Guys so due to the whole Trump's matter last year, my fiance and I applied for student visa but when it was confirmed that Biden has been sworn in by February we tried to make the switch to Fiance visa but it was late as the school had already sent out the i-20 to the embassy so we left it in order not to complicate things. After the long run, I went for the interview and was denied visa. Now we want to go through the Fiance visa, how long should we wait before we start applying for it? The student visa rejection happened just yesterday.

I got a mail from USCIS Requesting for my Evidence. Now my Question is Who is going to receive the letter to request for more evidence and and is the Evidence requested for going to be stated In the Letter and how soon is the Letter going to arrived?

the person who receive the NOA1 will receive the RFE ..the letter will tell u wat and wat u need to send .RFE may take 6days or so.. sorry about the RFE

Quick update guys!

Had my green card interview last week at New Orleans field office. It was just a mere conversation & no trivial question was asked.

My case has not been updated yet. Still on “Interview was scheduled”

Although, the interviewer told us if she needs anything, she will definitely mail us.
Quite unusual with the delay but I’m hopeful it will come through.

You or your fiancé(e) should receive an instruction mail to that effect.
You need to fill out DS-160, pay the fee and schedule your medical. And make sure you are on the look out to book an appointment for the visa interview dates randomly pop up on the cgi portal.

Also, You need to open an account on there(cgi portal) if you dont have one already.

Why would you need an immigration lawyer? Is your case complex? Being denied a Student Visa in the past will not affect your Fiancée Visa application. It will be adjudicated based on its merit and not based on your previous visa denials.

We will be moving to our new apartment soon. When that is done, I intend filling the Change of Address Card, AR-11. It can either be done online or via paper but I think they prefer we use online unless the person is a victim of domestic violence or something.

I am told it's a serious offence not to let USCIS know of your change of address so I'm taking no chances. However I've heard stories of people having mailing issues after informing USCIS of their address change, I just pray I won't fall in that category. I don't even know how easy for mails to get delivered to the new address.. I've never had issues with mails in the house where we are staying at the moment. What I will do when filling the AR-11 is to put the new address but still put my old address as the mailing address since we still have family in that address.

You can also subscribe for mail forwarding with the USPS. Costs very little, about $2 or so a year.

Update on our case- So we received RFE today for our case but they've not emailed my fiance what additional evidence they need yet. NOA1 was nov 2nd 2020 and got feedback 16th June 2021 that's 7months and 2 weeks. What are the common reasons for RFE?

They just need additional evidences or sometimes they are documents which you and your partner forget to send along with the initial i-129F petition.

RFE can include;

proof that you and your partner has met within the 2 year bracket prior to filing the application
proof of divorce certificates if previously married and you forget sending it along the initial petition
sometimes they do ask for RFE when you forgot to fill in some places in the i-129F form, they normally send that place back to the petitioner
They can also ask for proof of intention to marry if you and your partner forgot to include the letter of intent to marry within 90 days

There are many reasons. So it will be difficult to guess. It could be the Birth Certificate (wrong format), or tax returns (not filed properly), or income (below poverty line), or Divorce Certificate (not filed properly), etc. Just wait for the request.

Thanks bro. Yes I'm sure everything will be OK. I suspect 2 things
1. We forgot to add proof that we did not meet on marriage broker site, she forgot to add that document. 2 she left 2 boxes about my criminal records information on the form I - 129f unchecked, although we sent a letter afterwards for correction but don't know if it gets to them. So we're waiting to see
