LutanFyah:1.The accused was also wounded check the first picture released by the police. And the accused was equally drugged just like the deseased. Nobody goes to the hospital to treat a punch wound. 2. Doing that might have complicate her cos along the line a urine test will be conducted and an autopsy of the deseased will also show drug traces. Our client knowing this decided not to report to the police but let them discover the body themselves. Our client was never criminal minded my lord, she was about to turn herself in and that is the reason she never left lagos. 3. There was only 1 place with traces of blood. This shows that the deseased was killed by at the same spot. 4. Was there any place in the deseased body that suggest a toture wound. Perhaps a rope to bind him or a cloth to gaude his mouth?. Let's just leave this the way it is sir.... I have great respect for dead people. |

Doradorwa:Thank God for your life that you aren't a lawyer otherwise these lines of defence will get your clients into trouble. These are my responses to your submissions: 1. Someone who accidentally killed in self defence wouldn't stab his or her victims several times. Usually, the intention in self defence is to destabilize the assailant and escape 2. Fear of what the law would say about having drugs in your system is not a defence in a possible murder or manslaughter case. It is never an excuse. There is a reason why drivers are not to abscond from accident scenes even if lives are lost. Leaving the crime scene without turning yourself in to the police leads to complications that wouldn't help the defence team. 3. Not leaving the State where the crime was committed is not the same thing as not taking flight from the crime scene. Leaving the scene of the crime without reporting to the nearest police station for several days showed that she wanted to conceal her crime and evade justice. Remember that she didn't even tell her dad of what happened even if she could have lied to her dad that she accidentally killed a man who wanted to rape her. Further questions would reveal what happened to the blood stained clothes she wore on that day and the amount of blood at the crime scene. Were there attempts to clean up the scene? 4. Assuming without conceding that the late Ataga gave her his pin while alive, the right to use that PIN and ATM card expires the moment he died to the knowledge of the girl. How do you justify the "killing of a man in self-defence against sexual assault and withdrawal from the man's account after killing him in self-defence"? I understand that you aren't related to the lady and might just be considering the various possibilities. But the truth is that this girl's case is a very BAD one and self defence wouldn't suffice. Too bad that she killed the man and decided to waste her own life. |
