impossible without a competent public sector. 800,000 commit suicide from depression annually—DON A professor of psychiatry, Joseph Adeyemi, has said that no fewer than 800,000 people commit suicide yearly due to depression, yet policies on mental challenges remain archaic. Professor Adeyemi, who spoke in Lagos at the presentation of the book Shadows in the Mirror: the Many Faces of Depression, written by Dr. Vivian Ikem, said the Mental Health Act, enacted in the 1900s, was last reviewed in 1959 despite medical improvements made over the years. He said: “Our laws should keep up with current situations, but we have remained static; the way we were in 1959.” Adeyemi described the book as “spectacular,” praising the author for “coming to help” those in the field of psychiatry. According to him, it was difficult to get depression patients to accept the fact of their illnesses. Governor Akinwunmi Ambode of Lagos State, represented by General Manager, Lagos Television, Deji Balogun, said the issue of mental health had not received the attention it deserved. He said that the symptoms of depression could easily be observed, yet people turn a blind eye to the plight of victims, with attendant costs on the economy. “This publication by Dr Vivian Ikem is a timely wake-up call to government and everybody in the society that a smile, a word of encouragement and understanding would go a long way in curtailing the destructive effect of depression in our society,” Ambode said. All Progressives Congress, APC, National Leader, Asiwaju Ahmed Tinubu, described the author as a woman of “excellent intellect” and “unmatchable lucidity.” Represented by Mr. Sunday Dare, Tinubu said depression was a global problem, with 400 million people suffering from it, 12 percent (48 million) of which are Nigerians. Calling the publication “a terrific book,” Tinubu said he had a dream that someday, the author would be celebrated across the country. The former Lagos State Governor said for the author, a Ph.D holder in Chemical Engineering, to write so convincingly about a field of medicine shows her “intellectual discipline, curiosity and intellectual responsibility.” The author, in her remarks, said having suffered from depression, she felt she needed to help others. “I am happy that life gave me lemons, but I am able to make lemonade out of it,” she said. The democratic experience in Nigeria has definitely been a continuing learning curve, and the more lessons we learn at various active centres: people, platforms and processes, the richer our democracy, the stronger the society evolves to deliver a brighter future for the sovereign. The greatest residue of our democracy in the last 16 years (1999–2015), I think, is the manner in which our community has been enriched by lessons that have practically changed our lives. The democratic deficit is less than the gain; for us, democracy is essentially liberative and should endure. It is partly the reason why no matter the observed shortcomings of the five-month old Buhari administration, the Nigerian people remain optimistic about their belief in the viability of the democratic option. They know that they have been empowered in such a manner that succeeding governments will always be held accountable to the electorate. Thus, democracy has reframed the national dialogue and the people’s expectations. In 1999, with the return to civilian rule, the Nigerian people secured victory against a military establishment, which had exercised political authority, formally and informally, for about 33 years. They fought for six years to insist on democracy and the people’s right to choose. Sixteen years later, after many seasons of trial, we have reached a point in our romance with democracy, whereby no other form of government appeals to us. It is clear to every discerning person that only democratic rule is now acceptable to Nigerians. For it has shown us, how powerful we can possibly be. No other event has proven this to be true, more concretely than the last general elections. It should not be lost on Nigerians, the significance of the removal from office of an incumbent President. In 2015, the power of the vote turned the Nigerian voter into the ultimate political authority, resulting in a greater sense of public ownership of the democratic enterprise. He or she knows that elected representatives can be held accountable through the ballot box. Democracy, building on the increased access to information and social interactions, has thus given Nigerians of voting age a voice and power that they never imagined possible. Military figures still show up and occupy high positions, but they do so only through the democratic process and it is only a matter of time before the myth of the military strong man being fit for public office will be completely exploded and laid to rest. In reality, the military’s political authority is diminished as old soldiers seek legitimation through the people. It is a great achievement for Nigeria. Secondly, in 2005, an attempt was made to bypass the Nigerian Constitution and extend to a third term, the tenure of the then incumbent President. This alleged plan against the people was to have been hatched with the imprimatur of the national legislature, but again the people rose against the planned subterfuge. Pierre Nkurunziza may have succeeded in executing the same anti-people ploy in Burundi, and Paul Kagame may be toying with it in Rwanda, but it is not the kind of folly that anyone will ever try again in Nigeria and hope to succeed. The people have learnt that those in positions of power at the highest level may not be trusted to respect the laws of the land or the oath of office they took. Having stopped one former President from transforming into a monarch, the phrase – third term remains in our political lexicon, a reminder of what is constitutionally unacceptable. And for Nigerians, “stayism”, sit-tightism” or the Biya disease is definitely risqué. When people are elected to high office, they will not be allowed to change the rules of the game to suit their own purposes. Third lesson: Nigerians have become very conscious of the implications of the health of their leaders for the stability of the polity. They were taught that lesson during the three-year rule of late President Umaru Musa Yar’Adua. At the time, the key subject was the mortality of the President. From that point onwards, any sign that a potential President could be nursing a terminal disease became a major campaign issue. President Yar’Adua’s death threw up other sub-lessons about the supremacy of the Constitution and the right of other Nigerians to aspire to the highest office in the land, but the people would have preferred to have him healthily alive and not to have a Presidency dominated by morbidity and remembered, and excused, largely on that score. It is therefore not surprising that in the last elections, physical fitness and mortality became key issues of campaign. Fourth lesson: that any Nigerian child regardless of the manner of extraction can aspire to the highest office in the land. With his emergence as Nigerian President in 2010, Goodluck Jonathan laid to rest the myth that to occupy that office, the candidate must be a person of privilege. His parents were ordinary folk. He was himself like the guy next door; his life a replica of the life of any struggling Nigerian of his age who had attended university, gone through national service, hustled for employment and was like the rest of us. Hitherto, Nigerian leaders had elite connections or bearings and they wielded authority as if it was their birthright to do so. This claim to leadership birthright is now a subject of inquiry. It explains why in the last general elections, it became clear to all and sundry that there are now certain minimum standards being set nationwide in terms of personal attributes, experience and exposure with regard to public office. That is precisely the way our democracy has turned out: it has built confidence at all levels, and every Nigerian imagines himself to be a potential President. This is good, for as many people as imagine themselves to be national problem-solvers, the better for our community. However, President Jonathan was the first to prove the point that any citizen whoever he or she may be, can aspire to the highest office in the land and receive popular support. Fifth lesson: when President Goodluck Jonathan conceded victory to President Buhari after the 2015 elections, he raised the moral bar of our democratic process. Nigerians have taken to heart the fact that the people have the power to change a sitting government at all levels and that the power of incumbency even at the centre is at the mercy of the electorate. These days, it is not unusual to find an average Nigerian of voting age holding an elected person accountable and swearing that any form of misconduct will be questioned. Good news! What prevails in Nigeria today therefore is not merely voter confidence; it is best described as voter arrogance or voter dictatorship. In Ekiti, they voted out a well educated, cerebral Governor and replaced him with someone with a popular touch, and they have stubbornly defended their choice. In Abuja, they replaced a young Ph.D holder with a retired old man, called back to serve and “restore.” With the way the Nigerian voter has seized power in the public sphere, only his or her wishes can prevail. And so in the future, with the Jonathan example and experience, no incumbent can hold on to power once the people have spoken. The Nigerian voter is further empowered by digital revolution. He votes on election day with his card, but he votes everyday with his phone, with his access to internet platforms, and he speaks loud and clear, honestly or mischievously depending on his or her constitution. The Nigerian people can no longer be ignored. Positive development? Certainly. But all of what we describe has been made possible by the strengthening of the electoral institutions and processes. It is hoped that successive administrations will see the need to protect and preserve the integrity of electoral bodies, and thereby deepen emergent confidence in their capacity to deliver free, fair and credible elections. Sixth lesson, and this is probably the most important. Nigerians have learnt after 16 years of democratic rule not to place implicit trust in politicians without asking for accountability. They know that professional politicians are capable of lies, they deceive, they over-promise in order to secure their mandate, and also, that there are no true saints in power-ville. They are also learning that election campaign is different from governance, that governance is complex, politics is treacherous, and that politicians will say anything to win the votes and get into power. A corollary lesson: to resolve the cleavages that trouble Nigeria and render institutions ineffectual, government must be effective and our democracy must become more liberal and less of a mechanism for class formation and ethnic competition. Five months of reverse ratiocination by the Buhari administration should make that clear even to the most naive. The people should also know that politicians have no differences on matters of self-interest; and they choose to exploit our many fault lines to achieve their objectives. They can be in this party today and move to the other party tomorrow – which we may see again in 2019. Nigerian politics is therefore not about ideology or principles; it is about power and who gets into the arena. But the people have also learnt one more thing: that change is possible, no matter the shape. And the power to effect change lies in their hands, for we have in 16 years managed to create a citizenry that is both deliberative and participative, whose notion of the state is that it must be affirmative, competent and constructive. By Esther Onyegbula LAGOS—A passenger who was arrested while attempting to smuggle 23 wraps containing $34, 000 has revealed that he hid the wraps under his pants when he could not swallow it. The suspect, identified as Ozoh Ikenna, said: “I was only a courier. I was paid to smuggle the $34,000 to Brazil. They promised to pay me five per cent. I agreed to smuggle the money to alleviate my financial hardship. I could not swallow the wraps, so I decided to hide it in my underpants.” The suspect, Ozoh Ikenna. The suspect, Ozoh Ikenna. According to the National Drug Law Enforcement Agency, NDLEA, Head of Public Affairs, Ofoyeju Mitchell, Ozoh Ikenna was arrested at the Murtala Mohammed International Airport, MMIA, Lagos, on his way to Brazil. The money was detected during the screening of passengers for an Etihad Airways flight to Abu Dhabi. He said the suspect packed the dollars in wraps and concealed in his boxer shorts. NDLEA airport commander, Ahmadu Garba, said the arrest was facilitated by a scanning machine. “We also conducted a follow-up operation where one Ogbo Emmanuel who gave Ozoh the $34,000 dollars was arrested. Investigation by the Assets and Financial Investigation Directorate, headed by Mrs Victoria Egbase, revealed that the suspects were involved in the laundering of substantial amounts of illicit drug proceeds. The account name is Eternal God International Limited.” Investigations also revealed that the cosmetic business of Ogbo Emmanuel at the Trade Fair Complex, Lagos, was a mere hoax, as his sales records did not justify the large inflow of money into his bank account. A Hyundai Tucson Jeep was seized as an exhibit during the raid operation. It was also discovered that suspected drug proceeds were regularly deposited in the said bank account by members of an international drug cell that smuggle cocaine from South America to West Africa.
