The Federal Government says the Federal Inland Revenue Service (FIRS) will continue to collect Value Added Tax (VAT) following the ruling of the Court of Appeal on the matter.

The Attorney-General of the Federation (AGF) and Minister of Justice, Abubakar Malami, told the News Agency of Nigeria (NAN) in New York while speaking on the disagreement over the collection of VAT between FIRS and Rivers Government.

The chief law officer of the Federation explained that the ruling of the Court of Appeal that FIRS and the Rivers Government maintain status quo, favoured FIRS.

He said that it was Federal Inland Revenue Service (FIRS) that had been collecting the VAT before the dispute arose, over which the Rivers government approached the High Court.

“The position of not only the Federal Government but indeed the judiciary is the fact that status quo associated with the collecting of VAT should be maintained,” Malami said.

“And as far as the judicial system is concerned, the status quo as at the time the parties approached the court, it was the Federal Inland Revenue Service that was indeed collecting the value added tax.

“So with that in mind, the Federal Government has succeeded in obtaining an order that establishes the sustenance of the status quo, which status quo is that the Federal Inland Revenue Service should continue collection.
This is pending the determination of the cases that were instituted by states, particularly the Rivers State Government and the Lagos State government. The cases are being determined by the court.”

Rivers government had urged the Supreme Court to set aside the Court of Appeal’s Sept. 10 ruling ordering it and FIRS to maintain status quo on the issue of VAT collection.

A three-member panel of the Court of Appeal headed by Haruna Tsammani, issued the order being challenged at the Supreme Court by the Rivers government.

The State also urged the apex court to disband the panel of the appellate court, which gave the interim order and ordered another one to be constituted to hear the case.

“But one thing of interest is the fact that the Federal Government had indeed taken cognisance of the fact that where there exists a dispute between a State and Federal Government, it is the Supreme Court that should naturally have the jurisdiction to determine the dispute between the state and the federation.

“And we are taking steps to consider the possibility of instituting an action before the Supreme Court for the purpose of having this matter determined once and for all,’’ Malami said.

As long as each states utilize the VAT for the development and progress on their people.
As long as it won't end in the foreign accounts of politicians in the states.

We've talked about ranching many times here.
This is how things are done in saner climes.
Miyetti Allah need to give the good ones among their members all the re-orientation that things can be done the way it is done in civilized nations.

Land resources were very important to the state, adding that the relationship between cattle herders and farmers should be symbiotic.

Until we have the political will to scrap so of the abnormalities that has kept these country backward, this country will remain backward.

The concept of Federal roads and state dependence on the federal purse should be scraped. States should be given more responsibilities and be allowed to control its resources and develop on its pace. The ealier we get rid of the status quo the better for us and the future generations. The status quo has failed. Let's practice true federalism like US and see how far it will take us. Change is dynamic.

a governor in rivers will give Julius Berger 200 billion naira contract for road and then a VAT of 7.5% will be deducted to be given to Kaduna state. what if the Rivers state governor refuses to do work in order to save his 7.5% of 200billion?
is that then not encouraging kaduna state governor and northern governor's to continue being dormant and just using free money to marry?
forget about the roadside argument about VAT for beer. that is not the issue.
the main argument is why a governor will have to pay 7.5% of the contract sum he awarded in his state to another state governor who is receiving the same monthly subvention.
VAT should be collected at the point where value is being added.
hope it is simple enough to take in.

It appears u don't know anything about vat. That's definitely not how it works.

First of all, the FGN contributes about 65% of the entire vat so all the other states put together is about 35%.

Moreover, the distribution of vat is not to take from one state to give another. Vat is collected collectively and shared to all the states. So even your so called rivers state also benefits from other states too.

Further vat is a consumption tax, not production. So even if u produce in rivers state and sell in nassarawa, nassarawa will also be paying vat per product.

As it is, FGN. Is able to collect the VAT from the source once and for all. But if u leave VAT to the states, it means that many businesses will die because each state will continue collecting VAT from the same company. It means that that your Julius berger will pay the same 7.5 over and over again in each state it has presence. Julius berger can cope, but what of small startups
