How did you lodge your complain? Is it by verbal communication or written communication? If it is by writing and you have the acknowledged copy, write acomplain to cbn and you will see Wonder.
Anytime you have an issue with bank don't complain verbally do it in writing and after 48 hours no issue resolved channel it to CBN.

I went to the bank and filled form. Since then, they have been posting me.

My head is not thinking right right now cos I'm going through a lot. I was in dire need of money for hospital bill when someone sent me some money due to my cries. Using ATM to withdraw it, I was debited but not dispensed. Going to 3 months now, the bank has not refunded. That money was to save a life but bank played politics with it.

What are my chances if I sue them for damages?
Just look for a reputable law firm..una share the money 60:40 the firm 60 you forty sue for 200m. Come back and thank us later. But you tell the firm say pay after service na why their share large. Na form of investment.

Look for a lawyer that can understand with you , explain to him, when you win the case you give him a percentage of the money requested

Someone sent you urgent 2K meanwhile you survived without it, a proof that the urgent 2K was not urgent afterall, go and fill the form in the bank, there is a process for it, your money would be returned to you in no time it was a technical error, the money had left your account and now hanging especially if you used an ATM not operated by your bank. Sorry about your misfortune, now that your fine, you can withdraw the 2K and go and price land in Lekki
People like this are the reason banks don't take cases like this serious.

It's crazy how you just form opinions on cases you know nothing about. So because she was able to source for alternative means to solve her problems means the issue wasn't urgent?

Did she in a any part of her write up state directly or indirectly that it was only the sender of the withheld 2k she knew? What if she called another person? What if she took a loan from someone or app?

Does it even matter if the case was urgent or not? The time frame given to banks by CBN to reverse dispense errors is less than 5 days and this one is more than 3 months so what's the banks excuse?

Thanks for this link. I intend to use it to force GTB to reverse a 5K airtime purchase that didn't go through but was debited. Six weeks after, they are yet to reverse.

OP don't give up, also try this option.

To all others with similar issues, don't give up. Report to the regulatory bodies and follow up until your issue is resolved. I have twice gotten Glo and Airtel to refund through NCC Complaint Unit.

Please don't keep quiet...Report them.

check behind your atm card, you'll see the bank's customer care line, recharge your phone and call them. It won't take you one week to get your money refunded. If you sue the bank, you might win the case but the court will not award you any significant damage.

My learned colleague, I beg to differ with the above assertion.
Op can actually make more than 2k+ damages from this if she reports to CBN. According to CBN, a customer ought not complain before reversing dispense error within agreed timeline.
I could walk her through this if she wants her 2k before Friday 17 Nov 2021
I may not be learned yet, though I surround my self with the learned as you presume, but the situation here is such that if you argue that a customer may not complain, then there is technicality situation here that CBN as we had seen is quite bereft of some certain issues, without customers formally notifying the bank, the bank may not be aware of such errors as, the situation is such that a cashier in the bank may not be able to access database queries as such their may not be automated updates to automated errors.

Then the second situation, if her transaction was done in another bank, chances is that the money had been wired to the other bank and in this case, both banks needs a back and fort Sequence to retract the money, these things takes time, like I had said, the bank shall eventually plead guilty but if I may see this case from the prism of the judge, I would issue justice on the basis that the young woman was obviously frustrated but then both parties had no malicious intent.

She would eventually get some palliative but not on the angle of justice but as such to alleviate her frustration

If you looked at the issue and my second comment I was quite concerned but then it is what it is, forget about whatever CBN directed, bail is free, an accused is innocent until found guilty, a suspect is not suposed to be detained bla bla bla, you and I knows that these issues can take way more time to rectify, I had stated that especially if it is connected to another bank ATM sometimes the money would even be in your account but it would not be seen by you.

I'm not trying to sarcastic but the most important thing to her was her health which is quite a serious thing but even within the five days as stipulated by CBN, she could have died if her life was to be solely dependent on the money, let's look at justice from the perspective of mercy too.

I explained to them that i did 2 transactions and the first 1 didn't dispense cash to me.

Uptil now, no solution and i have not been refunded.

Well, same thing happened to be with atm dispense error(twice ,one was on a Saturday (10k) and the other was the following monday(20k)). I followed up the matter with emails (which many organisations don't like cos it keeps trails). After "steady" back and forth with them, the 10k that was first debited and didn't dispense was refunded, less than a week after the occurrence, then the 20k was refunded after about 10 days or so. By back and forth(i keep sending them msgs on their live handles and whenever they mention "sorry for all inconveniences in this regard",i remind them of their own sms charges and stamp duties which they never fail to take

Why will she forget it, this is the reason this country is not moving forward.
Everybody is just accepting something wrong and moving on, nobody is willing to fight for their right

That's why when we see people that can talk and stand up we worship them when they are even doing the bare minimum.

My dear go to your bank and make noise, when you do it once or twice even the manager will use his own money to pay you

Not sound argument.

Yes, she survived; but what if she died because an appropriate hospital could not treat her due to incomplete hospital fees?
Would that bank share no blame for her death?

Again, will that bank now pay her interest for her money she did not receive?

Do we have to make banks go on with such avoidable errors?

I believe she stands a chance of winning compensation from the bank if there are lawyers in Nigeria who engage in sharing compensation from litigation without first making clients part with litigation fees.

go for it.. people do not know this. Banks or corporations don't like public cases such as court. Once your lawyer writes the bank, trust me, the bank would call you and your lawyer to resolve the issue.

That's not an avoidable error, it could have taken at least 48 hours in the most efficient respond system and in that case, if it that critical, she could have died, the fact is that life and death is not predictable some people even died becuase they were given medical attention, I had seen someone who survived an ailment for quite a while and the moment he was taken to hospital he couldn't survive so forget the issue of life and death shouldn't be the basis of sound judgement,

Yes she was sick and her condition was critical but we are talking about machines here, if the ATM refused to pay her, in the most efficient system it could have still taken some extra time to get back to her, that small delay can be costly, what I know is, this had added to her stories in life, Being health related doesn't make it different from the person who want to withdraw to buy beer or weed from the eyes of the machines so it had happened the question now is, is it worth pressing charges, I would still say no, the bank manager should be approached first, he can shell out the money on his own since the said lady is so determined and as well frustrated
