We are a registered Cooperative society in Nigeria, We lend money to some of our deserving members as a way of encouraging them and in return make profit for our investors and the cooperative.

We lend money about 2.2m to one of our members who work in a very reputable communication industry in Nigeria. This guy seems be very good from the begining, because before then we use to lend him like 500k and he always return it even before the time elapse so he has build a trust with us that warrant us to give him a higher amount.

The problem started after we gave him the 2.2m in July 2020 and he started giving one excuse or the other and eventually left the country to USA (Japa) with our money.

Now he dont pick our calls or answer to our text messages.

We have presented his cheques saverally even when he was still in Nigeria the cheques returned as dud cheques. We try to involved the police but he was begging us that he will surely pay us we should just give him sometimes.

Even when we discovered that he was no longer coming to hos office he keep on telling us that he is only leave and had traveled to the village.

What can we do that will make him suffer for his wicked actions.

Remember this is cooperative money and we are only the managers of the cooperative.

Security is about to come.’ " That means there are informants in the security that are part of them. THE LORD BURY YOU AND YOUR GENERATION!
The moment they left, the security people arrived saying 'Come out Come out; we are here'. Houses had been burnt and people had been killed. Some were set on fire in their house.
It is delusion of grandeur for any group of people to think that millions of christians in Nigeria will suddenly disappear. It is a symptom of madness.

Former Vice-President Atiku Abubakar has rubbished claims by President Muhammadu Buhari led government that it has defeated Boko Haram. Former Vice-President, Atiku Abubakar Former Vice President, Atiku Abubakar, on Saturday countered claims by the Nigerian government that it has defeated dreaded terrorist Boko Haram. While speaking in Yola, the capital of Adamawa state at the 11th Founder’s Day Ceremony of the American University of Nigeria (AUN), the former vice president said claims by the Federal Government that it has defeated Boko Haram were untrue as the terrorist group is still strong and deadly. According to him, “the insurgents still occupy a specific geographical space,” Atiku said. He added, “they (Boko Haram) still retain the capacity for occasional deadly attacks. Many citizens in the zone still remain vulnerable and live in fear.” It would be recalled that the Minister of information minister, Lai Mohammed had repeatedly claimed that Boko Haram had been defeated, and was no longer holding any territory in the country. In fact, the President while speaking in the 2016 Independence Day speech on October 1, had insisted that Boko Haram was defeated in December 2015. But, latest onslaught by the group against the Nigerian military and serious of other suicide bombing by members of the sect indicates that the President and his Minister of information were just making bogus claims. The former Vice-president further stated that the government "cannot say that the problem is over until every displaced person is able to return home, to the office, to the market, to the farm, and resume normal activities. “We cannot say it is over until we rebuild the schools, the churches, the hospitals, the markets, and the homes that had been destroyed. And we cannot say it’s over until the survivors of this insurgency receive the help they need, including psychological therapy to deal with the trauma that they have been through. “I visited an IDP camp on Saturday and had the privilege of teaching a math class to some children. But the site of hundreds of children running around and unable to attend school was very gut wrenching. It still breaks my heart. So we cannot say the insurgency is over until all the displaced children return to their schools. “And, as I indicated last year, it would not be enough for people to simply return to their pre-insurgency lives. It doesn’t feel that long ago when we broke ground here for what is to be the first private university in Northern Nigeria, and the first American university in Sub-Saharan Africa. Here we are today at the 11th Founder’s Day of this dream we the AUN. Looking back and looking around, we have made tremendous progress. The little acorn is growing into a promising oak. But there’s a lot still left to be done. As you know, the work of building a great university never really finishes. A university is a living organism. It has to keep growing; it is continuously nourished. It becomes ever more complex but also integrated, more extended, and more interesting. This past year has been particularly challenging for us and for the country. The country’s economy, which had remained weak, slid into a recession. There has been little public spending as the new government in Abuja and most state capitals try to figure out how to proceed with governance, just as oil production and revenues plummeted. And when citizens, including parents, have little income to spend, especially in the midst of uncertainty, the effect spreads to various sectors of the economy, including higher education. But it was also a year that saw significant improvements in the security situation in the North East, our catchment area. The commitment of the Federal government and the state governments in this zone, as well as the support of the governments of our neighbouring countries of Cameroon, Chad and Niger, have pushed back against the violent insurgency and improved the security of citizens in the area. The improvement in the security situation also means that some internally displaced persons have been able to return to their homes and try to resume normal lives. I would like to specially acknowledge the efforts of our security forces in making these possible. However, more still needs to be done to restore normalcy in this area. The insurgency remains. The insurgents still occupy a specific geographical space. They still retain the capacity for occasional deadly attacks. Many citizens in the zone still remain vulnerable and live in fear; and we cannot say that the problem is over until every displaced person is able to return home, to the office, to the market, to the farm, and resume normal activities. We cannot say it is over until we rebuild the schools, the churches, the hospitals, the markets, and the homes that had been destroyed. And we cannot say it’s over until the survivors of this insurgency receive the help they need, including psychological therapy to deal with the trauma that they have been through. I visited an IDP camp on Saturday and had the privilege of teaching a math class to some children. You see, Western education really belongs to humanity since different parts of the world contributed to that which we now call Western education and culture. In any case, nobody says we must take everything that is associated with that culture; we can take that which helps us improve our societies while ignoring that which doesn’t. And we must no longer wait for socio-economic and political problems to fester for a long time before we tackle them, the way we routinely wait for small potholes on our roads to develop into huge gullies and death-traps before we try to fix them, if at all. That should be a critical lesson of this insurgency. So let us take immediate steps to put our people to work. Let’s fix our roads, bridges and schools and other infrastructure. Let us expand schooling in this zone and other parts of the country. Let’s expand enrolment, and hire and train highly qualified and motivated teachers who are paid well. Let’s resolve to strictly enforce the law that makes primary and secondary education free and compulsory in this country so that every child stays in school until at least the age of 18. Let us expand vocational training in addition to improving our universities and polytechnics. Let us expose our youth to entrepreneurship as part of their education, to help us to really create employment and grow the economy and incomes in a sustainable way. Germany seems to offer a great example on vocation training and apprenticeship. We may want to carefully study its system to see how we can adopt elements of it for our country, our people and our economy. When we take these measures that expand educational and career opportunities for our young people, we give them hope; we give them positive things to aspire to. We must demonstrate to our youth that living is far better than dying. When we provide them these opportunities we are likely to see more of them receive the kinds of awards and honours that were bestowed on these outstanding people that were so honoured here today. But we should not stop there. Citizens are not just about jobs and incomes. We have to take measures to facilitate citizen engagement, especially the youth. Our young people have to take greater interest in public affairs. And I am not just talking about voting in elections. They should be organized and participate in debates on public policy and community service. And as a country, we have to find ways to lift up those who need help, to give voice to the voiceless, to listen to the voices of those who feel marginalized and left behind, and find ways to address their concerns. The recent Brexit referendum in the UK and the November 8 Presidential election in the US hold important lessons for us. Being established and stable democracies they had peaceful outcomes. We may not be that lucky because of the fragility of our democratic and other public institutions. To our students I say your handwork and sacrifices are worth it. You are among the privileged. So take full advantage of the opportunities you have. Education is an opportunity and remains the key that unlocks opportunities and opens new horizons. And in the contemporary world, those without education and requisite skills will have a harder time attaining social mobility. This is the world of big data, of coding, of genetic engineering, of 3D printing, of renewable energy, of artificial intelligence, of self-driving automobiles, of space tourism, of inter-connected devices (the internet of things), and of social diversity and inclusion. You have the opportunity to prepare and equip yourselves for that world so that you, your families and your country are not left behind. I sincerely thank the leadership of this University under the tireless Dr Margee Ensign. I salute the faculty and staff, all of you that make this place work. Let me also thank the Board of Trustees, under the very smart and meticulous Akin Kekere-Ekun, for its work over the past year and the preceding years. A Kano Magistrates’ Court on Thursday discharged all the five suspects, who allegedly killed a trader, Bridget Agbahime in Kano on June 2 over allegations of blasphemy.
The suspects, Dauda Ahmed, Abdulmumeen Mustafa, Zubairu Abubakar, Abdullahi Abubakar and Musa Abdullahi were slammed with a four-count charge of allegedly inciting disturbance, culpable homicide, joint act and mischief.
Mrs. Agbahime, 74, an Imo indigene, was murdered in Kofar Wambai Market in Kano over alleged blasphemy.
The Chief Magistrate, Muhammad Jibril, discharged the five suspects and terminated the case as advised by the attorney-general of Kano State.
Earlier, the Principal State Counsel, Rabiu Yusuf, representing the attorney-general of Kano State, told the court that they received the case diary from the police on June 8.
“Having gone through the case diary, the attorney- general of Kano State evaluated the facts in accordance with Sections 130 and150 of the Criminal Procedure Code, presented the legal advice,” Mr. Yusuf said.
“The legal advice presented to the court, dated June 24, states that there is no case to answer as the suspects are all innocent and orders the court to discharge all the suspects.”
The counsel to the suspects, Abdulsalam Gambo, commended the attorney-general for the judgment in the case.

The trial of the former national publicity secretary of the Peoples Democratic Party (PDP) Olisa Metuh continued today, October 10 – The witness in the matter told the court the part of Metuh’s statement which was torn was unsigned. At the resumed hearing, EFCC investigator and Prosecution Witness 1 (PW1), Junaid Sa’aid during cross-examination by defence counsel, Onyechi Ikpeazu told the court that sheet of the statement allegedly torn by the accused was not signed.

Sa’aid told the court that after Metuh had written his statement, he (Sa’aid) read it and took it his superior who also read it and instructed that he return it to Metuh to sign. He said Metuh signed the first two pages but when he got to the third page, instead of signing, he (Metuh) tore the page. He however said he did not take any statement from the defendant regarding the alleged tearing of statement. The PW1 also told the court that the accused did not chew or attempted to chew any part of his statement as reported in a section of the media. Also at the resumed hearing, another EFCC investigator and Prosecution Witness 2 (PW2) said the former PDP spokesperson tore the unsigned third sheet of his statement after which he demanded a new sheet to continue his statement.

Ibrahim, in a statement published in The Nation newspaper said the portion in the book by Professor John Padden on President Buhari, titled: “Muhammadu Buhari: Challenges of Leadership”, was wrong.

This comes as Econet’s mobile financial service platform, EcoCash yesterday distanced itself from the pyramid scheme. Participants claimed they were using EcoCash for their transactions.

Zimbabweans have in the past months been joining the online investment scheme in droves in a bid “to get rich quickly”.

The Reserve Bank of Zimbabwe warned people that the scheme was fraudulent and there was no legal recourse in the event they lost their money. The central bank said MMM, which advertises its operations through a website and recruiting agents, was not a registered or regulated entity.

EcoCash yesterday said: “We have noted that some of these pyramid schemes are allegedly advertising in a manner that suggests that the Ecocash facility is a medium for prospective members to deposit their money. This is not correct.

“We advise our valued customers and all stakeholders that Ecocash is a licensed mobile payment platform that enables customers to make financial transactions such as sending money, buying prepaid airtime as well as paying for goods and services within the confines of the law of Zimbabwe.

EcoCash promotes safe and legal transactions but will not be held liable for any losses arising from the use of EcoCash to engage in illegal activities such as Ponzi schemes.”

The scheme advertises itself as a mutual aid fund under which recruited members contribute money to assist others and are promised investment returns of 30 percent per month.

Some of the people left counting their losses told The Herald that they received emails that the scheme had been suspended until September 15.

At the conclusion of his five-day activities during the 71st Session of the United Nations General Assembly (UNGA71), President Muhammadu Buhari declared that he had a very successful outing.

Addressing the media to round off his visit to New York, the president reviewed all his major and side events during the visit and highlighted the issues on which he sent a direct message to world leaders.

“I highlighted the need for the international community to work together to liberate humanity from poverty, save our planet from the devastation of climate change and rid the world of terrorism for a more peaceful and prosperous future,” a statement from his office said.

President Buhari also said that, “I mentioned that the plight of Internally Displaced Persons (IDPs) arising from Boko Haram terrorism is of particular concern to us. For this reason, we have taken concrete steps to address their humanitarian needs and to ensure that necessary conditions are established to enable the voluntary return of the displaced persons to their homes in safety and dignity”.

While acknowledging that “Nigeria as a developing country has been adversely affected by the global economic downturn,” he however, said that “we are undeterred and have embarked on a wide range of reforms in our efforts to diversify our economy and shift emphasis to mining, agriculture, industrialization, infrastructure development and the creation of the enabling environment for Foreign Direct Investment”.
He also noted that “fighting corruption remains of prime importance to our administration,” adding that the campaign is already yielding positive gains including significant stolen assets recoveries.

The president stated clearly Nigeria’s position on Climate Change, development in developing countries, youth development, statehood for the Palestinians, and reform of the UN Security Council with Nigeria ready to serve on a reformed Council to “advance international peace and security.”

President Buhari listed his meetings with world leaders and the benefits from some of the side events such as the US-Africa Business Forum during which discussions focused on how top American business executives “can collaborate with us to diversify our economy, which will in turn drive development, job creation and general business development in Nigeria.”

He mentioned his meeting with top Nigerian professionals in the United States and the urgent need to reclaim the shrinking Lake Chad, even as he expressed delight that “some countries notably the United Kingdom and United States pledged additional support in the tune of US $391 million humanitarian aid for the Lake Chad region.”

President Buhari used the occasion of the media event to thank relevant United States authorities for efficient security and administrative arrangements, and officials of the Nigerian Ministry of Foreign Affairs for demonstrating “that we still have capable officers in our Foreign and Civil Services”.

He commended the Nigerian officers for the “tireless effects in projecting a positive image to our country, even in difficult times”.

President Buhari did not forget members of the Nigerian media, as he thanked them for “going through elaborate security checks and clearance procedures to follow my activities and hectic schedule in order to keep all our people at home well informed of my meetings and engagements”.

RESPONSE ON BEHALF OF LATE REV. SAMMOSES ENENCHE'S FAMILY

Information of news on social media, blogs and other platforms reached us accusing the Family of the late Rev. Sammoses Odiba Enenche who has just been laid to rest barely 7 days ago of ejecting his widowed wife from a rented apartment in a certain area in Abuja which she lived with her late husband before his sudden demise.

The family of our late brother Rev. Sammoses Odiba Enenche who we are still grieving and mourning received this news with great shock and initially decided to pay deaf ears to it as we believe that mourning time is a period for reflection on our own lives while we are still on earth.

After much consideration, we deem it necessary to clear the air and share the untold side of the story haven received messages from concerned friends of our family who know us and what we stand for.

Rev. Sammoses Odiba Enenche, a promising and fast rising man of God suddenly met his death without illness. Glory to God for a family who without doubt and suspicion received the sad news of their brothers demise from his wife at mid night and decided to make all arrangements to lay his body to rest in peace without medical procedures of autopsy as required in our present times.

Thus, it may sadden you to know that the late Rev. parted suddenly with a lot that needed to be addressed and executed both in his ministry and his private dealings before his sudden departure whose cause was never known, as the family outrightly refused the need to run any form of medical examinations but chose to accept the fate.

In the bid to assist carry on the legacy of our late brother Rev. Sammoses Odiba Enenche, it was first pertinent to coordinate the affairs of his ministry Jesus Glory Chapel International in conjunction with his widow for which a lot needed to be put in place. The Siblings of the Late pastor came together with his widowed wife as expected to discuss the need to move on and to assist her move on in any capacity required.

It is however sad that despite the immense love and contributions made by the members of the family to support our Late Brothers widow and to help offset outstanding bills in the ministry which she would not have been able to meet up with, the family was shocked with the stage -managed reaction from a rented apartment, the rentage of which had expired since July.

The mischievous unwarranted accusation and defamation of the Character and personalities of the entire family is suspected to have been prompted by the reaching out of the family to help ORDER the affairs of her husband's ministry and concerns, to which she seems to be allergic. She is also showing signs of resistance to sound counsel, order, and wisdom.
So much love has been shown to her, shielding her from every negative tradition and culture against Widows after burials.

Therefore, for the purpose of clarity we wish to state categorically and in emphatically the following:

1. The Family of our late brother Rev. Sammoses Odiba Enenche are by the special grace of God well blessed and fortunate and have no need to desire any form of possession or acquisition of our late brother to whose life and ministry we have immensely contributed both in cash and kind over the years and up till this moment, being the last born of his mother.

2. The Family of our late brother who suddenly passed on without illness are all known for philanthropic activities with track record of assisting widows and orphans in thousands. You may recall that massive supply and relief was sent by the family to Agatu in Benue State to assist widows and orphans who were displaced and with their husbands killed by recent attacks. As a principle the family stands against the oppression of Widow's and the less privileged.

3. The family was willing and ready with the full knowledge of the widow to make payment for the renewal of the rent of the 5 bedroom apartment in Abuja where our late Brother before his demise lived with his wife as the rent had expired a couple of months before his demise , all geared towards ensuring the comfort of his widowed wife.

4. We agreed with our late brothers wife that the Ministry of our Late Brother will have to continue as a legacy and therefore should move on. It was in the light of this that arrangements were being made to offset all the bills running into Millions of Naira owed by the ministry due to his sudden demise. It may interest you to note that actions had already been taken as salaries owed some workers were already paid on Monday by the family before this mischievous outrage of Tuesday. The Tuesday meeting was intended to continue the next stages of actions from the families own personal accounts just to shield her.

5. We wish to inform the general public that the news making rounds on social media, blogs and news platforms accusing the family of Rev Sammoses Odiba Enenche of ejecting his widow out of a rented house, whose rent expired 2 months ago. And asking her to go back to the village with a pay of N50,000 for allowance for 6 months, and all sorts of accusations are false, mischievous , unrealistic and a conspired and constructed attempt to dent the image of the family. Family matters are not meant for the media but to be settled privately within the family.

6. We wish to inform the general public that the entire Family are still till this moment willing to show our relentless love and total support towards the widow and ministry of our Late Brother Rev.Sammoses Odiba Enenche and we await her return to the house she voluntarily vacated without our prior notice and amidst all pleas to restrain her from her unilateral decisions and actions.

7. We wish to state at this point that she is free to do everything she wishes with her late husband's affairs and ministry. We have no intention to interfere in the affairs and ministry of our late brother Rev Sammoses Enenche since our attempt to assist has been misconstrued and violently resisted.

Every attempt to reach her since her decision to move out of the house has been futile as her phones and contacts have not been accessible. We however are available and open for discussions and conclusions on any pending issues as soon as she is willing to respond to our gestures.

God bless us and may we please understand that life is a seed; what we sow in time, we reap in eternity. Let's hear people out before rushing to conclude on issues. Let's be careful of making comments on issues we don't understand.

Justice Abang removes self from case against Buhari

Justice Abang has disqualified himself from a case against President Buhari – Incorporated Trustees of Oron Union brought a case against PMB regarding his nominations – The nominations of Mr Obong and Frank Samuel to the NDDC board led to the filing of the suit against President Muhammadu Buhari.

Justice Okon Abang of the Abuja federal high court, on Tuesday, August 23 disqualified himself from presiding over a suit accusing President Muhammadu Buhari of illegal nominations. The suit against Buhari accused him of breaching certain laws when he nominated persons not from oil producing regions, into the board of the Niger Delta Development Commission (NDDC). The law suit was filed before the court by a body known as Incorporated Trustees of Oron Union, Akwa Ibom state. The plaintiff said it was illegal for President Buhari to nominate Mr Obong Nsima Ekere and Frank Samuel George, as Managing Director and Commissioner, respectively, on the board of the NDDC since they were not indigenes of oil producing areas of Akwa Ibom state.

They said that the action was in violation of the NDDC Act, in the laws of the federation of Nigeria 2004. According to Vanguard, the Attorney General of the Federation, Mr Abubakar Malami, SAN, the Senate President, Dr Bukola Saraki, the National Assembly and the two nominees were also defendants in the case.

The plaintiff appealed to the court for the following: “A declaration that the nominations of the 5th Defendant as the Managing Director of NDDC, and the 6th as Commissioner on the Board of the said NDDC, by the 1st and 2nd Defendants, and the subsequent forwarding of the names of the 5th and 6th Defendants to the 3rd and 4th Defendants for confirmation and for appointments as Managing Director and Commissioner respectively on the Board of NDDC when the said 5th and 6th Defendants are not indigenes of oil producing areas of Akwa Ibom State, are all done contrary to the provisions of section 12(1) of the NDDC Act, Cap N86, Laws of the Federation of Nigeria 2004, and therefore illegal, null and void and of no effect whatsoever and howsoever.” The Oron Union which covers five local government areas of Akwa Ibom also prayed the court to issue an order of perpetual injunction restraining the National Assembly from confirming the nominations.

However when the matter came up on Monday, August 22, all the defendants asked Justice Abang to remove himself from the case, due to conflict of interest, since he is also from Oron. The 6th defendant, George, who is also one of the nominees wrote a letter to the Chief Judge of the Federal High Court, Justice Ibrahim Auta, asking that the case-file be retrieved from Justice Abang. Consequently, in a bench ruling, Justice Abang disqualified himself from the case and returned the case-file back to the Chief Judge for reassignment to another judge. He said: “Having regard to the fact that I am from Oron nation of Akwa Ibom State with the plaintiff and the 5th and 6th defendants are also from Akwa Ibom my state of origin, I hereby disqualify myself. Justice must not only be done but seen to be done. This case is hereby remitted back to the CJ for reassignment to any other judge other than myself, upon the court resumption from vacation.”

Meanwhile, on Thursday, August 18, Justice Abang was faulted by the appeal court in Abuja for refusing to hands-off the suit that led to the removal of Ikpeazu as Abia state governor. The five-man panel equally faulted him for “over reaching his powers”, by wrongly interpreting the Appeal Court Rules.

The whereabouts of a mother of three, Olubunmi Uko, said to have walked out of her Fola Agoro home in Somolu area of the state with one of her sons after leaving a suicide note, was still unknown at press time. She had complained to a relative that her business had gone bad due to the exchange rate and that her debts had risen beyond redemption.

Olubunmi Uko Uko, a businesswoman, reportedly walked out of her home last Friday evening with her last child, identified as Seun. She reportedly woke up her other children and informed them that she was going to visit someone. The older children, Iyiola and Toni, allegedly woke up later to find a suicide note written by their mother.

A relative, who simply gave his name as Folu, told Vanguard: “She addressed the suicide note to her children, her mother and to any other person concerned. She said nobody should bother to look for her, that she was going to jump into the river and end it all. “She said she was tired of life. She also said that by the time the letter would be seen, she would have ended inside the belly of a shark. “She had always complained of dwindling business due to high exchange rate.

At a point, she complained that she owed people and had no means to pay back. She also said that she borrowed half a million naira to offset the loan, but decided to use it on her business with the hope to realise some gain, but that the money ended up sinking in the business.” Vanguard gathered that prayer sessions are ongoing at different prayer centres for her safe return. Another relative, Mimnimah Uko, who identified the missing woman as her cousin-in-law, wondered why she would allow herself to be overwhelmed by the issues of life to the extent of taking such decision as solution.

The relative said: “Our prayer is for God to have mercy by ensuring her safe return and that of her son, Seun. We are imploring Nige-rians to please join us to pray.”

Ikpeazu’s Governorship: Appeal Court Nullifies High Court Judgement

An Appeal Court in Abuja, Nigeria’s capital city, has ruled that the removal of the Abia State Governor, Mr Okezie Ikpeazu, by a lower court was null and void.



The court on Thursday set aside the judgement of Justice Okon Abang of the Federal High Court, sacking Mr Ikpeazu over allegations of poor documentation.

In the lead judgement read by Justice Ibrahim Bdliya the Appeal Court insisted that the lower court lacked jurisdiction to hear the case and that any decision that flowed from it was null and void.

The five-man panel stressed that the law has laid down principles by which a case could be instituted.

Explaining that the process was wrong, Justice Bdilya said that on the motion which led to the appeal, three people indicated themselves as lawyers and signed the document while the law says only an identifiable legal practitioner can do so.

He added that it was not the business of the court to embark on a voyage of helping a litigant decide who filed his case.

Justice Bdilya said:”As such, the lower court erred in its deciding for the litigants,” he insisted.

“To this end the lower court lacked the jurisdiction to adjudicate on the matter because the initiation process of the suit was not properly done.

“Therefore any decision taken by it flowing from that suit is null and void”.

The Appeal Court ruled on three out of six appeals filed by the Peoples Democratic Party, under which Governor Ipeakzu won the governorship election.

According to the court, the issues are identical and as such it adopts the ruling of the previous judgement.

While reading the decision of the court, Justice Bdliya insisted that the evidence raised by the faulty originating summons could not have been easily resolved because they were contentious and hostile.

He said that an amendment could not have cured a faulty originating summons.

Explaining the court’s decision further he said that the orders made by the lower court could only be valid if the two issues raised were already decided to be valid.

“The lower trial judge was not right in his findings and decisions,” he insisted.

On whether the lower court delved into the main issue in deciding an interlocutory injunction, the Appeal Court said it was imperative to examine the record of the appeal.

The Justice also said that his findings showed that the outcome of the case would definitely affect the mind of the High Court Judge when he eventually goes to the main suit because he had taken a stand on the tax document submitted to inec to be faulty.

“A judge is expected not to take any position on any issues in the main suit because doing so will prejudice the main suit,” Justice Bdliya explained.

He further told the court that the burden of proof laid on the Governor who was the fourth respondent in the appeal to prove that what he submitted to the Independent National Electoral Commission as tax document was not faulty.

This, he said was because “it is he who alleges that should prove”.

“The issue of tax clearance which puts the burden of proof on the Governor on the tax issues, was not an issue, with regards to a civil servant or public officers whose tax is deducted at source and of which the first respondent was one.
his tax income will be assessed by the tax office.

“I do not agree with the trial judge that it is the second respondent that is the governor that supplied the information to the tax office.

“That would have been true if he had a private business on the side, for which he would have been required by law to declare to the tax office.

“But as a civil servant his tax is deducted at source and imputed by the tax office.

“If the trial judge cannot understand how civil servants tax clearance works he ought to have sought clarifications,” he stressed.

A Golden Opportunity

Explaining further, he pointed out that he could not agree that the tax documents submitted were irregular and false.

“The challenge in the originating summons in relation to tax clearance is not any where near the narrow view envisaged by the Electoral Act.

“There is no allegation of non-payment of tax but that the documentation was false. I therefore resolve this ground in favour of the pdp.

“It is my view that the judge committed a great injustice to the rules of natural justice by not listening to all sides In the case.

“By not listening to the Chief tax officer in defence of the Governor he had shut out their opportunity to defend themselves.

“By failing to consider the application of one James Okeji, a director in the Abia State tax office and on the other hand saying that it was an afterthought, the High Court Judge missed a golden opportunity to give all sides opportunity, thereby abandoning his training as a judge,” the Appeal Court held.

It also held that that except a person had participated in an election that he would not be issued a certificate of return and not that could not be decided by a court.

“That is why in the case of Rotimi Amechi the Supreme Court ordered that he should be sworn in and not issued a certificate of return.

“There is a laid down proceedings as to how a certificate of return should be issued to a person,” the Justice held.

Just read president Buhari's Democracy day speech and all I can do is to shake my head as his Speech is stuffed with lies.

1. He said Boko Haram was in charge of 14 LGAs when he took over as President. The reality is that the army had recovered most LGAs by May ending, 2015

2. He also mentioned that Infrastructure was in a state of decay including rail. One thing we know is that the GEJ's administration revived rails.

3. Buhari said his government has reduced extravagant spending. Do I need to remind him that the budget for Presidency is N20 billion more than that for 2015? How's that reducing spending?

4. Also, he mentioned that Capital expenditure in the 2016 budget is 30%. I can't really blame him on this because we know he is not mathematically sound. The is fact, capital expenditure is N1.59 trillion of total of N6.06 trillion which equals 26.2%.

5. The most annoying one is the one he said the budget process is more transparent than ever. I need to remind him that the details of the budget were revealed by BudgIT. The budget was only published after agitations from Nigerians.
Do we also remind him that the budget has different versions? Went missing at some point and was disowned? How's that transparency??

6. He said his government has delivered significant milestones on security, economy and security. Well, the indices show otherwise.

7. Another nauseating one is when he said his government is committed to democratic principles. Is this not the same administration that has continued to disregard court orders? Or same one that has changed INEC to an Inconclusive commission?

8. He failed to criticize the activities of Fulani herdsmen or commiserate with the bereaved but was quick to call out the Niger Delta Avengers. Interesting

Finally, I was looking out for the names of looters that President Buhari without anyone asking him said he would release on democracy day. We, seems like all his other promises, he broke this one too.

No integrity. This APC and Buhari administration don't surprise me anymore...

A member of the President Muhammadu Buhari’s Presidential Advisory Committee against Corruption, Benedicta Daudu, is currently embroiled in allegation that she cheated in an examination at the University of Jos (UNIJOS), on May 4, 2016, PREMIUM TIMES can authoritatively report today.
The Presidential Advisory Committee against Corruption, headed by prominent law professor and civil rights campaigner, Itse Sagay, and made up of mainly university professors, is the intellectual wing of Mr Buhari’s anti-corruption war.
The mandate of the committee includes advising the President on the implementation of required reforms in Nigeria’s anti-corruption campaign and criminal justice system.
Mrs Daudu, an associate professor of law and head of the Department of Jurisprudence and International Law of the Faculty of Law in UNIJOS, was allegedly caught cheating while writing an examination for a Master’s degree in Research and Public Policy in the Faculty of Social Sciences of the same university.
Although she has a Masters in Law, the associate professor had been working towards another masters in Research and Public Policy.

PREMIUM TIMES learnt that the department later accused her of sneaking in prepared answers, also referred to as “chokes” by students, during the examination for the Global Context in Public Policy course.

Sources said the matter was subsequently reported to the university’s examination committee but some students and faculty claimed there were attempts at cover ups by the university authorities.
But the Dean, Faculty of Social Science of the University, Prof. Ezekiel Best, said it was not true that authorities were trying to cover up the matter.


“I was not even around when the incident happened,” Mr. Best told PREMIUM TIMES. “So I don’t have all the details at this time. But there is nothing like that that we are doing nothing about it.”
The Coordinator of the Research and Public Policy programme, Prof. Bonaventure Haruna, however, said he reported the matter to Dean Best.
“I report to the Dean,” he said. “I don’t report to any other person. So call the Dean of Social Science and ask him. He takes the next action.”
When Prof Best was confronted with Prof. Haruna’s claim, he simply said, “Whatever Prof. Haruna said is correct. He is the head of department.”
When contacted for comments, the affected professor, Mrs Daudu, repeatedly hung up the phone after questions on the incident was posed to her. She declined to answer subsequent calls made to her mobile phone. She also did not respond to a text message sent to her.
The public relations officer of the university, Abdullahi Abdullahi, said the matter had not been officially brought to the attention of the school’s management.
“I tried to confirm whether there was anything like that, really I couldn’t get any confirmation. It has not been brought to the attention of management. So right now I wouldn’t know,” he said.
“Although the university has internal processes that deals with these issues, even if there was anything like that, which I doubt much, it would have to go through the normal internal processes from the department to the faculty and then to the exam misconduct committee. It is at that stage it would be brought to the appropriate authority for sanction.”
Similarly, the Vice Chancellor of UNIJOS, Hayward Mafuyai, told this newspaper via a text message that he was yet to receive any report on the incident.
The Executive Secretary of the Presidential Advisory Committee Against Corruption, Bolaji Owasanoye, initially said the committee was unaware of the incident, and asked for time for him to make an inquiry.
Later, Prof. Owasanoye reverted to say Mrs. Daudu confirmed to him there was a pending allegation of examination malpractice against her but that she was working to establish her innocence.
He said he would inform members of the committee of the development immediately.
