Politics / Xenophobia: Dabiri-erewa Battles FG, Zuma On Twitter by pontirock(m): 8:21pm On Apr 20, 2015
Chairperson, the House Committee on Diaspora Affairs, Abike Dabiri-Erewa, has reiterated her call for urgent actions to stop attacks on foreigners in South Africa.

She took her cause to Twitter on Sunday, saying urgent actions must be taken by Nigerian as well as South African governments to halt the killing of foreigners in the former apartheid country.

The lawmaker also made case for Nigerians who lost their lives and property in the attacks, saying they must be adequately compensated by the South African government.

The country has come under intense pressure in the past few days to halt the killing of innocent people and find a lasting solution to the inhuman act.

The recent attacks, according to reports, have led to the death of 10 Nigerians and several other nationals of African origin.

Dabiri-Erewa had, on Friday, moved a motion demanding a swift action from the Federal Government to ensure the safety of Nigerians living in South Africa.

In a series of tweets, she insisted the country’s ambassador to South Africa must be recalled as part of the process of seeking a lasting solution to the injustice suffered by Nigerians who live and work there.

She also called for an immediate intervention of the African Union and President Jocobs Zuma to end the violence.

“To a large extent, Nigerians do their businesses lawfully in South Africa. They should be compensated for damages caused by the attacks,” she tweeted.

The legislator, who represents the Ikorodu Federal Constituency at the House of Representatives, regretted that the Federal Government had yet to take any decisive action to assure the affected Nigerians of their safety.

She said, “The government needs to be more decisive and proactive in the interest of the welfare of Nigerians abroad. Immediate actions should be taken. We cannot afford to be complacent in this matter, If need be, Nigerians in South Africa should be evacuated.”

Commending the composure of Nigerians, Dabiri-Erewa called on Nigerians in South Africa to be calm and obedient to the limited movement order while a lasting solution is being worked out.

She also called for the speedy trial of those arrested in connection with the attacks. Victims, she said, must get justice.

On different social media platforms, ordinary Nigerians are speaking out on what they think the country should do to reduce the exposure of its citizens to the rising hatred in different parts of the world.

One Tunde Joseph, who blogged on Sunday, urged the government to reshape its domestic policies to plug the hole in the social welfare. This, he said, would make the country attractive to individuals who would ordinarily have sought succour in other countries.

“Nigeria and its people should be the centre of our new policies. We must begin to think of how to make Nigeria a comfortable place for all citizens. We must stop pursuing policies that do not add real value to the lives of Nigerians,” said the blogger.

As horrible photographs of attacks circulated on social media at the weekend, Africa and, indeed, the world raised their voices against the violent killings, describing them as inhuman and barbaric. Social media activists have called on governments of affected countries and the international community to rise in defence of targeted individuals.

A tweeter, Baba Oliver, urged affected countries to weigh a reprisal as a possible option to compel the South African government to take a sincere action. He suggested the repatriation of South Africans living in Nigeria and other African countries, saying the option would force Zuma to call the attackers to order.

While Zuma has publicly expressed his sympathy to those affected, some online reports said he failed to act when it was most necessary. Some reports suggest the President has encouraged the growing xenophobic attitude of his people.

On Facebook, one Gabriel Emameh said the attackers and those who, by their inaction, had encouraged them should be prosecuted at th

Politics / Folarin Campaigns At Polling Unit, Doles Out Money by pontirock(m): 10:41pm On Mar 28, 2015
There was commotion at Ward 5, Ona Ara Local Government Area of Oyo State, on Saturday when the Peoples Democratic Party governorship candidate in the state, Teslim Folarin, publicly doled out money to his party supporters at his polling unit.
The PDP governorship candidate defied the rules when he openly shouted ‘Te sibe'(print it there), a popular campaign slogan, urging people to vote for him.
One of the youths, who grabbed the money from Folarin, tried to run away, but was soon held by the angry crowd.
Those on the queue waiting to vote began to scramble for their share of the money.
The commotion, which lasted for over 20 minutes, saw the youths squeezing one another’s clothes while those, who managed to grab a few notes, received blows from others.
Police deployed in the unit watched as the youths tackled themselves in the brawl.
Folarin, who cast his votes at St. John’s Primary School, hosting two polling units at about 3pm, had addressed journalists before voting.
He came in company with his wife, Angela.
He told journalists that he was not satisfied with the performance of the card reader.
He said,”The card reader is very slow in accrediting and verifying voters’ identity. This was why we kicked against it earlier. Although, I was not delayed, reports from other parts of thstate are not commendable.”
He said the All Progressives Congress had failed to deliver good governance to the masses.
Folarin predicted a landslide victory for President Goodluck Jonathan, saying he was impressed with the large turnout of voters, which he said showed people desperately wanted change in the state.http://www.punchng.com/news/folarin-campaigns-at-polling-unit-doles-out-money/

Politics / 2 Days To Presidential Election, AD Candidate Pulls Out, Endorses Buhari by pontirock(m): 3:33pm On Mar 27, 2015
Barely 48 hours to Nigeria's presidential election, The Presidential candidate of the Alliance for Democracy (AD), Rafiu Salau Thursday stepped down for the presidential candidate of the All Progressives Congress (APC), General Muhammadu Buhari.
Addressing journalists in Abuja, Salau said he is stepping down for Buhari to save the country’s democracy from one party system which he said encourages dictatorship.
He said: “The PDP had been in power for 16 years, and it has tried its best. No matter how good the performance of PDP, you need to vote for another party before you can know that you always get a better performance when you create a competition among the parties.
“One party system takes away democracy from the owners, and denies them the right to use their democratic system to determine the level of the national development. No matter how good the performance of one party system, it cannot perform 10 percent of a democratic system with at least two strong parties that make the people to have the opportunity to control their democracy”.
He called on his supporters and all the party members to vote for Buhari on March 28 presidential election, saying Buhari is the candidate of all the democrats who will bring the desire the country have been yearning for change.
“It is your responsibility to vote for another party that will also executes its program. This is the only way the country can move forward like other democratic countries that have the control of their democracy. You need to create competition among the parties so they can always go back to their drawing board to redesign their program for your benefits.
“I urged all of you the 68 million voters, should vote for Gen, Buhari the candidate of all the democrats who will bring change. Vote APC. Show the world that you are in control of your democracy,” he said.
Responding, National chairman of the APC, John Oyegun, commended the AD candidate for identifying with Buhari, and urged those who are yet to decide on who vote to emulate Salau and support the APC presidential candidate.

Politics / I’m Doing My Best For Jonathan’s Re-election – Mu’azu by pontirock(m): 7:15pm On Mar 09, 2015
National Chairman of the ruling Peoples Democratic Party, Alhaji Adamu Mu’azu has said he is doing his best to make sure that President Goodluck Jonathan wins the March 28 Presidential election.
Mu’azu is being criticized for not doing enough to sell the candidature of the President in the northern part of the country where he hails from.
Apart from not embarking on campaigns different from the ones organised by the party’s Presidential Campaign Council in the states, he’s also being criticized for allegedly not speaking against the presidential candidate of the All Progressives Congress, Maj. Gen. Muhammadu Buhari(retd.).
Like Mu’azu, Buhari is from the northern part of the country.
The former governor of Bauchi State however insisted that he has been working tirelessly for the re-election of the President, adding that he had been doing this in conjunction with the party’s Presidential Campaign Council.
Speaking through his Chief Press Secretary, Mr. Tony Amadi, Mu’azu also said there was no need for him to embark on any private campaign apart from the one organised by the party.
Amadi, who spoke with our correspondent on the telephone, said, “He’s working with the presidential campaign directorate. He doesn’t need to organize his own campaign.
“He’s Also doing a lot of working to reconcile warring factions of the party in his state. He doesn’t rattle around unlike others. He also doesn’t go about with retinue of journalists to do his job.
“The chairman is fully committed to the re-election of the President and he has been working well for this.”
Also, the National Publicity Secretary of the ruling party, Mr. Olisa Metuh said as one of the founding fathers of the PDP, Mu’azu has continued to add immense value with his mature and decent approach to issues in keeping with the tradition and vision of our great party.
He said this disposition has continued to attract massive support across board for the party’s presidential flag bearer, President Jonathan.http://www.punchng.com/news/im-doing-my-best-for-jonathans-re-election-muazu/

Politics / Southwest Leaders Absent At Mimiko’s Post-confab Summit, Say It’s PDP Politics by pontirock(m): 7:07pm On Feb 22, 2015
Numerous major political figures from the Southwest region on Thursday were conspicuously absent from a “post-national conference summit” hosted by Governor Olusegun Mimiko of Ondo State at the Royale Park Lane Hotel in Akure, the state capital.
by SAHARAREPORTERS, NEW YORKFeb 20, 2015
Numerous major political figures from the Southwest region on Thursday were conspicuously absent from a “post-national conference summit” hosted by Governor Olusegun Mimiko of Ondo State at the Royale Park Lane Hotel in Akure, the state capital.
Governor Olusegun Mimiko of Ondo state poses with some Yoruba elders
The summit, with the theme “The National Conference, 2015 Elections and the Yoruba Nation”, was ostensibly aimed at raising awareness among the Yoruba about the outcome of the 2014 National conference.
The event was attended mostly by members of the Peoples Democratic Party (PDP), including leaders of a faction of the Pan-Yoruba group, Afenifere, which recently endorsed President Goodluck Jonathan. The participants included political office holders from the southwest states of Oyo, Osun, Ondo, Ekiti, Ogun and Lagos states. But prominent traditional rulers and religious leaders from the region were absent at the summit.
The chairman of the summit and an Afenifere leader, Ayo Adebanjo, observed that the gathering was almost exclusively of PDP members and leaders.
Mr. Adebanjo noted that the summit, if truly convened for its stated aim, should have attracted prominent personalities and voices from the southwest. He expressed sadness that no key traditional ruler or religious leader attended the summit. He said that the event lacked significance, being mostly attended by PDP members and their allies.
“My observation here is that the summit seems to be dominated by the members of the Peoples Democratic Party (PDP),” Mr. Adebanjo stated, remarking the presence of the party’s candidates for elective offices.
“The summit should be more important than Peoples Democratic Party (PDP) affairs. If you are convening something like this in future give the impression that we are doing it on non-partisan basis and in a fair manner cut across board,” he said.
Also speaking, the chairman of the Unity Party of Nigeria (UPN), Fredrick Faseun, said his party adopted the PDP presidential candidate, Mr. Goodluck Jonathan, because of the UPN’s belief that the incumbent president would implement the recommendations of the National Conference. He described Mr. Jonathan as the only “good” thing in Nigeria.
“I am not in President Jonathan’s party but I chose to adopt him for my own political platform because I feel he’s the only good thing available to Nigeria now,” Mr. Faseun said.
The coordinator of the Odua Peoples Congress (OPC), Gani Adams, echoed Mr. Adebanjo’s sentiment that the summit should have included Yoruba political figures from opposition parties if the event was truly meant to discuss the way forward for the southwest.
“We need a platform to sensitize Nigerians about who will implement the outcome of the National Conference,” he said, adding that the meeting should not be a gathering of the PDP.
Earlier, Governor Mimiko, the convener of the summit, said the mission of the event was to gather Yoruba leaders from the southwest to deliberate on the importance of the National Conference by endorsing President Goodluck Jonathan for the second term for the conference’s quick implementation.
“Convening the 2014 National Conference was indeed a historic assignment that we are proud of. And as a people, we must do everything possible to ensure that the confab recommendations get implemented.
“The idea of President Goodluck Jonathan allowing Nigerians to discuss is therefore a right step in the right direction. The platform afforded Nigerians the opportunity to dialogue and, through consensus, to evolve a workable agreement that is geared towards the self-expression of its socially and culturally diverse peoples within a nation-state that reflects their desires,” said the governor.
He added: “Indeed, everybody has something in the confab report that contained over 600 resolutions which 492 people passed by consensus—that is unprecedented in the history of Nigeria. Therefore, it is clearly a
different kind of report.”
Governor Mimiko said the confab recommendations, when implemented, would “create room for each state to have its own constitution, its own police force, its own prison service, can create its own local governments, can build its own airports, seaports and railways and, in addition, in the economic domain, solid minerals that had been the exclusive preserve of the Federal government since Independence, have now been brought to the concurrent list. States can now create employment and develop at their
own pace,” adding that the report would open up the political space.http://saharareporters.com/2015/02/20/major-southwest-leaders-absent-mimiko%E2%80%99s-post-confab-summit-say-it%E2%80%99s-pdp-politics
Politics / Governor Fayose Confesses To Partaking In Ekiti Poll Rigging Meeting by pontirock(m): 4:07pm On Feb 15, 2015
Ekiti state governor, Ayodele Fayose has finally confessed to partaking in the secret meeting where politicians led by former minister of state for defense, Musiliu Obanikoro met with army officer led by a Brigadier General plotted how to rig last August's gubernatorial election for Mr. Fayose.
Mr. Fayose was speaking at an event in Ekiti where he inadvertently referred to the tape and then he quickly tried to change his story by claiming that he was only chastising the army general for being compromised in the presense of his collegaues. Mr. Fayose's confession contrasts his earlier stance that the tape was manufactured with the aid of a voice software. The minister of Police Affairs, Jelili Adesiyan had earlier confessed to being at the meeting, however, President Goodluck Jonathan told reporters from the Wallstreet Journal during a recent interview that the tape was not "real" stating that the incident will not be probed.http://saharareporters.com/2015/02/15/governor-fayose-confesses-partaking-ekiti-poll-rigging-meeting-secretly-recorded-army

Politics / Re: Jonathan Afraid Buhari Will Jail Him — Obasanjo by pontirock(m): 8:07am On Feb 15, 2015
He said he was worried that President Jonathan had said in his recent media chat that he knew nothing about the postponement of the elections.
“I want to believe that this was forced on them (security chiefs). I want to believe that whether it was forced on them or it was their initiative, it was bad, very bad. I hope we will never have a repeat performance of this in this country again.
“It was even made worse when the President in the media chat on the 11th of this month claimed not to have knowledge or not to have authorised it. I get worried, very worried that if the President of Nigeria is not in charge of security, maintenance of law and order and such a decision can be taken behind him, assuming that it is true, then the President must be reigning and not ruling.”
While puncturing a hole in the excuse of the Boko Haram insurgency as a reason for the postponement, Obasanjo said it remained to be seen how the war against Boko Haram which could not be won since 2009, could be won in six weeks.
Obasanjo also appealed to the two leading political parties, Peoples Democratic Party and the All Progressives Congress not to heat up the polity.
He said, “I have offered some warnings but let me also offer some appeals and the appeals for me will be for President Goodluck Jonathan. I appeal to him not to do anything to destroy the fledgling democracy that we are enjoying, democracy is not a destination. It is a process and the more we strengthened the process of democracy, the institutions and the factors, the better it is for us.”
In its reaction, the Presidency on Saturday said it was aware of a plot by Obasanjo and some unnamed persons within and outside the country to thwart the forthcoming general elections and foist an unconstitutional Interim National Government, which Obasanjo hopes to head, on the nation.
Special Adviser to the President on Media and Publicity, Dr. Reuben Abati, said this in a statement made available to journalists in Abuja.
Abati said, “We find the false claims and allegations reportedly made against President Goodluck Jonathan by Chief Olusegun Obasanjo on Saturday in Abeokuta very odious and repugnant.
“As we have had cause to say before, it is most regrettable indeed that a man like Chief Obasanjo, who should know better, chooses to repeatedly, wantonly, and maliciously impugn the integrity of a sitting President of his country for the primary purpose of self-promotion.
“It is obvious from Chief Obasanjo’s serial vituperations against President Jonathan who is doing his best to positively transform Nigeria for the benefit of all of its people that he has willfully chosen to close his eyes to the present administration’s good works and intentions. For reasons best known to him, Chief Obasanjo has set his mind on regime change by fair or foul means.
“Otherwise, it would be completely senseless, irrational and out of place for Chief Obasanjo, who still claims to belong to the same party as the President, to accuse President Jonathan of plotting to win the rescheduled presidential elections by ‘hook or crook’ and planning to plunge the nation into crisis if he loses the election.
“For the record, President Jonathan has no such intention and will continue to give the greatest possible support to INEC and other relevant federal agencies to ensure that the rescheduled elections are successfully conducted.
“Chief Obasanjo’s plot with others within and outside the country to thwart the general elections and foist an unconstitutional Interim National Government, which he hopes to head, on the nation is well known to us, but by the Grace of God Almighty, his odious plan to return to power through the backdoor will fail woefully.”
Also, the Peoples Democratic Party Presidential Campaign Organisation said it was not true that Jonathan was planning to retain power at all cost.
Its Director of Media and Publicity, Mr. Femi Fani-Kayode, said this in a statement.
He said, “It is sad and unfortunate that President Olusegun Obasanjo, a father of the nation and a man that we all revere and have immense respect for, could have misread the situation so badly.
“It is simply not true that President Goodluck Jonathan wishes to remain in power at all costs and the suggestion that he has a hidden agenda or that he somehow imposed his will on INEC by getting them to postpone the elections is baseless and absurd.”
In a related development, Soyinka, in his letter titled, ‘Under-reading violence’, noted that the use of security operatives to intimidate the populace other than to protect them, is a “new low in the life of this nation,” adding that it is a serious threat to the future of democracy in Nigeria.http://www.punchng.com/news/jonathan-afraid-buhari-will-jail-him-obasanjo/

In a related development, Soyinka, in his letter titled, ‘Under-reading violence’, noted that the use of security operatives to intimidate the populace other than to protect them, is a “new low in the life of this nation,” adding that it is a serious threat to the future of democracy in Nigeria.

Politics / Jonathan Afraid Buhari Will Jail Him — Obasanjo by pontirock(m): 8:02am On Feb 15, 2015
Former President Olusegun Obasanjo on Saturday alleged that President Goodluck Jonathan had a grand plan to scuttle the coming elections for fear that if General Muhammadu Buhari(retd) of All Progressives Congress succeeds him, Buhari would send him to jail.
He said this at his Hilltop presidential residence in Abeokuta, Ogun State while talking with journalists. He said he broke his promise not to talk till after the elections because the elections were postponed.
Obasanjo spoke just as Nobel laureate and playwright, Prof. Wole Soyinka, warned President Goodluck Jonathan not to use security agencies to scuttle the current democratic dispensation.
Soyinka’s warning to Jonathan was contained in a letter he sent to one of our correspondents on Saturday.
In another letter that was made public on Saturday, former chairman of the National Population Commission, Chief Festus Odimegwu, called on Jonathan to ensure that the polls were free and fair.
Obasanjo, who just returned from foreign trips, said, “I believe the President’s fear is particularly motivated by whom he sees as his likely successor, that is, Gen. Muhammadu Buhari. I believe people would have been telling him that Buhari is a hard man; he will fight corruption and he (Jonathan) may end up in jail if not in the grave. I think people would have told him that sort of thing and he is not the only one afraid of Buhari.”
But Obasanjo said Buhari should have learnt his lessons and might not be contemplating sending people to jail to fight corruption.
“If he has not learnt his lessons, he would be probably the most unlearning human being. Now if he has learnt his lessons, he will know that you do not fight corruption by putting people in jail for 200 years. This was done by my predecessor in office, Gen. Abdulsalami Abubakar. He recovered over $750m from Abacha’s estate without putting anybody in jail and without harming or hurting anybody.
“When I took over, we recovered over $1.25bn from the same Abacha without hurting anybody and without harming anybody. What is rather unfortunate is the fact that our lawyer who is still alive, who was chasing this money all over the world, said to us that there was still well over $1bn to be recovered from the Abacha estate.”
On the allegation that Jonathan had a grand plan to scuttle the coming polls, Obasanjo likened Jonathan to the former president of Cote d’lvoire, Laurent Gbagbo, who shifted election dates until he believed the odds were in his favour.
Obasanjo said, “President Jonathan has a grand plan to ensure that he wins the election by hook or crook and if he loses, he scuttles it and brings chaos and confusion in the whole country.
“It looks to me that the President is trying to play (Laurent) Gbagbo. Gbagbo was the former President of Cote d’Ivoire and Gbagbo made sure he postponed the election in his country until he was sure he would win and then allowed the election to take place. He got an inconclusive election in the first ballot and I believe this is the sort of thing Nigeria may fall into if I am right in what I observed as the grand plan.
“Then in the run-off, Gbagbo lost with 8 per cent behind (Alassane) Quattara and then refused to hand over. All reasonable persuasion and pleading was rebuffed by him and he unleashed horror in that country until nemesis caught up with him. I believe that we may be seeing the repeat of Gbabgo or what I called Gbagbo saga here in Nigeria, I hope not.”
Obasanjo noted that the Chairman of the Independent National Electoral Commission, Prof. Attahiru Jega, must have been boxed to a corner by the powers that be, before announcing the postponement of the elections.
He recounted how world leaders confronted him over political developments in the country, saying, “I was away because I had a number of assignments abroad which took me to Morocco, Munich, Nairobi, London and New Delhi. Exactly a week today, when we were in Munich for what they called the Munich security conferences annual event, everyone in the security community was there.
“I refused to make any categorical statement on this issue because I wanted to come back home and learn what actually transpired and what was going on, and it turned out to be a forced decision on the INEC, because it was alleged that the security chiefs were unable to provide security and as a result, the Chairman of INEC had to postpone the elections, in accordance with the dictates of the so-called security chiefs.
“For me, that was a bad precedent for democracy in Nigeria. It meant it doesn’t matter what preparation or lack of preparation any electoral body could make in Nigeria, the final decision on whether election will take place on the day scheduled for it lies in the domains of the security, it is a sad day for democracy in Nigeria.”
Politics / APC Resorts To Private Security Guards by pontirock(m): 7:46am On Feb 15, 2015
Following what the All Progressives Congress described as the growing threat to the lives of its leaders, some of the party’s chieftains have resorted to making private security arrangements.
SUNDAY PUNCHgathered on Friday that part of these arrangements included engaging private security guards (some of which allegedly carry arms) as well as beefing up security in and around their homes and offices.
Some of the party members volunteered this information on the condition of anonymity.
One of them explained that the chieftains were forced to make backup plans because it was becoming clear that the Peoples Democratic Party-led Federal Government would withdraw the services of regular security men as the elections approach.
He said, “We cannot pretend we don’t know what the PDP is up to. There is more to the deliberate harassment of our leaders by security agencies within the last one week.
“First, it was Asiwaju Ahmed Tinubu and Governor Rochas Okorocha; then our Presidential Campaign Director of Media, Mr. Garba Shehu. Only God knows who will be next.
“It was in this same country during election period that Chief Harry Marshal and Bola Ige were killed. Only a careless person will rely solely on government security men who can be withdrawn at any time.”
In Rivers State, the state chapter of the APC said its members were relying on “natural human instincts” to protect party leaders from assassination plots.
The state Publicity Secretary, Mr. Chris Fynebone, told one of our correspondents that no matter how the party’s political detractors tried to intimidate its leaders, it would be impossible to eliminate all of them.
The Kwara State Secretary of the party, Mr. Adekanye Olabode, also said the party had written to all relevant security agencies to provide security for its prominent members.
Olabode said, “We cannot do anything that is contrary to the law. So we have taken the legal step. We have also committed our lives to God’s hand who can best secure human lives.”
Similarly, the Akwa Ibom State spokesperson of the APC, Mr. Udobong Samuel, said the soldiers’ siege on Tinubu’s house could mean that none of the party’s candidates was safe in the hands of the security agencies.
He said “When we hear something like this we raise the alarm because if we don’t do this, something else may happen.”
Although the Ogun State chapter of the party declined to give details of its security arrangements, it said it was not leaving anything to chance.
The National Publicity Secretary of the party, Mr. Lai Mohammed, also said the party would rely on the security provided by the Nigerian people.
He noted that the use of security services to serve the interest of those in power was not only weakening their capabilities but also putting democracy at risk.
But reacting to reports that some politicians’ security men were carrying arms, the police said it was illegal for politicians’ private security guards to bear arms.http://www.punchng.com/news/apc-resorts-to-private-security-guards/
Politics / Court Refuses To Hear Suit Seeking Tambuwal’s Removal by pontirock(m): 12:04pm On Feb 10, 2015
Justice Ibrahim Buba of a Federal High Court sitting in Lagos on Monday refused to assume jurisdiction over a suit seeking to stop the House of Representatives from holding a plenary towards the execution of impeachment moves against President Goodluck Jonathan.
The suit also sought an order restraining Aminu Tambuwal from carrying on as the Speaker of the House of Representatives.
But Buba refused to entertain the suit on the grounds that it fell short of the provisions of Order 2 Rule 2 of the Federal High Court Rules on jurisdiction.
Two lawyers namely, Anthony Nwajiugo and Okechukwu Ebirim, filed the suit marked FHC/L/CS/1863/14.
In it, they sought a declaration that the House of Representatives, as presently constituted with Tambuwal as the Speaker, was subversive of the 1999 Constitution, as amended.
They sought a declaration “that the House of Representatives as presently constituted cannot embark on any legislative business, including the adjournment of plenary sessions on the impeachment of the President of the Federal Republic of Nigeria, being improperly constituted; and
“A declaration that Hon. Aminu Waziri Tambuwal of Kebbe/Tambuwal Federal constituency of Sokoto State cannot remain and by his action, lost the competence to remain the Speaker of the House of Representatives of the National Assembly of the Federal Republic of Nigeria of Nigeria.”
But on Monday when the second plaintiff, Ebirim, appeared before Buba, the judge asked why the plaintiffs did not go to Abuja to file the suit, since the defendants carry out their statutory duties in Abuja.
“Give me reasons why I should sit in Lagos and say the House of Representatives should not sit in Abuja. You have not served them in Abuja; you have served them in Lagos. Can we constitute our own jurisdiction?
“The two plaintiffs are lawyers, why are they afraid to go to Abuja? Does the National of Assembly carry out its business in Lagos?
“Learned counsel should address this court on why the court should entertain this suit in Lagos, in view of Order 2 Rule 2 of this court.”
But Ebirim submitted that being an issue that borders on the Constitution, and given the fact that the National Assembly had a liaison office in Lagos, the plaintiffs had the right to ventilate their grievances before the Federal High Court, irrespective of division.
He said, “We submit that a matter that borders on the constitution is national in nature and can be heard in a Federal High Court, irrespective of division.”
But Buba dismissed the argument and held, “This case is wrongly constituted in Lagos. The case shall be transferred to Abuja. The plaintiffs shall approach the Chief Judge of this court for a date for hearing.”
In an affidavit filed in support of the suit and deposed to by the first applicant, Nwajiugo, the deponent averred that by virtue of his citizenship and training as a lawyer, he was aware that Section 68 (1) (g) of the Constitution provided that a member of Senate or House of Representatives shall vacate his seat upon defection from the party that sponsored him or her before the expiration of his or her tenure.
He added that the suit was filed basically to challenge the propriety of Tambuwal presiding over the House business, especially the plans to impeach Jonathan.http://www.punchng.com/news/court-refuses-to-hear-suit-seeking-tambuwals-removal/
