Lawyers encourage their clients to plead guilty all the times even for crimes they did not commit. You should know this if not you should watch ID Channel for a bit.

Last night, A Time To Kill was on telly. A little black girl was rapped by two white men and her father shot them in public. He was offered life first by the prosecution if he pled guilty but he declined it. He was offered 20 years for manslaughter by the judge but declined that too and went before an 'all white jury of his peers' in Mississippi, who, despite all attempts to find him guilty, found him not guilty and he walked.

It's just a film, based on a fictional book by John Grisham, but I could not overcome the irony of it being on telly just as I'm educating you to stand and fight instead of cop a plea for a crime you never committed.

A new paper published by the National Association of Criminal Defense Lawyers (NACDL) “The Trial Penalty: The Sixth Amendment Right to Trial on the Verge of Extinction and How to Save It.” We may not know every amendment to the Constitution, but we all embrace the fact that in the U.S. everyone is entitled to a fair trial by a jury of our peers. However, going to trial can be a gamble with one’s life. One conclusion reached by the NACDL was that “ There is ample evidence that federal criminal defendants are being coerced to plead guilty because the penalty for exercising their constitutional rights is simply too high to risk.”

The Federal Sentencing Guidelines, which I have written about here before, provides for stiff penalties, even life sentences, for a number of crimes that are usually categorized as non-violent (drug offenses, white collar crime, etc.). Some have speculated that President Trump’s former campaign manager, Paul Manafort, who is on trial for various fraud/tax charges, could face over 300 years in prison if convicted.

I recently attended what was supposed to be a guilty plea in federal court in Boston. The defendant, who was there on various drug-related charges, sat as a federal judge explained that pleading guilty would amount to waiving his rights to a jury trial. The plea would likely render a prison term of 30 years … so one can only imagine what the term would be if a jury trial resulted in a “guilty” verdict. The judge, to his credit, explained in great detail how much the government would have to prove in order to convict him and that a jury might find him innocent. The judge looked at the defendant and said, “Do you understand that?” To which the defendant replied, “I’d like to talk to my attorneys.” The hearing was adjourned while the defendant considered his options. The point is, I have witnessed the struggles that people have when they choose to waive their rights when they plead guilty.

Another case NACDL cited was that of Christian Allmendinger, another case that I have written about. Allmendinger was involved in a complex case of purchasing life insurance policies. He was partners with another guy, Brent Oncale. Onacle pleaded guilty and was sentenced to 10 years in prison. Allmendinger went to trial where Onacle testified against him … he was found guilty and sentenced to 45 years in prison. Onacle had his sentence reduced to 5 years after testifying. It is disparities like this that are just a few of the reasons we have a growing issue with our criminal justice system.

Now they are out with this. What's my stance ? My stance is that the FBI have done a lot of bad things and Michael Flynn is one. They force people with various ways to take a guilty plea and till they indict others from that group with seditious conspiracy its all a hogwash. So you did not address what I am saying.

We know of people who were there planning to storm the capital on camera and are still free despite calls for their arrest. So this guilty plea might even be a plant or someone who has been offered cash to testify against others.

You are talking rubbish. The facts of Flynn's case still stood and he was going to be sentenced to probation or 6 months until Trump pardoned him. Bill Barr request to get the case dismissed was denied. The Judge ruled the case moot since he had already received a pardon.

Of Special Counsel Robert Mueller’s many targets, the most tragic may be former National Security Adviser Michael Flynn. The former three-star general pleaded guilty last year to a single count of lying to the FBI about conversations he had with Russia’s ambassador to the U.S. Now we learn from Mr. Flynn’s court filing to the sentencing judge that senior bureau officials acted in a way to set him up for the fall.

Not a rich man after decades in uniform, Mr. Flynn pleaded guilty to avoid bankruptcy and spare his son from becoming a legal target. Mr. Flynn’s filing doesn’t take issue with the description of his offense. But the “additional facts” the Flynn defense team flags for the court raise doubts about FBI conduct.

The Flynn filing describes government documents concerning the Jan. 24, 2017 meeting with two FBI agents when Mr. Flynn supposedly lied. It turns out the meeting was set up by then Deputy FBI Director Andrew McCabe, who personally called Mr. Flynn that day on other business—to discuss an FBI training session. By Mr. McCabe’s account, on that call he told Mr. Flynn he “felt that we needed to have two of our agents sit down” with him to talk about his Russia communications.

Mr. McCabe then urged Mr. Flynn to meet without a lawyer present. “I explained that I thought the quickest way to get this done was to have a conversation between [Mr. Flynn] and the agents only. I further stated that if LTG Flynn wished to include anyone else in the meeting, like the White House Counsel for instance, that I would need to involve the Department of Justice. [Mr. Flynn] stated that this would not be necessary and agreed to meet with the agents without any additional participants,” wrote Mr. McCabe in a memo viewed by the Flynn defense team.

According to the FBI summary of the interview—known as a 302—Mr. McCabe and FBI officials “decided the agents would not warn Flynn that it was a crime to lie during an FBI interview because they wanted Flynn to be relaxed and they were concerned that giving the warnings might adversely affect the rapport.”

We also know from then FBI Director James Comey that this was his idea. This is “something I probably wouldn’t have done or wouldn’t have gotten away with in a more organized administration,” Mr. Comey boasted on MSNBC this weekend. “In the George W. Bush Administration or the Obama Administration, if the FBI wanted to send agents into the White House itself to interview a senior official, you would work through the White House counsel, there would be discussions and approvals and who would be there. And I thought, it’s early enough let’s just send a couple guys over.”

The FBI agents had seen transcripts of Mr. Flynn’s conversations with the Russian ambassador that were “unmasked” by Obama Administration officials. The 302 says that rather than flag this and ask Mr. Flynn for an explanation, the FBI agents decided before the meeting that if “Flynn said he did not remember something they knew he said, they would use the exact words Flynn used, . . . to try to refresh his recollection. If Flynn still would not confirm what he said, . . . they would not confront him or talk him through it.”

Keep in mind the FBI’s counterintelligence probe into Russia and the Trump campaign was still secret. Mr. Flynn had done nothing wrong in conversing with the Russian ambassador—it was part of his job—and he had no reason to believe he was in legal jeopardy. He initially claimed he misremembered what was discussed, which is more believable than that a highly decorated officer would lie to FBI officers he agreed to see without counsel.

Mr. Flynn’s lawyers are requesting probation and community service, though the facts suggest the judge should question the entire plea deal. Messrs. McCabe and Strzok have both been fired for misconduct, and their behavior reeks of entrapment.

If he does nothing else, President Trump has an obligation to former aides like Michael Flynn and to the public to declassify and disclose the FBI documents related to the FBI’s Russia probe.

Stop making noise. The judge ruled that his side of his story (lawyer not present, bla bla bla) was not grounds for dismissal of the case. All you are telling us is Flynn's filing (his side of the story) not the Judge ruling on whether it was grounds for dismissal. His only charge was lying to the FBI and the sentence was going ahead until Trump pardoned him. He was not charged with collusion or anything of the sort. Although suspected, it would be hard to prove in court without solid evidence so they got him on the lesser charge. Welcome to the world of prosecution, a world where a known murderer and drug dealer may be charged with domestic violence or a lesser charge because thats what the feds can prove to take him off the street for the good of society. If Flynn lied to Pence and got fired for it, then lying to the FBI is a small matter. He was guilty of what they charged him with. Pardons are given out to the guilty, not the innocent.

History has a way of repeating itself. Get in power get drunk with power and think that things will never change. History has shown that the truth always prevails. Flynn was framed because he knew too much. Flynn problem arose because he advised the saint that he was arming Al Qaeda in Syria during the Arab spring. The saint sent his goons to torment Flynn. Because while arming Al Qaeda Flynn told a congressional hearing that there were no moderates in Syria against what Clapper had said. Flynn as incoming Trump Security advisor would have uncovered the truth about WH arming Al Qaeda later morphed into ISIS.
