…all the votes cast for Umahi belonged to the party PDP. We do not have “independent candidates” contesting elections in Nigeria yet…..unlike in the USA. Maybe in another 20 years of practising this democracy!

Justice Inyang Ekwo is a PDP judge. All his rulings/ Judgements since 2015 has been against the APC and the federal government.

The earlier the NJC sacks or suspend him, the better for the judiciary.

This is a tough one but ....

The Constitution is silent on the repercussions that follow defection of persons under Section 308. The Judge is only to interprete the Constitution and not for any person(s) to infuse into it what is not. Ground 2 is sustained.

Section 308 covers the Offices of Gov, Dep-Gov, President & Vice-President. Only election petitions are sui generic. The case before this Court is not wrt to an election petition but defection. Ground 1 stands.

All others are academic.

Appeal Upheld.

I totally agree with you. The judge erred in law for this sack.

Im sure NJC will query this judge.
